Scope The Annual Report 2009–2010 outlines the activities and achievements of the Non-State Schools Accreditation Board and its related committee, the Non-State Schools Eligibility for Government Funding Committee. The report has been prepared in accordance with the prescribed requirements of the Financial Accountability Act 2009 and the Financial and Performance Management Standard 2009; and the detailed requirements set out in the Annual Report Guidelines for Queensland Government Agencies produced by the Department of the Premier and Cabinet. This report will be of interest to members of Parliament, Government agencies, persons in the education profession, students and the general public.

Emeritus Professor S Vianne (Vi) McLean AM Chairperson, nominee of the Minister I have great pleasure in presenting the ninth annual report of the Non-State Schools Accreditation Board and its related committee, the Non-State Schools Eligibility for Government Funding Committee. It is important that Queensland families have educational choice and the Board is continuing to make an important contribution in helping parents, students and the community at large have confidence in the quality of the education being provided in the private sector. After a prolonged period of stability in Board membership, in December 2009 there was a reconstitution of the Board and the Funding Committee. The founding chairperson, Emeritus Professor Roy Webb AO, concluded his long and eminent service to the citizens of Queensland as Chair of the Board. From the initial constitution of the Board in 2001, Professor Webb provided outstanding leadership in establishing the processes of non-State school accreditation in Queensland. His depth of knowledge and wise counsel was greatly appreciated not only by Board members, but also by many others in the non-State school sector. It is only fitting that the importance of his many contributions is formally recognised as part of this annual report. Members of the Board also would want me to formally acknowledge the generous contributions of two other Board members whose service on the Board came to an end in December 2009. Foundation member Mrs Patricia Reust showed great professionalism, and had a profound influence on the work of the Board. Ms Jennifer Haddrell also made notable contributions as a Board member. Her deep knowledge of education was very much appreciated. Three new appointments were made to the Board in December 2009. Ms Anna Brazier was appointed as nominee of the Director-General of Education and Training, Professor Victor Callan was appointed as a nominee of the Minister for Education and Training, and I was appointed by the Minister as Chairperson of the Board. Ms Vicki Ward was appointed as nominee of the Minister to the Funding Committee. During the year, the Board and Funding Committee continued a program of regional meetings and school visits. In September 2009, the Board and Funding Committee held meetings in Caloundra and visited a number of schools on the Sunshine Coast. In May 2010, the Board met at and the Funding Committee met at St Peters Lutheran College at Indooroopilly. Members also visited schools in Brisbane Central and Brisbane West areas. Members place great value on these opportunities to talk with school staff and members of school governing bodies. Whilst the non-State schooling sector in Queensland has continued to grow in terms of overall student enrolments, the number of non-State schools has remained relatively stable during the last year. Having robust processes to evaluate proposals to establish non-State schools is an important component of the Board’s work, but providing for ongoing review of the extent to which accreditation criteria are continuing to be met by existing schools is equally as important. The Board requires school governing bodies to conduct a review on a five-year cycle. The Board sets guidelines for these reviews, approves individual review plans and receives reports at the conclusion of each review.

2 | Annual Report 2009-10 This year saw the implementation of several changes to the Board’s cyclical review program. These amendments included discontinuation of participation by a Board representative in a sample of school reviews and the introduction of an external validator on every review panel, to provide a measure of independent judgment. The Board is continuing to monitor the effectiveness of the cyclical review program, particularly in the context of the increasing volume of benchmarked student learning data routinely available to schools, so further changes to the guidelines are likely in the 2010–2011 year. The Board continues to make use of a small group of highly professional assessors and auditors, who undertake visits to newly accredited schools and schools that have undertaken a recent change to their accreditation attributes to confirm all is operating as planned, conduct investigations where there are specific concerns, and visit a sample of schools to validate census submissions. In 2010, the Board was pleased to receive the auditors’ report of a high level of accuracy in census returns. The Board appreciates the high-quality work consistently provided by these professionals. The Board continues to play an important role in helping ensure child safety in non-State schools. It carefully monitors the requirement that all directors of governing bodies of schools possess a current positive notice blue card, and peruses school policy manuals on child protection during assessor visits, to ensure they are consistent with legislative requirements. Child protection is a high priority in Queensland, and the lack of appropriate child safety policy and practice in schools is a ground for cancellation of a school’s accreditation. School governing bodies have a significant responsibility to ensure that the school’s child protection procedures are compliant with legislation and that implementation is carried out in accordance with the policy. Consistent with its statutory function under the Accreditation Act, the Board has continually monitored accreditation policy and practices and at various times since 2004, has made policy recommendations to the Minister in the interest of long-term legislative improvements. In early 2010, the Board put forward some further recommendations to simplify and clarify the operations of the legislation. The Board hopes these will be taken up as a component of the Flying Start package of reforms. In May 2010, the Minister released a green paper titled A Flying Start for Queensland Children, in the interests of identifying new ways to improve educational outcomes for Queensland children. The green paper outlined a number of proposals for reforms, and invited submissions on these proposals. One of the proposals related directly to the future of the Board, as it foreshadowed the creation of a new independent statutory authority, to incorporate the work of the Non-State Schools Accreditation Board and Funding Committee, the Queensland Studies Authority and the Queensland College of Teachers. In its submission to the Flying Start green paper, members of the Board expressed general support for the package of proposals, but also expressed reservations about the practicality of subsuming the work of the three current statutory bodies into a single agency. Whilst members of the Board agree that there is a growing need for collaboration among the entities, we do not believe that amalgamating the three bodies into one authority would be necessarily more efficient and effective than the current arrangements. The consultation process is not yet complete, so the future of the Board is still somewhat uncertain. It has been gratifying however, to learn of the public support expressed for the work of the Board through the consultation process, and it seems whatever changes in structural arrangements might emerge from this initiative, the accreditation of non-State schools will continue as a cornerstone of quality assurance in providing Queensland families with educational choice.

Our vision Non-State Schools Accreditation Board The purpose of the Board is to promote excellence in education in the non-State schooling sector by the upholding of standards, the maintenance of public confidence and the fostering of educational choices. Non-State Schools Eligibility for Government Funding Committee The purpose of the Funding Committee is to uphold the principles on which Government funds are distributed to non-State schools by applying the legislated criteria for eligibility for Government funding in a just and impartial manner.

Our legislation The present accreditation and funding framework for Queensland non-State schools was introduced by the Education (Accreditation of Non-State Schools) Act 2001 (the “Accreditation Act”) and the Education (Accreditation of Non-State Schools) Regulation 2001 (the “Accreditation Regulation”) which commenced on 1 January 2002. The foundations for this legislation were largely laid by the 1999 review of accreditation and funding arrangements for non-State schools chaired by Emeritus Professor Roy Webb AO, then Vice-Chancellor of Griffith University.

4 | Annual Report 2009-10 Amendments to legislation There were several amendments to the relevant legislation within the reporting period. The new financial and accountability regime for departments of government and statutory bodies, enacted by the Financial Accountability Act 2009, commenced on 1 July 2009. This new legislation made several consequential amendments to the Accreditation Act and impacted on the Board’s financial and planning operations. The Criminal History Screening Legislation Amendment Act 2010 amended the Accreditation Act to provide that, from 1 July 2010, police officers and registered teachers will no longer apply for positive notice blue cards and instead must apply to the Commissioner for Children and Young People and Child Guardian for an exemption notice when providing child-related services which are outside of their professional duties. These amendments are particularly relevant for police officers and registered teachers who seek to become or who are directors of non-State school governing bodies. The Education (Accreditation of Non-State Schools) Amendment Regulation 2009 amended the Accreditation Regulation to provide that a non-State school’s written statement of philosophy and aims must be consistent with the Declaration on Educational Goals for Young Australians which was made at the 26th Ministerial Council on Education, Early Childhood Development and Youth Affairs. A copy of the declaration may be viewed at the website www.mceecdya.edu.au.

Establishment of Board and Funding Committee The Accreditation Act provides for the establishment of the Non-State Schools Accreditation Board and the Non-State Schools Eligibility for Government Funding Committee, a committee of the Board. The Board and Funding Committee were established on 21 September 2001.

Functions of the Board The functions of the Board are to: • assess applications for accreditation of non-State schools; • accredit schools complying with the accreditation criteria; • keep a register of provisionally accredited, and accredited, non-State schools; • monitor whether: o accredited schools continue to comply with the accreditation criteria; o the governing body of a provisionally accredited, or accredited, school is suitable to continue to be the school’s governing body; o a Government-funded school is a school not being operated for profit; o the governing body of a Government-funded school is not a party to a prohibited arrangement in relation to the operation of the school; o there is no direct or indirect connection between the governing body of a Government-funded school and a for-profit entity that could reasonably be expected to compromise the independence of the governing body when making financial decisions; and • examine, and advise the Minister about, the operation of the accreditation scheme under the Accreditation Act.

Non-State Schools Accreditation Board | 5 Functions of the Funding Committee The functions of the Funding Committee are to: • assess, or reassess, the eligibility of a school’s governing body for Government funding for the school; and • make recommendations, for the Minister’s consideration, about the eligibility of a school’s governing body for Government funding for the school. The Minister is the decision maker on eligibility for Government funding. In assessing applications for funding for new schools and for existing schools whose accreditation status has changed, the Funding Committee takes account of complex and, at times, sensitive issues such as: • anticipated enrolments; • the extent of educational choice based on the religious, philosophical or educational approaches the school proposes to offer; • enrolment capacities of other schools in the catchment area; and • the impact on existing neighbouring State and non-State schools in both the short term and over the following five years.

The Non-State Schools Accreditation Board Secretariat The Non-State Schools Accreditation Board Secretariat, within the Department of Education and Training, provides administrative and operational support to both the Board and the Funding Committee. The Secretariat also performs other functions related to the non-State education sector. The goals, strategies and performance measures of the Secretariat are covered by the strategic plan of the Department of Education and Training, and any relevant performance measures are reported in the Department’s annual report.

Queensland demography The population of Queensland has more than doubled in 35 years. The State’s population has increased from 1.85 million people in 1971 to 4.09 million in 2006, which amounts to an increase of 2.24 million or 121 per cent. In the 30 years from 2006 to 2036, the population is expected to grow by another 2.56 million to 6.65 million (medium series projections). This represents a growth of 62.5 per cent over 30 years. By 2056, the population in Queensland is expected to reach 7.98 million (medium series projection). Compared with the population in 2006, Queensland is expected to have another 3.89 million people in 2056 (medium series projection). Display 4 shows the actual and projected (low, medium and high series) Queensland population from 1971 to 2056. The medium series shows the population growing from 4.57 million in 2011 to 7.98 million in 2056. The high and low series represent a range of likely alternative population growth scenarios.

In the 25 years between 2006 and 2031, a further increase of 233 768 is expected. In the 25 years between 2031 and 2056, an increase of 161 414 is forecast reaching 1 133 760 by 2056 (medium series). If the high series predictions are reached, the number of children and young people in 2056 will be 1.48 million, a doubling of the population in 2006 (0.739 million). The schools At the end of the 2009–2010 financial year there were 467 operating non-State schools. Included in this total were eight schools established as grammar schools within the meaning of the Grammar Schools Act 1975.

Non-State Schools Accreditation Board | 17 On 30 June 2009, there were 466 accredited and operating non-State schools. During the reporting period two new schools commenced, both offering secondary education only, and two new sites opened for existing non-State schools. Two schools added secondary education as a new type of education. Primary and secondary education was surrendered for one school. The 467 operating non-State schools comprised 52 single-gender (29 female only and 23 male only) and 415 coeducational schools. All schools offered classroom education and five schools also offered distance education. A total of 48 non-State schools are accredited for boarding. Display 8 shows the number of operating non-State schools in Queensland by type of education at 30 June from 2007 to 2010. Included in the count are types of education that an operating school may be provisionally accredited for but may not be offering yet.

Under current arrangements, non-State schools receive funding from the State Government and the Australian Government, and from private sources mainly in the form of fees. Although the mix of funding varies considerably between schools, it is reasonable to say that, on average, schools derive about 62 per cent of their funds from Government sources. State Government funding for the sector in 2009–2010 was $491.8 million. This consisted of $440.5 million in total grants and $51.4 million for capital projects.

18 | Annual Report 2009-10 The students In 2002, there were 9 428 preschool students, 91 826 primary students and 86 268 secondary students enrolled in 439 non-State schools. At that time, this total enrolment of 187 522 students represented 28 per cent of all Queensland school students. There were a total of 237 350 students recorded in February 2010 in the 467 non-State schools, which was comprised of 130 661 primary students (including 16 779 students in the Preparatory Year) and 106 689 secondary students. This shows an increase of 6 302 students from February 2009 which constitutes a 2.73 per cent growth. The total enrolment numbers include 2 630 students receiving distance education from the five non-State schools accredited for distance education. Among the total student population the following special needs students were identified: • 10 998 English as a second language students • 7 329 Indigenous students • 5 314 students with disabilities • 4 037 students from isolated areas. Not included in the total figures are 2 286 overseas students who are responsible for the cost of their own education. Combined, the 239 636 domestic and overseas students represent approximately 32.8 per cent of all Queensland school students. Display 11 shows the number of enrolments in non-State schools from 1997 to 2010 at February census date. The numbers represent an average increase of approximately 3.04 per cent for each of the 13 years. Over the same period, the average increase for primary education, including preschool and the Preparatory Year, was 3.43 per cent for each year, and the average increase for secondary education was 2.59 per cent for each year. There was a reduced number of primary education enrolments in 2007 (-0.8 per cent) which may be attributed to the half-cohort intake of Preparatory Year students in that year.

Accreditation To operate in Queensland, a non-State school must be provisionally accredited or accredited by the Board under the Accreditation Act. To become accredited, a school’s governing body must apply to the Board for the accreditation of the school.

Applications for accreditation During the reporting period, the Board received 27 applications for accreditation, changes of accreditation attributes, or changes in provisional accreditation period. Display 12 shows the number of applications received by the Board in each of the reporting years from 2006–2007 to 2009–2010 by application type.

During 2009–2010 the Board made decisions on 34 applications. This includes decisions relating to applications lodged prior to 1 July 2009. Two applications were withdrawn before a decision was made. Still under consideration by the Board on 30 June 2010 were one application for a new school, one application to add a type of education to an existing school, three applications for a change of accreditation attribute and one application to change a period of provisional accreditation.

Appendix D provides a summary of the type and scope of applications for changes of attributes and changes to periods of provisional accreditation.

Applications for eligibility for Government funding In the reporting period, 10 new applications for eligibility for Government funding were received by the Funding committee. These consisted of two applications for new schools and eight applications for variations to existing approvals. In 2009–2010, the Funding Committee made recommendations on eligibility for Government funding to the Minister on two new school applications and five applications for variations. Appendix E provides a summary of the type and scope of applications for eligibility for Government funding.

Not-for-profit operation Under the Accreditation Act, to be entitled to apply for eligibility for Government funding, and to remain eligible for Government funding, a school’s governing body must not be an ineligible company. A company limited by guarantee is an eligible company. In addition, the school must be operated on a not-for-profit basis. The governing body must not be a party to nor intend to enter into a prohibited arrangement in relation to the operation of the school. A prohibited arrangement is a contract or arrangement with a for-profit entity not dealt with at arm’s length. Further, there should be no direct or indirect connection between a governing body applying for, or holding, funding eligibility and a for-profit entity that could reasonably be expected to compromise the independence of the governing body when making financial decisions.

Provisional accreditation to accreditation During 2009–2010, the Board gave approval for six non-State schools to move from provisional accreditation to accreditation. Two of these approvals were given following assessments commenced in the previous financial year. The Board’s decisions were based on reports provided under section 33 of the Accreditation Act by Board- appointed assessors who visited schools to conduct assessments. Appendix F provides a summary of schools moving from provisional accreditation to accreditation.

Assessment of sectors of schooling During the reporting period, the Board completed eight assessments of non-State schools that had commenced operating within a sector of schooling at an existing site and three assessments of non-State schools that had commenced operating within a sector of schooling at a new site. Six of the sector assessments at an existing site had commenced in the previous financial year. Each of these was assessed by a Board-appointed assessor. Appendix G provides a summary of Board decisions relating to schools commencing new sectors at existing or new sites.

Assessors Section 144 of the Accreditation Act provides for the appointment of assessors by the Board. The present three assessors were appointed in a manner consistent with the Accreditation Act and the Board Purchasing Procedures (Assessors) from February 2010 up to and including 31 December 2012. The previous term of appointment for the assessors concluded on 31 December 2009.

Non-State Schools Accreditation Board | 21 Under section 141 of the Accreditation Act, assessors have the functions of finding out the following: • whether a provisionally accredited, or accredited, school is complying with the accreditation criteria; • whether a Government-funded school is not being operated for profit; • whether an accredited school, the governing body of which is applying for Government funding for the school, is not being operated for profit; • whether the governing body of a Government-funded school is a party to a prohibited arrangement in relation to the operation of the school; • whether there is a direct or indirect connection between the governing body of a Government- funded school and a for-profit entity that could reasonably be expected to compromise the independence of the governing body when making financial decisions; • whether the governing body of an accredited school that is applying for Government funding for the school is a party to, or intends to enter into, a prohibited arrangement in relation to the operation of the school; • whether there is a direct or indirect connection between the governing body of an accredited school that is applying for Government funding for the school and a for-profit entity that could reasonably be expected to compromise the independence of the governing body when making financial decisions; and • whether the governing body of a provisionally accredited, or accredited, school is suitable to continue to be the school’s governing body.

Accreditation certificates In the appropriate circumstances, the Board issues new and amended certificates of accreditation under the Accreditation Act.

Surrender of accreditation Section 70A of the Accreditation Act gives a school’s governing body the option of surrendering an accreditation or provisional accreditation of the school. The surrender must be by way of a notice given to the Board by the school’s governing body. During the reporting period, the surrender of whole of school accreditation became effective for one school. Appendix H provides information on surrenders of accreditation.

Cancellation of accreditation (show cause notices) Under the Accreditation Act, the Board is authorised to cancel a non-State school’s accreditation in certain circumstances and following statutory processes. The key grounds on which the Board is able to base a cancellation relate to the suitability of a school’s governing body and compliance with the statutory accreditation criteria. If the Board reasonably believes grounds exist to cancel a non-State school’s accreditation, it must issue the school’s governing body with a show cause notice. This notice sets out the details of the matter including key dates, the Board’s proposed action, the grounds for the proposed action, an outline of the facts and circumstances forming the basis for the grounds and an invitation to the school’s governing body to make representations as to why the proposed action should not be taken. Following consideration of any such written representations, the Board is authorised to proceed to cancel accreditation. The cancellation does not take effect, however, until the last day to apply for a review of the decision to cancel, or the day that a decision is made about a review application if such an application is made.

22 | Annual Report 2009-10 A governing body is entitled to apply to the Minister for a review of the Board’s cancellation decision. After reviewing the decision, the Minister may refer the matter back to the Board for further consideration or decline to refer the matter back to the Board. If accreditation is cancelled, under section 99 of the Accreditation Act, eligibility for Government funding for the school is taken to be withdrawn when the cancellation takes effect. During the reporting period, the Board issued 14 show cause notices proposing to cancel accreditation. A total of eight were resolved without any further action taken by the Board, while one resulted in the change of an accreditation attribute of a non-State school. Five show cause notices had not been resolved by 30 June 2010. Appendix I and Appendix J show summary data for cancellation actions by the Board since 2001.

Compliance notices Under section 61 of the Accreditation Act, the Board may issue a compliance notice to a non-State school’s governing body if the Board reasonably believes that the school is not complying with an accreditation criterion and the matter relating to the non-compliance is reasonably capable of being rectified. The notice requires the governing body to rectify the matter. The governing body must comply with the compliance notice, unless the governing body has a reasonable excuse. In 2009–2010, seven compliance notices were issued by the Board. One school surrendered accreditation and no further action was taken by the Board. Six compliance notices had not been resolved by 30 June 2010. Appendix K contains information on compliance notices issued from 21 September 2001 to 30 June 2010.

Annual collection of school survey data In February 2010, the Board conducted its annual collection of school survey data (also known as the State census of non-State schools), thereby meeting its statutory obligation under section 166 of the Accreditation Act. Under the Accreditation Act, governing bodies of operating accredited and provisionally accredited schools must provide the Board with the prescribed school survey data. Generally speaking, school survey data relates to the numbers of students enrolled in various years of schooling. This information is used primarily as a basis for allocating any allowances paid on a per capita basis. In early February 2010, a total of 466 non-State schools completed the School Survey Data for Non-State Schools – Qld 2010. Help and guidance was available through an online help section on the Board’s website and via phone and email from the Board’s Secretariat. The prescribed day for the survey each year is the last Friday in February. For the reporting year, this was 26 February 2010. The information received in the data collection for the 466 schools was subjected to visual and electronic validation checks and was used to pay the schools’ 2010 recurrent grants and allowances.

Audit of 2010 school survey data Utilising the Board-appointed auditors for 2010, the Board completed its annual compliance program to verify school survey data supplied by the governing bodies of schools through the School Survey Data for Non-State Schools – Qld 2010 under section 166 of the Accreditation Act. The Board’s 2010 audit of school survey data, from 22 March 2010 to 28 April 2010, was carried out on a sample of 43 non-State schools, representing approximately 9.5 per cent of non-State schools in Queensland. These schools also represented a cross-section of geographic locations, sizes and sectors. Included in the audit were five schools providing both distance education and classroom education. A separate survey return was required for each of the two modes of delivery. The others offered classroom education only. A total of 49 audit reports were prepared. Overall, the results of the 2010 audit established the reliability and accuracy of the school survey data supplied by schools. In a total of 15 425 students in the 43 schools, the auditors found the vast majority of data in the survey returns to be fully accurate in relation to full-time and part-time student enrolments. The auditors identified some minor discrepancies with a small percentage of school survey data, several of which under-counted or were inaccurate in some aspects without affecting the total student count. Schools were generally able to provide evidence to demonstrate that they had efficient enrolment and attendance processes in place. The administrators and personnel who facilitated audit visits appeared aware of the importance of the validity of the data that they had supplied in the School Survey Data for Non-State Schools – Qld 2010.

Auditors The appointment of auditors by the Board falls under section 144 of the Accreditation Act. Auditors have the function, under section 142 of the Accreditation Act, of verifying school survey data relating to a provisionally accredited, or accredited, school given to the Board under section 166 (School survey data) of the Accreditation Act. The Board undertook a procurement process in 2007 to engage auditors for the 2008, 2009 and 2010 audit program.

24 | Annual Report 2009-10 Annual allowance acquittal Under the Education (General Provisions) Act 2006, the governing body of each non-State school with eligibility for Government funding must, within six months after the end of each calendar year, give the Board allowance acquittal details for the school for that year. The allowance acquittal details are provided by way of a statement showing how the governing body expended State Government grants and allowances during the year. Not providing the Board with the required acquittal details within the legislated timeframe is a ground for stopping payment of the allowances under the Education (General Provisions) Act 2006. The Board is required to give the Minister a written report about the acquittal details it receives as soon as practicable. At its meeting on 6 August 2009, the Board endorsed the report on the 2009 allowance acquittal program for State Government grants and allowances paid to non-State schools in 2008. The report was submitted to the Minister. In regard to the 2010 allowance acquittal program, in May 2010 the Board issued a statement to each governing body listing the State Government grants and allowances paid to their respective schools in 2009. In total, the Board distributed 466 forms covering the same number of schools to 141 governing bodies. Completed acquittal forms are required by the Education (General Provisions) Act 2006 to be returned to the Board by 30 June 2010. It is anticipated that the Board will prepare a report on the 2010 allowance acquittal program relating to 2009 payments, and submit the report to the Minister before the end of August 2010.

Positive notice blue card update program The Accreditation Act requires each director of a school’s governing body to have a current positive notice (also known as a blue card) issued under the Commission for Children and Young People and Child Guardian Act 2000. By virtue of section 198 of the Commission for Children and Young People and Child Guardian Act 2000, a director of a governing body of a non-State school who holds a valid blue card can continue as a director after the expiry date of his or her blue card, provided the card was not suspended or cancelled, and he or she has lodged a renewal application at least 30 days prior to the expiry of the card. In these circumstances, the existing blue card is deemed to remain current from the day it would otherwise end until the renewal application is decided or withdrawn. The Board has continued to monitor compliance with this requirement during the reporting period. As part of its Positive notice blue card update program, the Board sends letters monthly to all governing bodies of which the Board is aware that have a director whose positive notice blue card would expire within the following four months. Following on from the four month advance notice, the next phase of the update program involves the Board sending a letter to each relevant governing body seeking the following within 14 days: • confirmation that the director(s) concerned have a current positive notice blue card; and • if any director does not hold a current positive notice blue card — confirmation that the person is no longer a director. Under section 39(3) of the Accreditation Act, if a director of a school’s governing body does not have a current positive notice blue card, the Board must decide that the governing body is not suitable to continue to be the school’s governing body.

Governing body update program The Board has a statutory obligation to monitor the suitability of a governing body, and to that end, the Board maintains and regularly updates its information about governing bodies and their membership.

Non-State Schools Accreditation Board | 25 Board updates of governing body information include surveying each governing body at least once each year to collect information about the accuracy of contact details, the name of the chairperson/president, and particulars about directors (such as names and blue card details). For 2009, the governing body update program was conducted throughout August and September 2009.

Cyclical review program The implementation of the Board’s cyclical review program continued in the reporting period. Through their participation in the program, 70 schools successfully demonstrated to the Board their ongoing compliance with the statutory obligations of their accreditation. A forward schedule for the cyclical review program is established that will see all schools participate in the program at a minimum of once every five years. Schools’ governing bodies may choose to participate in the program at more frequent intervals by contacting the Board and nominating a suitable year. A central feature of the cyclical review program continues to be the manner in which the program builds upon the review and renewal processes being implemented within schools as part of their normal program of strategic planning and development. In many reviews conducted in 2009–2010, schools added depth and substance by drawing upon more extensive practices of collaborative enquiry and self-reflection that have been undertaken within the school. Such an outcome fits with the Board’s objective that reviews, as well as allowing schools to show how they are meeting their statutory obligations, are also useful for schools’ own evaluation and monitoring purposes. The recent review of the cyclical review program resulted in several adjustments to the way the program is conducted. These amendments include the introduction of an “external validator” to participate in the cyclical review process; the discontinuation of Board representatives attending a sample of school reviews; the inclusion of a copy of each school’s annual report published under the Education (General Provisions) Act 2006, section 423.

Regional visit program The Board and the Funding Committee have conducted a program of regional meetings and school visits since 2002. The regional visit program is designed primarily to facilitate familiarisation visits to as many non-State schools in a geographical location as possible. Members attend schools in small groups using the visit as an opportunity to gain an insight into the issues schools are currently addressing. The visits are therefore intended for familiarisation purposes only and are not part of the formal accreditation and assessment of Government funding eligibility work undertaken by these two bodies. The regular scheduled meetings of both the Board and the Funding Committee are incorporated into this regional program. In some locations, the mayor of the local city council will host a welcome function for members of the Board and Funding Committee, and for the principals and chairpersons of the governing bodies of local non-State schools, as well as local councillors. Such council-sponsored events are valuable opportunities for members to meet with school principals and representatives of school governing bodies as a whole, as well as to understand local needs. Both the Board and the Funding Committee met in the Sunshine Coast area in September 2009 in Caloundra and in the Brisbane Central and Brisbane West areas in May 2010. Members visited non-State schools in the area prior to their meetings. They also met with principals of the schools and the chairs of school governing bodies at an evening reception. Members valued the opportunity to visit schools in and around these regional centres, and to talk with civic leaders, school staff and members of school governing bodies.

Codes of conduct Under the Public Sector Ethics Act 1994, the Chairperson of the Board is required to develop a code of conduct for members of the Board, Funding Committee and other committees, and for any employees of the Board. A code of conduct must be approved by the relevant Minister. On 10 November 2002, the Minister approved the Code of Conduct for Members of the Non-State Schools Accreditation Board, the Non-State Schools Eligibility for Government Funding Committee and Other Committees of the Board. On 1 November 2003, the Minister approved the Code of Conduct for Authorised Persons appointed by the Board under the Education (Accreditation of Non-State Schools) Act 2001, section 144. This code applies to those persons who have been appointed as assessors and auditors under the Accreditation Act.

Complaints handling The Board is an independent body that has certain prescribed statutory responsibilities under the Accreditation Act. It is therefore reasonable to expect that persons who have issues with non-State schools will make complaints about those schools to the Board. The nature of these complaints may be about aspects of school operations or particular incidents that happen in schools. The Board’s jurisdiction under the Accreditation Act is confined to a limited number of matters in relation to non-State schools. The two key areas of this jurisdiction are whether the governing body of a non-State school is suitable to continue to be the school’s governing body; and whether a school is complying, or has not complied, with one or more of the statutory accreditation criteria prescribed by the Accreditation Regulation. Some complaints received, however, are not of a type that falls within the jurisdiction of the Board. In these situations, the Board directs the complainant to the appropriate authorities to address the matters or areas of concern. For example, persons complaining about the actions of schools in relation to minor disciplinary incidents are directed to the relevant school’s principal. If an issue cannot be resolved by that senior staff member of the school, it is directed to the school’s governing body. By way of another example, complaints about whether teachers are suitable to teach come within, in the first instance at least, the ambit of the Queensland College of Teachers, established under the Education (Queensland College of Teachers) Act 2005. In the reporting period, the Board received 17 complaints. The nature of the complaints was varied but generally they related to alleged breaches of the statutory accreditation criteria.

Purchasing procedures (Assessors) The Board has in place Purchasing Procedures (Assessors). These Purchasing Procedures (Assessors) are in accordance with the State Procurement Policy, which applies to all Budget Sector Agencies, Government- Owned Corporations and Statutory Bodies. The intent of the State Procurement Policy is that agencies must use their procurement to advance Government priorities while achieving value for money with probity and accountability. In doing so, each agency should use its best endeavours to: • ensure that competitive local firms are given a fair, full and reasonable opportunity to supply the Queensland Government • deal with firms which treat their employees fairly.

Non-State Schools Accreditation Board | 27 The objectives of the State Procurement Policy are to: • advance Government priorities; • achieve value for money; and • ensure probity and accountability for outcomes. The State Procurement Policy aims to ensure that the benefits of Government purchasing are maximised. The policy is not prescriptive and provides scope for individual agencies to conduct their procurement activities in a manner that enables the agency to link its procurement activities to Government priorities. The Purchasing Procedures (Assessors), in conjunction with sections 144 and 145 of the Accreditation Act, provide a framework for the Board to: • recruit suitably qualified and experienced persons as assessors; • assign assessments to particular assessors in an appropriate manner; and • provide fair remuneration for the work that gives an appropriate level of assurance to the Board about receiving value for money.

The Non-State Schools Eligibility for Government Funding Committee Business Procedures Under section 126(5) of the Accreditation Act, the Board may decide matters about the Funding Committee and any other committee of the Board that are not provided for under the Act including, for example, the way a committee must conduct meetings. On 5 September 2002, the Board approved the Non-State Schools Eligibility for Government Funding Committee Business Procedures (the “Funding Committee Business Procedures”). The Funding Committee Business Procedures are confined to the Funding Committee and do not extend to other committees that the Board is authorised to constitute from time to time. The Funding Committee Business Procedures are not a statutory instrument within the meaning of that term in the Statutory Instruments Act 1992.

NSSAB database The Board continued to enhance its information management system, the NSSAB database. The NSSAB database provides excellent facility and efficiency in data management, control and reporting. The system is able to undertake a wide range of data analysis and provide extensive reports to support the work of the Board and the Funding Committee. This allows information to be provided to the Board and the wider community more expeditiously. The NSSAB database was initially developed in 2005–2006 as part of the Board’s program to review its information technology and communication systems, including the register of non-State schools. At the end of June 2006, the review program saw the completion of the initial phase of the NSSAB database. The Board continues to monitor and enhance the NSSAB database. The NSSAB database is the principal data source for the Board.

Register of non-State schools As required by sections 164 and 165 of the Accreditation Act, the Board maintains a register of provisionally accredited and accredited non-State schools. The register contains the following information: • the school’s name; • if the school is provisionally accredited, its student-intake day, provisional accreditation period and its attributes of provisional accreditation; • if the school is accredited, the date of its accreditation and its attributes of accreditation; and • details of the type of education the school may provide. The register is open for inspection at the Board’s Secretariat by members of the public during ordinary office hours. There is no charge for inspecting the register. The Board will give a person a copy of the register, or a part of it, on payment of 50 cents for each page, or part of a page, of the register. The Board may waive, wholly or partially, payment of the fee if it is satisfied payment of the fee would cause financial hardship to the person liable to pay it.

Board’s website The Board’s website brings together information primarily for the governing bodies of non-State schools, parents, students and the education community about: • the accreditation of non-State schools in Queensland; • Government funding; • school reviews; • the Board and the Funding Committee; • announcements, coming events and activities associated with the Board; and • links to other relevant sources of information on non-State schooling. The design and content of the website are under continuous review to provide greater ease of access to information for users of the site. The website can be accessed at www.nssab.qld.edu.au.

Non-State Schools Accreditation Board | 29 Records management system Records of the operations of the Board and the Funding Committee are maintained in accordance with the Public Records Act 2002. The Board uses a quarantined part of the Electronic Document Records Management System of the Department of Education and Training for the electronic capture, management, storage and retrieval of its written documents. The Department also provides secure and confidential storage for the Board’s written and electronic documents.

Retention and disposal schedule The Non-State Schools Accreditation Board Retention and Disposal Schedule, approved by the State Archivist on 10 February 2004, covers all functional records created by the Board, including records relating to applications for accreditation and funding eligibility for non-State schools, compliance with accreditation criteria, ministerial referrals and decisions, and other miscellaneous functions assigned under legislation. Authorisation for the disposal of public records is given under the provisions of section 13 of the Public Records Act 2002.

Board involvement in key initiatives The Board continues to monitor legislation in force and under draft that might affect the governance and operations of non-State schools.

Budget of Board Under section 130(1) of the Accreditation Act, the Board is required to develop and adopt a budget for each financial year and submit that budget to the Minister for Education and Training for approval. On 6 August 2009, the Board adopted a budget for the 2009–2010 financial year (total expenditure $331 572) and submitted the budget to the Minister. On 9 October 2009, the Minister approved the budget as adopted by the Board. Subsequent to that, the Minister granted a $50 000 supplement to the board’s budget, which therefore stood at $381 572.

Conferences and seminars Board or Funding Committee members did not attend any conferences or seminars during the reporting period at the Board’s cost or sponsorship.

Consultancies The Board’s expenditure on each reportable category of consultancy is shown in Appendix L.

Corrections to previous annual reports There are no corrections made to any previous annual reports of the Board.

Details of Ministerial directions — review decisions Sections 101 to 103 of the Accreditation Act deal with the conduct of a review by the Minister of certain decisions of the Board. In undertaking any such reviews, the Minister has the following two courses of action available: • refer the matter to which the decision relates back to the Board for further consideration, subject to any directions decided by the Minister; or • decline to refer the matter back to the Board for further consideration. The Accreditation Act requires the Board to include details of any such directions received by it in the Board’s annual report. The Board has not received any directions under section 103 during the reporting period.

Details of Ministerial directions — public interest Under section 108 of the Accreditation Act, the Minister may give the Board written directions about the performance of its statutory functions if the Minister is satisfied the direction is necessary in the public interest. The Board is obliged to comply with any such directions. The Accreditation Act requires the Board to include copies of any such directions received by it in the Board’s annual report. The Minister has not given any directions under section 108 during the reporting period.

Non-State Schools Accreditation Board | 31 External scrutiny Apart from the Auditor-General’s report on the Board’s financial statements, there were no audits or reviews during the reporting period of the Board or Funding Committee conducted by any external agency.

A Flying Start for Queensland Children On 25 May 2010, the Board and the Funding Committee made a joint submission to the Minister on the Queensland Government’s A Flying Start for Queensland Children: Education Green Paper for public consultation.

Greenhouse gas emissions The Board is committed to supporting the Queensland Government’s Q2 target to cut Queensland’s greenhouse gas emissions by one-third by 2020. This commitment includes implementation of the Government's climate change and other environmental strategies. Six gases have been identified under the Kyoto Protocol as the main greenhouse gas emissions that need to be reduced. The gases are carbon dioxide, hydrofluorocarbons, methane, nitrous oxides, perfluorocarbons and sulphur hexafluoride. As part of standard emission measurement practices, these gases are mainly reported as carbon dioxide equivalent emissions (CO2-e). The Queensland Government continues to develop and improve whole-of-Government data collection processes and systems to standardise reporting of its greenhouse gas emissions. For the Board the key greenhouse emissions are those that are linked to the following business activities related to it, the Funding Committee and the Board’s assessors: vehicle usage; electricity consumption; and air travel. Display 15 outlines the emissions relating to the Board during the period 1 July 2009 to 30 June 2010.

32 | Annual Report 2009-10 Feedback from clients on performance The Board sought written feedback from all applicants (i.e. governing bodies) for which a Board decision was made during the reporting period. Each applicant was asked by email to provide feedback through an online questionnaire for each application lodged. The questionnaire was deliberately kept to six questions so as to require a minimal amount of time for respondents to complete. Respondents were also invited to provide comments beyond the set questions. Respondents were not required to identify themselves; however, many included identifying details in the optional section of the questionnaire. Overall, it is considered that respondents reported in favourable terms. Display 16 summarises the responses to each item of the questionnaire.

Non-State Schools Accreditation Board | 33 Internal audit function The Board has not established an internal audit function. This is on the basis of the following: • the Board is audited annually by the Queensland Audit Office; and • the Board has developed and implemented a comprehensive system of identifying areas of operational or financial risk and has arrangements in place to manage those risks; and • as a part of the Department of Education and Training, the Board’s Secretariat is subject to audit by that department’s internal auditors.

Machinery-of-Government changes During the reporting period, there were no machinery-of-Government changes which affected the operations of the Board.

Public interest disclosure No public interest disclosures were made to the Board under the Whistleblowers Protection Act 1994.

Remuneration Members of the Board and Funding Committee are remunerated consistent with Government policy entitled Remuneration of Part-Time Chairs and Members of Government Boards, Committees and Statutory Authorities. Section 144 of the Accreditation Act provides for the Board to appoint assessors and auditors. Board assessors are remunerated consistent with a fee, and related allowance, structure determined by the Board. Board auditors are remunerated consistent with the outcome of the Board’s competitive procurement process in 2007 to engage auditors for the 2008, 2009 and 2010 audit program. As officers of the Department of Education and Training, officers of the Board’s Secretariat are remunerated consistent with wages and salaries, and related benefits, applying to officers of that department.

Risk management In 2003, the Board adopted a system of risk management, and until 30 June 2009 conducted annually an assessment of risks, under the now repealed Financial Administration and Audit Act 1977 and attendant Financial Management Standard 1997. The risk management provisions of the new Financial Accountability Act 2009 and Financial and Performance Management Standard 2009 commenced on 1 July 2009. Accordingly, the Board adopted a system of risk management compliant with the new legislation and conducted an assessment of risks to identify and classify the risks, and apply risk controls/treatments. On 6 August 2009, the Board completed its annual risk identification and classification, and application of risk controls/treatments. On the basis that the Board is a relatively small agency, and that the potential risks and consequential costs would be generally medium to low, the Board has not established a risk management committee at this time, and the functions normally associated with a committee are undertaken by the Board as a whole.

34 | Annual Report 2009-10 Right to information, and information privacy, legislation The Right to Information Act 2009 commenced on 1 July 2009 and replaced the Freedom of Information Act 1992 on that date. The primary object of the Right to Information Act 2009 is to provide a right of access to information under the government’s control unless, on balance, it is contrary to the public interest to provide the information. The Information Privacy Act 2009 commenced on 1 July 2009. The primary object of the Information Privacy Act 2009 is to provide for the fair collection and handling in the public sector of personal information; and a right of access to, and amendment of, personal information in the government’s possession or under the government’s control unless, on balance, it is contrary to the public interest to give the access or allow the information to be amended. The Board implemented the new legislation on its commencement by publishing a new “Right to Information” section on the Board’s website and having appropriate processes in place to deal with applications under the new legislation. The new section includes the Board’s “Publication scheme”, “Disclosure log” and application forms as prescribed under the new legislation. During the reporting period, the Board received no applications under the Information Privacy Act 2009, and four applications under the Right to Information Act 2009.

Workforce planning, retention and turnover, voluntary early retirement, retrenchments As officers of the Board’s Secretariat are officers of the Department of Education and Training, details of workforce planning, retention and turnover, voluntary early retirement and retrenchments will be reported in the annual report of that department.

Carers (Recognition) Act 2008 During the reporting period the Board has not made any strategic policy or planning decision of a kind covered by section 9(2) of the Carers (Recognition) Act 2008. In the performance of its functions, in so far as they affect carers and the persons for whom they care, the Board has not taken any action which did not reflect the principles of the Queensland carers charter as set out in the schedule to the Carers (Recognition) Act 2008. As the Board’s Secretariat is constituted by officers of the Department of Education and Training, the department is obliged by section 9(1) of the Carers (Recognition) Act 2008 to ensure these officers have an awareness and understanding of the Queensland carers charter as set out in the schedule to that Act.

Government objectives for the community The Board and the Funding Committee take account of Government objectives when they develop and implement their strategic plans. Strategic plans are public statements of how the Board and the Funding Committee will undertake their statutory obligations and contribute to the Government’s social and fiscal objectives during the period covered by the plan. Plans provide statements about why the Board and the Committee exist as entities, their directions for the future and, in broad terms, how they intend to get there. Plans, therefore, identify the core services of the Board and Committee and detail corresponding goals, strategies and performance measures by which they can measure the standard of service delivery of their outputs. The development of effective strategic planning informs the activities of the Board and the Committee, as it assists in assuring that these contribute to high-quality performance in undertaking statutory obligations, as well as to the priorities and direction of Government. The Accreditation Act, the Accreditation Regulation and the Government’s social and fiscal objectives for the state provide the framework within which strategic plans are developed.

Strategic Plan 2010–2014 Consistent with the requirements placed on statutory bodies by the Financial and Performance Management Standard 2009, made under the Financial Accountability Act 2009, the Board developed and approved its Strategic Plan 2010–2014. As with the Board’s previous strategic plans, Strategic Plan 2010–2014 includes goals, strategies and performance indicators for the Funding Committee. Under the Standard, as a statutory body the Board is also required to have an operational plan, or operational plans, to implement the strategic plan. The Board has developed and approved its Operational Plan 2010–2011.

Strategic Plan 2009–2013 For 2009–2010, the Board operated within the jurisdiction of the Strategic Plan 2009–2013 approved by the Board before the start of the present reporting period. As with strategic plans in previous years, the 2009–2013 plan includes goals, strategies and performance indicators for the Board and Funding Committee. Also, the Board operated within its Operational Plan 2009–2010. The Board developed and approved each of these plans consistent with the requirements placed on statutory bodies by the Financial Management Standard 1997 (the “Standard”), made under the Financial Administration and Audit Act 1977. The vision and values that guide and underpin the Board and the Funding Committee in their operations are stated in the front of this annual report. When developing the Strategic Plan 2009–2013 and the Operational Plan 2009–2010, members were very conscious of the changing educational environment operating in Queensland, which is reflected particularly in Toward Q2: Tomorrow’s Queensland, Smart State Strategy 2008–2012: a new direction, and Smart Queensland: Smart State Strategy 2005–2015, and also the changing demographics of Queensland, the educational needs of the young people of Queensland, the education agenda of the Australian Government, the world economic situation, and the public interest in child protection and student welfare.

This appendix lists all operating non-State schools in Queensland at 30 June 2010, and gives the location of those schools, the type of education and year levels for which the school is provisionally accredited or accredited, and the name of the school’s governing body. 2. For type of education, the marker Prov indicates the school is provisionally accredited for that education type. 3. Even though a school is provisionally accredited or accredited for a particular type of education, the school may not be offering that education type. This may be for a number of reasons, including: (i) being provisionally accredited but the relevant student-intake day has not yet happened; or (ii) being accredited but the school has made a decision not to offer part of or all of the education type for a short period of time. 4. Accreditation Act The Education (Accreditation of Non-State Schools) Act 2001. accreditation criteria The accreditation criteria, prescribed in the Education (Accreditation of Non-State Schools) Regulation 2001, part 2.
