EXECUTIVE SUMMARY Talks regarding the harmonizing of the Cantonal Law on Internal Affairs (CLIA) culminated in a day-long meeting of Police Commissioners and (Federation) Ministers of Interior hosted by Federation Minister of Interior, Mr. Kurtes, and the BiH Federation Police Administration Director, Dragan Lukac. HoM met the RS Minister of Interior, Mr Cadjo in Banja Luka to discuss amendments to the RS Law on Police Officials (LoPO) and, inter alia, the upcoming Srebrenica Commemorations in early July. Together with the BiH Gender Equality Agency, EUPM launched the first of seven training sessions on gender awareness at the Police Academy in Sarajevo. DHoM attended a ceremony to unveil a memorial plaque in Bugojno in honour of the killed policeman following the bomb attack in the early morning hours of 27 June 2010. EUPM organized a three-day study visit for the Disciplinary Prosecutor’s Office of Bosnia and Herzegovina to the Romanian Superior Council of Magistrates in Bucharest from 31 May to 4 June 2011. EUPM organized the 5th BiH Prison Directors Conference in Sarajevo, which invited all BiH prison directors and assistant directors responsible for security, representatives from all three ministries of justice and high-level police officials from Federation BiH and Republika Srpska as well as relevant representatives of the international community. 12628/11 EXT 1 PH/lz 3 ANNEX DGC 1C EN www.parlament.gv.at The investigation in to a case codenamed Diploma, which launched in 2008 into the alleged abuse of position in the Tuzla branch of the Sarajevo Law Faculty, continues with the matter being discussed and upheld before the Senate of the University of Sarajevo in late June. Canton 8 Police conducted operation ‘Special Ride’ targeting a group believed to be involved in forging and altering vehicle documentation. Drug seizures: Brcko District Police conducted an operation codenamed, ‘Pancir’, SIPA officers conducted an operation codenamed Babo Lee; MoI Canton 4 (Zenica) searched several houses in Kakanj municipality and seized illegal substances and ammunition; RS police led an operation code named Hercegovina; RS police continued activities within ongoing operations Plantaza 2011 and Kula. On 23 June, Banja Luka police conducted an operation codenamed Sparta and arrested three social workers suspected of abuse of position and sexual abuse of minors. Several locations were searched and certain evidence was seized. Canton 8 Police initiated a corruption case against the former Canton 8 Prime Minister, accused of authorising payment of financial support to a company engaged in the production of bottled water in the amount of 100.000 KM. The BiH State Court rendered a decision terminating the custody of Ramo Brkic, former Canton 1 Police Commissioner, since his arrest in December 2010, imposing prohibitive measures. 2. COMMENTS BY HOM The month of June witnessed an increased momentum in both: mission activities and the consultation regarding the Rule of Law, as EUPM worked closely with OHR and ICITAP on the Cantonal Law on Internal Affairs, regarding an initiative of cantonal ministers of interior to propose a new draft of the Cantonal Law on Internal Affairs (CLIA). I attended the first round of talks in an all-day conference, on 15 June, of cantonal ministers of internal affairs in Banovici (Tuzla region) to discuss the Laws on Internal Affairs (LIA). A document was subsequently prepared by EUPM, in coordination and agreement with OHR and ICITAP experts, which I presented to the Federation Minister of Interior, Mr. Kurtes, on 28 June, 12628/11 EXT 1 PH/lz 4 ANNEX DGC 1C EN www.parlament.gv.at clearly expressing that the draft law has been meticulously assessed and the comments, which are made one to offer assistance, and for the minister’s consideration. Now the process is expected to be locally led. This document was drafted following consultations hosted by EUPM in conjunction with legal representatives from OHR and ICITAP on 27 June. Further talks were held on 30 June when the Federation Minister of Interior, Mr. Kurtes, and the BiH Federation Police Administration Director, Dragan Lukac, hosted Police Commissioners and (Federation) Ministers of Interior in a day-long meeting. I attended, as well as OHR, and, in opening remarks, I emphasised that EUPM welcomes the initiative to reform legislation in the Federation and cantons in a harmonised manner, and prepare the law enforcement sector for the process of EU integration. Amendments to the RS Law on Police Officials (LoPO) were also discussed on 20 June when I traveled to Banja Luka to meet the RS Minister of Interior, Mr Cadjo. We also discussed current issues including the upcoming Srebrenica Commemorations in early July. With reference to this latter event, the Minister of Security, Mr. Ahmetovic, hosted a meeting on 22 June which I attended. Relevant Law Enforcement Agencies and the State Prosecutor were present, except the invited representatives of the RS Police who did not attend for unforeseen operational reasons. There is currently no indication or information on any potential security threats surrounding the 16th Srebrenica Commemorations in early July, and EUPM continues to monitor the operational conduct which appears to be ongoing in a comprehensive manner. Progress within coordinated meetings and talks to resolve and harmonize police laws, however, is over shadowed by the lack of momentum in other important areas essential to EU membership and post visa liberalisation. With regards to the continuing lack of appointment of the Director and deputy Directors to the ‘Agency for Prevention of Corruption and Cooperation in the Fight Against Corruption’, the Acting Head of the EU Delegation sent a letter to the Collegium of the House of Peoples on 23 June, urging a solution. The Law on Agency for Prevention of Corruption and on Cooperation in the Fight against Corruption entered in to force on 7 January 2010. 12628/11 EXT 1 PH/lz 5 ANNEX DGC 1C EN www.parlament.gv.at Further negative impact was felt when the Office of Disciplinary Prosecutor (ODP) of the High Judicial and Prosecutorial Council (HJPC) of BiH launched a disciplinary action against the BiH Chief Prosecutor Milorad Barasin on 28 June, requesting his suspension from office until the end of disciplinary action. The ODP accuses Barasin of unprofessional conduct and inappropriate contact with parties to the proceeding, which bring into question the public’s faith in judiciary and its credibility. Focusing on other important aspects of the mission’s mandate, on 13 June, together with the 'LUHFWRURIWKH*HQGHU(TXDOLW\$JHQF\6DPUD)LOLSRYLü-+DGåLDEGLüDQGWKH)HGHUDWLRQ%L+ Minister of Interior, Predrag Kurteš, I spoke at the first session of Gender Awareness Training at the Police Academy Sarajevo. This training is a part of the joint project developed by EUPM, the BiH Gender Equality Agency and police education institutions in BiH. I stressed the importance of this activity and EUPM’s readiness to assist domestic authorities in its implementation. Also during the reporting month, as traditional partners of the Kids Festival in Sarajevo since 2003, EUPM and BIH police agencies hosted a Police Day, on 14 June which I attended together with Canton 9 Police Commissioner, the deputy Director of SIPA and the deputy Director of Border Police. 3. MISSION ACTIVITIES – EUPM DHoM visits Bugojno On 25 June, EUPM DHoM attended a ceremony to unveil a memorial plaque in Bugojno, in honour of the killed policeman following the bomb attack in the early morning hours of 27 June 2010. Background: An explosive device went off behind the police station in the Central Bosnia town of Bugojno (Canton 6, Travnik), killing one police officer and seriously wounding one female police officer. On 17 December 2010, the BiH Prosecutor's Office issued an indictment against six persons involved in this bomb attack. Three main suspects are charged with criminal offense of "terrorism" while their three accomplices are charged with the criminal offense "accessory after the fact".
