DESPATX OFICIAL PLE 19 De Novembre De 2020 DESPATX OFICIAL PLE 19 de novembre de 2020 El Sr. Alcalde dona la benvinguda al ple de l’Ajuntament d’Olot d’aquest mes de novembre, una sessió que continua essent telemàtica per la situació generada arran de la COVID. El Sr. Alcalde inicia la sessió amb una nova crida a la responsabilitat davant la segona onada de la pandèmia. Tot i que les últimes dades confirmen una tendència a la baixa de l’índex de rebrot, demana no abaixar la guàrdia per no haver de tornar enrere d’una situació prou complicada com la que estem afrontant. El Sr. Alcalde reitera el suport de l’Ajuntament als responsables d’establiments que han vist restringida la seva activitat. En aquests sentit, anuncia que com a mesura de suport s’ha creat una nova línia d’ajuts per a les activitats que han hagut de tancar per les mesures de contenció de la COVID i els que han tingut unes pèrdues molt importants aquests últims mesos, una convocatòria que avui es porta per a la seva aprovació en aquest plenari. I com a les anteriors sessions, l’Alcalde fa un reconeixement a totes les persones que estan a primera fila lluitant contra la COVID. D’altra banda, el Sr. Alcalde proposa fer arribar la felicitació del Ple al Sr. Francesc Serés. El responsable de l’àrea de Creació de l’Institut Ramon Llull i director de la Residència Faber ha guanyat el premi Proa 2020 amb “La casa de foc”, una novel.la ambientada a la Garrotxa que es troba a les llibreries des d’aquest dimecres 11 de novembre. El Sr. Alcalde proposa traslladar una altra felicitació als responsables de La Fageda. Acaben de rebre un reconeixement internacional. Un estudi de la Secretaria General Iberoamericana i la Universitat Politècnica de Madrid inclou la cooperativa entre les 9 empreses que contribueixen de manera important als objectius de desenvolupament sostenible de l’ONU. Per últim i com a cada Ple, expressa la solidaritat amb les víctimes dels feminicidis, que malauradament continuen estant en el nostre dia a dia. I torna a demanar la llibertat dels dos Jordis, de l’Oriol Junqueras, d’en Joaquim Forn, de la Dolors Bassa, de la Carme Forcadell, d’en Raül Romeva, d’en Josep Rull i d’en Jordi Turull, injustament tancats a la presó. També el retorn de Carles Puigdemont, Lluís Puig, Meritxell Serret, Clara Ponsatí, i Toni Comin i de l’Anna Gabriel, Marta Rovira i el Valtonyc. El Sr. Alcalde informa del nombre de VISITES que ha mantingut des de la celebració del darrer Ple, el dia 29 d’octubre. - de particulars: 6 - d’entitats: 6 Seguidament, el Sr. Alcalde dona compte de les ENTREVISTES amb diferents càrrecs de l’Administració que ha tingut des de la celebració del darrer Ple ordinari, del passat 29 d’octubre: - El divendres 6 va prendre part de la visita que el conseller d’Educació, Josep Bargalló i el conseller de Treball, Afers Socials i Famílies, Chakir El Homrani van realitzar a l’Institut la Garrotxa per avaluar el Pla Pilot d’FP Ocupacional als centres de secundària. - Cada dimarts participa a la reunió telemàtica del Gabinet Territorial de Coordinació d'Emergències per la Covid-19 de la Generalitat a comarques gironines. Seguidament dona compte dels ACTES i REUNIONS a les quals ha assistit durant el mateix període: - El dissabte 31 d’octubre va participar, de manera telemàtica, als IX Premis Jordi Pujiula. - El dimarts 3 de novembre a la tarda va assistir a una formació sobre polítiques de gènere a càrrec d’en Miquel Missé. - El dilluns 9 de novembre va mantenir una reunió amb representants de diferents clubs esportius. La trobada -que també va comptar amb l’assistència del regidor d’Esports, Aniol Sellabona,- forma part de les trobades telemàtiques amb representants de diferents sectors de la ciutat. - El dimarts 10 de novembre va presidir la Junta de Govern de l’Institut de Cultura i posteriorment el Patronat i el Consell Social i Territorial de l’Hospital d’Olot i Comarcal de la Garrotxa. - El dijous 12 de novembre va participar al Consell d’Alcaldes de la Garrotxa que es va fer telemàticament. - El divendres 13 de novembre va mantenir una reunió amb representants de diferents empreses del transport. La trobada va comptar amb l’assistència del regidor de Promoció de la Ciutat, Estanis Vayreda. - El dilluns 16 de novembre va mantenir una reunió amb representants de diferents clubs esportius. La trobada -que també va comptar amb l’assistència del regidor d’Esports, Aniol Sellabona- és la segona que es convoca amb entitats esportives i forma part de les reunions amb representants de diferents sectors de la ciutat. - El dimecres 18 de novembre, acompanyat de la regidora d’Acció Social, Imma Muñoz, va felicitar una veïna de la ciutat en motiu del seu centenari. La Sra. Dolors Giol i Bayona ha complert aquest dimecres 100 anys. Tot i que a causa del context actual no ha pogut fer una celebració com la que voldria amb els seus 4 fills i 7 nets, ha rebut el reconeixement de la família. .

    Aires nous a ERC? A fi d’acarar amb un mínim de garanties les eleccions espanyoles, Esquerra Republicana de Catalunya sembla voler recobrar aquell “aire nou” impulsat per “mans netes” que tants bons resultats li va donar en el seu moment. No tan sols ha canviat el seu president, substituint Joan Puigcercós per Oriol Junqueras, sinó que —després d’una més que lamentable lluita intestina fratricida— ha tingut la bona idea d’escollir un independent amb empenta, Alfred Bosch, com a cap de llista per la demarcació de Barcelona. Convidant, a més a més, a les altres forces independentistes a afegir-se al seu projecte. Crida que desoí Solidaritat Catalana, però que acollí amb els braços esbatanats Reagrupament, aquella fracassada formació política on s’havien reunit les seves ovelles negres esgarriades. Talment com si, després de la seva espectacular esfondrada electoral, Joan Carretero i els seus n’haguessin tingut prou amb un estentori i temptador xiulet del seu vell pastor per a retornar, amb la cua entre cames, a la cleda que fins fa tot just quatre dies tant els engavanyava. Fa la impressió que per a dedicar-se a la política sigui necessari comptar amb un cert component de desmemòria adaptativa, que permeti patir sobtats atacs d’amnèsia quan més convé. Ataca d’amnèsia que, si és possible, s’haurien d’encomanar als electors... Hem de recórrer a les hemeroteques a fi de recordar que, encara no fa un any i mig, el llavors Conseller d'Innovació, Universitats i Empresa, Josep Huguet, definia al líder de Reagrupament com un independentista “de dreta” —“digues-li dreta, digues-li populista”? O que l’incombustible Puigcercós, que segueix aferrat contumaçment a l’executiva nacional d’ERC, el convidava a abandonar Esquerra per a “omplir l’espai de centredreta independentista”.

    Brussels, 17th June 2019 Dear Bureau Members of the European Parliament, Newly elected MEPs Carles Puigdemont, Antoni Comín and Oriol Junqueras, have been prevented from taking office as Members of the European Parliament by the Spanish authorities after the European election on 26th of May. The list led by Carles Puigdemont and Antoni Comín received 1.025.411 votes, and the list led by Oriol Junqueras received 1.257.484 votes. On 14th of June 2019, elected MEP Oriol Junqueras –in pre-trial detention for 593 days for having organized the Catalan self-determination referendum in 2017– has been banned by the Spanish Supreme Court to leave the prison in order to take the MEP credential. Furthermore, on the 13th of June 2019, the Spanish Electoral Board imposed elected MEPs Carles Puigdemont and Antoni Comín –in exile since October 2017– to be personally in Madrid in order to take their seats as MEPs. The decisions taken by the Spanish authorities banning newly elected MEPs from taking office and attending to the European Parliament’s constitutive plenary session on the 2nd July 2019 are a clear violation of their political rights and a disregard of more than 2 million European citizens that voted for them. These acts of the Spanish authorities attempt against the political rights of the MEP-elected Carles Puigdemont, Oriol Junqueras, Antoni Comín and more than 2 million European citizens that voted for them. An unacceptable breach of the Rules of Procedures of the European Parliament, the consolidated Treaties of the EU, the European Charter of Fundamental Rights, and the International Covenant on Civil and Political Rights.

    Catalan Independence 2018 On October 1, 2017, the Catalan Government headed by Carles Puigdemont of the Junts per ​ Catalunya parliamentary alliance held a referendum on the future independence of Catalonia. A ​ semi-autonomous region within Spain, Catalonia enjoyed comparatively larger self-governance than many of Spain’s other regions after Francisco Franco’s rule ended in 1975. While independence has had relatively strong support in recent years, a final decision has remained elusive due to inconclusive elections, referenda, and political opposition from Madrid. The 2017 referendum recorded 92% of respondents favoring Catalan independence. However, only 43% of registered voters voted in the election marred by domestic and national opposition. The government nonetheless pushed through, declaring itself independent on October 27th. Declaring the referendum and declaration illegal, Spanish Prime Minister Mariano Rajoy dismissed the Catalan Generalitat and renewed elections. Puigdemont and his cabinet subsequently fled to Brussels, the headquarters of the European Union. This committee takes place in Catalonia, but Puigdemont remains in exile and his former vice president, Oriol Junqueras, remains in prison. This cabinet consists of fifteen members of Junts ​ pel Sí (Together for Yes) who had not been prosecuted by the Spanish Government after the ​ ​ ​ referendum, and five Spanish representatives sent from Madrid to ensure compliance. Each Catalan member will have access to powers retained after the dissolution of parliament and powers temporarily withheld by Madrid in response to the crisis. Each Spanish member starts with greater powers given by the Spanish government, but will lose some power if and when Madrid deems the situation more under control.

    BRIEFING #12/2019 A HUNDRED YEARS OF INJUSTICE On 14th October, Spain’s Supreme Court made public its verdict convicting nine political and civil society pro-independence leaders of sedition and sentencing them to a total of 99 years and 6 months of prison and to a similar ban from holding public office1. It is worth remembering that, as pointed out in a communiqué by Agora Judicial- a professional association of judges- “Those found guilty worked together in the calling and the organisation of a referendum on self-determination and that, in itself, is not a crime (...). Such was the decision of the [Spanish] Parliament in 2005 when it excluded from the Criminal Code the call of a referendum without legal base.” Similarly, magistrate and jurist Joaquim Bosch claims that “(…) the verdict attributes to the pro-independence public officials the authorship of sedition through a stream of behaviours linked to the call of the referendum and their calls to go to vote. That attribution of guilt also generates legal doubts, because holding illegal referendums is a conduct that was decriminalized. And encouraging citizens to vote cannot criminalize the summoners for the crimes that may occur subsequently. If it is not a crime to hold a referendum, even less so calling to participate in the consultation. For instance, those who call to take part in a peaceful demonstration cannot be responsible for the offenses that may occur in it. There is no causal link. However, the sentence considers several public officials responsible for sedition, while admitting that they did not participate in acts of passive resistance, nor did they encourage the sitting downs to hinder the actions of [police] agents”.

Report Rapporteur: Mr Boriss Cilevičs, Latvia, Socialists, Democrats and Greens Group A. Draft resolution 1. The Assembly stresses the crucial importance, in a living democracy, of politicians being able to freely exercise their mandates. This requires a particularly high level of protection of politicians’ freedom of speech and freedom of assembly, both in parliament and when speaking to their constituents in public meetings or through the media. 2. The European Convention on Human Rights (ECHR, the Convention) protects everyone’s freedom of speech, including the right to make statements that “shock or disturb” those who do not share the same opinions, as established in the case law of the European Court of Human Rights (the Court). 3. The Assembly also notes that freedom of speech is not unlimited. Hate speech condoning violence against certain persons or groups of persons on the grounds of race, origin, religion or political opinions, as well as calls for the violent overthrow of democratic institutions are not protected. Politicians even have a special responsibility, due to their high visibility, to refrain from such abuses. 4. Everyone, and in particular politicians, has the right to make proposals whose implementation would require changes of the constitution, provided the means advocated are peaceful and legal and the objectives do not run contrary to the fundamental principles of democracy and human rights. 5. This includes calls to change a centralist constitution into a federal or confederal one, or vice versa, or to change the legal status and powers of territorial (local and regional) entities, including to grant them a high degree of autonomy or even independence.
