Evaluating the Sociology of First Amendment Silence by MAE KUYKENDALL* Introduction Silence is that curious answer to the riddle, "What is golden and disappears when you speak its name?" In the context of First Amendment jurisprudence, Silence is just as puzzling as a riddle. Silence may be used as a verb, as in, to cause a speaker to cease speaking or as a noun, as in, the absence of speaking or sound. In either form, Silence has long been recognized as a rhetorical vehicle for expression. As it is wont to do, Silence often sits quietly in the interstices of First Amendment doctrine. But when she speaks, she roars. When Silence becomes speech, and that speech becomes law, Silence can get a thumping for its unseemly intrusion. The thumping of silence as legal doctrine, such as it has been, was a product of the Court's rescue of the Boy Scouts in Boy Scouts of America v. -

CHAPTER 1 Formative Years Mohandas Karamchand Gandhi was born on October 2, 1869, in Porbandar, a seaside town in western India. At that time, India was under the British raj (rule). The British presence in India dated from the early seventeenth century, when the English East India Company (EIC) first arrived there. India was then ruled by the Mughals, a Muslim dynasty governing India since 1526. By the end of the eighteenth century, the EIC had established itself as the paramount power in India, although the Mughals continued to be the official rulers. However, the EIC’s mismanagement of the Indian affairs and the corruption among its employees prompted the British crown to take over the rule of the Indian subcontinent in 1858. In that year the British also deposed Bahadur Shah, the last of the Mughal emperors, and by the Queen’s proclamation made Indians the subjects of the British monarch. Victoria, who was simply the Queen of England, was designated as the Empress of India at a durbar (royal court) held at Delhi in 1877. Viceroy, the crown’s representative in India, became the chief executive-in-charge, while a secretary of state for India, a member of the British cabinet, exercised control over Indian affairs. A separate office called the India Office, headed by the secretary of state, was created in London to exclusively oversee the Indian affairs, while the Colonial Office managed the rest of the British Empire. The British-Indian army was reorganized and control over India was established through direct or indirect rule. The territories ruled directly by the British came to be known as British India. -

The title had been chosen some time ago but, in view of the drastic change in US policy, it could not have been a more fitting subject. Often pushed aside in the light of apparently more pressing issues, this is a subject which unfortunately is bound to come into higher profile as the results of global warming become more evident – unless of course there are serious policy changes worldwide. -

Intellectuals and the Maoists Uddipan Mukherjee∗ A revolution, insurgency or for that matter, even a rebellion rests on a pedestal of ideology. The ‘ideology’ could be a contested one – either from the so-called leftist or the rightist perspective. As ideology is of paramount importance, so are ‘intellectuals’. This paper delves into the concept of ‘intellectuals’. Thereafter, the role of the intellectuals in India’s Maoist insurgency is brought out. The issue turns out to be extremely topical considering the current discourse of ‘urban Naxals/ Maoists’. A few questions that need to be addressed in the discourse on who the Maoist intellectuals are: * Dr. Uddipan Mukherjee is a Civil Service officer and presently Joint Director at Ordnance Factory Board, Ministry of Defence, Government of India. He earned his PhD from the Tata Institute of Fundamental Research, Department of Atomic Energy. He was part of a national Task Force on Left Wing Extremism set up by the think tank VIF. A television commentator on Maoist insurgency, he has published widely in national and international journals/think-tanks/books on counterinsurgency, physics, history and foreign policy. SEVEN DEADLY SINS According to the Indian political activist and philosopher Mahatma Gandhi, there are 7 dangers of human virtue: Wealth without work Pleasure without conscience Knowledge without character Business without ethics Science without humanity Religion without sacrifice Politics without principles These are often called the "Seven Social Sins", and are connected to the Seven Deadly Sins: Lust Gluttony Greed Sloth Wrath Envy Pride The most serious of the seven deadly sins is often considered “Pride”. “Pride” is connected with arrogance and lack of humility. But that is often what causes people to commit these sins. They do whatever it takes to benefit themselves, often causing great harm to the others. Lust is the extremely strong desire of something, to a point that exceeds moral values. That is an extremely common sin, strongly connected with greed. People inherently strive to get something better, something new, something that they really desire, and sometimes they exceed the limits. Gluttony bares some similarities, but the true meaning of it is often disputed. At first glance, it refers to food overconsumption. However, many argue that it doesn’t actually refer just to food. It also refers to selfishness and general overconsumption of anything. People commit this sin because they just can’t get enough of something, neglecting the fact that some might need it more than they do. Greed can be seen everywhere. One commits it when he can not be satisfied with anything, and just wants more and more, often doing everything he can to get it, whether that is ethical or not.
