Instead, in the limited time available before being arrested they tried to destroy as much incriminating evidence as possible. Thus, it comes as no surprise that the history of law, and its construction in both academic and popular literature, should be denied characterization as a form of science or scientific activity. Nevertheless, legal history and theory, sometimes labeled Jurisprudence in law school seminars, a discipline even Langdell was not always prepared to denominate the science of law,2 can be said to achieve discoveries or breakthroughs. Each of these break- throughs represented the potential, at least, for a dramatic rewriting of contemporary legal theory. During a critical juncture in twentieth-century United States political history, the first discovery produced such a change. The second, not yet made general to the field of legal thought in the United States, at least could become a common assumption of ongoing legal studies, indeed of popular legal consciousness as a whole. Whether it will depends largely on the same kind of historical and political factors which not only shaped the reception of legal realism and its systematic exposure of the unwritten constitution but, necessarily, grounds the success or failure of any theoretical innovation in philosophy or natural science. The social context within which the discovery of the unwritten constitution took place should by now be familiar. The liberal capitalist road to modernization (represented by Britain, France, and the United States) had increasingly come into conflict with the authoritarian capitalist model (Germany and Japan), as sociologist Barrington Moore describes in his classic study of the social origins of dictatorship and democracy.4 When President Franklin Roosevelt assumed office in 1933, he confronted a situation where, according to world-systems theorist Immanuel Wallerstein, the liberal capitalist approach was challenged sharply from the right by Germany and, equally disconcerting to those whose task it was to manage the state apparatus, from the left by the Soviet Union. Both the New Deal program engineered by Roosevelt and the Nazi program led by Hitler were carried out within the confines of a capitalist political economy. But the rise of the Nazis in Germany (and, to be sure, emperor-system fascism in Japan) facilitated, as Wallerstein observes, Roosevelt's development of "the New Deal as an alternative type of political solution," one that was liberal rather than authoritarian in Moore's terminology, "centrist" rather than "rightist" in Wallerstein's.' Once the international right wing, the Axis powers, had been defeated (and the Red Army was in Berlin), the United States shifted from a left of center strategy (aimed at defeating authoritarian forms of capitalist rule) to a right of center strategy, becoming as Wal- lerstein puts it, "the leader of a 'free world' alliance against the world left 4. " This volte-face in United States policy (identified as a postwar response to communist expansion by some historians but as already taking place early in the war by critics like Gabriel Kolko) 7 provides an essential historical boundary alongside of which to locate legal realism's rise and relative decline. Thus, diplomatic recognition of the Soviet Union by the Roosevelt administration and equally unprecedented unemployment figures claimed center stage at the same time that Karl Llewellyn, at the political margin represented by professional culture, published his realist manifesto on the Constitution. "I am not arguing," he declared, that the United States ought to have the sort of constitution loosely designated as "unwritten." I am arguing that they have such a constitu- tion, and that nobody can stop their having such a constitution, and that whether anyone likes that fact or not, the fact has been there for decades, and must be dealt with by any theory that purports to do a theory's work.' What troubled Llewellyn, of course, and other realists at that moment was the Supreme Court's obstruction of the New Deal; specifically, the roadblocks in the path of liberal capitalism's reconstruction (under new and transparently dangerous circumstances) thrown up by a judiciary clinging to the conservative apologetics of substantive economic due process. If the Court ruled that laissez-faire had been written into the Constitution, the realists, echoing Holmes' famous Lochner dissent,9replied that the con- stitution to which the Court should turn was, in fact, essentially unwritten and therefore no economic philosophy could be designated as permanent, unalterable, fixed.'0 The Constitution itself, following Llewellyn's 6. And if ever there was a context which cried out for a new constitutional verdict, it was the suddenly worldwide economic depression. The cumulative weight of social and political events-from the instability in government precipitated by spectacular economic dislocation to the alarming cartelization of world markets, from the reelection of Roosevelt in 1936 to his bold, court-packing maneuver--effectively pro- duced capitulation by the Supreme Court. Michael Ariens has recently described how, initially, it was taken for granted that politics, not some autonomous unfolding of constitutional principle, had caused the judiciary to change its tune. This theoretical reformulation of constitutional doctrine starkly revealed by the notorious "switch in time that saved the nine" was uniformly regarded as an adjustment by the Court, in the nick of time as far as most observers were concerned, to social and economic facts which were simultaneously new and inescapable." An epistemological break within the history of American legal and constitutional theory was thus provoked, ultimately, by an evolution in forces and relations of production and by that transformation's necessary political corollary. NOVAK PROFESSOR, UNIVERSITY OF MICHIGAN SCHOOL OF LAW The idea of regulatory capture has controlled discussions of economic regulation and regulatory reform for more than two generations. Originating soon after World War II, the so-called “capture thesis” was an early harbinger of the more general critique of the American regulatory state that dominated the closing decades of the 20th century. The political ramifications of that broad critique of government continue to be felt today both in the resilient influence of neoliberal policies like deregulation and privatization as well as in the rise of more virulent and populist forms of anti-statism. Indeed, the capture thesis has so pervaded recent assessments of regulation that it has assumed something of the status of a ground norm – a taken-for-granted term of art and an all-purpose social-scientific explanation – that itself frequently escapes critical scrutiny or serious scholarly interrogation. This essay attempts to challenge this state of affairs by taking a critical look at the emergence of regulatory capture theory from the perspective of history. After introducing a brief account of the diverse intellectual roots of the capture idea, this essay makes three interpretive moves.

    was the cold war necessary? the revisionist challenge to consensus history norman m. wilensky Nearly ten years ago, seventy-five distinguished students of American history participated in a poll measuring the performance of thirty-one presidents from George Washington to Dwight Eisenhower. Each par­ ticipant in the poll helped to place the presidents into five general categories: "Great/' "Near Great," "Average," "Below Average," and "Failure." One of the surprise rankings was the "Near Great" mark accorded to Harry Truman, ninth on the list. Only the five "Great" presidents—Lincoln, Washington, Franklin Roosevelt, Wilson and Jeffer­ son—and three "Near Great" executives—Jackson, Theodore Roosevelt and Polk—preceded Truman. John Adams and Grover Cleveland, who immediately followed Truman, completed the "Near Great" group. What qualities and achievements elevated Truman above many other presidents? He was, according to these historians, a strong executive who acted masterfully and farsightedly in foreign affairs. Summarizing the poll for his fellow historians, Arthur M. Schlesinger, Sr. noted that Tru­ man "discharged impressively the awesome obligations devolving on the United States as the leader of the free world in the cold war with Soviet Imperialism." The Truman Doctrine, the Marshall Plan, the Berlin airlift, the Point Four program and the intervention in Korea "all con­ stituted landmarks in an assumption of global responsibilities undreamed of only a few years before."     Vietnam: Anatomy of a Peace Gabriel Kolko London: Routledge, 1997 Reviewed by Kenneth J. Hammond Northwest of Ho Chi Minh City, the former Saigon, in Long Anh province lies the district of Cu Chi. Here, during Vietnam's long war against the Americans in the 1960s and early 1970s, a massive system of tunnels was constructed which allowed major forces of the Liberation Army to operate in close proximity to the nerve centre of the American military-sponsored regime. Thousands of soldiers and cadres of the National Liberation Front worked and lived in these tunnels, suffering under harsh jungle conditions, repeated incursions by American and ARVN units, and relentless bombing from unseen 8-52s. In July 1997, I visited Cu Chi and observed two very different legacies from the wartime era. The tunnel complex has been turned into a kind of theme park for tourists, mostly foreigners. The tunnels themselves have been widened to accommodate the girth of Western visitors, and lined with concrete to spare travellers the dirt and dampness of the underground world. A firing range has been set up to allow returning veterans or the merely curious to shoot off bursts of bullets, getting the 'feel' of war, and lending a surreal soundtrack to the scene. Cu Chi was the only place in Vietnam, North or South, where physical signs of the war could stilI be seen - craters from B-52 bombs dot the jungle, looking almost as if they have been preserved to maintain the ambience of battle. The tunnel site is a favourite, almost a mandatory destination for tourists, and the souvenir stands and soda stalls were packed with sweaty Caucasians.

Tens of thousands were processed at a military base on Guam, far away from the American mainland. President Bill Clinton used the same base to save the lives of nearly 7,000 Kurds in 1996. But if you mention the Guam Option to anyone in Washington today, you either get a blank stare of historical amnesia or hear that “9/11 changed everything.”1 Recently, with the end of the Iraq War, the memory of the evacuation of Vietnamese refugees at the conclusion of the Vietnam War has reemerged as an exceptional rescue effort. This perception resonates with previous studies that consider the admission of the refugees as “providing safe harbor for the boat people.”2 This rescue narrative has been an integral part of U.S. power, justifying its military and political actions. In response, this paper challenges the perception of the U.S. as rescuing allies.

    Vietnam’s Changing Historiography: Ngo Dinh Diem and America’s Leadership Derek Shidler Derek Shidler, who earned a B.A. in History from Southern Illinois University, is now a graduate student at Eastern Illinois University and a member of Phi Alpha Theta, where he is researching the Vietnam War. This paper was written for Dr. Shelton’s History 5000, Historiography, in the fall of 2008. The Vietnam War has certainly produced burgeoning scholars and literature. In the decade or so after the Vietnam War ended, most scholars wrote critically of the United States’ intervention in Indochina. Heated debates began to take place within books, article, and conferences. Given the lavish attention, three scholarly views have arisen and become increasingly heated. Orthodox scholars follow the traditional doctrine that America’s involvement in the war was unwinnable and unjust, while the revisionists believe that the war was a noble cause and Vietnam, below the 17th parallel, was a viable and stable country, but policies and military tactics were improperly executed. The heated debates have focused on two central issues—Ngo Dinh Diem and his reign over South Vietnam and poor leadership by American presidents and top officials. Orthodox scholars argue that Diem as a corrupt tyrannical puppet, while revisionists believe Diem was an independent leader who knew what was necessary to allow his young country to survive. According to the orthodox scholars, American presidents John Fitzgerald Kennedy and Lyndon Baines Johnson and other top officials did their best to control the situation in Vietnam, though the war was doomed from the beginning.

Rauh, Jr., a lawyer who fought for American civil liberties during a time when they were in great peril. Rauh challenged the federal government's loyalty- security program during the height of McCarthyism and the Red Scare through his representation of government employees and contractors that were faced with termination and humiliation due to allegationsof disloyalty. This Article recounts Rauh's efforts by examining his representation of James Kutcher, William Remington, and Charles Allen Taylor, three men who were accused of disloyalty to the United States under the federal government's loyalty-security program.

This dilemma revolves around the problem of articulating a strategic concept for a military alliance in the nuclear era. NATO was born of a perceived need to defend Western Europe from a Soviet onslaught. It was an imperative of the early alliance to develop a military strategy and force posture to defend Western Europe should such a war break out. It was not long after the first iteration of strategy took shape than the imperative for a military defense of Europe receded under the looming threat of thermonuclear war. The advent of thermonuclear arsenals in both the United States and Soviet Union brought with it the potential destruction of civilization should war break out. This realization made statesmen on both sides of the Iron Curtain undergo what has been referred to as an ongoing process of nuclear learning.
