PETITION FILED UNDER SECTION 439 OF Cr.P.C. OFFENCE UNDER SECTION 8 (i) (ii) TSPS Act, Section 5 of ES Act, 1908.

This petition is coming on before me on this day for hearing in the presence of Sri.C.Raman Kumar Reddy, Advocate for the petitioners/accused No.1 to 5 and Addl. Public Prosecutor for State, upon perusing the material papers on record, upon hearing the arguments and having stood over for consideration to this day, this Court made the following :-

This is a petition filed under Section 439 Cr.P.C by the petitioners/Accused No.1 to 5 in Crime No.128/2020 of P.S., Adavi Mutharam Police Station for the offence punishable under Section 8 (i) (ii) TSPS Act, Section 5 of ES Act, 1908 for grant of bail. 2 2. The brief facts of the petition are as follows:

That Police Station Adavi Mutharam, District Jayashankar Bhupalapally has registered a case in Crime No.128 of 2020 dated: 29-08-2020 u/sec.8 (i) (ii) TSPS Act,

Section 5 of ES Act, 1908 against the petitioners/accused No.1 to 5 basing on the complaint of Chandragiri Srinivas/LW1 alleging that A-1/Madakam Nandhu,

S/o.Devaiah, Age 26 years, A-2/Madakam Mahesh, S/o.Jogaiah, Age 35 years, A-

3/Madakam Kamalesh, S/o.Lachaiah, Age 20 years, A-4/Podiyam Lingaiah,

S/o.Bheemaiah, Age 40 years, A-5/Madakam Badraiah, S/o.Jogaiah, Age 47 years, all are Caste: Guthikoya and R/o.Guthikoyagudem, H/o.Singaram village colluded with banned CPI Maoist party and illegal possession of explosive articles i.e., Gelatin sticks,

Detonators, Tiffin boxes and Govt. banned CPI Maoist party pamphlets and the same were supplying to the Govt. banned CPI Maoist extremist party with criminal conspiracy to commit an extremist offence.

The learned counsel for the petitioners/accused No.1 to 5 contended that the petitioners never committed any offence and they are innocent of the offence and a false case is foisted against them by planting witnesses and in this case material witnesses were examined and almost all investigation has been completed and prayed to grant bail to the petitioners/accused No.1 to 5.

On the other side, the learned Public Prosecutor filed counter and opposed the bail stating that the petitioners/Accused No.1 to 5 are extremist sympathizers, because they might have commit the another offence and there is a chance to leak the police movement and kill the police party because of Kataram and Adavimutharam area is an extremist area and also help to the aboard of remaining accused No.6 to 11.

5. Heard the learned counsel for the petitioners as well as learned Addl. Public

Prosecutor for the State. Perused the record.

6. Now, the point for consideration is whether the petitioners/ accused No.1 to 5 are entitled for bail as prayed for? 3 7. On perusal of case diary, it is found that a case was registered by the police

Adavi Mutharam u/sec.8 (i) (ii) TSPS Act, Section 5 of ES Act, 1908 against the petitioners/accused No.1 to 5 basing on the complaint of Chandragiri Srinivas/LW1 and the petitioners were in judicial custody since 29-08-2020. On perusal of CD file as well as, as reported by Addl.P.P., it is clear that as of now the police examined material witnesses LWs 1 to 6 and almost all investigation is completed. Apart from that due to pandemic situation prevailing in the State due to out breaking of covid 19 this Court finds the necessity of petitioners/accused No.1 to 5 to take care of their families as contended by counsel for petitioners. Further, even if the petitioners/accused No.1 to 5 are released on bail there will not be any possibility to interfere with the investigation by threatening or influencing as the material witnesses were examined and almost all investigation has been completed. Hence, this Court is inclined to grant bail to the petitioners/accused No.1 to 5. Hence, the petition is allowed.

8. IN THE RESULT, the petition is allowed and the petitioners/ accused No.1 to 5 are ordered to be enlarged on bail on their executing a personal bond of Rs.10,000/-

(Rupees ten thousand only) each with two sureties each for a like sum to the satisfaction of the Addl. Judicial Magistrate of First Class, Manthani.
