Jesse Lowe, applicant, gave a lenghtly overview of the proposed request, adding that there has been numerous times where the property at 303 Ada has been vandalized and that is the main reason of his fence request; to keep people off his property.

Vice-Chairman Burns asked the applicant what was his plan was for the house at 303 Ada Street. Mr. Lowe responded that he and his wife have different options but have not decided yet. He stated that for now they would like to secure the property.
Chairman Spurlock asked the applicant if he feels that by a fence would alleviate the current problem. Mr. Lowe responded that by having a fence, it will be a challenge for people to just get in and get out of his property.
Commissioner Collins asked the applicant if the reasoning for this request is to protect his family. Mr. Lowe responded affirmatively. Commissioner Collins then stated that she’s hesitant on her vote at the moment because down the road if the applicant moves out, the wall/fence would still remain. He stated that he is open to any ideas that the Commission and staff could provide to move forward with his request.
Commissioner McPhail thanked the applicant for brining his ideas to the table. He then suggested the applicant to postpone this case indefinitely so that he works with the Commission and City staff to work out his ideas and bring a plan back to the Commission for a recommendation.
Commissioner Joy asked the applicant if he is trying to put a single fence to encompass both properties. Mr. Lowe responde affirmatively. Commissioner Joy stated that this neighborhood is improving as there are new houses in and he believes that the applicant has the right to protect his investment, and supports the solid fence on the back but he does not like the idea of enclosing the front at 303 Ada Street.

Secretary Cronenwett asked the applicant if he intends to do the fence along the rail road tracts on the back property lines. Mr. Lowe responded affirmatively.
Stacy Day, Senior Planner, clarified that the variance is for the 8-foot tall fence along the front yard property line as the code currently allows a 4-foot tall see-throught fence.
Secretary Cronenwett stated that an 8-foot tall fence would be too enclosed on the front yard. Mr. Lowe stated that he will be okay with a 6-foot tall fence. Secretary Cronenwett responded that it is okay, but a 4-foot tall fence is more ideal for a residential area on the front yard setback. Mr. Lowe stated that currently, they have a 4-foot wrought-iron on the back that people jump all the time to commit vandalisms. Secretary Cronenwett stated that he believes the 8-foot solid fence on the back and the 4-foot tall fence on the front would alleviate some of the issues that Mr. Lowe is currently having.
Commissioner Joy asked if the discussion is only for 303 Ada Street. Vice-Chairman Burns commented that he had the same impression as Commissioner Joy, but the applicant is requesting an 8-foot tall fence on the front of 303 Ada Street and the city code requires a 4-foot tall visibility, fence. Vice-Chairman Burns then asked the applicant if he would compromise to a 6-foot tall fence. Mr. Lowe responded affirmatively. He added that his thought was to place a wrought-iron fencing, but is open to any ideas.
Secretary Cronenwett stated that he prefers a 4-foot tall fence, but will support a 6-foot tall fence due to the applicant’s security issues.
Vice-Chairman echoed Secretary Cronenwett’s comments.
Vice-Chairman Burns moved to approve a 6-foot tall open wright-iron fence on the front property lines of 303 and 305 Ada street, and to postpone indefinitely the request for the garage and the accessory structure. Commissioner Zeske seconded the motion.

Barbara and Willie Smith, Lincolnshire Dr., Bedford, read her concerns about the reasons why the tower would impact their property.
There was no one else to speak in opposition to this item. Chairman Spurlock then closed discussion to the floor and returned to the Commission.
At 8:12 pm. Assistant City Attorney, Carolyn Matthis read the Commisison into Executive Session pursuant to Texas Governemnt Code, Chapter 551.071.
At 8:29 pm. Assistant City Attorney, Carolyn Matthis reconvened the Planning and Zoning Commission back into open session.
Chairman Spurlock called on the applicant for a rebuttal period.
Mr. Gatz, responded that a letter was introduced in the packet of a study done by Valbridge Property Advisors in 2018 for the City of Dallas, explaining how does the proximity to a cell tower impact home values which overall the study showed that there was no measurable price difference.
Commissioner Patel asked the applicant how the proposed cell towers are differeng form the 5G devices. Mr. Gatz responded that in order for a 5G to work, they need to connect to a macrosite area, if there is not one avialble then they don’t work as it s a 2-way communication.
Vice-Chairman Burns commented that he feels there are better locations in the immediate area for a cell tower. Mr. Gatz responded that the location of the tower is where the area coverage is needed otherwise, he would have proposed it somewhere else.
Vice-Chairman Burns stated his opposition to this item due to other areas being available and desirable for a cell tower.
Chairman Spurlock stated that since many years ago, many cases have come forward and moslty the complaints had been location for these towers. He stated that the responsibility of the Commision is to protect the people and the City.

Mr. Gatz asked Vice-Chairman Burns if there is a possibility that he could meet with him to discuss another location for the tower, if so he proposed postponement of his request. Vice-Chairman Burns responded that he could recommend but not charge for services. Assistant City Attorney, Carolyn Matthis advised Vice-Chairman Burns about the communication to be discussed.
Mr. Gatz stated that he would like to request postponement of his case until January 6, 2020.
Commissioner McPhail moved to postpone Zoning Case #ZC19-0083 to the January 6, 2020 meeting. Commissioner Zeske seconded the motion.
