Why Do Six of Our Council Members Insist That the EV Is Legal According to the Proposition That Was Passed?

Following is a transcription from the City website of a conversation between Roy Santoscoy and Charles Anderson, City Attorney, at the February 16 Council meeting in regard to the legality of pursuing the building of the Entertainment Venue as a separate “entity” as both referred to the EV:

SANTOSCOY (paraphrased): Stated that he had always looked upon the proposition passed by the voters as giving Irving the right to build two different “entities.” He also stated that some people do not interpret it this way saying that they only voted to build one “entity.” Then he turned and asked Charles Anderson for a legal opinion as to whether the original proposition gave Irving the authority to build two “entities” or one.*

[NOTE ONE:** Anderson’s reply follows and in IV’s opinion, Anderson’s answer was NOT a legal opinion, but rather a summary of what Irving has been doing. In the end he makes a slight reference to it being legal, but never does he state that it is HIS LEGAL OPINION. Judge for yourself.]

ANDERSON: “The proposition did call for development and construction financing costs for both the Convention Center and the Entertainment Venue Project (note: no ‘s’ on ‘project’).” [Then Anderson reads verbatim the Proposition on which we voted.] He then continues, “We have ALWAYS TAKEN IT THAT THE... RELATED INFRASTRUCTURE DESCRIBED BY THE STATUTE SUPPORTING EITHER THE CONVENTION CENTER OR THE ENTERTAINMENT VENUE… is covered including the parking garage or plaza… the city has been authorized to pursue all those and is legal in pursing those pursuant to this election and proposition that was passed.”*

[NOTE TWO:** Anderson never said, “My legal opinion is…” or “The legal opinion of our legal department is…” or “The legal opinion of the court is ….” He simply said, “WE HAVE ALWAYS TAKEN IT THAT….”* which IV believes is in no way a legal opinion.]

[NOTE THREE:** Anderson also did not confirm what Roy was seeking. Roy wanted assurance that the vote on the proposition said that Irving voters had voted on two totally separate projects. WE HAD NOT. The word PROJECT, singular, was used exclusively throughout the Proposition as it was also used by Anderson. Anderson postured that the City was authorized to pursue this ALL INCLUSIVE PROJECT, although HE DID NOT SAY THAT THE CITY WAS AUTHORIZED TO PURSUE SEVERAL DIFFERENT PROJECTS* as Santoscoy originally sought to confirm.]

[NOTE FOUR:** If Rick, Roy, Rose, Mike, Dennis, and Lewis were so absolutely positive that the original Proposition gave them authority to BUILD TWO SEPARATE PROJECTS, WHY THEN DID THE COUNCIL PASS RESOLUTION 210-159 ON JULY 8, 2010, CALLING THE ENTERTAIN- MENT CENTER “AN EXPANSION OF THE CONVENTION CENTER?”* Why not leave it a separate project? Why attempt an apparent cover up?]
