G.O.Ms.No. 316, Finance (Pension) Department Dated 19.09.2018. ---- PROCEEDINGS: In the Proceedings first read above, among other things, orders were issued allowing 7% of Dearness Allowance to the Pensioners/Family Pensioners of Generation and Distribution Corporation Limited with effect from 01.01.2018. In the Government Order second read above, orders were issued revising the rate of Dearness Allowance from 7% to 9%, payable to the Pensioners/Family Pensioners with effect from 1st July, 2018. It has been decided to extend the same benefit to the Pensioners/Family Pensioners of TANGEDCO. 2. State’s share 40% : Rs.10.75 Crore TANGEDCO share 30% : Rs.7.50 Crore MNRE share 20% : Rs.4.25 Crore Sub Total : Rs.22.50 Crore Farmer’s share 10% : Rs.2.50 Crore Total : Rs.25.00 Crore

3. The Delta farmers who are willing to relinquish their free electricity application registered already in TANGEDCO and their applications shall be cancelled thereafter by TANGEDCO for free power connections are only eligible for 90% subsidy. 4. Those farmers who want to continue with free electricity provided by TANGEDCO are not eligible for this scheme. 5. Implementation Procedure: a) During 2017-2018, G.O.(Ms) No.217 Agriculture (AE1) Department dated 31.08.2017 has been issued for provision of 1000 numbers Solar pump programme and has been implemented jointly by Agriculture Engineering Department/GoTN and TANGEDCO. TANGEDCO contribution of 30% is Rs.14.97 Crores. The scheme is successfully nearing completion. b) Now, during this year “Kuruvai 2018-2019” has been approved by GoTN vide G.O.(2D) No.94, Agriculture (AP1) Department dated 15.06.2018 Solar pump programme shall be implemented jointly by Agricultural Engineering Department (AED), GoTN as per the MNRE, GoI guidelines stipulated in coordination with Planning and NCES wing (for AED/GoTN tenders) of TANGEDCO. The beneficiaries/eligible and willing farmers in Delta area covering the entire district of Thanjavur, Tiruvarur, Nagapattinam Districts and part of Trichy, Cuddalore, Pudukottai, Ariyalur and karur Districts respectively shall be identified by agricultural Engineering Department in an appropriate manner and LT Tariff IV application registration details in EE/O&M office shall be got approved from TANGEDCO. c) The 90% subsidy is eligible to the Delta farmers who are willing to relinquish their free electricity application registered already under LT Tariff IV and the farmers applications shall be cancelled on getting joint commissioning report for commissioning of Solar power pumping system from Agricultural Engineering Department/GoTN. d) Farmers who are already provided with free electricity by TANGEDCO cannot participate in this scheme. e) The Agricultural Engineering Department shall evolve the total project cost and award the works of installation of solar pumps as per the tender norms of GoTN/MNRE, GoI. Further, the Agricultural Engineering Department shall carry out techno feasibility survey for suitability of site, based on factors such as depth of bore well/Open well, pumping water level, required shade free area for erection of solar panels etc.,. f) The TANGEDCO contribution shall be handed over to the Agricultural Engineering Department on obtaining 10% contribution from farmers and on issue of work order by agriculture Engineering Department. TANGEDCO’s 30% contribution of Rs.7.5 Crores will be released to 25 Agriculture Engineering Department only when Agricultural Engineering Department furnishes the copy of work orders issued along with the copy of letter of consent of the willing farmers to relinquish their free electricity application registered already under LT tariff IV. The farmers applications shall be cancelled on getting joint commissioning report for commissioning of Solar power pumping system from Agricultural Engineering Department/GoTN. g) The Agricultural Engineering Department shall obtain the respective subsidy amount from MNRE, GoI and Agriculture Department, GoTN. On submission of joint inspection and commissioning report duly satisfying all technical specifications and performance of the system, payment shall be effected by the Agricultural Engineering Department to the Companies. h) The farmers shall be permitted to install solar pump of capacity 5 HP, 7.5 HP and up to 10 HP. 3. The expenditure is chargeable to TANGEDCO funds – Capital Expenditure – A/c. code No.14.706 (Pump set electrification). 4. Necessary budget provision shall be made in the Revised Estimate for the year 2018-2019.

Now, based on the issues pertaining on “Iyarkai Valam” case in W.P.No. 36135/2015 and the meeting held on 19-04-2018 under the Chairmanship of the Chief Secretary to the Government, the Public Works Department (Water Resources Department) vide reference (1) cited requested the TANGEDCO to refrain water bodies from effecting electricity connection on the encroachments in objectionable Poromboke particularly in water courses. The minutes of the meeting also carries the statutory definition of “Water bodies”, which is given as below: 36 “Water bodies include areas of lakes, ponds, rivers, tanks, reservoirs, areas of marsh, fen, peat land and their peripherals and channels, whether the same actually contain water or not, and whether the same are above the ground or below the ground. These may be natural or artificial, permanent or temporary, located in public or private property, with water that is static or flowing, fresh, brackish or salt. These also include areas classified as water bodies in official maps and revenue records, even if they have been reclassified or encroached upon in any way or inlets blocked.” In view of the above, it is hereby instructed that the field officials shall follow the Regulation 27(12) of the TNE Distribution Code while effecting electricity service connection in Poromboke lands/Government lands and obtain No Objection Certificate from the concerned officer of the Government of Tamil Nadu who is not below the rank of Deputy Tahsildar. Further, the field officials are instructed to refrain from effecting electricity connection to the encroachments in objectionable Poromboke particularly in water courses. The above instruction shall be followed without any deviation. Any lapses in this regard shall be viewed seriously and action as deemed fit will be taken against the erring officials.
