Equality as a Human Right: The Development of Anti-Discrimination Law in Hong Kong CAROLE J. PETERSEN* The women's movement in Hong Kong has significantly benefited from the political and legal changes that oc- curred during the transition to 1997. Citizens of Hong Kong developed a greater awareness of human rights issues, and women have successfully identified equality as a "human right" deserving legalprotection. The women's movement has also allied itself with the increasingly democratic and assertiveLegislative Council. As a result, the legalprohibition offemale inheritance of land in Hong Kong was repealed in 1994 and the first law prohibiting sex discrimination was enacted in 1995. Additionally, Hong Kong's first Equal Opportunities Commission is being established. Ironically, the very developments that strengthened the women's movement in recent years-its association with the broaderhuman rights movement and with assertive legislators--may threaten it when China regains sovereignty. * Lecturer in Law, School of Professional and Continuing Education, University of Hong Kong. In its early years as a Crown Colony, it suffered from corruption and racial segregation but grew rapidly as a free port that supported trade with China. It took about two decades before Hong Kong established a genuinely independent judiciary and introduced the Cadet Scheme to select and train senior officials, which dramatically improved the quality of governance. Until the Pacific War (1941–1945), the colonial government focused its attention and resources on the small expatriate community and largely left the overwhelming majority of the population, the Chinese community, to manage themselves, through voluntary organizations such as the Tung Wah Group of Hospitals. The 1940s was a watershed decade in Hong Kong’s history. The fall of Hong Kong and other European colonies to the Japanese at the start of the Pacific War shattered the myth of the superiority of white men and the invincibility of the British Empire. When the war ended the British realized that they could not restore the status quo ante. They thus put an end to racial segregation, removed the glass ceiling that prevented a Chinese person from becoming a Cadet or Administrative Officer or rising to become the Senior Member of the Legislative or the Executive Council, and looked into the possibility of introducing municipal self-government. -

N337 Historic Building Appraisal Entrance Gate San Wai, Ha Tsuen, Yuen Long, New Territories The entrance gate of San Wai (新圍), which literally means “new Historical walled village”,1 is situated in a local district known as Ha Tsuen (廈村) or Interest Ha Tsuen Heung (廈村鄉).2 Ha Tsuen was founded by two brothers, Tang Hung-chi (鄧洪贄) and Tang Hung-wai (鄧洪惠), both ninth generation members of the Ng Yuen Tso (五元祖) of the Tang (鄧) clan.3 As one of the oldest villages in Ha Tsuen, San Wai has a history of more than 250 years. It was established by Tang Tso-tai (鄧作泰, 1695 – 1756), an eighteenth generation member of the Ng Yuen Tso, and Tang Wai-yuk (鄧為玉, 1715 – 1755), a generation younger than Tso-tai. The village’s name “新圍” in Chinese and “San Wai” in English can be identified from a government report of 1899 and a land record of the then colonial government dating from 1905 to 1907. Regarding its layout, San Wai is composed of rows of houses, with an entrance gate. It is believed that the entrance gate was originally situated on the central axis of the village. As the village expanded, this central axis gradually lost its significance, and the view from the entrance gate was eventually blocked by rows of houses. A map dated 1917, which is the earliest record of its kind identified, shows that by that time two rows of houses had been built in front of the entrance gate.4 Interestingly, no shrine was built within San Wai, as villagers believe that the village is “protected” by the Earth God shrine near the Yeung Hau Temple (楊侯古廟), which is locally known as Sai Tau Miu (西頭廟, western temple). -

HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. The Hong Kong Government has adopted a range of measures to improve water quality including the enactment of the Water Pollution Control Ordinance which specifies Water Quality Objectives (WQO) for rivers. One of the key WQO for the Kam Tin River, one of the largest rivers in Hong Kong, is an annual median suspended solids value of <20 mg/L. During the years of 2006 to 2011, regular weekly sampling at the Kam Tin monitoring station revealed dry season median values for suspended solids of 82.1, 84.4, 52.6, 74.3, 82.2 and 60.6 mg/L, respectively, well above the WQO limits. In the summer wet season the annual median values are 52.2, 43.4, 19.1, 21.6, 25.0 and 56.6 mg/L, respectively, which are much lower than those in the dry season and in general exceed the WQO limit. Monitoring at three additional stations indicates spatial variation in sediment concentrations in the basin. -

BUSH: [In progress] I've long thought that politically Hong Kong plays a very important role in the Chinese political system because it can be, I think, a test bed, or a place to experiment on different political forums on how to run large Chinese cities in an open, competitive, and accountable way. So how Hong Kong's political development proceeds is very important for some larger and very significant issues for the Chinese political system as a whole, and therefore the debate over democratization in Hong Kong is one that has significance that reaches much beyond the rights and political participation of the people there. The election that occurred last Sunday is a kind of punctuation mark in that larger debate over democratization, and we're very pleased to have two very qualified people to talk to us today. The first is Professor Sonny Lo Shiu-hing, who has just joined the faculty of the University of Waterloo in Canada. -

Tang As Hong Kong in 2009 retained its title as the world’s freest economy for the fifteenth consecutive year, radicalism seemed to have gained wider support in local politics at a time of economic turbulence—even though a timetable for universal suffrage has been set. Hong Kong kept its top position in an index of economic freedom developed by the Heritage Foundation, a Washington DC think tank, due to its record of economic openness. -
