3 USE OF CRICKET RESOURCES 3.1 MEMORANDUM OF UNDERSTANDING 3.1.1 The conditions have been amended to be consistent with the provisions of the Memorandum of Understanding. The intention of this section is: (a) to ensure fair qualification of Cricketers to play Franchise cricket; (b) to provide for optimum use of Cricketer resources; (c) to promote the retention of South African-raised Cricketers in South African professional cricket. 3.2 PROVINCIAL CRICKET AND CLUB CRICKET 3.2.1 A Franchise Cricketer shall be available to play amateur provincial cricket in the area of his Franchise and shall, at the time of signing his Franchise Contract, nominate the province for which he shall play when required. 3.2.2 A Franchise may direct a Franchise Cricketer to nominate a particular province provided such direction is not unreasonable and will not give rise to unreasonable consequences for the Franchise Cricketer. 3.2.3 A Franchise Cricketer shall be available to play club cricket in the area of his Franchise and shall, at the time of signing his Franchise Contract, nominate the club for which he shall play when required. 3.2.4 A Franchise may direct a Franchise Cricketer to nominate a particular club provided such direction is not unreasonable and will not give rise to unreasonable consequences for the Franchise Cricketer. 3.2.5 A Franchise Cricketer may only nominate a club outside the area of the nominated Province (but which must be in the area of the Franchise) with the consent of the Franchise. 3.2.6 A Cricketer may not play for more than one club or one province in any year except that if he is transferred as envisaged in clause 3.4 below or he may transfer clubs or provinces on a written clearance given by the transferring club or province, which clearance shall not be unreasonably withheld and provided the club or province has exercised its decision in the best interests of promoting participation by the Cricketer in club and/or provincial cricket. 3.2.7 Following the Coaches workshop, the Transformation Indaba and the recent CSA Board meeting, the following team composition targets for improving representivity have been set by the CSA Board: 2015/2016 SUMMER HANDBOOK 113 CSA | ADMINISTRATIVE CONDITIONS 3.2.7.1 Domestic Professional Cricket (Franchises): A minimum of six players of colour in the starting eleven. A minimum of three Black African players in the starting eleven.; and 3.2.7.2 Semi Professional Cricket: A minimum of six players of colour in the starting eleven. A minimum of three Black African players in the starting eleven. The policy is intended to be incentive-based although there are minimum requirements which CSA believes can be readily met. Team sheets are required to be sent to the CSA Offices before matches are played and if the targets are not met, a motivation must be submitted to the Chief Executive Officer before the commencement of the match. The targets should be considered minimum targets intended to improve the access and quality of participation to develop black players. In keeping with our drive for accelerated transformation, CSA expects that team representivity should be greater than the minimum targets. 3.3 OVERSEAS CRICKETERS 3.3.1 An Overseas Cricketer shall mean: (a) a Foreign Overseas Cricketer, except if he has Kolpak rights in South Africa and also has played international cricket for another country, in the past twelve (12) months; or (b) a Kolpak Overseas Cricketer who does not seek qualification to play for a country other than South Africa. 3.3.2 A Franchise may contract a maximum of three (3) Overseas Cricketers but a maximum of one (1) Foreign Overseas Cricketer at any time in a Year. For sake of clarity this means that a Franchise may replace a Foreign Overseas Cricketer with another provided their contract periods do not overlap. 3.3.3 An Overseas Cricketer shall, unless agreed otherwise with the Franchise, comply strictly with the commencement and termination dates of his contract with the Franchise and should he not do so he may be disqualified from playing professional in the future. 3.3.4 A Franchise shall contract any Foreign Overseas Cricketer for any period it deems appropriate during the Year but must inform CSA and SACA in writing of such contract before it commences. 3.3.5 A Franchise may only contract a Foreign Overseas Cricketer if it is able to show that at least fifty percent (50%) of the cost of contracting him will be funded by a sponsor or other third party. The Franchise shall provide proof of such sponsor or third party funding to CSA and to SACA if requested to do so by either of them. 3.3.6 A Kolpak Overseas Cricketer shall be considered a Franchise Cricketer, for the purposes of the Memorandum of Understanding shall be contracted on a Franchise Contract and his Remuneration shall be paid from the Franchise Allocation. 3.3.7 A Foreign Overseas Cricketer shall not be considered a Franchise Cricketer, for the purposes of the Memorandum of Understanding and shall be in addition to Franchise Cricketer numbers provided for in the MOU and his Remuneration shall not in any way be paid from the Franchise Allocation. 2015/2016 SUMMER HANDBOOK 114 CSA | ADMINISTRATIVE CONDITIONS 3.4 CRICKETER RELEASE AND NOC’s 3.4.1 Any Cricketer who wishes to participate in a cricket match, series, tour or event which is not an obligation under his National Contract or his Franchise Contract, or is not expressly provided for in the MOU, shall be required to be released to play by CSA, in the case of a National Cricketer, or his Franchise, in the case of a Franchise Cricketer, by way of the granting of an NOC (No Objection Certificate). 3.4.2 For sake of clarity a NOC will be required by a Cricketer in order for him to participate for example in the Indian Premier League, County Cricket in the United Kingdom or any other similar match or event in another country. Although it is acknowledged that participation in the CLT20 is not an obligation under a National Contract or a Franchise Contract and is not expressly provided for in the MOU (as it is dealt with in a separate agreement between CSA and SACA which provides for the Cricketer to sign separate terms) a Cricketer does not require an NOC to participate in CLT20 for his Franchise but would nevertheless require an NOC to participate in this event for a team from another country. 3.4.3 Where a Cricketer is granted an NOC by either CSA or a Franchise then, unless otherwise agreed between CSA and the National Cricketer, or his Franchise, and the Franchise Cricketer as the case may be, the Cricketer’s monthly retainer shall be reduced as follows: (a) If no Proteas or Domestic Competition match is to be missed by the Cricketer then a reduction of Twenty Five percent (25%) of his monthly Retainer pro- rata the period he is away; and (b) If one or more Proteas, or Domestic Competition, matches are to be missed by the Cricketer then an additional reduction of Ten percent (10%) of his monthly Retainer for each day of such match missed, but subject to the total reduction not exceeding the total retainer the Cricketer would otherwise have received had he not been away and missed such match, or matches. 3.4.4 The retirement of a Cricketer from playing international or Domestic Competition cricket at the expiry of his contract shall not constitute grounds for refusal by CSA or a Franchise to grant an NOC which a Cricketer may otherwise require in order to play in a match, series tour or event. 3.4.5 The Parties shall use their best endeavours to conclude agreement on standard provisions to be contained in an NOC following signature of the MOU and, once agreed in writing by CSA, SACA and the Franchises, such standard NOC shall be incorporated into the MOU by Addendum. 3.5 COMPULSORY UPWARD RELEASE 3.5.1 The Parties acknowledge the importance of upward movement of Cricketers for participation in higher teams throughout cricket and also downward participation of Cricketers to strengthen provincial amateur cricket and also to provide Cricketers with playing opportunities at all levels. 3.5.2 Accordingly each Franchise shall procure that its articles of association and/ or shareholder agreements provide that provincial shareholders, whose teams participate in amateur cricket, shall at all times ensure that players shall be made available to play in Franchise Cricket when selected by a Franchise. 2015/2016 SUMMER HANDBOOK 115 CSA | ADMINISTRATIVE CONDITIONS 3.6 CRICKETER TRANSFERS 3.6.1 A Franchise Cricketer may, while under a Franchise Contract with a Franchise, transfer and enter into a Franchise Contract with another Franchise provided this occurs in accordance with this clause 3.5. The transferor Franchise is deemed to be in agreement where the relationship between the transferor Franchise and the Cricketer has irretrievably broken down, and if the transferor Franchise wishes to dispute such breakdown it will refer this dispute to the Disciplinary Commissioner for a decision, based on the facts presented to him, on whether or not the Cricketer may transfer. Such referral shall be made within fourteen (14) days of becoming aware of the proposed transfer and the Disciplinary Commissioner shall, unless agreed otherwise in writing between the Cricketer and the transferor Franchise, decide the matter within seven (7) days of the referral to him. 3.6.5 The transferee Franchise shall pay the Transferor Franchise a transfer fee in respect of a transferred Cricketer which fee shall either be agreed between the two Franchises or if there is no agreement then an amount equal to fifty percent (50%) of the Remuneration payable to the Cricketer for the unexpired period of his Franchise Contract with the transferor Franchise. 3.6.6 On the date of transfer the Franchise Contract with the transferor Franchise shall terminate and a Franchise Contract with the transferee Franchise, on terms and conditions as agreed with the Cricketer, shall commence. 3.6.7 A transferred Cricketer is excluded from the Cricketer numbers provided for in clause 2.1.2.1 of the Memorandum of Understanding but only for the remainder of the Year in which the transfer takes place. 3.6.8 Neither the transfer fee nor the Cricketer’s Remuneration with the transferee Franchise, for the remainder of the Year in which the transfer takes place, may be paid from the Franchise Allocation. 3.6.9 Any saving effected by a transferor Franchise, by virtue of no longer paying Remuneration to a transferred Cricketer to the end of the Year, shall be for the account of the transferor Franchise and shall not be required to be spent on Franchise Cricketer Remuneration as provided for in clause 5.3 of the Memorandum of Understanding. 3.6.10 Any consents given and agreements entered into, under this clause 3.5 may only be by the chief executive officer of the Franchises involved, or his nominee. 2015/2016 SUMMER HANDBOOK 116 CSA | ADMINISTRATIVE CONDITIONS 3.7 CRICKETER LOAN-OUT REGULATIONS 3.7.1 A franchise cricketer (“the Franchise Cricketer”) under contract to a franchise (“the Lender Franchise”) may, with his consent, be loaned-out to another franchise (“the Borrower Franchise”) for a period as agreed between the Lender Franchise, the Franchise Cricketer and the Borrower Franchise (“the Loan Out Period”) in accordance with these regulations. 3.7.2 A provincial cricketer (“the Semi-Pro Cricketer) under contract to a province (“the Lender Province) may, with his consent, be loaned out to another province (“the Borrower Province”) for a period as agreed between the Lender Province, the Semi- Pro Cricketer and the Borrower Province in accordance with these regulations. 3.7.3 For the purpose of the regulations a Franchise Cricketer shall include a Pay for Play player who is not a Provincial Cricketer but has played for the Lender Franchise in the current season and a Provincial Cricketer shall include a Pay for Pay Player who is not contracted to the Lender Province but has played for the Lender Province in the current season. 3.7.4 For the purpose of these regulations a Franchise Cricketer may include a cricketer contracted to CSA but who has nominated to play for the Lender Franchise. 3.7.5 The Franchise / Semi-Pro Cricketer who is loaned out remains under contract to the Lender Franchise / Province but eligible for selection for all matches played by the Borrower Franchise / Province during the Loan Out Period.
