I am writing to express my intense opposition to the proposed Hundal Subdivision located at 45089 Cougar Circle in the Vineyard Hills neighborhood of Fremont. I live in the neighborhood and really appreciate that Fremont's Staff Planners have twice rejected the proposed Hundal Subdivision. We believe that the proposed project contravenes existing restrictions and covenants applicable to preservation of open space and natural habitats that broadly benefits all Fremont residents.

We are the original owners of our home at , Fremont, where we have resided for over 30 years. We have seen many changes in our neighborhood and Fremont during that time. While we understand that change is inevitable, not all changes are positive. It has been truly sad to see the significant and continuing diminishment of the city's open spaces, and the adverse impact that that has had on wildlife once so much more prevalent in our neighborhood and Fremont.

We urge the Fremont City Council to support the decision of city Planning Staff and deny the proposed Hundal Subdivision. The proposed project can only lead to the further destruction of open space in this area near Mission Peak, which provides the city and region with a precious resource for recreation and nature conservation.

Just to give you a flavor of what Open Space means to us, we have attached a few pictures taken from our backyard. We also enjoy the sounds of chirping birds just sitting in our backyard, and we are afraid such views and wildlife would be permanently disrupted with new construction in the Open Space. The open space attracts wildlife to the area which preserves the rural character of the neighborhood. The destruction of open space by the Hundal subdivision would not only ruin the rural character of the neighborhood, but would also negatively impact wild life habitats in our community.

We are grateful the Planning Commission has upheld Measure A that was passed by voters in 1981 to protect Open Space and denied the proposed Hundal Subdivision. We have also attached the map (available from City of Fremont web site) depicting the Open Space that is 'protected' ‐ see the bottom right, marked with my Red Arrow that points to the Open Space easement that runs through Hundal property.

We hope the Fremont City Council will also deny the proposed destruction of open space in this rural area near Mission Peak that serves the city and region with scenic beauty for recreation and the conservation of natural resources.

Dear Vice Mayor Salwan,

Please view the short video attachment I was amazingly able to capture July 2019 (after the planning commission hearing on June 13, 2019). It was perfect timing to see this wonder in nature right from my upstairs window, looking onto Hundal's property behind our home.

I would like to formally write you to express my feelings about the Hundal subdivision appeal which the City Council will be reviewing at an upcoming City Council meeting. I am 100% opposed to the request to subdivide a lot which was purchased by Mr. Hundal who is fully aware his deed allows only one house on the lot he purchased.

Measure A was created and adopted by Fremont voters to protect our valuable open spaces. As my home is adjacent to Hundal's property, I am witness to how this protected open space easement has allowed continued wildlife to still venture into the neighborhood. Sightings of a mama bobcat and her 3 babies, deer, jack rabbits, wild turkey, , foxes, have shown how we should continue to respect our environment. What will happen when this open space is demolished IF Hundal is allowed to add three more lots? And once this precedent is set, what will prevent other property owners from subdividing their one massive property into smaller lots?

I am an original Vineyard Hills homeowner, living here for 30 plus years. I have seen Fremont and surrounding cities grow immensely: 237 had a couple of signal lights with a produce stand on the way into Sunnyvale, 84 was a 2 lane country road winding through the hills between Fremont & Livermore, Nagata brothers and the Corn Palace were favorite places to go buy fresh farm produce. Today, to the west of my home, building & traffic have become horrendous. However, to the east, in my backyard, the view of Mission Peak & Mission hillside anchors me, reminding me of the Fremont we first made our home in 1988.

8 We are grateful the Planning Commission has denied the Hundal subdivision proposal twice, and hope the Fremont City Council will also deny the proposed destruction of open space that serves the city and region with the scenic beauty for recreation and conservation of our natural resources. Please allow future generations to have the same opportunity to enjoy & preserve these open environments.

I am writing to express my strong OPPOSITION to the proposed Hundal Subdivision at 45089 Cougar Circle in the Vineyard Hills neighborhood adjacent to Mission Peak in Fremont. I am also opposed to subdivisions of other lots that are covered under open-space easements.

Me and my family are residents of Fremont , Fremont CA. We live in the Vineyard Hills neighborhood and frequently walk in the neighborhood enjoying the open space views and the wildlife that live in that area.

The open space in the area attracts wildlife to the area which preserves the rural character of the neighborhood. The destruction of open space by the Hundal subdivision would not only ruin the rural character of the neighborhood, but would also negatively impact wild life habitats in our community.

We are grateful the Planning Commission has denied the proposed Hundal Subdivision, and hope the Fremont City Council will also deny the proposed destruction of open space in this rural area near Mission Peak that serves the city and region with scenic beauty for recreation and the conservation of natural resources.

Dear Mr. Salwan, We are the neighbor of Mr. Hundal at 45089 Cougar Cir. We bought our house at Cougar Cir. at the similar time with him. At that time, the builder, Citation Developer, promised that there is only one neighbor behind us. That land is so big because of Fremont city had a deal with Citation in exchange of smaller lot size around that area. Now he wants to subdivide his land due to huge increasing real estate market price. That breaches the commitment at the beginning and affect all neighbors. Our community and school already overcrowded. Why make those getting worse due to someone's greedy! You are our Vice Mayor; to protect our city and people live in there is your responsibility. I hope you can try your best to prevent this happen.

Having seen the incredible amount of overcrowding in Fremont, I am firmly opposed to any development that worsens the problem. The area in South Fremont with all the construction around Bart and now this Hundal Subdivision thing are very bothersome. I was seriously considering getting out of Fremont even though this is where we raised our daughters and have loved it here. I am writing this email to express my opposition to the proposed Hundal Subdivision at 45089 Cougar Circle in the Vineyard Hills neighborhood adjacent to Mission Peak in Fremont. I am opposed to subdivisions of other lots that are covered under open-space easements. We live at in the same Vineyard Hills area. I want to preserve the open space and all flora/fauna that goes with it. The wildlife adds to the character of the area and I wouldn’t want any perturbation to any of it. Enough with the overcrowding.

Please OPPOSE the proposed Hundal Subdivison at 45089 Cougar Circle in the Vineyard Hills neighborhood, which is adjacent to Mission Peak in Fremont. This

46 subdivision will set a precedent encouraging more development around the Mission Peak area and other subdivision lots that are covered under open-space easements.

We've been at our current address at in Fremont since 1984. The biggest reasons why we moved here was because of the open space and natural beauty of the Mission Peak area. Our family often hikes Mission Peak and we enjoy the wild life and undeveloped land that Fremont should embrace for generations to come.

The Sierra Club, which we have been members since 2006, opposes the Hundal Subdivision. The Fremont Planning Commission has denied the proposed Hundal Subdivision. Being a resident of the Mission Peak area, we strongly oppose the Hundal Subdivision. Preserve the beauty, wild life, and open space of the Mission Peak area and OPPOSE the Hundal Subdivison.

I strongly urge you to deny the Hundal Subdivision appeal that is coming before the City Council in October, 2019. I live in the Vineyard Hills neighborhood and my house is adjacent to the Hundal property where I have resided for over 30 years as one of the original homeowners.

The Fremont Planning Commission denied the Hundal Subdivision Proposal at their hearing held on June 13, 2019. The planning commission report articulates the Fremont laws and State laws that clearly prohibit a subdivision from being allowed, specifically with the Open Space Easement designation that encumbers the full Hundal property in perpetuity.

The Hundal property is part of Planned District P‐84‐14 established in 1985. It is one of five large lots in the planned district where the City of Fremont imposed an Open Space Easement designation that restricts each lot to only one single‐family home. This open space designation on the five large lots was necessary for the overall planned district to meet open space requirements mandated by the Measure A Hillside Initiative passed by Fremont voters in 1981. In addition, Open Space Easements are heavily protected by California State code per the Open Space Easement Act of 1974.

Please vote to deny the Hundal Subdivision appeal when it is presented to the City Council and uphold the laws in place to protect designated open space.

My name is Anand Birje and I am a resident of , since last 7 years have lived and enjoyed this beautiful neighborhood. I and my wife Pareezad chose this house back in 2013 specifically for the open spaces and wilderness around the home. We had paid premium at that time compared to other similar properties in the area due to the open lots behind our house including the Hundal home/property in the subject.

This is a very very important part of the Fremont City ecosystem and we are already killing this habitat with the amount of building permits Fremont has been giving builders around the city. Lets not further damage the mountain area which is the last remaining habitat for the animals and also creates the breathing air /oxygen for our city.

My name is Donald Li, and I am writing to express our strong opposition to the Hundal Subdivision for many reasons.

We live at , adjacent to Hundal's residence. I purchased our house 30 years ago and paid a premium for a view of Mission Peak. Our neighbors on both sides also chose to raise their families and bought their houses around the same time, for the same reason. I'm fairly certain many other homeowners in our area have the same story. Building new houses on Hundal's lot would not only obstruct our view, but also drive down our house prices. As retirees, the equity of a house, developed over decades, offers not only a place to sleep, but also security in our aging years. If Hundal is permitted to subdivide his lot, one man would benefit at the expense of several families, most of whom are elderly retirees who have invested decades into their homes.

Furthermore, I'm concerned for the environmental impact. I know there is a petroleum pipe line buried underneath that land. What sort of hazards would construction pose? We frequently spot hares, hawks, , and even coyotes on that land. What would become of this habitat?

Please deny Hundal's request to subdivide his land. Security, neighborly kindness, and nature are more important than any one individual's wealth.

Mr. Hundal obviously feels he does not belong in our neighborhood because trying to build more homes is simply breaking relations with us and our City. Wouldn’t Mr. Hundal be breaking a permanent, legally binding agreement by getting such a proposal granted? Is he so above the rest of us that he should be allowed to break such an agreement?

My husband and I own a home and live at , within the Vineyard Hills area since 2005. We live in the Vineyard Hills neighborhood and frequently walk in the neighborhood enjoying the open space views and the wildlife that live in that area.

The open space in the area attracts wildlife to the area which preserves the rural character of the neighborhood. The destruction of open space by the Hundal subdivision would not only ruin the rural and historic character of the neighborhood, but would also negatively impact wildlife habitats in our community. Such a property was meant to conserve pathways for wildlife that have no other safe alternative path. Here, we constantly encounter deers, coyotes, lynx, wild cats, many wild birds, hares, turkeys, foxes all roaming in the area. All are within a safe distance due to the space that our community left for them after our Vineyard Hills Community was built. Building more would negatively intrude on their territory making them prone to re-location, more prone to having closer, dangerous encounters with humans, all due to the home construction and encroachment on their space. Animals don’t have a voice. The least we can do is help the wildlife stay and continue their growth where they have been for generations without forcibly driving them away too. The strain of adding more homes in our small community will also trickle out of our area.The construction would not only bring noise, debris, get rid of natural drainage, slopes, and other sensitive environmental aspects here, blockage of views, more competition for road space, school space (where will those children go to school?, will they be bused to other schools?, etc. The list is endless. Your decision to allow this would have lasting consequences in almost every aspect of human and wildlife.

Furthermore, granting Mr. Hundal’s proposal is just incompatible with maintaining and preserving the natural or scenic character of the land. Mr. Hundal was aware of all this when he purchased his land, and now wishes to void all of it so he can a profit?

Last, the Fremont we knew from years ago had open space by Durham, Cushing Pkwy., Osgood, Grimmer, Walnut, etc., all of those are now occupied by apartments, businesses, etc. Clearly you would not want more of that in our community that has just few spots open still for wildlife. The proximity to Mission Peak makes it even less ideal to have more subdivisions of property.

When I came home from college last June, I was exhausted from a semester of heavy coursework and research. Like always, I looked out my window and cast my eyes on the graceful slopes of Mission Peak. I ate up the sight, greedily; hills and open landscape are extreme rarities in the city where I go to school. As someone who grew up with those hills as the backdrop of my life, I want to explain what that view has really meant to me. Waking up to the rolling brown and green of the regional preserve imbued me with an abiding appreciation for the natural environment. The jackrabbits, squirrels, birds, insects, bobcats, and at one point, peahen, who cohabited the area behind my backyard provided vivid examples of the ways in which non-human flora and fauna persist in pockets of the built suburban environment. They were the inspiration for the ecosystem project I created in fourth grade, and later, the CHANGE project I conducted at Tule Ponds about honey bees and colony collapse disorder. When I started attending university for my undergrad education, I organized panels about environmental issues like climate change, renewable energy, and land conservation. Ultimately, my interest and fascination with the ecological surroundings of my California home drove me further into research about other people’s dynamic relationship with their land and its alterations, including the negative impacts of hydraulic fracturing in Midwest America and the formation of the Climatic Research Unit in Britain. Thinking about the loss of that view of the hills and the disruption of the ecosystem behind our house is incredibly painful. To lose that area to a subdivision would be to lose a landscape that has and continues to contribute to my environmental consciousness and awareness. While I realize that Fremont is a rapidly expanding city, I urge you to consider the consequences of growth without conscience. I ask you to rethink the relationship between people and the land, a relationship in which land is not just something to live on, but to live with. What that relationship can be, but also, what it ought to be.

Besides this specific property, let it also be known that we are also opposed to any subdivision of any other lot that is covered by the open-space easements in the city of Fremont.

We are residents of the Vineyard Hills neighborhood (we live on ) in Fremont, and have resided in that location for over 27 years! My house backs up to the creek and a lush grove of trees. My neighborhood is constantly frequented by deer and wild turkeys, adding a rural touch to an otherwise overpopulated area.

The beauty of where we live is the unobstructed views of Mission Peak and the surrounding hills. Unfortunately due to poor planning in the past, this Mission Hills area as it stands, is already quite overcrowded with small lot sizes and large ‘mega-mansions’ packed into small lots packed close to each other.

If there is further subdivision of open space as in the Hundal subdivision we would be adding to the already congested nature of our neighborhood, further impacting the quality of our life and the life of the wild life that inhabits our community.

The Planning Commission has (wisely) already denied the proposed Hundal Subdivision. We hope that the Fremont City Council will follow suit and deny this proposed destruction of open space in our community. We cannot afford, for the future of our beautiful city, further reduction in the quality of life.

We paid a premium for the lot because it backed on the open space and the areas adjoining to Hundal’s proposed Subdivision. Citation Homes at the time had promised that there would be only 1 house in the back of our property and rest of it would be OPEN space, therefore the premium price. The City of Fremont had accordingly zoned and approved the large lots on the back of our homes. We believed in this and trusted the zoning that the City had approved. If these are now overturned and subdivided we believe this would be a breach of trust.

The open space in the area attracts wildlife to the area which preserves the rural character of the neighborhood. The destruction of open space by the Hundal subdivision would not only ruin the rural character of the neighborhood, but would also negatively impact wild life habitats in our community.

Having seen the incredible amount of overcrowding in Fremont, I am firmly opposed to any development that worsens the problem. The area in South Fremont with all the construction around Bart and now this Hundal Subdivision thing are very bothersome. I was seriously considering getting out of Fremont even though this is where we raised our daughters and have loved it here. I am writing this email to express my opposition to the proposed Hundal Subdivision at 45089 Cougar Circle in the Vineyard Hills neighborhood adjacent to Mission Peak in Fremont. I am opposed to subdivisions of 1 other lots that are covered under open-space easements. We live at 890 Boar Circle in the same Vineyard Hills area. I want to preserve the open space and all flora/fauna that goes with it. The wildlife adds to the character of the area and I wouldn’t want any perturbation to any of it. Enough with the overcrowding.

I am happy that the Planning Commission has denied the proposed Hundal Subdivision, and hope the Fremont City Council will also deny the proposed destruction of open space in this rural area near Mission Peak that serves the city and region with scenic beauty for recreation and the conservation of natural resources.

I am writing to express my strong OPPOSITION to the proposed Hundal Subdivision at 45089 Cougar Circle in the Vineyard Hills neighborhood adjacent to Mission Peak in Fremont. I am also opposed to subdivisions of other lots that are covered under open-space easements. If such agreements are not respected, what is this saying to others?

I was shocked to hear that such a maneuver was trying to be ‘passed’ over our own eyes in our community. I have done some research and I now understand how this all works. I never met Mr. Hundal but from my home I can hear his parties and loud music quite often. I can see now that he has a much disregard for where he lives, and with whom he ‘shares’ ‘his’ space with. Mr. Hundal obviously feels he does not belong in our neighborhood because trying to build more homes is simply breaking relations with us and our City. Wouldn’t Mr. Hundal be breaking a permanent, legally binding agreement by getting such a proposal granted? Is he so above the rest of us that he should be allowed to break such an agreement?

My husband and I own a home and live at 890 Boar Circle, within the Vineyard Hills area since 2005. We live in the Vineyard Hills neighborhood and frequently walk in the neighborhood enjoying the open space views and the wildlife that live in that area.

The open space in the area attracts wildlife to the area which preserves the rural character of the neighborhood. The destruction of open space by the Hundal subdivision would not only ruin the rural and historic character of the neighborhood, but would also negatively impact wildlife habitats in our community. Such a property was meant to conserve pathways for wildlife that have no other safe alternative path. Here, we constantly encounter deers, coyotes, lynx, wild cats, many wild birds, hares, turkeys, foxes all roaming in the area. All are within a safe distance due to the space that our community left for them after our Vineyard Hills Community was built. Building more would negatively intrude on their territory making them prone to re-location, more prone to having closer, dangerous encounters with humans, all due to the home construction and encroachment on their space. Animals don’t have a voice. The least we can do is help the wildlife stay and continue their growth where they have been for generations without forcibly driving them away too. The strain of adding more homes in our small community will also trickle out of our area.The construction would not only bring noise, debris, get rid of natural drainage, slopes, and other sensitive environmental aspects here, blockage of views, more competition for road space, school space (where will those children go to school?, will they be bused to other schools?, etc. The list is endless. Your decision to allow this would have lasting consequences in almost every aspect of human and wildlife.

Furthermore, granting Mr. Hundal’s proposal is just incompatible with maintaining and preserving the natural or scenic character of the land. Mr. Hundal was aware of all this when he purchased his land, and now wishes to void all of it so he can a profit?

Last, the Fremont we knew from years ago had open space by Durham, Cushing Pkwy., Osgood, Grimmer, Walnut, etc., all of those are now occupied by apartments, businesses, etc. Clearly you would not want more of that in our community that has just few spots open still for wildlife. The proximity to Mission Peak makes it even less ideal to have more subdivisions of property.

I am grateful the Planning Commission has denied the proposed Hundal Subdivision, and hope the Fremont City Council will also deny the proposed destruction of open space in this rural area near Mission Peak that serves the city and region with scenic beauty for recreation and the conservation of natural resources.

I have lived in the Vineyard Hills subdivision for more than 20 years and enjoyed having the views and wildlife which have resulted as a benefit of having open space easements in place on a number of the lots in our neighborhood.

I have had the pleasure to see families of partridges and other birds, rabbits and other wildlife nest in make home in our yard. We have also been visited by peacock, turkey vultures and falcons. I also had a deer jump over the fence into our yard.

1 I have enjoyed unobstructed views from our back yard and many times had family outings going up Mission Peak Trail enjoying the open views and stopping for a leisurely lunch along the way.
