All of the materials listed below are relevant to arguments made 5 in Mercy's demurrers to the Verified Complaint. 6 1. Exhibit 1: An excerpt from the Official Catholic Directory, which reflects that 7 Mercy is an official part of the Catholic Church, a true and correct copy of which is attached 8 hereto as Exhibit 1. 9 Judicial notice is proper under Evidence Code section 452(h), which permit courts to take 10 judicial notice of "[f]acts and propositions that are not reasonably subject to dispute and are 11 capable of immediate and accurate determination by resort to sources of reasonably indisputable 12 accuracy." Courts have taken judicial notice of the Official Catholic Directory, noting it is a 13 "published book, widely disseminated, publicly available, and generally known." See, e.g., 14 Overall v. Ascension, 23 F. Supp. 3d 816, 824 (E.D. Mich. 2014) ("The directory meets the 15 requirements of Fed.R.Evid. 201."). Courts also have routinely taken judicial notice of facts set 16 forth in similar sources. See, e.g., Protestant Episcopal Church in the Diocese of LA v. Barker, 17 115 Cal. App. 3d 599, 606 (1981) (taking judicial notice of historical facts related to Catholic 18 Church); Walter E. Heller Western, Inc. v. Sup. Ct., 111 Cal. App. 3d 706, 708 n.2 (1980) (taking 19 judicial notice of facts (i.e., professional ratings) stated in the Martindale-Hubbell Directory). 20 2. Exhibit 2: The Ethical and Religious Directives for Catholic Health Care Services, 21 5th Edition; Issued by the United States Conference of Catholic Bishops, November 17, 2009, a 22 true and correct copy of which is attached hereto as Exhibit 2. 23 Judicial notice is proper under Evidence Code section 452(h).
