COHEN* I. INTRODUCTION Since the United States Supreme Court's approval of "minimum con- tacts" as a basis for state court jurisdiction over persons not present in a forum state, general purpose long-arm statutes have become part of the jurisprudence of almost every state. These statutes typically subject a party who is not present in a state to suit there, so long as the cause of action arises from certain contacts of the party in the state. An example of this type of long-arm jurisdiction is an action in one state to recover for personal injuries incurred within its borders, but resulting from the use of a defective product manufactured by a company with no physical presence in the forum. The distribution of the defective product in the forum state would generally be a sufficient state "contact" on which to assert personal jurisdiction over the distant manufacturer.' There is, however, no general federal law akin to a state long-arm statute which authorizes in personam jurisdiction in a federal district court. Such a void restricts the court's authority over persons who cannot be served with process within the geographic boundaries of the state in which the district court sits. Although some statutes that establish federal rights and remedies do authorize extraterritorial service of process in cases arising under them,2 most do not. Thus, for many federal causes of action in which extraterritorial service of process is needed it is necessary to rely on Rule 4(e) of the Federal Rules of Civil Procedure.3 Rule 4(e) permits a federal plaintiff to utilize the long-arm jurisdiction provided by the law of the state in which the district court sits.' An approach to long-arm jurisdiction which invests a federal court with the same degree of long-arm jurisdiction as a state court has little to command for itself. This situation arises from the fact that Rule 4(e) looks to state law principles of extraterritorial personal jurisdiction, which (in both a statutory and constitutional sense), depend upon the alien corporation's activities or contacts with the forum state. If these contacts are insufficient to satisfy state statutory or fourteenth amend- ment due process criteria, the state long-arm statute cannot be invoked, and long-arm jurisdiction in that forum is unavailable. Moreover, if the alien corporation has no state contacts sufficient to permit the use of a state long-arm statute, but there are sufficient contacts with the United States as a whole to satisfy a fifth amendment due process test of juris- diction, current law would permit such a defendant to escape federal ju- risdiction under most circumstances. With regard to a foreign corporation,5 current reliance on state long- arm jurisdiction may be interfering with policies embodied in the general and specific federal venue statutes of Title 28 of the U.S. Code. For exam- ple, section 1391(b), allows federal question cases to be brought, inter alia, in the district in which the claim arose. That district may not, how- ever, be the one in which the defendant has sufficient contacts under state law to support in personam jurisdiction. Since a federal court is con- stitutionally permitted to exercise jurisdiction over any domestic corpora- tion regardless of where located, Rule 4(e)'s dependence on state contacts effectively increases locational requirements of federal venue law (e.g., contacts with the forum state). When so viewed, Rule 4(e) may be unin- tentionally derrogating from policies expressed in federal venue statutes and may be an unnecessary circumscription on a plaintiff's choice of fora. The discussion which follows examines the current status of federal long-arm jurisdiction, the practical problems associated with its use, and the constitutional limits on federal in personamn jurisdiction. The conclu- sion drawn is that a generally applicable federal standard for long-arm jurisdiction presents the possibility of a more rational assertion of in per- sonam jurisdiction by federal courts over distant parties - especially alien corporations. Such a standard should be authorized either by stat- ute or as an amendment to Rule 4 of the Federal Rules of Civil Procedure for use in federal question cases. II. THE PROBLEM: THE USE OF STATE LONG-ARM STATUTES IN FEDERAL QUESTION CASES CREATES A GAP BETWEEN A FEDERAL COURT'S ACTUAL AND CONSTITUTIONAL REACH OVER DISTANT PARTIES Several federal remedial statutes contain provisions for extraterrito- rial service of process in cases arising under them. Section 12 of the Clay- ton Antitrust Act, for example, provides: Any suit, action or proceeding under the anti-trust law against a cor- 5. An "alien corporation" is one incorpo- rated in a foreign country. 1985 IN PERSONAM JURISDICTION IN FEDERAL COURTS poration may be brought not only in the judicial district whereof it is an inhabitant, but also in any district wherein it may be found or transacts business, and all process in such cases may be served in the district of which it is an inhabitant, or wherever it may be found. (emphasis added.)6 Section 27 of the Securities Exchange Act of 1934 is similar, authorizing extraterritorial jurisdiction wherever a defendant is an inhabitant, trans- 7 acts business, or in any district in which an unlawful act has occurred. Under the Clayton Act, the "transacts business" test of anti-trust venue has permitted long-arm jurisdiction to be exercised over corporate defendants with no physical presence in the forum state.6 Long-arm juris- diction under the Securities Exchange Act has extended to defendants with virtually no contacts with the forum state, when venue was based on the occurrence of an unlawful act in that state.9 Many federally-created causes of action, however, contain no provi- sions for extraterritorial service of process.10 In proceedings under such statutes, in personam jurisdiction over a corporation which cannot be physically served in the forum state depends upon state long-arm law, 6. Other federal long-arm provisions are found in the Foreign Sovereign Immunities Act of 1976 §4 & 5, 28 U.S.C. §1391(0, §1608 (1982) (service of a summons on a foreign state or agency or instrumentality thereof may be made by mail wherever the party is located, if other specified methods not available); federal interpleader, 28 U.S.C. §2361 (1982) (service may be made in any district in which a party resides or is found) and the Miller Act §2, 40 U.S.C. §270b (1982) (where venue is proper,extraterritorial service of process is authorized in suits by subcontractors on federal construction projects against sureties on payment bonds). 8. Fisher* Introduction Civil forfeiture under the Comprehensive Drug Abuse Prevention and Control Act 1 has become surrounded by much controversy, since the Reagan Administration's introduction in March 1988 of a zero- tolerance policy in the war on drugs. Since then, federal and state drug enforcement activities have included the increasing use of civil forfeiture as a means of deterring illegal drug trafficking, punishing drug dealers and users, and providing additional revenues for the war on drugs. Under the Drug Control Act, a person may forfeit any real or personal property used to facilitate the manufacture, transportation, sale, or possession of illegal drugs or property acquired with proceeds connected with drug trade. 2 This Note will focus on federal civil procedure in cases involving forfeiture of personal property pursuant to the Drug Control Act. The issue considered is whether execution of a civil forfeiture judgment should extinguish federal courts' jurisdiction, thereby precluding a claimant from seeking relief from an adverse judgment. Personal property, especially intangibles, is of particular interest because the situs, or jurisdictional location, of such property is movable and often difficult to ascertain. Civil forfeiture cases under the Drug Control Act traditionally have followed in rem admiralty procedures. Under admiralty rules, the court's jurisdiction continues only so long as it maintains physical control over the property. Hence, the court loses jurisdiction once it executes judg- ment. However, in recent years, several circuits instead have asserted in personam jurisdiction over the government as plaintiff, thereby preserving a losing claimant's right of appeal after execution of the judgment.

Prior to InternationalShoe, the Supreme Court limited a court's jurisdiction to cases involving persons or property located within the forum state.' MERRILL, ) ) Defendant. ) MEMORANDUM OPINION At the dawn of our nation, Alexander Hamilton adopted the words of the philosopher Montesquieu and wrote that “there is no liberty if the power of judging be not separated from the legislative and executive powers.” The Federalist No. 78, at 465 (Alexander Hamilton) (Clinton Rossiter ed. 1961). The founding fathers instituted the separation of powers, which lies at the very foundation of American democracy, to protect liberty. Occasionally, that careful separation creates situations in which the court must abstain from delivering judgment, even where it might wish to interject, to respect the structure of our democratic government. This is one such case. The Plaintiffs in this case raise issues under § 2 of the Voting Rights Act. However, the court cannot reach the merits of those issues because it lacks the ability to grant the Plaintiffs effective relief under the facts of the case. This inability to provide relief renders the case moot and, moreover, creates a situation in which any opinion issued by this court would be an advisory opinion addressed to the legislature in contravention of the separation of powers. This court’s power of judging must remain separate from the legislative powers of creating new congressional districts, so the court must dismiss this case as moot and jurisdictionally barred.

With the growth of transnationallitigation, the issue of reactive, duplicative proceed- ings-and the waste inherent in such duplication-becomes a more common problem. The future does not promise change. In a modem, globalized world, litigants are increasingly tempted to forum shop among countries to find courts and law more favorably inclined to them than their opponents. The federal courts, however, do not yet have a coherent response to the problem. They apply at least three different approaches when deciding whether to stay or dismiss U.S. litigation in the face of a first-filed foreign proceeding. All three approaches, however, are undertheorized, fail to ac- count for the costs of duplicative actions, and uncritically assume that domes- tic theory applies with equal force in the international context.

The additional Samuel Breckenridge Prize of ten dollars for the best note in Volume XIII has been awarded to Abraham E. Margolin for his note on "Liability of Employer Under Work- men's Compensation Act for Accidents Sustained by Employee on Way to or From Work," which was adjudged best in the first issue and awarded the prize for that issue. The notes in Volume XIII were judged by a special committee, consisting of Messrs. Ralph R. Neuhoff, John M. Holmes, and Harry W. Kroeger, who are also members of the Law Review Advisory Committee.

In Personam Jurisdiction-General Appearance Howard W. L'Enfant* In Socorro v. City of New Orleans,' the plaintiff sued several defendants, including the City of New Orleans and its liability insurer, to recover damages for the injuries plaintiff sustained in a diving accident in Lake Pontchartrain which resulted in permanent quadraplegia. In the petition the plaintiff named DEF Insurance Company as the liability insurer of the City of New Orleans, and even though the plaintiff later learned through discovery that Angelina Casualty Company was the City's insurer, he did not amend the petition to substitute Angelina for DEF Insurance Company or serve Angelina with process. Before trial, an unsuccessful motion for summary judgment was filed on behalf of the City and Angelina, which were represented by the same attorney. After trial the court rendered a judgment against the City but refused to enter judgment against Angelina.

    1 FORFEITURE REFORM ACT, §809A.14 809A.14 In personam proceedings. 1. A judicial in personam forfeiture proceeding brought by a prosecuting attorney pursuant to an in personam civil action alleging conduct giving rise to forfeiture is subject to the provisions of this section. If a forfeiture is authorized by this chapter, it shall be ordered by the court in the in personam action. This action shall be in addition to or in lieu of in rem forfeiture procedures. 2. The court, on application of the prosecuting attorney, may enter any order authorized by section 809A.12, or any other appropriate order to protect the state’s interest in property forfeited or subject to forfeiture. 3. The court may issue a temporary restraining order on application of the prosecuting attorney, if the state demonstrates both of the following: a. Probable cause exists to believe that in the event of a final judgment, the property involved would be subject to forfeiture under this chapter. b. Provision of notice would jeopardize the availability of the property for forfeiture. 4. Notice of the issuance of a temporary restraining order and an opportunity for a hearing shall be given to persons known to have an interest in the property. A hearing shall be held at the earliest possible date in accordance with rule of civil procedure 1.1507, and shall be limited to the following issues: a. Whether a probability exists that the state will prevail on the issue of forfeiture. b. Whether the failure to enter the order will result in the property being destroyed, conveyed, encumbered, removed from the jurisdiction of the court, concealed, or otherwise made unavailable for forfeiture.
