1 Introduction

November, 2014: As I write this book, 23 states and the District of Columbia (D.C.) have legalized cannabis, or marijuana (the leaves and flowers of the cannabis plant), for medical use. Four, Colorado, Washington, Alaska, Oregon, and D.C. have legalized it for recreational use as well. At the Federal level, however, cannabis, in all its forms, remains illegal; its use, sale and distribution are prosecutable as a felony.

The DEA classifies marijuana as a Schedule I narcotic, which, along with heroine and other hallucinogenic drugs, is deemed as having no medicinal value. Arguments against this classification have been publicized and promoted by marijuana activists, medical providers, and elected officials, but legalization at the federal level is still under debate.

Several bills, including H.R. 499 H.R.499 - Ending Federal Marijuana Prohibition Act of 2013 which was introduced on February 5, 2013, have not been pushed through the senate.

Recent headway into legalization, however, was made in August, 2013 when the Department of Justice released a memorandum stating that the federal government would not interfere with state laws regarding recreational and medical marijuana, so long as they did not interfere with their own eight enforcement priorities. In some states, however, local municipalities began creating bans on medical marijuana dispensaries, shutting down physical storefronts.

Those dispensaries then began to rebrand themselves as marijuana delivery services. They are thriving in the midst of legislative ambiguity. Marijuana is the new green rush, and its newest customers are apt to be regular people, often with ailments, chronic illnesses, and injuries. They are willing to pay a higher premium for a quality product that is reliable and safe, and they want to ensure the transaction is legal.

STATES COVERED IN THIS GUIDE

Currently, a number of states that have legalized marijuana for medicinal use do not have any legal method in which patients can obtain their medicine. Methods to establish and regulate dispensaries are still under discussion. While enterprising entrepreneurs have tried to get around state statutes in creative ways, this is likely to lead to lead to legal problems. CANNABIS OVERVIEW

Cannabis is a species of the Cannabinaceae plant family. Its psychoactive effects are caused by the chemical compound chemical compound THC (delta-9 ). Marijuana is comprised of the dried leaves and flowers of the plant.

There are multiple delivery systems, giving customers many options when using marijuana products. They included the following:

SMOKING

Marijuana can be rolled into cigarettes, smoked through a pipe or water pipe (bong). Smokers feel the effects immediately, but they soon dissipate, with most effects wearing off completely within 90 minutes, depending, of course, on the potency of the strain and amount smoked.

VAPORIZING (“VAPING”)

EDIBLES

A little goes a long way. Also, unless you have a background in baking edibles, it may be best to purchase from a reputable cannabis baker who can also provide dosing guidelines.

Tinctures contain a small amount of cannabis in an alcohol- based solution. Because tinctures are highly concentrated, they should be used sparingly, and with caution. They can be mixed with non-alcoholic cold drinks, if desired.

2 Cannabis Plants and Subclasses

There are three species of plants used for marijuana: , , and (which grows wild in parts of Eastern Europe and Russia).

SATIVA

The Sativas are tall and thin plants, with narrow leaves and a light green color. They are quick growers, and can grow great heights in one season. They originate from Colombia, Mexico, Thailand, and Southeast Asia. After flowering has started, they mature from two and a have to four months. The high they produce is energetic, and often euphoric. Sativas are known to induce laughter. These plants help with social anxiety.

INDICA

Unlike the Sativas, the Indicas are short, thick plants. They are usually a darker green. Indicas originate from Afghanistan, Morocco, and Tibet. After flowering has started, they will mature in a month and a half to two months. Smoking indicas will have a relaxing effect on the body. It can make the user feel drowsy, lethargic, and apathetic—even lazy. Indicas help with pain relief.

INDICA/SATIVA CROSSES

Crosses aim to provide the best aspects of each strain while relieving some of the less desirable effects. For example, your customers may want a strain that relieves pain while leaving them clear-headed and able to concentrate.

CANNABOIDS

ABOUT MARIJUANA STRAINS

There are over 1000 marijuana strains with new ones being created at all times. As a purveyor, you will likely be offering a few at a time as part of an overall product line. Your goal should be to provide the best quality product over quantity of strains. Strains are generally Sativa, Indica, or Hybrid strains which are Sativa or Indica- dominant, or a 50/50 hybrid of each. Rarely, Ruderalis can also be found. Please note that there can be variations in naming among growers and dispensaries. Each strain has its own specific flavor and smoke profile and effects. Another consideration is how the plant has been grown: in soil vs. a hydrophonic. This may affect the potency of the strain.

STRAIN TERMINOLOGY

Afghan/Afghani: The region where the original plants were produced. Plants with Afghan genetics are prized for their heavy resin content.

BC: Potent Indica strains which are grown in British Columbia, Canada.

Berry: The berry strains have various berry notes when smoked: strawberry, blueberry, blackberry, etc.

Black: Black strains have deep purple leaves, and a strong berry/grape flavor.

Blue: Blue strains have blue leaves, and a strong berry flavor.

Bubblegum: Bubblegum is a popular strain which has a sweet taste similar to its namesake.

Chemdog (or Chemdawg): This potent strain is a cross of and OG Kush, and omits a strong diesel scent when smoked.

Early: Early strains flower in 45-50 days.

3 Business Plan

Drafting a comprehensive business plan is ordinarily one of the most critical steps in opening your business. If your business is a marijuana delivery service, it is even more important. The information contained in your business plan will be needed, in whole or in part, to apply for your dispensary license (should one be required).

As the business grows, the business plan should be updated to reflect this, as well as reflecting any changes in direction. 5 Risk Mitigation and Awareness

While marijuana is still classified as a Schedule I narcotic and prosecutable at the federal level, no series of best practices can keep you completely safe from prosecution. However, the tips below can help you to create and manage your business in such a way that your risk is mitigated as much as possible. ∑ Do understand the Federal, State, and local laws governing your business inside and out. ∑ Do purchase marijuana business insurance. It absolutely should cover legal fees should you or a member of your staff be prosecuted under the federal laws.

∑ Do understand the legality of your product for customers.

FEDERAL MARIJUANA LAWS

The following is an overview of the Federal marijuana laws. These apply to the use, sale, cultivation, and transport of cannabis. A successful medical marijuana delivery service business depends on good customer service. What sets your business apart from the others in this space must be your understanding of your customers: their conditions, preferences, limitations, and prior marijuana usage.
