Description of the Project Jammu and Kashmir Urban Sector Development Project (JKUSDP) is under preparation for sector loan funding from the Asian Development Bank for improving infrastructure and municipal services in two municipal corporations of Jammu and Srinagar cities and selected tourist centres1 within Jammu and Kashmir State. The Project will include investment in physical infrastructure plus proposals for capacity building and institutional strengthening of city and state authorities. In order to prepare and process the Project in accordance with ADB’s procedures for sector lending, a set of four sample subprojects have been selected one each in each of the four major urban sub- sectors namely – Water Supply, Sewerage, Solid Waste Management and Urban Transport in the two cities of Jammu and Srinagar. In keeping with ADB’s sector loan procedures; this short Resettlement Plan (RP) has been prepared for the Municipal Solid Waste collection and Disposal Site development sample subproject in Srinagar city. This short RP, identifies the broad scope of the subproject and outlines the policy, procedures for acquisition of land, compensation and other assistance measures for affected persons and institutional requirements for this subproject under the loan B. Scope of Land Acquisition & Impacts The sample subproject comprises of developing the existing 606 kanal2 (30.62 hectare) solid waste disposal site at Saidpora-Achan in Srinagar to increase its useful life as well as prevent environmental pollution. In addition to the improvement of the disposal site, a new access road has also been proposed entailing construction of a direct access road (20 meters width) to the site from the main road of approx. 300m length. The new access road will avoid the need to transport waste through the Achan-Saidpora Colony. The key benefits envisaged out of this subproject mainly comprise of improvements in basic service provision within the city of Srinagar. Benefits will also be available in the form of improved living conditions, a healthier living environment and the prospect of improved health status of the population living conditions around the waste disposal site. However, the surveys and assessments undertaken during Project Preparation also indicated that the subproject will entail some degree of land acquisition and resettlement impacts. Based on the census survey undertaken in May 2006, it is estimated that a total of 34 households affecting a total of 1843 persons will be affected as a result of the subproject construction. The land for the waste disposal site is owned by the Government of Jammu & Kashmir (GoJK) and currently under the Srinagar Municipal Corporation (SMC). However, of the 606 kanal4 (30.63 hectare) of total state land area, 10 local households have encroached upon 36 kanals (1.82 hectare) of land and are cultivating it. On the other hand, the construction of the new access road will necessitate acquisition of a total of 6.92 kanals (0.35 hectare) of private and Mosque owned land in the Acchan area thereby affecting a total of 13 households. In addition, the subproject construction would lead to adverse impacts in terms of indirect loss of livelihood of 11 households, comprising of rag pickers who dwell outside the waste disposal site and currently derive their livelihood by means of collecting recyclable plastic and other waste from the dump. Alternative arrangements and/or compensation for the affected families will thus be required. Table 1 below provides information on the affected households and types of losses in the subproject. 1 The tourist centres initially selected for consideration are Patnitop (Jammu region), Gulmarg, Pahalgam and Sonamarg (Kashmir region). 2 Kanal is the local unit of measurement. Objectives of the Short Resettlement Plan This Short Resettlement Plan is prepared to deal with the limited aspects of land acquisition and resettlement impact resulting from the solid waste collection and disposal site construction. The Plan provides an analysis of the impacts, identifies the nature and types of losses, and establishes an entitlement matrix as a guide to payments of compensation and resettlement benefits. The primary objective of this short RP is to restore the income and living standards of the affected persons (APs) due to land acquisition within a short period of time without any disruptions in their own economic and social environment. D. Gender impacts & mitigative measures A gender analysis was also undertaken during the course of the social assessments to look into the
