Kalimantan 37, Jember 68121 E-mail: DPU @unej.ac.id Abstrak Konflik antara Sri Lanka dan Macan Tamil merupakan salah satu konflik terlama sepanjang sejarah yang dimulai pada tahun 1983 dan baru berakhir pada tahun 2009 yang ditandai dengan hancurnya kekuatan Macan Tamil dan terbunuhnya pemimpinnya, Velupillai Prabhakaran. Sri Lanka dengan itu mengumumkan kemenangannya melawan kelompok separatis Tamil. Namun, Macan Tamil menebar ancaman bahwa ini bukanlah akhir dari perjuangan mereka. Hal inilah yang membuat penulis merasa perlu mempelajari apakah konflik di Sri Lanka dapat kembali terjadi dengan mempelajari kekuatan organisasi Macan Tamil pasca kekalahannya oleh tentara Sri Lanka. Metode analisa data yang digunakan dalam penulisan karya ilmiah ini adalah metode analisa deskriptif-kualitatif. Penulis menggunakan cara berfikir deduktif untuk menganalisa data. Penelitian ini bertujuan untuk mengetahui bagaimana kekuatan Macan Tamil pasca kekalahannya oleh tentara Sri Lanka. Hasil penelitian menunjukkan bahwa Macan Tamil tidak lagi memiliki kekuatan untuk melakukan pemberontakan karena tangible power dan intangible power mereka sudah jauh berkurang sehingga Macan Tamil sebagai organisasi sudah melemah. Kata Kunci: konflik, Macan Tamil, Sri Lanka. Abstract The conflict between Sri Lanka and Tamil Tigers is one of the longest in the history of the conflict that began in 1983 and ended in 2009 were marked by destructive forces and the killing of Tamil Tiger leader, Velupillai Prabhakaran. -

! 8 The Left and the 1972 Constitution: Marxism and State Power g Kumar David ! ! The drafting of the 1972 Republican Constitution was dominated by the larger than life figure of Dr Colvin R. de Silva (hereafter Colvin), renowned lawyer and brilliant orator, neither of which counts for much for the purposes of this chapter. Colvin was also co-leader with Dr N.M. Perera (hereafter NM) of the Lanka Sama Samaja Party (LSSP), and that is the heart of the matter. Although it was known, rather proudly till recently in the party, as ‘Colvin’s Constitution,’ this terminology is emblematic; no, not just a Colvin phenomenon,1 it was a constitution to which the left parties, that is the LSSP and the Communist Party (CP), were inextricably bound. They cannot separate themselves from its conception, gestation and birth; it was theirs as much as it was the child of Mrs Bandaranaike. Neither can the left wholly brush aside the charge that its brainchild facilitated, to a degree, the enactment of a successor, the 1978 J.R. Jayewardene (hereafter JR) Constitution, which iniquity has yet to be exorcised a quarter of a century later. However, even sans this predecessor but with his 5/6th parliamentary majority, JR who had long been committed to a presidential system would in any case have enacted much the same constitution. But overt politicisation, dismantling of checks and balances, and the alienation of the Tamil minority afforded JR a useful platform to launch out from. The relationship of one constitution to the other is not my subject; my task is the affiliation of the LSSP-CP, their avowed Marxism, and the strategic thinking of the leaders to a constitution that can, at least in hindsight, be euphemistically described as controversial. -

PUBLICATION No. 38 MARCH, 1978 THOMAS MEIKLE, 1862-1939 The founder of the Meikle Organisation sailed from Scotland with his parents in 1869. The family settled in Natal where Thomas and his brothers John and Stewart gained their first farming ex perience. In 1892 the three brothers set off for Rhodesia with eight ox- wagons. Three months later they had completed the 700 mile trek to Fort Victoria. Here they opened a store made of whisky cases and roofed over with the tarpaulins that had covered their wagons. Progress was at first slow, nevertheless, branches were opened in Salisbury in 1893, Bulawayo and Gwelo in 1894, and in Umtali in 1897. From these small beginnings a vast network of stores, hotels, farms, mines and auxilliary undertakings was built up. These ventures culminated in the formation of the Thomas Meikle Trust and Investment Company in 1933. The success of these many enterprises was mainly due to Thomas Meikle's foresight and his business acumen, coupled with his ability to judge character and gather around him a loyal and efficient staff. His great pioneering spirit lives on: today the Meikle Organisation is still playing an important part in the development of Rhodesia. THOMAS MEIKLE TRUST AND INVESTMENT CO. (PVT.) LIMITED. 35th Conference on South Asia October 20 – 22, 2006 Accardi, Dean Lal Ded: Questioning Identities in Fourteenth Century Kashmir In this paper, I aim to move beyond tropes of communalism and syncretism through nuanced attention to Indian devotional forms and, more specifically, to the life and work of a prominent female saint from fourteenth century Kashmir: Lal Ded. She was witness to a period of great religious fermentation in which various currents of religious thought, particularly Shaiva and Sufi, were in vibrant exchange. This paper examines Lal Ded’s biography and her poetic compositions in order to understand how she navigated among competing traditions to articulate both her religious and her gender identity. By investigating both poetic and hagiographic literatures, I argue that Lal Ded’s negotiation of Shaivism and Sufism should not be read as crudely syncretic, but rather as offering a critical perspective on both devotional traditions. Finally, I also look to the reception history of Lal Ded’s poetry to problematize notions of intended audience and the communal reception of oral literature. Adarkar, Aditya True Vows Gone Awry: Identity and Disguise in the Karna Narrative When read in the context of the other myths in the Mahabharata and in the South Asian tradition, the Karna narrative becomes a reflection on the interdependency of identity and ritual. This paper will focus on how Karna (ironically) negotiates a stable personal identity through, and because of, disguised identities, all the while remaining true to his vows and promises. His narrative reflects on the nature of identity, self-invention, and the ways in which divinities test mortals and the principles that constitute their personal identities. -

6 An Eager Embrace: Emergency Rule and Authoritarianism in Republican Sri Lanka Deepika Udagama Introduction Much of Sri Lanka’s post-independence period has seen governance under states of emergency. The invocation of the Public Security Ordinance (PSO)1 by successive governments was a common feature of political life and, indeed, an integral aspect of the political culture of the republic. Several generations of Sri Lankans have grown up and have been socialised into political and public life in an environment fashioned by states of exception replete with attendant symbols and imagery. Images of police with automatic weapons, military check-points, barbed wire, lengthy periods of detention (often administrative detention) mainly of the political ‘other’, the trauma of political violence and the ever- present sense of fear became the ‘normal’. The state of exception has become the norm in Sri Lanka from the 1970s onwards. The permanency of the state of exception was further consolidated when the Prevention of Terrorism (Temporary Provisions) Act, No. 48 of 1979 (PTA) was converted into a permanent law in 1982.2 Although not an emergency regulation, the PTA conferred extraordinary powers on the executive branch (e.g. powers of arrest and detention) to deal with what it recognised as acts of terrorism. That in combination with the ever-present emergency powers, which were sanctioned by the Constitution, provided a formidable legal framework to entrench the state of exception. The omnipotence of the executive presidency created by the second republican constitution (1978) amplified the potency of those exceptional powers. Reforming Sri Lankan Presidentialism: Provenance, Problems and Prospects Edited by Asanga Welikala Volume 2 18 Failure of Quasi-Gaullist Presidentialism in Sri Lanka Suri Ratnapala Constitutional Choices Sri Lanka’s Constitution combines a presidential system selectively borrowed from the Gaullist Constitution of France with a system of proportional representation in Parliament. The scheme of proportional representation replaced the ‘first past the post’ elections of the independence constitution and of the first republican constitution of 1972. It is strongly favoured by minority parties and several minor parties that owe their very existence to proportional representation. The elective executive presidency, at least initially, enjoyed substantial minority support as the president is directly elected by a national electorate, making it hard for a candidate to win without minority support. (Sri Lanka’s ethnic minorities constitute about 25 per cent of the population.) However, there is a growing national consensus that the quasi-Gaullist experiment has failed. All major political parties have called for its replacement while in opposition although in government, they are invariably seduced to silence by the fruits of office. Assuming that there is political will and ability to change the system, what alternative model should the nation embrace? Constitutions of nations in the modern era tend fall into four categories. 1.! Various forms of authoritarian government. These include absolute monarchies (emirates and sultanates of the Islamic world), personal dictatorships, oligarchies, theocracies (Iran) and single party rule (remaining real or nominal communist states). 2.! Parliamentary government based on the Westminster system with a largely ceremonial constitutional monarch or president. Most Western European countries, India, Japan, Israel and many former British colonies have this model with local variations. -
