The Applicants allege that the Respondents are occupying the property in question unlawfully inasmuch as no consent was given to them for such occupation. Within this main application, various other applications were brought. 1 [2] Firstly, as part of the main application, an application was brought for an order in terms of which the Applicants could be allowed to dispense with the forms and service provided by the Uniform Rules of the High Court, and enabling this matter to be treated as one of urgency in terms of Rule 6(12), and in accordance with the provisions of section 5 of the Prevention of Illegal Eviction From and Unlawful Occupation of Land Act 19 of 1998 [hereinafter referred to as PIE]. [3] Secondly, the essence of the main application, an application for the eviction of the various occupiers (Respondents) from the area known as Joe Slovo informal settlement, and in the event of their failure and/or refusal to vacate the said area, an order to authorize and direct the Sheriff of this Court to enter the premises occupied by the Respondents and to remove all the movable items in the premises to an identified place in the temporary relocation area in Delft and to eject such Respondents in accordance with the schedule which was handed in as annexure “XS31” to the principal founding affidavit. -

Volume TWO Chapter SEVEN Political Violence in the Era of Negotiations and Transition, 1990-1994 I INTRODUCTION 1 The Commission had considerable success in uncovering violations that took place before 1990. This was not true of the 1990s period. Information before the Commission shows that the nature and pattern of political conflict in this later period changed considerably, particularly in its apparent anonymity. A comparatively smaller number of amnesty applications were received for this period. The investigation and research units of the Commission were also faced with some difficulty in dealing with the events of the more recent past. 2 Two factors dominated the period 1990–94. The first was the process of negotiations aimed at democratic constitutional dispensation. The second was a dramatic escalation in levels of violence in the country, with a consequent increase in the number of gross violations of human rights. 3 The period opened with the public announcement of major political reforms by President FW de Klerk on 2 February 1990 – including the unbanning of the ANC, PAC, SACP and fifty-eight other organisations; the release of political prisoners and provision for all exiles to return home. Mr Nelson Mandela was released on 11 February 1990. The other goals were achieved through a series of bilateral negotiations between the government and the ANC, resulting in the Groote Schuur and Pretoria minutes of May and August 1990 respectively. The latter minute was accompanied by the ANC’s announcement that it had suspended its armed struggle. 4 A long period of ‘talks about talks’ followed – primarily between the government, the ANC and Inkatha – culminating in the December 1991 launch of the Convention for a Democratic South Africa (CODESA). -

Reality is that th is protracted period of disservice to our people has been marked by the deteriorating living conditions for the poor and marginalised, which forced thousands of people to take to the streets on Freedom Day, calling on the DA Government to break with the past and focus on service delivery. The most pressing challenges faced by the people in this province include inadequate living conditions, crime, poverty, dread diseases and unemployment. These challenges seem to be colour -conscious as they affect the black majority, while the minority is well taken care of. -

In other words, the need for making place for the ‘black’ majority in urban spaces previously reserved for ‘whites’ is premised on notions of equity and social change in a democratic political dispensation. However, these potentially transformative thrusts have been eclipsed by more conservative, neoliberal developmental trajectories. Failure to transform apartheid spatialities has worsened income distribution, intensified suburban sprawl, and increased the daily livelihood costs of the poor. After a decade of unintended consequences, new policy directives on informal settlements were initiated through Breaking New Ground (DoH 2004b). -

Course code: L9L3. March 2010 Relocation, relocation, marginalisation: development, and grassroots struggles to transform politics in urban south africa. Abstract 2 Society in post-apartheid South Africa is highly polarised. Although racial apartheid ended in 1994, this paper shows that an economic and spatial apartheid is still in place. The country has been neoliberalised, and this paper concludes that a virtual democracy is in place, where the poor are excluded from decision-making. Urban shack-dwellers are constantly under threat of being evicted (often illegally) and relocated to peri-urban areas, where they become further marginalised. The further away from city centres they live, the less employment and education opportunities are available to them. The African National Congress (ANC) government claims to be moving the shack-dwellers to decent housing with better facilities, although there have been claims that these houses are of poor quality, and that they are in marginal areas where transport is far too expensive for residents to commute to the city for employment. The ANC is promoting ‘World Class Cities’, trying to facilitate economic growth by encouraging investment. They are spending much on the 2010 World Cup, and have been using the language of ‘slum elimination’. -

Such calls obfuscate the dynamics of the Green Revolution. Using Arrighi’s analysis of capital accumulation cycles, it is possible to trace a Long Green Revolution that spans the twentieth and twenty-first centuries. Such an analysis illuminates common- alities in past and present Green Revolutions, including their bases in class struggles and crises of accumulation, modes of governance – particularly in the links between governments and philanthropic institutions – and the institutions through which truths about agricultural change were produced and became known. Such an analysis also suggests processes of continuity between the original Green Revolution and features of twenty-first-century agricultural change, while providing a historical grounding in international financial capital’s structural changes to help explain some of the novel features that accompany the New Green Revolution, such as ‘land grabs’, patents on life, and nutritionism. -

This park is South Africa’s only urban open-access park and has been declared a World Heritage Site. This thesis is an anthropological and historical examination of the past and present conservation of the Cape Peninsula . I provide an overview of the relationship between the urban environment and the Cape Peninsula aiming to illustrate the produced character of the mountains and its mediation in power relations. This study of custodianship reveals that protecting and conserving the Cape Peninsula is shaped by the politics of the urban and natural environment as well as by the experience of living in the city. -

“WHERE THERE IS FIRE, THERE IS POLITICS”: Ungovernability and Material Life in Urban South Africa KERRY RYAN CHANCE Harvard University Together, hand in hand, with our boxes of matches . we shall liberate this country. —Winnie Mandela, 1986 Faku and I stood surrounded by billowing smoke. In the shack settlement of Slovo Road,1 on the outskirts of the South African port city of Durban, flames flickered between piles of debris, which the day before had been wood-plank and plastic tarpaulin walls. The conflagration began early in the morning. Within hours, before the arrival of fire trucks or ambulances, the two thousand house- holds that comprised the settlement as we knew it had burnt to the ground. On a hillcrest in Slovo, Abahlali baseMjondolo (an isiZulu phrase meaning “residents of the shacks”) was gathered in a mass meeting. Slovo was a founding settlement of Abahlali, a leading poor people’s movement that emerged from a burning road blockade during protests in 2005. In part, the meeting was to mourn. Five people had been found dead that day in the remains, including Faku’s neighbor. “Where there is fire, there is politics,” Faku said to me. This fire, like others before, had been covered by the local press and radio, some journalists having been notified by Abahlali via text message and online press release. The Red Cross soon set up a makeshift soup kitchen, and the city government provided emergency shelter in the form of a large, brightly striped communal tent.
