												  Regulations and the Rule of Law: a Look at the First Decade of IsraelKeele Law Review, Volume 2 (2021), 45-62 45 ISSN 2732-5679 ‘Hidden’ Regulations and the Rule of Law: A Look at the First decade of Israel Gal Amir* Abstract This article reviews the history of issuing regulations without due promulgation in the first decade of Israel. ‘Covert’ secondary legislation was widely used in two contexts – the ‘austerity policy’ and ‘security’ issues, both contexts intersecting in the state's attitude toward the Palestinian minority, at the time living under military rule. This article will demonstrate that, although analytically the state’s branches were committed to upholding the ‘Rule of Law’, the state used methods of covert legislation, that were in contrast to this principle. I. Introduction Regimes and states like to be associated with the term ‘Rule of Law’, as it is often associated with such terms as ‘democracy’ and ‘human rights’.1 Israel’s Declaration of Independence speaks of a state that will be democratic, egalitarian, and aspiring to the rule of law. Although the term ‘Rule of Law’ in itself is not mentioned in Israel’s Declaration of Independence, the declaration speaks of ‘… the establishment of the elected, regular authorities of the State in accordance with the Constitution which shall be adopted by the Elected Constituent Assembly not later than the 1st October 1948.’2 Even when it became clear, in the early 1950s, that a constitution would not be drafted in the foreseeable future, courts and legislators still spoke of ‘Rule of Law’ as an ideal. Following Rogers Brubaker and Frederick Cooper, one must examine the existence of the rule of law in young Israel as a ‘category of practice’ requiring reference to a citizen's daily experience, detached from the ‘analytical’ definitions of social scientists, or the high rhetoric of legislators and judges.3 Viewing ‘Rule of Law’ as a category of practice finds Israel in the first decades of its existence in a very different place than its legislators and judges aspired to be.

												  The Image of the Amish in the New York Times Versus the Image of the Haredim in Haaretzconflict & communication online, Vol. 13, No. 1, 2014 www.cco.regener-online.de ISSN 1618-0747 Benyamin Neuberger & Keren-Miriam Tamam The image of the Amish in the New York Times versus the image of the Haredim1 in Haaretz (1980-2010)2 Kurzfassung: Der vorliegende Aufsatz vergleicht die Presseberichterstattung über die Beziehung zweier ultra-religiöser Gruppen, der Amish-Gemeinde in den USA und der Haredi-Gemeinde in Israel, zu ihren jeweiligen Staaten. Obwohl die Amish in Israel mitunter als "ame- rikanische Haredim" bezeichnet werden, gibt es bedeutende Unterschiede zwischen den beiden Gruppen und ihrer Darstellung in den Me- dien. Nichtsdestotrotz gibt es aber auch hinreichend viele Ähnlichkeiten, um einen Vergleich zu rechtfertigen. Im Wesentlichen spiegeln die Unterschiede der Berichterstattung über die beiden Gruppen in der New York Times und in Haaretz die grundlegenden Unterschiede ihrer Stellung in ihrer jeweiligen Gesellschaft und ihrer Haltung gegenüber dem Staat wider. Während die Amish die USA als "land of freedom" akzeptieren, betrachten die Haredim Israel nicht als einen wirklich jüdischen Staat. Während sich der Dialog zwischen den Amish und ihrem Staat um bürgerliche Freiheiten und Rechtsgrundsätze dreht, leitet sich die Auseinandersetzung mit den Haredim von einer abweichenden Wahrnehmung des Charakters des israelischen Staates her. Die Haltung der Haredim gegenüber der Mehrheitsgesellschaft und dem Staat ist in großem Maße konflikthaltig und damit meilenweit entfernt von der Einstellung der Gelas- senheit, die für die Amish charakteristisch ist. Abstract: This article compares the newspaper coverage of the relationship of two ultra-religious groups, the Amish community in the USA and the Haredi community in Israel, with their respective states.

												  “Centrist” Orthodoxy and Religious Zionismchapter 7 Two Orthodox Cultures: “Centrist” Orthodoxy and Religious Zionism Shlomo Fischer Introduction In this paper I will compare two contemporary Jewish Orthodox cultures, American “Centrist” Orthodoxy and Israeli Religious Zionism. I argue that despite common Orthodox religious orientations and a shared right-wing polit- ical orientation, these two communities have significantly different underlying religious cultures. Israeli Religious Zionism is a Romantic nationalist culture with a strong expressivist dimension; that is, a strong emphasis on self-expres- sion and notions such as authenticity. American Centrist Orthodoxy continues the traditional Jewish pattern of emphasis upon religious heteronomy; that is, the Torah and God’s commandments are imposed externally on the Jew. As a result of these cultural differences, the two communities differ in terms of cul- tural phenomena such as the place of art and literature and, to a certain extent, in regard to the type of interpretation of Biblical and Talmudic sources that is current, favored, and valued. Underlying these differences are fundamen- tal differences concerning how the self and its relation to religious practice, authority, and tradition are conceived in the two communities. I would like to conduct this comparison mainly through two Orthodox publications: Makor Rishon in Israel, and The Jewish Press in New York. Both are leading newspapers for their respective communities. The Jewish Press was founded in the 1960s and targets the Centrist Orthodox community (Beckerman, 2010). The Haredi community in America is served by English versions of two Haredi newspapers that appear in Israel, Yated Neeman and Hamodia. The Jewish Press is published in New York, but sells the newspaper nationally and has a weekly circulation of 50,000.

INTRODUCTION [1] The issues on appeal concern whether an internet libel action, based on a newspaper article uploaded in Israel, can and should proceed in Ontario. Page: 2 [2] In November 2011, an Israeli newspaper, Haaretz, published an article criticizing the management practices of Mitchell Goldhar, the owner of the Maccabi Tel Aviv Football Club, a soccer team based in Tel Aviv, that plays in the Israeli Premier League. [3] Goldhar is a prominent Canadian businessman and lives in Toronto. [4] In addition to being published in print, the article was available on the newspaper’s Hebrew and English-language websites. It came to the attention of some Canadian readers through the English-language website. [5] The article asserted that Goldhar imported his management model from his main business interest — a partnership with Walmart to operate shopping centers in Canada — and that he “runs his club down to every detail.” It also included a suggestion that his “managerial culture is based on overconcentration bordering on megalomania” and questioned whether “his penny pinching and lack of long term planning [could] doom the [soccer] team.” [6] In December 2011, Goldhar launched an action in Ontario, claiming damages for libel against Haaretz, its sports editor and the reporter who wrote the article (collectively “Haaretz”).

												  The Haredim As a Challenge for the Jewish State. the Culture War Over Israel's IdentitySWP Research Paper Peter Lintl The Haredim as a Challenge for the Jewish State The Culture War over Israel’s Identity Stiftung Wissenschaft und Politik German Institute for International and Security Affairs SWP Research Paper 14 December 2020, Berlin Abstract ∎ A culture war is being waged in Israel: over the identity of the state, its guiding principles, the relationship between religion and the state, and generally over the question of what it means to be Jewish in the “Jewish State”. ∎ The Ultra-Orthodox community or Haredim are pitted against the rest of the Israeli population. The former has tripled in size from four to 12 per- cent of the total since 1980, and is projected to grow to over 20 percent by 2040. That projection has considerable consequences for the debate. ∎ The worldview of the Haredim is often diametrically opposed to that of the majority of the population. They accept only the Torah and religious laws (halakha) as the basis of Jewish life and Jewish identity, are critical of democratic principles, rely on hierarchical social structures with rabbis at the apex, and are largely a-Zionist. ∎ The Haredim nevertheless depend on the state and its institutions for safeguarding their lifeworld. Their (growing) “community of learners” of Torah students, who are exempt from military service and refrain from paid work, has to be funded; and their education system (a central pillar of ultra-Orthodoxy) has to be protected from external interventions. These can only be achieved by participation in the democratic process. ∎ Haredi parties are therefore caught between withdrawal and influence.

												  Cityscape: a Journal of Policy Development and Research • Volume 23, Number 2 • 2021 Cityscape 381 U.Sby Moshe Shamai and Ravit Hananel Urban Renewal or Earthquake Preparedness: Lessons from Israel’s National Master Plan for Earthquake Preparedness (TAMA 38) Moshe Shamai Ravit Hananel Tel Aviv University Abstract TAMA 38 is a national master plan for reinforcing existing structures against earthquakes and has been Israel’s flagship urban renewal policy during the past decade. This study analyzes the effect of TAMA 38 at both the national and local levels. At the national level, we analyze the spatial distribution of TAMA 38 projects and the plan’s pace of implementation. At the local level, we examine the influence of extensive TAMA 38 redevelopment on a neighborhood’s diversity and the local authority’s infrastructure and budget. The research findings and the lessons that can be learned from the Israeli case may assist decisionmakers elsewhere seeking new policy tools for addressing the need to reinforce buildings against earthquakes and the emerging need for urban renewal of city centers. Introduction TAMA 38—Israel’s national master plan for reinforcing existing structures against earthquakes— has been the country’s flagship urban renewal policy for the past decade. Under TAMA 38, the state offers incentives to developers and property owners to turn old residential buildings into earthquake-resistant ones (GAUR, 2018; Geva and Rosen, 2018; Margalit and Mualam, 2020; Shamai and Hananel, 2021). This concept makes TAMA 38 an interesting, unorthodox plan in the fields of earthquake preparedness and urban renewal because it reduces the state’s role to mere regulator and leaves the initiative to the private market. 												  Kalman NeumanNew Politics, No Politics, and Antipolitics: The Dilemma of the Religious Right in Israel Kalman Neuman Different explanations have been offered for the widespread phenomenon of disillusionment, disengagement, and escape from politics in general or from involvement in formal political activity in particular. These include an aversion or disinterest in the political sphere altogether as a result of a change in sense of public and civic duty, a rejection of politicians as self-serving at best or corrupt at worse, or as a result of the convergence of the policies of political parties, who offer little to choose between them (Hay 2007, 56). How do these phenomena impact on the behavior of political parties? One result is the attraction to short-lived “non-political” parties that try to benefit from the disgust from established politics. The success of the Retirees’ party in the 2006 Israeli elections was an example of this trend (Susser 2007); it was expected that in the 2009 Israeli election parties focusing on environmental issues would benefit from such antipolitics. Established parties also tried to capitalize on such perceived tendencies. They try to attract new faces, untainted with the stain of being “politicians.”1 * At the conference in December 2008, Israel was entering an election campaign that culminated on February 10, 2009. I have tried to include events leading up to the election in an epilogue to this paper. 1 For example, in the recent Israeli elections the head of the left-wing Meretz party, Haim Oron, said that his party wants to attract votes from 333 Kalman Neuman What is the relative importance of the different factors? To the extent that escape from politics is caused by policy convergence that leads to the Tweedledee-Tweedledum perception that “they are all the same,” a party that offers (as Barry Goldwater did in the US elections in 1964) “a voice, not an echo” may be less affected.
