Rather, we have a professional interest in seeing trademark law interpreted with fidelity to the First Amendment. We have recently published a large-scale empirical study of all 6.7 million trademark applications filed at the PTO from 1985 through 2016, together with the 300,000 trademarks already registered at the PTO as of 1985. See Barton Beebe & Jeanne C. Fromer, Are We Running Out of Trademarks? An Empirical Study of Trademark Depletion and Congestion, 131 Harv. L. Rev. 945 (2018) (Beebe & Fromer, Are We Running Out of Trademarks?). As a result of that work, we are in possession of comprehensive data on the operation of the trademark registration process at the PTO. This brief seeks to put these data at the Court’s disposal in the hope that doing so proves useful in resolving the question presented. INTRODUCTION AND SUMMARY OF ARGUMENT In 2017, this Court held that the Lanham Act’s prohibition on the registration of trademarks that 1 All parties have consented to the filing of this brief. No counsel for a party authored this brief in whole or in part, and no person other than amici and their counsel made a monetary contribution to its preparation or submission. 2 Our institutional affiliation is given for identification purposes only. 2 “disparage * * * or bring * * * into contemp[t] or disrepute” any “persons, living or dead,” 15 U.S.C. § 1052(a), violates the Free Speech Clause of the First Amendment. Matal v. Tam, 137 S. Ct. 1744, 1751 (2017). This case presents the question whether the neighboring prohibition on the registration of trademarks that “[c]onsis[t] of or compris[e] immoral * * * or scandalous matter,” 15 U.S.C. § 1052(a), also runs afoul of the First Amendment’s Free Speech Clause. Whether this provision is unconstitutional turns in part on whether, and to what extent, the PTO has applied this provision arbitrarily or inconsistently. We have therefore undertaken a large-scale empirical study of trademark applications and registrations at the PTO to assess to what degree the PTO is arbitrary or inconsistent in its implementation of the § 1052(a) prohibition on the registration of immoral or scandalous marks. In particular, we have systematically studied all 3.6 million applications for marks that include text (which we refer to as “word-mark applications”) filed at the PTO from 2003 through 2015 to learn which marks the PTO has refused to register for being immoral or scandalous in contravention

Creation of an extensible, detector-independent toolkit (RAVE) for vertex reconstruction, to be embedded into various environments: • RAVE = “Reconstruction (of vertices) in abstract versatile environments”; • The toolkit includes both vertex finding (a pattern recognition task a.k.a. track bundling) and vertex fitting (estimation of the vertex parameters and errors); • Synergy used: starting point was the old CMS software (ORCA) which has recently been refactored and ported to the new CMS framework (CMSSW); • Principal algorithmic assets are robustified reconstruction methods with estimators based on adaptive filters, thus downweighting the influence of outlier tracks; • RAVE is foreseen to stay source-code compatible with CMSSW, but thanks to its generic API may easily be embedded into other software environments. 2. The purpose of the thesis is to study how Instagram interprets violations against its guidelines, and whether decisions to remove certain pictures from the platform are in line with terms of use, or part of human subjectivity. The noticeable pattern among the removed pictures is that they are often norm-breaking. The thesis discusses communication within Instagram to reveal how and why some pictures are removed while others are not, which limits women’s possibilities to express themselves in non-conventional settings. The study applies semiotics to analyse 12 pictures that were banned from the platform without directly violating its guidelines. Role theory and norms are used to supplement semiotics and shed light on the underlying societal structures of female disadvantage. Two major conclusions are presented: 1) Instagram has unclearly communicated its guidelines to women’s disadvantage, and 2) Instagram has therefore been subjective in the decisions to have the pictures removed from the platform, also to women’s disadvantage. Further, the discussion focuses on how Instagram handles issues related to (1) female sexuality, (2) women stereotyping, and (3) female self-representation.

    Medical Marijuana, Illicit Marijuana and Mr. C In late 2013, word came out that New York State was looking into legalizing medical marijuana for treatment of certain serious symptoms that arise from certain serious medical conditions. Among the symptoms and medical conditions to be included were muscle spasms in multiple sclerosis patients. Since multiple sclerosis is my specialty, both professionally and personally, I decided to write this article to help educate people about medical marijuana. I. My Experience with Marijuana as a Street Drug Until sometime in the recent past, I had had minimal experience with the world of marijuana. I know I had smelled something weird at several concerts that I went to when I was in college. My friends told me that it wasn’t marijuana but rather “herb cigarettes.” They told me that they were sold in a store in CollegeTown by a Ms. Jayne. One time, my friend asked if I could drive him to CollegeTown so he could get more “herb cigarettes.” When we got there, my friend told me that he would go purchase them and that I should wait in the car. I thought “whatever” because I knew smoking was bad for you regardless of what you smoked and I didn’t like the smell anyway. When he got out of the car, he went into a place that didn’t look so much like a store, but more like an alleyway that had several crates stacked up high so you couldn’t really see it from the street. Postfeminist Hegemony in a Precarious World: Lessons in Neoliberal Survival from RuPaul’s Drag Race By Phoebe Chetwynd1 Abstract The popularity of the reality television show RuPaul’s Drag Race is often framed as evidence of Western societies’ increasing tolerance towards queer identities. This paper instead considers the ideological cost of this mainstream success, arguing that the show does not successfully challenge dominant heteronormative values. In light of Rosalind Gill’s work on postfeminism, it will be argued that the show’s format calls upon contestants (and viewers) to conform to a postfeminist ideal that valorises normative femininity and reaffirms the gender binary.
