    The Judicial Branch North Carolina’s court system had many levels before the judicial branch underwent comprehensive reorganization in the late 1960s. Statewide, the N.C. Supreme Court had appellate jurisdiction, while the Superior Court had general trial jurisdiction. Hundreds of Recorder’s Courts, Domestic Relations Courts, Mayor’s Courts, County Courts and Justice of the Peace Courts created by the General Assembly existed at the local level, almost every one individually structured to meet the specific needs of the towns and counties they served. Some of these local courts stayed in session on a nearly full-time basis; others convened for only an hour or two a week. Full-time judges presided over a handful of the local courts, although most were not full-time. Some local courts had judges who had been trained as lawyers. Many, however, made do with lay judges who spent most of their time working in other careers. Salaries for judges and the overall administrative costs varied from court to court, sometimes differing even within the same county. In some instances, such as justices of the peace, court officials were compensated by the fees they exacted and they provided their own facilities. As early as 1955, certain citizens recognized the need for professionalizing and streamlining the court system in North Carolina. At the suggestion of Governor Luther Hodges and Chief Justice M.V. Barnhill, the North Carolina Bar Association sponsored an in-depth study that ultimately resulted in the restructuring of the court system. Implementing the new structure, however, required amending Article IV of the State Constitution.

SILKENAT by CHIEF JUSTICE SARAH PARKER The Chief Justice welcomed the guests with the following remarks: Good morning, Ladies and Gentlemen. I am pleased to welcome each of you to your Supreme Court on this very special occasion in which we honor the service on this Court of Associate Justice Willis P. Whichard. The presentation of portraits has a long tradition at the Court, beginning 126 years ago. The first portrait to be presented was that of Chief Justice Thomas Ruffin on March 5, 1888. Today the Court takes great pride in continuing this tradition into the 21st century. For those of you who are not familiar with the Court, the portraits in the courtroom are those of former Chief Justices, and those in the hall here on the third floor are of former Associate Justices. The presentation of Justice Whichard’s portrait today will make a significant contribution to our portrait collection. This addition allows us not only to appropriately remember an important part of our history but also to honor the service of a valued member of our Court family. We are pleased to welcome Justice Whichard and his wife Leona, daughter Jennifer and her husband Steve Ritz, and daughter Ida and her husband David Silkenat.     ADMINISTRATION OF JUSTICE BULLETIN NO. 2015/01| JANUARY 2015 What Gets Judges in Trouble Michael Crowell CONTENTS Until 1973 the only way to discipline a wayward judge in North Carolina was impeachment Role of the Code of Judicial Conduct 2 by the General Assembly.1 A state constitutional amendment effective at the beginning of 1973 Other Means of Removal 2 empowered the General Assembly to adopt additional procedures for censure and removal of Statistics 3 judges for misconduct or disability.2 The resulting legislation authorized the North Carolina The Supreme Court’s Approach to Discipline 5 Supreme Court to censure or remove judges and established the Judicial Standards Commis- sion to receive and investigate complaints and to recommend action to the supreme court.3 Removal Cases 6 Starting in 2007 the legislature gave the supreme court the option of suspending a judge and Suspensions 7 authorized the Judicial Standards Commission to issue public reprimands on its own.4 The act Censures 8 also confirmed the commission’s already existing practice of private letters of caution. In 2013 Public Reprimands 10 the General Assembly removed the commission’s authority to issue public reprimands, though 5 Court’s Rejections of Commission Recommendations 11 the supreme court still has that option. As it now stands, only the supreme court may publicly discipline a judge. Conclusion: The Patterns of Discipline 13 Forty plus years of experience with the current disciplinary framework have resulted in fifty- three published opinions of the supreme court on recommendations from the Judicial Standards Commission plus seventeen public reprimands by the commission while it had that authority from 2007 to 2013.

    North Carolina Association of Women Attorneys (1978-2009): A Comparative History of NCAWA Members and Women Attorneys Nationally Compiled and edited by Jennifer Brobst, NCAWA Member 1 Over its 30 year history, the North Carolina Association of Women Attorneys (NCAWA) has provided personal and professional networking, support, and camaraderie among women lawyers in North Carolina. Each year the NCAWA worked to help further the cause of women in the law by assisting women lawyers in job placement, and campaigning to place women in positions of importance in the judiciary and law organizations. Through the years, the NCAWA also focused on keeping women attorneys educated about the issues facing women by providing Continuing Legal Education credit, seminars on current topics concerning women in the profession, and informative research articles in their newsletter. The NCAWA endeavored to promote the general welfare and legal equality of women in the state through lobbying and support of legislation. Through their efforts in the North Carolina General Assembly and support of various grassroots movements, they helped support the enactment of laws that promoted women’s rights and equality for all. Women’s struggles during this period were inexorably intertwined with other equally important issues, including the struggle against discrimination on the basis of class, race and sexual orientation, and the promotion of children’s interests. The following is a brief, by no means exhaustive, chronology of many of the major events in the history of the association, including major legislative efforts, projects, seminars, achievements of members, and other important moments in North Carolina and American women’s legal history.

    Secured Leave for Attorneys by Melvin F. Wright, Jr. Imagine that you are a busy trial lawyer and have not been able to take a vacation for the last five years. You have two children, ages four and seven. Your spouse knows you need time away from your practice, and you have promised him/her that you will take the family to Disney World for two weeks. Nonrefundable airline tickets and reservations have been made, and everyone is extremely excited in anticipation of some much needed quality time together. Thirty days before you are scheduled to leave, a final trial calendar comes out. One of your cases is the first case listed for trial. The case was dismissed once before, and there is no way the opposing attorney or the trial judge will take this matter off the calendar. Is there anything that could have been done to prevent such a nightmare? North Carolina found a way to do so. In 1999, the North Carolina Supreme Court, by the authority of Article IV of the Constitution of North Carolina, amended the Rules of Appellate Procedure and the Rules of Practice for the Superior and District Courts (N.C.G.S. 7A-33 and 34) to include the Secured Leave Periods for Attorneys. The adoption of this policy was one of the first official acts of the newly created North Carolina Chief Justice's Commission on Professionalism (CJCP). Former Chief Justice Burley B. Mitchell, Jr. gives credit to the members of the CJCP and the North Carolina Bar Association's Quality of Life Committee for input and emphasis on the importance of quality time away from the practice of law.
