I care deeply about this property and completely support Mark Baez' height exception proposal for the following reasons:

This property is an asset to the Venice, Oakwood area. It's unique design make it an attractive and artistic addition to 5th Ave. Its sustainable materials and green sensibility are important examples of fo!Ward-thinking design and architecture. This property has been featured in highly respected design magazines like Dwell and Plenty, and it has also been featured on various green websites. The project has been championed on Home and Garden TV, as well as the international tv program Greenlist. All these media feature 709 5th Ave as a flagship example of ecologically-sensitive building.

Additionally, The Amer Inst. of Architecture, Kaboom, the OTIS school of design, and a local non-profit proudly show this property as one of their note-worthy tour-sites. This says much about how the property is special in appearance and function.

The local community also whole-heartedly supports this site. There have not been any negative comments from its surrounding neighbors, but instead, dozens of letters of support and positive attendence by neighbors at many hearings. People in LA care about this property and support this proposal!

This bldg is not an anomoly in appearance, nor in height, to the area. Venice is famous for its varied and unique architecture styles, and modern design is very popular in our area. 709 5th Ave's modern style compliments the neighborhood. In regard to its size"' there are many 3 story mulit-family bldgs nearby. Also, buildings in the area with a mechanical roof build up to 35'. There are other bldg's in the area with height exceptions; this proposal hardly a precedent.

Mr. Baez is an earnest and honest designer. He's done everything to comply with the city to complete this project and to find ways to solve the construction error, after-the-fact. Another bldg he designed a couple blocks away on Rose Ave -after this property's height errror was discovered- meets all code. Mr. Baez is not is not a wealthy developer nor an arrogant architect who runs roughshod over local codes with little regard for his neighbors and surrounding community. He has responsibly kept all neighbors in the vicinty informed of the various stages this property has gone thru and Is always working cooperatively with the city.

This proposal is asking for a varied roof height exception of TWO FEET ... that's it. Is it really worth all the time, energy, money, human resource and public outcry to deny this property's 24" proposed height exception? Please consider how local organizations, neighbors and dozens of letter writers and hearing attendees prize this property and consider this project worthy of news and tours. Please consider the other buildings in the area that are as tall, or taller than, this property"' and that other nearby properties have received height exceptions. Please consider the working class individuals who are doing their best to comply with the city .. and that debating 24" comes at a severe cost of tax-payers dollars, human resources and extreme indiVudual hardship. Please consider that the alternative to approving this proposal would be extermely costly, disruptive to the community and devastating to the property owner, his neighbors and to me, personally, as I live at this site.

The 709 5th Ave. project is a jewel to the Venice community and deserves its humble request. Please approve the height exception proposal for 709 5th Ave,N and send a poignant message to your constituents and to other cities of how progressive and exemplary Los Angeles County truly is!

First, 709 5th Avenue is a unique, inspiring structure. When I frrst saw it, without knowing anything about its environmentally focused architecture and design, I was impressed by its modem, yet unobtrusive, exterior. It does not, in fact, seem any bigger than many of the other thtee-story residential buildings in the neighborhood. It is in line with the varied architectural character on 5th Avenue and surrounding streets. It is, simply put, Venice.

Once I learned more about what was actually within the walls of 709 5th Avenue -- such as solar panels and other elements exemplifYing his forward-thinking architecture -- I was blown away. Inhabitat called it a "gorgeous, flexible, solar-powered, and stunningly affordable housing option that exemplifies the benefits of prefabricated building." It goes on to say that "the system can be fully erected in 90 days at a cost starting at $100 per square foot! ... Considering how expensive most sleek SoCal prefab systems seem to be- this is a price tag that really got our attention."

Forward-thinkers do, yes, sometimes walk a not-so-straight line, and Baez has acknowledged mistakes in the construction of his building. But he and the community at large truly deserve some extra consideration in this case. He has worked with the community extensively, providing us thorough updates about his application process. He seems profoundly dedicated to fmding a workable solution with the community at large.

Please don't let this project dead-end. It would be a true loss of not just residential space if this building would require vacating but also a blow to community spirit. In a time when we need every inspiring example that we can get of workable, economic housing solutions, we can't let such an architectrrral gem bite the dust.

Although I am a supporter of retaining the Venice charm, I believe that our encouragement of green building practices needs to be paramount and that this project should be approved.

As a previous member of the Venice Neighborhood Council's Environmental subcommittee, I am proud of the many green building designs that are showcased throughout Venice. However, I realize that not all buildings are built the same and not all are easily adjusted to maximize their green potential. I feel it is worth it to grant variances to those projects that are truly making an effort to reduce the carbon footprint of our city, especially when the d!fference in height is so minimal.

The amount of environmental damage caused by forcing any building to be demolished, let alone a sustainably designed building such as this, should be taken into consideration and balanced against the city's stated environmental goals vs Venice's height restriction. I think you'll find that an exception in this case is warranted.

This project is important because it's a wonderful example of how green design benefits the community and its occupants, as well as looking great and enhancing the neighborhood. It will encourage more residents and even nearby business owners and commercial property owners to build/renovate green which benefits everyone and enhances the area. Benefits of green design for the occupants include reduced operational costs, healthier air quality, less energy consumption, and reduced water consumption which in turn creates a more prosperous community. Since I'm an eco-friendly interior designer and a Certified Green Building Professional (by Build It Green), I'm very familiar with the importance and benefits of green design. It's not just a good thing for the environment, but better for our health and saves us money thus positively impacting the economy.

In addition, it never occurred to me that the building doesn't fit in or seems to tall for the area. As an interior designer, I have a very keen and critical eye and I truly feel that this building fits into the neighborhood very well. I think its uniqueness enhances and complements the neighborhood.

If this project is denied, then it will surely create a misperception that green building is complicated and costly and thus discourage others in the area from going green which is definitely a negative to the community. Plus, the disruption to the neighborhood and traffic due to demolition would be so unnecessary and cause disruption and noise which is something you always want to keep to a minimum or avoid whenever possible. Also, the additional cost beyond what Mark Baez must have had to spend to fight this so far, seems so unnecessary. The additional expenses negatively affects the neighborhood Mr. Baez will have less to contribute to the property to make sure the replacement solution looks good in addition to contributing to neighboring businesses.

The character of these residences and businesses is crucial to maximizing the sense of community in this area. Projects such as Lincoln and Rose, and Groundworks coffee, recent multifamily and single family residences support a community of architecturally significant, sustainably designed neighborhood. Indeed, this community is one of the early adopters of concepts which forward a walkable, sustainably designed community. This project is important to this neighborhood as it continues to progress and improve from decrepit bungalows and low cost/low aesthetics tenement housing to a progressive community which exemplifies the distinctly "Venice" values of affordablilty, experimentation, artistry, craft, and individualism and shared living. I find it ironic that this 32 foot tall living community might be demolished due to a 24" incursion despite all of its significant contributions to the urban fabric. If one were to build a 30 foot tall, Mission style revivalist single family monstrosity which served only to insulate a single person from the fabric of the community-that would in conformance and would not be threatened with eviction and demolition. It would conform to the codes but not to the spirit of the neighborhood as this project does.

Please consider the values of the neighborhood in granting this variance to the 30 foot height restriction.

This project is important because Mark had done what we should all be doing with construction projects; making elegant designs that are environmentally sensitive and progressive.

Go after the buildings with the enormous air-conditioning units on their roofs. What if those dwellings were designed to take advantage of the Venice breezes like Mark's, instead of being built as conventionally as possible with enormous need for energy-hogging, heat-radiating air-conditioners? This reminds me of the story Barry Schwartz told at the TED convention in 2009. He spoke of an academic who brought his 12-year-old son to a baseball game. The bookish father went to get his son some lemonade; all they had was Mike's Hard Lemonade. The father had never seen it before and didn't realize it was an alcoholic beverage. But the cop who saw the 12-year-old boy drinking it sure did. The boy was taken to the Department of Family Services. All along the way, the father and son were apologized to ... People were just doing their jobs. Social workers visited their home, evaluated their case --and weeks later, the boy was finally allowed to return home-- as long as the father wasn't there! So a man's honest mistake turned into a huge trauma for a boy -- because everyone involved was just doing their job -- but not looking at the big picture.

Please look at the big picture, and allow the dwelling to stand.

Green technology is how we are going to help revitalize the economy in this country, and is part of how Los Angeles is going to put it's face of the map as one of the greenest cities in the country. When we talk about "bending the rules" it's usually for a particular exception, and if you're talking about the property at 709 5th Ave, well then you are talking about making an exception to support sustainable living design, and an exception I as an Angeleno would be proud to make.

Our city has a history of being on the "cutting edge" of many cultural movements. Supporting sustainable projects like this will be part of sending the message that this type of design is important not only to our planet, but to the way in which we live.

This has been a mess from the get-go and this poor architect has done nothing but try to build an environmentally friendly building which ultimately helps his neighborhood and our whole community. If more people in California would be this conscientious of their neighbors and their environment, certainly our state and specifically Venice would be real trendsetters in creating templates for other architects to model wonderful buildings on.

This is the kind of project we should support - not destroy!

This is important for so many reasons, including the following:

- All adjacent neighbors have expressed support of the project and none oppose. - The building is compatible in scale and character with the neighborhood, as there are many three-story multi-family residential buildings in the vicinity. -The building is an asset to the Venice community, both architecturally and environmentally. - The structure does not block any views or create any negative shade or lighting impacts. The applicant has worked extensively with the community, keeping everyone informed of the application process.

Failure to approve the application may have negative consequences, such as visual blight and problems with safety, because the property will have to be vacated and possibly abandoned. In addition, demolition of the structure would be disruptive to the neighbors and to the environment, and take away sorely needed residential space.

Please don't let this wonderful, creative, helpful, and beautiful project die!!

I have admired this building for the 4 years I have lived in the Santa Monica!V enice area. I have also read about the building in various architecture magazines where it was featured for its unique design and particularly for its envirorunentally friendly design.

I understand the building contravenes the height code for the area and I also understand the need to uphold these regulations. However I do not find that the building intrudes in any way on the local neighborhood amenity and I understand all the adjacent neighbors have also expressed their support for the building. I believe it would be a travesty to remove the building for a relatively minor infraction. In my opinion it this sort of envirorunentally friendly design is exactly what we as a forward-thinking community should be encouraging and I hope your committee take this into consideration in your deliberations.

Countries, cities, neighborhoods develop over time. Change and development is a necessity to humankind.

I have no doubt that Mr. Baez had the best formal intentions for the future of the city he lives in.

Please, let me make a point by stating that this architecture is very well suited for this site just as it is -because it has emerged from the context and city texture itself.

I want to ask in all sincerely that the jury of this hearing today not make a mistake by having something so real and original and so completely and genuinely Californian demolished.

I am a longtime resident, parent and professional in Los Angeles (who, until very recently, resided in Venice) and am writing to express comments on the above-mentioned project. I have attended a court hearing, read through applicable documents and have heard and understood arguments on both sides of the issue. But, in the end, I remain steadfastly in support of Mark Baez' s application to retain the height of his existing building.

First, 709 5th A venue is a unique, inspiring structure. When I first saw it, without knowing anything about its environmentally focused architecture and design, I was impressed by its modern, yet unobtrusive, stature. It does not, in fact, seem any bigger than many of the other three-story residential buildings in the neighborhood. It is in line with the varied architectural character on 5th Avenue and surrounding streets. It is, simply put, Venice.

Once I learned more about what was actually within the walls of 709 5th Avenue, such as solar panels and ways in which his forward-thinking architecture could translate into progressive, economical housing in a future that must be more environmentally efficient, I was blown away. If you have not had a chance to read some of the press garnered by Baez's architecture, please have a look at the following clip: http://www.inhabitat.com/2007 /09/07 /prefab-friday -mdesigns-mcube-green-horne-ll

Inhabitat called it a "gorgeous, flexible, solar-powered, and stunningly affordable housing option that exemplifies the benefits of prefabricated building." It goes on to say that "the system can be fully erected in 90 days at a cost starting at $100 per square foot! ... Considering how expensive most sleek SoCal prefab systems seem to be -this is a price tag that really got our attention."

Forward-thinkers do, yes, sometimes walk a not-so-straight line, and Baez has acknowledged mistakes in the construction of his building. But he and the community at large deserve some extra consideration in this case, and I truly do believe that. He has worked with the community extensively, providing us thorough updates about his application process. He seems profoundly dedicated to finding a workable solution with the community at large.

I am writing this letter in support of Mark Baez and his M Cube, which I understand is at risk of being torn down due to a height regulation. I am hoping you will make a height exception in Mark's case and not destroy the M Cube.

I ask you to consider this for three reasons:

(1) Mark has devoted years to developing this property. He has invested a tremendous amount of his own money into t his project and has borrowed an equally tremendous amount from friends who love him, admire his work, and want to see him attain the success that he deserves. Tearing the property down will be financially devastating to him and very possibly will prevent him from moving forward in his career and creating future artistic and innovative dwellings that many people would benefit from.

(2) Mark has also devoted his heart and soul to this project. I don't believe the imagery of someone giving their blood, sweat and tears to achieve something meaningful in this world is an exaggeration. Tearing the property down will be emotionally devastating to him as well, and very possibly will significantly dampen his spirit, his enthusiasm for life, his optimism, his humanism, and his altruistic contributions to people in general and society as a whole.

(3) Although I do not believe that rules are meant to be broken, I do believe that that there are exceptions to rules and that there need to be exceptions to rules. I believe that compassion and flexibility should be factored into any decision-making process, and that, under special circumstances, exceptions should be made, if at all possible.

Mark Baez is a decent, honorable, hardworking man with integrity and goodness. I believe, if the M Cube is allowed to survive and thrive, that the showing of such mercy, so to speak, will prove to be a victory for all concerned.

All through more than 2 years of construction, the owner and his builders received official approvals with no problems until one day when the Cubes were moments away from finished, officially 99% complete it was discovered they were slightly over height- much to everyone's surprise. The L.A City Council needs to see that quibbling over two feet of roof height is not worth tearing down these eco-sustainable homes! The alternative to this height exception approval is to tear down the Cubes -which no one wants to do for obvious environmental, extreme financial hardship to the owners and much-needed Westside residency space reasons.

One of the reasons I love this particular community is because of the diversity, artistry, and eclectic vibe of both its residents and the amazing things they create. I can see an original play at the Electric Lodge or simply stroll down Abbot Kinney Blvd and listen to the heartfelt songs of a struggling musician. Art can be found in a fancy gallery or down at the graffiti park near the Venice Boardwalk. And the architecture is amazing! Where else can you find a beach bungalow, a craftsman house, and some new fangled green structure all on the same street, and think to yourself, "You know, this all actually works!"

Mark Baez has created one such structure at 709 5th Ave, and it is in danger of being torn down. An asset to the Venice community both architecturally and environmentally (not to mention other communities that will emulate this structure due to its exposure in well respected magazines, Dwell and Plenty), this structure is compatible in scale and character with the neighborhood. It doesn't block any view or create negative shade/light impacts, and it also provides much needed housing for several residents in this neighborhood. Perhaps most importantly, all adjacent neighbors have expressed support for the project.

Mark has worked extensively with the community, keeping everyone informed of the application process with the utmost integrity and professionalism. It really seems silly to be squabbling over a couple of feet, and the impact of tearing this structure down would b a great deal more disruptive for the neighborhood and its residents.

I once again implore you to support the height exception proposal for the structure at 709 5th Ave. in Venice. Let's celebrate the diversity of our unique Venice neighborhood in all its many facets, enjoying all that it has to offer, which is a lot. As such, these communities serve as shining examples of the power that rests in locally minded custodianship.

Silver Lake and Venice are also model communities that showcase Los Angeles's rich architectural history. Both neighborhoods offer stunning examples of functional beauty meshed with forward-thinking design, there to be experienced and studied by residents and tourists alike. These iconic properties are destinations in and of themselves­ destinations that only contribute greatly to the wealth and reputation of Los Angeles as a whole.

Whether it be Lautner's revolutionary Silver Top residence, Neutra's gorgeous colony, or Mark Baez's Cubes, these structures are an enduring legacy to the aspirational spirit that continues to characterize this vast and wondrous city. Tearing down a landmark such as, say, Ennis House is as unthinkable as shuttering the entire entertainment industry. I believe that the possible razing of Mark Baez' s structure is on par with the above impossibilities: for I also believe that Baez has gifted the city of Venice with a revolutionary new perspective on green building: a deeply inspiring work worthy of study by a new generation of architects, artists, environmental builders and policy makers. My name is Richard Luthy and I live in Stanford, California. I have visited and toured the property at issue in this case, and I support the height exception proposal for the 709 5th Ave, 90291 property, Council File Number: 10-0393.

This project is important because it benefits the neighborhood by providing new housing that is seismically safe and compatible in scale and character with other structures. There are other three-story, multi-family residential buildings in the vicinity. The building embodies many innovative environmental design features.

All adjacent neighbors have expressed support for the project, and none oppose. The structure does not block any views or create any negative shade or lighting impacts.

Failure to approve the application will have many negative consequences, including take away of structurally safe and environmentally friendly residential housing.
