Staley, Ph.D., Catherine Annis and Matthew Kelly TAXI October 2018 Regulatory Overdrive Taxi Regulations, Market Concentration and Service Availability Executive Summary Traditional taxis are highly regulated in most American cities, with local regulators determining everything from how many taxis can be licensed to the types of services they can provide to the fares they can charge to where they can pick up customers. Ridesharing apps like Uber and Lyft, meanwhile, operate with comparatively few regulatory constraints, and there is little reason to believe consumers are faring any worse for it. In fact, consumers are increasingly voting with their feet—or phones—and choosing ridesharing services over taxis. This prompts an important policy question: Does traditional taxi regulation make sense in a world with ridesharing? To begin to answer this question, this study reviews the taxi regulations and market characteristics of 44 major U.S. cities. Specifically, it explores (1) the relationship between taxi regulations and concentration of ownership within a city’s taxi industry and (2) the relationship between concentrated ownership and taxi availability. Key findings include: • All 44 cities studied regulate taxis tightly, adopting five of 10 major regulatory provisions on average, but the specific regulations they use vary widely. This suggests cities are making taxi policy absent a common understanding of what regulatory provisions, if any, are necessary to protect consumers. • Taxi markets tend to be highly concentrated. In the average city, the top three taxi firms control about 61 percent of the taxi vehicles operating there.

Almost as well- known as the City's yellow taxis are the valuable licenses that vehicles must have in order to be used as taxis. Often called medallions, these licenses constitute a form of private property. They are routinely bought and sold, leased, used as collateralfor loans, and count as assets in bankruptcy. This Article emphasizes the political character of property rights in the modern state through a case study of why New York taxi medallions continue to exist. Prominent explanations of the evolution of property rights imply that they are a distinct category of rights that emerge organically within society because their benefits exceed their costs. This Article takes a decidedly more regulatory view of property rights as top-down creations of the state. As instruments of the state, property rights arise and persist from political decision-making processes influenced by interest group pressures. This avowedly regulatory conception of property rights suggests that we likely have both efficient and inefficient property rights because there is no necessary correspondence between what is cost-beneficial for society as a whole and the outcomes of political decision-makingprocesses. Stories abound in everyday life regarding immigrants with foreign medical degrees and PhDs forced to drive taxi cabs in order to make a living. In the light of a growing awareness of such wasted immigrant talent, the search for practical and sustainable solutions has acquired a sense of urgency. However, what lacks focus in the dominant public discourse is that the underutilization of immigrant knowledge and skills, observed in the taxi industry as well as other low-pay-low-prestige service sectors, is also an experience almost exclusively reserved for racially visible newcomers. Despite the preponderance of people of colour with devalued credentials, the mainstream public image of the credentialed foreigner in Canada is ‘deracialized’ as a general workplace malfunction rather than a political action. So, to date, the collective consciousness and public articulation of the ‘foreign credentials gap’ is slightly out of sync with the historical reality that underutilized foreign credentialed knowledge is not a generic phenomenon, thereby diverting attention from relevant and critical information needed to ensure sound judgments in social policy. This chapter engages some historical discourses on ‘pushing cab’ in order to illustrate how the taxi industry in contemporary urban Canada has evolved into a ‘brown collar ghetto.’ It argues that the 21st century big-city taxi driver as an ideal type must be understood in the context of global processes, as both a symbol of the foreign credentials gap and as an urban adaptation of people of colour living in the interstices of a dominant White cultural hegemony.

(314) 516-7272 Email: [email protected] Website: www.umsl.edu/~cts April 20, 2007 Executive Summary Coachella Valley Taxi Study The Coachella Valley taxi industry was studied through a series of personal interviews, surveys, and data analysis. It is the opinion of this reviewer that the industry is in a state of decline with respect to service levels, cost, efficient operations, and public image. Even with rates among the highest in the Nation, tourist and local users alike experience service in old vehicles, sometimes rude drivers, drivers predisposed to take the longer route, and sometimes drivers unwilling to take the short trip. Taxicab company owners, managers, and drivers alike all report that there are too many taxis in the valley for anyone to make a decent living. The number of taxis within the valley has increased from 175 vehicles to 265 in only a few years. Significant structural changes will be required if services and public image are to be improved and the taxi industry returned to economic health. The Palm Springs International Airport is experiencing the most rapid deterioration of taxicab service. Each day more and more authorized taxicabs are entering the taxi holding area spreading the existing demand among more and more drivers. In the past Coachella Valley taxi drivers could go into the airport taxi holding area after dropping off a customer at the airport. Now, most drivers of radio dispatched, full service taxi companies, choose to ignore the airport pick up market due to the longer wait times which can stretch into two or three hours between pickups.
