Mr. Justice Iftikhar Muhammad Chaudhry, Chief Justice of Pakistan/Chairman, LJCP chaired the meeting. In his introductory remarks Hon’ble Mr. Justice Iftikhar Muhammad Chaudhry stated that a strong judicial system ensures upholding of rights of the people through fair application of laws and that our procedural laws require modernization in the wake of advancement to address the challenges of changing social values. The meeting was attended by the Hon’ble members of the Commission including Mr. Muneer A. Malik, Attorney General for Pakistan, Mr. Justice Agha Rafiq Ahmed Khan, Chief Justice Federal Shariat Court, Mr. Justice Qazi Faez Isa, Chief Justice, High Court of Balochistan, Mr. Justice Dost Muhammad Khan, Chief Justice, Peshawar High Court, Mr. Justice Umar Ata Bandial, Chief Justice, Lahore High Court, Mr. Justice Muhammad Anwar Khan Kasi, Chief Justice, Islamabad High Court, Mr. Justice Faisal Arab, Judge, High Court of Sindh, Mr. Justice (R) Muhammad Raza Khan, Secretary, Ministry of Law, Justice and Human Rights. Members of the Commission namely Mr. Justice (R) Ghulam Rabbani, Former Judge, Supreme Court of Pakistan, Mr. Abid Hassan Minto, Senior Advocate, Supreme Court of Pakistan and Ms. Khawar Mumtaz, Chairperson, National Commission on the Status of Women (NCSW), Islamabad also attended. Mr. Justice Mohammad Azam Khan, Chief Justice Supreme Court of Azad Jammu and Kashmir, Mr. Justice Rana Muhammad Arshid Khan, Chief Judge, Supreme Appellate Court Gilgit Baltistan, Mr. Justice Ghulam Mustafa Mughal, Chief Justice, High Court of Azad Jammu and Kashmir and Mr. Justice Sahib Khan, Chief Judge, Chief Court of Gilgit-Baltistan also attended the meeting on special invitation. The Commission observed that though the cases of customers of the financial institutions whose cheques are dishonoured do not fall under the purview of section 489-F PPC but they are still prosecuted under the general law. Therefore, in order to check misuse of section 489-F PPC against customers of financial institutions, the Commission recommended amendment in the said section to exclude the customers of financial institutions from its operation. The Commission recommended amendment in the West Pakistan Maternity Ordinance 1958 to restrict the employers to ask their women employees to do any work which is of an arduous nature or which involves long hours of standing. The Commission was of the view that this amendment will facilitate working ladies during pregnancy and after giving birth to a child. In order to check false and frivolous complaints and abuse of provisions of Illegal Dispossession Act 2005, the Commission recommended imposition of compensatory cost on the complainants who misuse the process of law by filing false and frivolous applications under the said Act. The Commission also recommended amendment to the Special Courts (Offences in Banks) Ordinance 1984 to provide right of appeal against acquittal. Besides, the Commission also considered various proposals and referred the same for reconsideration and input of relevant stakeholders. Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime.

It traces the ―spread of legal discourse, jargon, rules and procedures into the political sphere and policy-making fora and processes,‖ as well as ―the expansion of the province of courts and judges in determining public policy outcomes, mainly through administrative review, judicial redrawing of bureaucratic boundaries between state organs, and ―ordinary‖ rights jurisprudence.‖1 At the same time, it underlines the emergence of a third and interrelated class of judicialization of politics, the ―reliance on courts and judges for dealing with what we might call ‗mega-politics:‘ core political controversies that define (and often divide) whole polities.‖2 Pakistan‘s contemporary constitutional jurisprudence furnishes a significant case study for the sustained escalation of this latest and most controversial brand of judicialization of politics. This Chapter analyzes the background reasons for and the distinctive nature of the contemporary engagement of Pakistani judges in mega-politics as well as that engagement‘s complex implications for democratic politics and the institutional balance of power. It also endeavors to explore the essential links between such judicialization and the persistence of unstable constitutionalism in the country.
