EUPM Monthly Report – June 2011 Reporting Period: 1 – 30 June 2011 Report number: 06/11

1. EXECUTIVE SUMMARY

Talks regarding the harmonizing of the Cantonal Law on Internal Affairs (CLIA) culminated in a day-long meeting of Police Commissioners and (Federation) Ministers of Interior hosted by Federation Minister of Interior, Mr. Kurtes, and the BiH Federation Police Administration Director, Dragan Lukac.

HoM met the RS Minister of Interior, Mr Cadjo in Banja Luka to discuss amendments to the RS Law on Police Officials (LoPO) and, inter alia, the upcoming Srebrenica Commemorations in early July.

Together with the BiH Gender Equality Agency, EUPM launched the first of seven training sessions on gender awareness at the Police Academy in Sarajevo.

DHoM attended a ceremony to unveil a memorial plaque in Bugojno in honour of the killed policeman following the bomb attack in the early morning hours of 27 June 2010.

EUPM organized a three-day study visit for the Disciplinary Prosecutor’s Office of Bosnia and Herzegovina to the Romanian Superior Council of Magistrates in Bucharest from 31 May to 4 June 2011.

EUPM organized the 5th BiH Prison Directors Conference in Sarajevo, which invited all BiH prison directors and assistant directors responsible for security, representatives from all three ministries of justice and high-level police officials from Federation BiH and Republika Srpska as well as relevant representatives of the international community.

The investigation in to a case codenamed Diploma, which launched in 2008 into the alleged abuse of position in the Tuzla branch of the Sarajevo Law Faculty, continues with the matter being discussed and upheld before the Senate of the University of Sarajevo in late June.

Canton 8 Police conducted operation ‘Special Ride’ targeting a group believed to be involved in forging and altering vehicle documentation. Drug seizures: Brcko District Police conducted an operation codenamed, ‘Pancir’, SIPA officers conducted an operation codenamed Babo Lee; MoI Canton 4 (Zenica) searched several houses in Kakanj municipality and seized illegal substances and ammunition; RS police led an operation code named Hercegovina; RS police continued activities within ongoing operations Plantaza 2011 and Kula.

On 23 June, Banja Luka police conducted an operation codenamed Sparta and arrested three social workers suspected of abuse of position and sexual abuse of minors. Several locations were searched and certain evidence was seized.

Canton 8 Police initiated a corruption case against the former Canton 8 Prime Minister, accused of authorising payment of financial support to a company engaged in the production of bottled water in the amount of 100.000 KM.

The BiH State Court rendered a decision terminating the custody of Ramo Brkic, former Canton 1 Police Commissioner, since his arrest in December 2010, imposing prohibitive measures.

2. COMMENTS BY HOM

The month of June witnessed an increased momentum in both: mission activities and the consultation regarding the Rule of Law, as EUPM worked closely with OHR and ICITAP on the Cantonal Law on Internal Affairs, regarding an initiative of cantonal ministers of interior to propose a new draft of the Cantonal Law on Internal Affairs (CLIA). I attended the first round of talks in an all-day conference, on 15 June, of cantonal ministers of internal affairs in Banovici (Tuzla region) to discuss the Laws on Internal Affairs (LIA).

A document was subsequently prepared by EUPM, in coordination and agreement with OHR and ICITAP experts, which I presented to the Federation Minister of Interior, Mr. Kurtes, on 28 June,

clearly expressing that the draft law has been meticulously assessed and the comments, which are made one to offer assistance, and for the minister’s consideration. Now the process is expected to be locally led. This document was drafted following consultations hosted by EUPM in conjunction with legal representatives from OHR and ICITAP on 27 June.

Further talks were held on 30 June when the Federation Minister of Interior, Mr. Kurtes, and the BiH Federation Police Administration Director, Dragan Lukac, hosted Police Commissioners and (Federation) Ministers of Interior in a day-long meeting. I attended, as well as OHR, and, in opening remarks, I emphasised that EUPM welcomes the initiative to reform legislation in the Federation and cantons in a harmonised manner, and prepare the law enforcement sector for the process of EU integration.

Amendments to the RS Law on Police Officials (LoPO) were also discussed on 20 June when I traveled to Banja Luka to meet the RS Minister of Interior, Mr Cadjo. We also discussed current issues including the upcoming Srebrenica Commemorations in early July. With reference to this latter event, the Minister of Security, Mr. Ahmetovic, hosted a meeting on 22 June which I attended. Relevant Law Enforcement Agencies and the State Prosecutor were present, except the invited representatives of the RS Police who did not attend for unforeseen operational reasons. There is currently no indication or information on any potential security threats surrounding the 16th Srebrenica Commemorations in early July, and EUPM continues to monitor the operational conduct which appears to be ongoing in a comprehensive manner.

Progress within coordinated meetings and talks to resolve and harmonize police laws, however, is over shadowed by the lack of momentum in other important areas essential to EU membership and post visa liberalisation. With regards to the continuing lack of appointment of the Director and deputy Directors to the ‘Agency for Prevention of Corruption and Cooperation in the Fight Against Corruption’, the Acting Head of the EU Delegation sent a letter to the Collegium of the House of Peoples on 23 June, urging a solution. The Law on Agency for Prevention of Corruption and on Cooperation in the Fight against Corruption entered in to force on 7 January 2010.

Further negative impact was felt when the Office of Disciplinary Prosecutor (ODP) of the High Judicial and Prosecutorial Council (HJPC) of BiH launched a disciplinary action against the BiH Chief Prosecutor Milorad Barasin on 28 June, requesting his suspension from office until the end of disciplinary action. The ODP accuses Barasin of unprofessional conduct and inappropriate contact with parties to the proceeding, which bring into question the public’s faith in judiciary and its credibility.

Focusing on other important aspects of the mission’s mandate, on 13 June, together with the 'LUHFWRURIWKH*HQGHU(TXDOLW\$JHQF\6DPUD)LOLSRYLü-+DGåLDEGLüDQGWKH)HGHUDWLRQ%L+ Minister of Interior, Predrag Kurteš, I spoke at the first session of Gender Awareness Training at the Police Academy Sarajevo. This training is a part of the joint project developed by EUPM, the BiH Gender Equality Agency and police education institutions in BiH. I stressed the importance of this activity and EUPM’s readiness to assist domestic authorities in its implementation.

Also during the reporting month, as traditional partners of the Kids Festival in Sarajevo since 2003, EUPM and BIH police agencies hosted a Police Day, on 14 June which I attended together with Canton 9 Police Commissioner, the deputy Director of SIPA and the deputy Director of Border Police.

3. MISSION ACTIVITIES

– EUPM DHoM visits Bugojno On 25 June, EUPM DHoM attended a ceremony to unveil a memorial plaque in Bugojno, in honour of the killed policeman following the bomb attack in the early morning hours of 27 June 2010. Background: An explosive device went off behind the police station in the Central Bosnia town of Bugojno (Canton 6, Travnik), killing one police officer and seriously wounding one female police officer. On 17 December 2010, the BiH Prosecutor's Office issued an indictment against six persons involved in this bomb attack. Three main suspects are charged with criminal offense of "terrorism" while their three accomplices are charged with the criminal offense "accessory after the fact". The main trail commenced on 22 March 2011.

– Study trip to for the Disciplinary Prosecutors Office Sarajevo EUPM organized a three-day study visit for the Disciplinary Prosecutor’s Office of Bosnia and Herzegovina to the Romanian Superior Council of Magistrates in Bucharest from 31 May to 4 June 2011. The visit consisted of meetings with members of the Romanian Superior Council of Magistrates – the equivalent of the Bosnian High Judicial and Prosecutorial Council (HJPC), and covered topics related to judges’ and prosecutors’ independence with regard to politics and the media, methods of dealing with media pressure, inspection teams and disciplinary procedures and the relationship between the disciplinary, criminal and civil responsibilities of judges and prosecutors. Overall this trip is part of EUPM’s dedicated activities towards improving the management performance of prosecutors and judges both in the High Judicial and the Prosecutorial Council.

– Gender Equality Training Throughout June seven training sessions on gender awareness and equality took place across BiH, jointly sponsored by EUPM and the Gender Equality Agency. The sessions, specifically targeted at police instructors are designed to introduce gender equality and awareness into the curricula taught to trainee police officers, and further encourage their promotion in every aspect of police life. Also discussed during these sessions is the need to increase the presence of women in the police, as women are currently significantly underrepresented within the security structures of BiH, particularly at higher levels. These training sessions are one of the initiatives from BiH’s Action Plan for implementing UNSCR 1325 on women, peace and security. The plan aims to increase the number of women engaged in the police and the military, and to reaffirm the work of those women currently engaged in managerial positions. It is hoped that through these training sessions, held across the country, BiH police can guarantee a systematic, coherent and coordinated approach to the issue of gender equality.

– BiH Prison Directors Conference On 22 June, EUPM organized the 5th BiH Prison Directors Conference on prison security in Sarajevo, gathering all BiH prison directors and assistant directors responsible for security, representatives from all three ministries of justice and high-level police officials from Federation BiH and Republika Srpska. Representatives from OSCE, the Council of Europe and the EU

Delegation to BiH also attended. The agenda of the meeting mainly focused on the new security strategy for BiH prisons, as a part of an ongoing process to build capacity within the BiH prison service to combine efforts in responding to increasing security demands. The attendees were also given the opportunity to meet two high-ranking prison officials from Finland: Mr. Esa Vesterbacka, Director General of the Finnish Prison Service, presented the new role model of the Criminal Sanctions Agency as well as the most important aspects of legislation concerning prison service and the implementation of goals set by the Government and Parliament; Ms. Marjatta Kaijalainen, the Head of Planning of the Finish Prison Service, gave a presentation on the newly developed security strategy of the Criminal Sanctions Agency, the cooperation between relevant agencies and the statistics used for monitoring the security situation. The Conference was funded by the EU Technical Assistance and Information Exchange (TAIEX) program.

– Optical Character Readers (OCR) at Border Crossings A corner stone for an efficient post visa liberalization policy is the use of Optical Character Readers (OCR) for identification documents at border crossings. In the past EUPM witnessed a significant lack of use of OCRs at border crossings, except in the airports. In 2010 only 5.4 % of the documents were checked. EUPM Border Police advisers visited several border crossings urging officers to use OCRs and demonstrating correct use of the readers. Statistics have subsequently revealed a large increase in the number of documents processed through the readers, reaching an average of close to 50% in 2011.

– 16th Medal The mission held its 16th Medal Awarding Ceremony on 3 June in the mission Headquarters in Sarajevo, awarding exemplary mission staff for service and commitment to the EUPM's goals towards the professionalization and modernization of police work in BiH and their overall contributions to the Common Security and Defense Policy (CSDP).

HoM awarded 19 mission members with Service Medals and one national staff with the certificate of appreciation at the ceremony which represents an opportunity to cherish the achievements of the EUPM since its beginning in 2003.

4. POLITICAL AND SECURITY UPDATE

– Formation of state authority stalled over Council of Ministers (CoM) chair Following the unexpected formation of the BiH House of Representatives (HoR), the formation of state authorities continued with the constitution of BiH House of Peoples on 9 June and the continuation of the long delayed and still disputed Council of Minsters (CoM) Chair appointment process, though even this became stalled by month’s end.

In early June, the BiH Presidency finally commenced consultations with parliamentary parties on a candidate for this position. They selected three Croat1 candidates for chair designate: Borjana Kristo (HDZ BiH), Mladen Ivankovic-Liljanovic (NSRzB) and Slavko Kukic (non-aligned but nominated by the ‘platformist parties’). On 14 June the latter received the highest combined rating from the three Presidency members. The HDZs and their SNSD allies consequently objected that Mr Kukic

was not a ‘legitimate representative’ of the Croat people, as he was not a candidate from the largest Croat grouping.

The procedure nevertheless continued with Mr Kukic given additional time to lobby for sufficient party support for his program prior to a HoR vote. This resulted in him picking up SBB support. On 29 June he polled 21 votes, enough for a simple majority, but not the needed entity majority from RS delegates, none of whom voted for him. A second round vote in mid July will now be required to decide the matter.

– BiH Prosecutor suspended as HJPC responds to allegations At the end of June the Office of the Disciplinary Prosecutor to the High Judicial and Prosecutorial Council (HJPC) launched a disciplinary process against the BiH Chief Prosecutor, Milorad Barasin. This was connected to recent media allegations concerning possible connection to arms dealers as well as his public reaction to this. On 30 June the Disciplinary Panel reviewing the case decided to temporarily suspend him, effective from 1 July, which Mr Barasin is expected to appeal. The process will examine whether Mr Barasin engaged in inappropriate communications with any parties, any behaviour of his that may demean the dignity of the prosecutor, or behaviour which would represent a serious breach of official duty or that would compromise the public confidence in the impartiality or credibility of the prosecutor.

5. MEDIA

– EUPM prepares for mini summer campaigns For several years now, EUPM, in cooperation with local law enforcement agencies, has used the summer months for short but powerful public awareness campaigns especially targeting traffic and property safety, which are always of the greatest concern during the vacation season. During July and August 2011, BIH law enforcement agencies will again address these topics, sharing simple but useful advice with the citizens that might help save someone’s life on the road or prevent a burglary. The individual PR events across the country will be accompanied by a series of television spots, offering advice and instructions, and enabling citizens to recognize and address gaps in their own security. The official launch scheduled for 1 July.

– Ministers Sign Off on Harmonization of Cantonal Laws on Internal Affairs Following the signing of a joint statement by all cantonal ministers of interior on officially initializing the harmonization of the cantonal laws on internal affairs on 16 June, HoM was quoted as saying that the Mission welcomes the initiative. “BiH, as potential EU candidate, needs to be properly equipped to adequately implement the growing framework of EU common rules,” he said. “Above all, this requires a strong and well-integrated administrative capacity within the law enforcement agencies and other relevant bodies, which must attain the necessary standards. A professional, reliable and efficient police organization is of paramount importance to meet EU requirements.”.
