CONCLUSIONI DELLE PARTI Requisitoria del Pubblico Ministero PUBBLICO MINISTERO - Grazie Presidente, grazie signori Giudici, comincio questo intervento, già il collega ha anticipato come abbiamo pensato di suddividere lo schema del nostro intervento. Io oggi esporrò gli elementi che secondo noi sostengono l’accusa e il giudizio di responsabilità a carico delle società Eni e Shell, e degli Imputati dell’odierno procedimento, nella prossima udienza saranno affrontate delle tematiche più specifiche delle tematiche delle consulenze tecniche, su cui oggi sarò estremamente rapido, e saranno affrontate le linee difensive, gli argomenti difensivi che sono emersi R.G. 1351/18 - TRIBUNALE DI MILANO VII SEZIONE PENALE - 02/07/2020 - C/SCARONI PAOLO + 14 - 3 di 78 VERBATIM - SOCIETA' COOPERATIVA A RESPONSABILITA' LIMITATA SOCIA DEL CONSORZIO CICLAT nel corso di questo dibattimento. Nel preparare questa discussione abbiamo pensato di non affidarci a un’esposizione puramente cronologica, perché è vero che un’esposizione cronologica forse sarebbe stata più ordinata, perché mettere in fila i fati uno dopo l’altro può sembrare più ordinato, però sarebbe stato secondo noi troppo dispersivo. Perché? Perché la vicenda è complessa e perché ci avrebbe costretto a fare… ad aprire numerose parentesi, a fare un avanti e indietro, e quindi a non essere, come speriamo di essere, efficaci nell’argomentare. Proponiamo quindi una rappresentazione tematica per argomenti, che però dovrebbe essere in grado di coprire i temi di prova che presentiamo a questo Tribunale. Questo possiamo farlo perché naturalmente siamo all’esito di un dibattimento rispetto a un Tribunale che conosce già bene la vicenda, quindi è inutile per me soffermarmi su ciascun elemento e ripetere per l’ennesima volta che in questa data è successo questo fatto o quest’altro fatto, alcune le darò per scontate, per conosciute. Permettetemi soltanto di dare, giusto per introdurre il discorso, perché non ci vediamo da diversi mesi, qualche coordinata temporale, soltanto questo, su cui ci eserciteremo. L’ambito delle indagini… questa è una vicenda che nasce molti, molti anni fa, ma l’ambito delle indagini, e quindi del dibattimento, ha focalizzato essenzialmente un periodo che inizia nell’autunno del 2009, autunno del 2009, un momento in cui ancora Eni non è parte integrante dei negoziati, un periodo in cui Shell e Malabu si vedono per concordare un’ipotesi di settlement al 50 percento, poi succede che entra Eni, entra Emeka Obi, siamo alla fine del 2009, viene firmato il confidentiality agreement a febbraio del 2010, naturalmente parleremo di questo. Eni fa le sue offerte non vincolanti ad aprile e a giugno, il fatto importante è che da febbraio 2010 Goodluck Jonathan prende i poteri effettivi di Presidente della Nigeria a causa delle condizioni di salute del Presidente Yar’Adua. E Goodluck Jonathan diventerà poi Presidente effettivo alla morte di Yar’Adua nel maggio del 2010. Quindi l’altra pietra miliare di questo discorso cronologico è questa: la presa del potere di Goodluck Jonathan e delle persone del governo a sé Vicine, Diezani Alison-Madueke e Adoke Bello in primis. La conseguenza di questa presa del potere, per quello che ci riguarda, è l’adesione incondizionata alle aspettative di Dan Etete che si tramuta in una riassegnazione totale del 100 percento di OPL 245 a Malabu. Siamo a luglio del 2010. Ancora fino a quel momento si era negoziato per acquistare soltanto il 40 percento, da qui in poi si pensa ad acquistare il 100 percento, perché Goodluck Jonathan ha dato il 100 percento a Etete, e naturalmente bisogna rifare tutto. Si rimescolano le carte in tavola, Eni e Shell devono trovare un accordo, Paolo Scaroni con la sua delegazione Eni incontra il Presidente Jonathan il 13 agosto 2010 in Nigeria, Eni e Shell trovano un accordo per fare un’offerta congiuntamente, o meglio sulla base di un’intesa comune. Entra in gioco, ancora di più a quel punto, il ruolo dell’Attorney General. Adoke Bello è il protagonista di quello che succede, già lo è stato prima, ma ancora di più è il protagonista di quello che succede da novembre, sostanzialmente, in poi. Quindi ci sono i tavoli presso l’Attorney General, e a un tratto prende forma un nuovo schema di transazione, che è quello che poi porta al resolution agreement dell’aprile 2011. Noi collochiamo questo cambio di schema nelle offerte al dicembre del 2010. C’erano stati molti avvenimenti, alcuni li vedremo, c’era stata la diffida del figlio di Abacha, c’erano state delle difficoltà che non permettevano più di continuare in quel modo, che comunque vedevano questo nuovo schema tripartito nel governo a fare da filtro tra le compagnie petrolifere e Malabu, più vantaggioso, più conveniente per tutti. Poi ci sono dei tavoli tecnici per definire le intese, e subito dopo le elezioni, ad aprile 2011, vengono firmati i resolution agreement. A maggio ci sono i pagamenti, da NAE verso l’escrow account del governo, e dall’escrow account del governo verso… in teoria verso Malabu, in realtà no. Verso Petrol Service, ne parleremo, poi il trasferimento viene restituito, ci sono i tentativi di trasferimento in Libano, e alla fine, ad agosto 2011, Dan Etete, Malabu, riceve 801 milioni su due conti correnti in Nigeria, Keystone Bank e First Bank of Nigeria. Da lì oltre la metà vengono monetizzati in contanti da Alhaji Aliyu Abubakar, che provvederà a fare quello che c’è da fare. Dico così, citando a memoria, alcuni passaggi documentali che poi vi… INTERVENTO - Scusi, Presidente, non si sente, quando riparte se possiamo… avvicinarsi di più al microfono. PRESIDENTE - Si può alzare il volume? Cosa possiamo fare per… PUBBLICO MINISTERO - Preferirei non essere costretto a urlare, però così forse si sente. PRESIDENTE - Così sentite? PUBBLICO MINISTERO - Provo ad andare avanti. Dunque, queste sono le coordinate temporali che ho voluto ricapitolare, giusto per non entrare ex abrupto nell’analisi dei fatti, ma dicevo questa storia comincia ben prima dell’ottobre 2009, comincia con la storia di OPL 245, che come sappiamo è ben precedente all’ottobre 2009. E quello che vorrei evidenziare già da ora è un dato che apparentemente può sorprendere, almeno a me ha sorpreso all’inizio quando ho cominciato a occuparmi di questa vicenda, cioè che dal 2009, 2010, 2011, le persone, parlo soprattutto dal punto dei Pubblici Ufficiali nigeriani, tutto sommato sono sempre le stesse. This study will employ a socio-legal approach to investigate the root causes of Nigeria’s limited legal aid scheme. It will also focus on the relationship between law and society and will employ appropriate empirical research methods for an in-depth understanding of significant causal factors that influence legal aid provision in Nigeria. These factors will include an examination of Nigerian legal institutions, legal processes, and legal behaviour,1 particularly how legal institutions and legal processes affect individuals and how they are perceived by ordinary citizens and potential recipients of legal aid. This research considers the potential for other sources of law, and other legal institutions, such as customary legal systems, to be used as an additional, credible way to access, develop and expand legal aid provision in Nigeria. This study adopts two qualitative techniques: semi-structured telephone interviews and self- administered questionnaires, which were completed and returned via email. The request for respondents was launched on social media. In total, fifteen respondents partook in the study: twelve via self-administered questionnaires and three via telephone interviews. The inquiry was focused on a people’s perspective, the respondents were a variety of ages above 18, and evenly distributed by gender.

Adebowale Abstract The history of constitutional development in Nigeria reveals the tortuous road the legislators have taken to bestow a legacy of a befitting Constitution. Constitutional provisions on amendment are tedious, and sometimes, manifestly insurmountable. It therefore behoves the National Assembly to painstakingly adhere to the various provisions of the Constitution in order to fill the lacunae in the Nigeria corpus juris which has constantly plagued the country‟s political, judicial and socio-economic sectors. From the colonial era, it has always been the same story of exploring different types of constitution. This “try and error” approach has never yielded any acceptable grundnorm for the Federal Government of Nigeria. The peculiar composition of Nigeria as a multilingual, multi-culture and religiously diversified country has virtually been cited as the key issue in Nigeria‟s tortuous road to a satisfactory constitutional achievement. The much touted “unity in diversity” has proved to be nothing more than political slogan. With the pervasive cry for restructuring in Nigeria, and the continuous failure of successive governments to find sustainable solutions to the yearnings and cravings of the citizenry, this writer looks back at where it all went wrong.
