Whether described in class terms as the ‘forward march of labour’ or ideologically as the rise of socialism, the narrative is broadly the same. The old certainties had to give way in the face of modern mass societies. This poses no problem for anarcho-communism. It can be accommodated comfortably on the libertarian wing of collectivism. But what of individualism? It seems out of place, a curiosity; the last gasp of a liberal England that was about to die. Perhaps that explains its comparative neglect. Yet seen as part of the radical milieu of the time, it seems neither anomalous nor a fringe movement. It stood firmly in the tradition of a left libertarian radicalism that was a serious competitor of the collectivist left. There were two main groupings of individualists in late Victorian Britain. -

chapter 4 Ideological Contributions of Celtic Freedom and Individualism to Human Rights This chapter emphasizes the importance of the often-overlooked contribu- tions of indigenous European cultures to the development of human rights. Attention is given to the ancient Celtic culture, the ideas of Celtic freedom and individualism, the distinctive role of the Scottish theologian, John Dunn Scotus and the Scottish Arbroath Declaration of Freedom (1320).1 It is from the Scottish Enlightenment and its subsequent influence on the late 18th century revolutions that we see an affirmative declaration of the Rights of Man, which is a precursor to the development of modern human rights. The importance of the Celtic-Irish-Scottish contribution to human rights is that it was the foun- dation for individual liberty and dignity in Western civilization. Indigenous Celtic culture staked an original and critical claim to the ideal of universal hu- man dignity. This is an important insight because it broadens the ideals that promote human rights, including within them those ideals of the indigenous cultures of the world, whose voices are oftentimes forgotten. It strengthens the universality of human rights. i The Intellectual and Philosophical Origins of International Law and Human Rights The intellectual and philosophical origins of human rights rhetoric and law, democracy, freedom and ideas supporting “consent of the governed” are in- tertwined in this composite explanation that attempts to explain all of these themes with the historical themes of Roman natural law, Athenian democracy and later the modern political philosophy of John Locke and his followers. The absence of a medieval connection between the alleged ancient Roman and Greek sources and the modern developments of human rights indicates that this perspective is faulty. -

Left-libertarianism is not a new star on the sky of political philosophy, but it was through the recent publication of Peter Vallentyne and Hillel Steiner’s anthologies that it became clearly visible as a contemporary movement with distinct historical roots. “Left- libertarian theories of justice,” says Vallentyne, “hold that agents are full self-owners and that natural resources are owned in some egalitarian manner. Unlike most versions of egalitarianism, left-libertarianism endorses full self-ownership, and thus places specific limits on what others may do to one’s person without one’s permission. Unlike right- libertarianism, it holds that natural resources may be privately appropriated only with the permission of, or with a significant payment to, the members of society. Like right- libertarianism, left-libertarianism holds that the basic rights of individuals are ownership rights. Left-libertarianism is promising because it coherently underwrites both some demands of material equality and some limits on the permissible means of promoting this equality” (Vallentyne and Steiner (2000a), p 1; emphasis added). -

Any successful answer to this Wquestion must find a way of incorporating and reconciling two moral ideas. The first is a particular conception of individual freedom: because we are agents with plans and projects, we should be accorded a sphere of liberty to protect us from being used as mere means for others’ ends. The second moral idea is that of equality: we are moral equals and as such justice requires either that we receive equal shares of something—of whatever it is that should be used as the metric of distributive justice—or else requires that unequal distributions can be justified in a manner that is consistent with the moral equality of persons. These twin ideas—liberty and equality—are things which no sound conception of justice can properly ignore. Thus, like most political philosophers, I take it as given that the correct conception of justice will be some form of liberal egalitarianism. A deep and difficult challenge for all liberal egalitarians is to determine how the twin values of freedom and equality can be reconciled within a single theory of distributive justice. Of the many attempts to achieve this reconciliation, left-libertarianism is one of the most attractive and compelling. By combining the libertarian commitment to full (or nearly full) self-ownership with an egalitarian principle for the ownership of natural resources, left- libertarians offer an account of justice that appears firmly committed both to individual liberty, and to an egalitarian view of how opportunities or advantages must be distributed. -

Positive vs Negative Liberty: Isaiah Berlin’s highly influential article brought to light the nature of the disagreement about political freedom. Largely until his time, the default assumption was that ‘liberty’ referred to what Berlin calls ‘negative liberty’. Negative Liberty: Roughly, freedom FROM. One is free in this sense to the extent that their actions are not hindered or prevented by outside interferers. Jefferson & Madison: This is, for instance, how the founding fathers understood liberty. Consider our constitutionally recognized rights of freedom of speech, freedom of religion (in James Madison’s Bill of Rights), and rights to life, liberty, and pursuit of happiness (in Thomas Jefferson’s Declaration of Independence). Example: Freedom of Speech: Having this right means that the government will not interfere with your speech (e.g., they will not pass laws forbidding you from saying whatever you want, and they will pass laws forbidding others from coercively preventing you from saying whatever you want, etc.). The same can be said for all of the others I listed. (For instance, as one more example, the government will allow you to pursue happiness, and they will not interfere with you or try to prevent you from doing so.) But, negative liberty of, say freedom of speech, doesn’t do me any good if I lack the ability to speak. For instance, imagine that I was raised by wolves and I don’t know how to speak any human languages, or read, or write, etc. -

Education for Liberal Democracy: Fred Clarke and Educational Reconstruction in England 1936-1952 Hsiao-Yuh Ku Institute of Education, University of London Thesis for the degree of PhD 2012 Abstract This thesis explores the connection between the democratic ideas of Fred Clarke (1880-1952), an English educationist, and his contribution to educational reconstruction in England in the 1940s. By drawing on biographical method and documentary research, this thesis demonstrates that Clarke's democratic ideas reflected the ideals of liberal democracy and ways in which his ideas informed his positions on various issues of the educational reform and his actions or activities towards them, which constituted his substantial contribution to the reform. Three general themes in this thesis support the main argument. First, Clarke's ideas about the distinction between community and the State, his conception of equality, and his emphasis on free personality and moral qualities of all citizens found their roots in the ideals of liberal democracy, especially those of developmental democracy. Second, Clarke's ideas of democracy underlay his positions on educational issues such as the reorganization of the central authority; the public schools; the administrative system, selection and organization of secondary education; further education; teacher education and the teaching profession; and adult education. Third, Clarke contributed himself to the reform primarily through arousing and guiding public opinion by means of his speeches, writings, cooperative actions, engagement in professional organizations, and the publication of the first report of the Central Advisory Council, School and Life (1947), which were also in accordance with his ideas of democracy. Clarke also exerted his influence on cultural elites through discussion groups and on policy-makers and key figures through memoranda, private meetings and correspondence. -

Introduction For over two decades, scholars have been working to measure the degree to which a nation has implemented a certain set of policies that Adam Smith called a “System of Natural Liberty”; Marx called “Capitalism”; some call “laissez faire”; and we shall call “economic freedom”. Economic freedom is present when individuals are permitted to choose for themselves and engage in voluntary transactions as long as they do not harm the person or property of others. Individuals have a right to their own time, talents, and resources, but they do not have a right to take things from others or demand that others provide things for them. The use of violence, theft, fraud, and physical invasions are not permissible in an economically free society, but otherwise, individuals are free to choose, trade, and cooperate with others, and compete as they see fit. When government agents, such as police officers or judges, work to protect people from private predators, government acts in support of eco- nomic freedom. On the other hand, government agents, such as tax collectors and regulators, often violate the economic freedom of individuals by preventing them from trading as they see fit. When governments plan at the collective level the eco- nomic decisions of people, they violate their economic freedom. chapter four Measuring Individual Freedom Actions and Rights as Indicators of Individual Liberty Peter Graeff * Introduction—the problem of measuring freedom The problem with measuring individual freedom begins on the theoretical level. After centuries of debating, theorists still do not agree about what freedom actually is. There are at least two distinct theoretical streams— positive and negative freedom, as discussed later—that claim to provide theoretical foundations for measurement. The measurement problem is becoming more acute as there is also a gap between theory and empirical operationalization, partly because scholars tackling the issue of freedom are mostly interested in theoretical approaches and do not construct their theories or ideas with regard to empirical conditions. Empirical issues also restrict the theory-operationalization fit by the fact that data are not producible for all theoretical ideas. From a measurement perspective, this could be taken as a drawback. In theory, these aspects make theoretical propositions irrefutable. * Peter Graeff is Assistant Professor of Sociology in the Department of Social Sciences, Goethe-University Frankfurt am Main. He obtained a Ph.D. from the University of Bonn. His research interests focus on the analysis of negative and positive social capital and free- dom. Egalitarian Liberalism And Economic Freedom Abstract This dissertation considers three major challenges to egalitarian liberal institutions made by classical liber- als: that egalitarian liberal institutions involve too much coercive interference with individual economic decisions, that free markets tend to do better at rewarding people on the basis of their economic choices, and that only by recognizing full liberal rights of ownership can a society best promote a stable property regime consistent with our pre-political conventions of ownership. Each of these objections fails, but they point to an underlying concern that egalitarian liberal institutions fail to adequately protect economic freedom. The dissertation then develops and defends a conception of economic freedom that is reflected in egalitar- ian liberal institutions.
