Right to the City as the Basis for Housing Rights Advocacy in Contemporary India The Right to the street Submitted by: Dr. Anushyama Mukherjee Dr. Ratoola Kundu Ford Foundation Sponsored Research (Year 2016 -18) Tata Institute of Social Sciences 1 Chapter 1: Introduction The Centre for Urban Policy and Governance at TISS has embarked upon a multifaceted research project “Right to the City” funded by Ford Foundation which aims to a) generate knowledge b) inform policy and practices c) build networks of solidarity on the various aspects of claiming and upholding the right to the city, particularly for marginalised and excluded communities and groups that inhabit the urban space. Within the broader rubric of the Right to the City project, this study attempts to re-conceptualise the Right to the Street as a democratic and socio-political right which is increasingly under threat from the dominant development planning paradigms of urban imagination that seek to reduce the street to a particular function - as merely a space for vehicles carrying goods and people. The street emblematizes the concrete everyday reality of cities in India and much of the Global South, and also offers an insight into the workings of larger scale political economic structures (Saskia Sassen 1988, 1990, 1994, 2000; Manuel Castells 1983, 1996; Parthasarathy 1996; Ramchandraiah 2003; and Annapurna Shaw 1999). It reveals and hides, simultaneously, the complex mesh of claims and forces that shapes its life, that of the city at large, as well as of larger geographies. One of the key stakeholders in this highly contested space and a co-producer of the space of the street as a space of production, accumulation and of livelihood is the hawker. -

BANERJEE ROAD, KOLKATA - 13 Foreword Cities are important centres of modern societies that will continue to gain in importance in the future. Today, more than half the world’s population lives in urban areas. The high density and interdependence of urban lifestyles and work, and the growing dependence on increasingly complex infrastructure systems and services, are making cities more vulnerable to a variety of hazards — natural and man-made. These can be the result of technological, natural or social causes. The populous City of Kolkata is situated in the multi-hazard prone southern part of the state of West Bengal which has considerable risk of damage/loss of lives and property due to natural hazards like Cyclone, Earthquake and Flood even if we keep aside the threats due to human induced hazards as Fire, Accidents, Industrial & Chemical hazards etc. To minimize the losses due to disasters and to have a disaster resilient society, we must have clear understanding in regard to the type and strength of each of the probable threats which may cause disasters of medium or large scale in the city. The perception about disaster and its management has undergone a change following the enactment of the Disaster Management Act, 2005. The definition of disaster is now all encompassing that includes not only the events emerging from natural and man-made causes, but even those events which are caused by accident or negligence. There was a long felt need to capture information about all such events occurring across the sectors and efforts made to mitigate them in the city and to collate them at one place in a global perspective. -

Press Release 02.09.2021 Enforcement Directorate has filed a Prosecution Complaint under Prevention of Money Laundering Act, 2002 (PMLA) in the case of Narda Sting Operation, against Firhad Hakim, Transport & Housing Minister, Government of West Bengal, Subrata Mukherjee, Panchayet Minister, Government of West Bengal, Madan Mitra, MLA West Bengal, Sovan Chatterjee, former Mayor of Kolkata and S.M.H.Meerza, an IPS Officer of West Bengal Cadre before the Hon’ble Special Judge (PMLA), Kolkata with the prayer for awarding punishment to the accused for committing offence of money laundering and confiscation of the amount of gratification. ED initiated investigation on the basis of FIR dated 16.04.2017 registered by ACB, CBI under the provisions of corruption act, 1988 and IPC, 1868 against 12 public persons which includes sitting MLA’s and MP’s of West Bengal and an IPS officer of West Bengal cadre. As per FIR, Mathew Samuel had conducted a sting operation during 2014 and recorded visual footage of these persons, who either themselves took money or instructed someone else to take money on their behalf from him. In the sting operation, it was seen that the accused, in their capacity as public servants, accepted bribes to favor an individual, who was posing as a representative of a company at the time of transaction. Money laundering investigation conducted by ED has revealed that accused persons not only received illegal gratifications but also possessed the proceeds of crime and tried to conceal it by creating fictitious stories and mislead the investigation. Therefore today, ED has filed Prosecution Complaint, wherein it is highlighted that how the above mentioned highly placed persons laundered the proceeds of crime/illegal gratification. -

The Government of West Bengal, by a resolution No. 5584-UD/O/M/SB/S-22/96 dated 6th October 1997, constituted a Committee known as “Expert Committee on Heritage Buildings” to identify the heritage buildings and sites in Kolkata Municipal Corporation (KMC) area. The said Expert Committee submitted its final report to the State Government on 02.11.1998. The report was discussed in a meeting on 01.12.1998, which was presided over by the Hon’ble M.I.C., Home (Police) and I & CA Departments, and attended by, inter alia, the Hon’ble M.I.C., Urban Development Department and the Hon’ble Mayor of Kolkata; the Principal Secretary, Urban Development Department; the Secretary, Municipal Affairs Department; the Chief Executive Officer, KMDA etc. It was decided in the meeting that the list recommended by the Committee would be sent to KMC for the acceptance and for taking suitable actions towards the preservation and conservation of those heritage buildings/sites in terms of the KMC Act, 1980 (Amendment). The KMC accepted and adopted the report in principle. 2. Meanwhile, in 1997 the Chapter XXIIIA was inserted in the KMC Act 1980 for introducing a Chapter for preservation and conservation of the heritage buildings. -
