    CHOOSING A LAW TO LIVE BY ONCE THE KING IS GONE INTRODUCTION Law is the expression of the rules by which civilization governs itself, and it must be that in law as elsewhere will be found the fundamental differences of peoples. Here then it may be that we find the underlying cause of the difference between the civil law and the common law.1 By virtue of its origin, the American legal profession has always been influenced by sources of law outside the United States. American law schools teach students the common law, and law students come to understand that the common law is different than the civil law, which is prevalent in Europe.2 Comparative law courses expose law students to the civil law system by comparing American common law with the law of other countries such as France, which has a civil code.3 A closer look at the history of the American and French Revolutions makes one wonder why the legal systems of the two countries are so different. Certainly, the American and French Revolutions were drastically different in some ways. For instance, the French Revolution was notoriously violent during a period known as “the Terror.”4 Accounts of the French revolutionary government executing so many French citizens as well as the creation of the Cult of the Supreme Being5 make the French Revolution a stark contrast to the American Revolution. Despite the differences, the revolutionary French and Americans shared similar goals—liberty and equality for all citizens and an end to tyranny. Both revolutions happened within approximately two decades of each other and were heavily influenced by the Enlightenment.

    5 Three Aspects of Spartan Kingship in Herodotus Rosaria Vignolo Munson erodotus’ Histories are governed by the rule of resemblance: they explain the nature of a given historical phenomenon by sug­ gesting similarities to unrelated phenomena entirely different in Hother respects.! We may safely state, in particular, that Herodotus’ analysis of any form of personal power is inseparable from his representation of monarchical rule. This was an essential feature of the foreign culture that threatened the integrity of Hellas at the time of the Persian wars, and it provided the Greeks with a foil for self-definition. The components of the monarchical model in Herodotus have often been discussed,^ and I need only to recall a few points. The speech of Otanes in the Constitutional Debate is the basic theoretical document (3.80). The monarch is here defined as an individual who “can do what he wants without being accountable” (dvevOvvco Trottem ra /SouXerat). When placed in such a position, even the best of men finds himself outside the normal way of thinking (/cat yap av tov aptcTOV avhputv TravTwv (TTavTU e? TavTTjv TTjv apy^v e/cxd? twv ewOoToiv voripdraiv cTTpcreid) and commits many unbearable things (iroWd /cal dracrOaka) out of u/3pts and cpOovos.     Establishing an Acting Regency: A Countermeasure Necessitated to Protect the Interest of the Hawaiian State David Keanu Sai, Ph.D. Establishing an Acting Regency: A Countermeasure Necessitated to Protect the Interest of the Hawaiian State November 28, 2009 Unable to deny the legal reality of the American occupation of the Hawaiian Kingdom, and in light of the absence of any legitimate government in the Hawaiian Islands since 1893, the author and Donald A. Lewis, both being Hawaiian subjects, took deliberate political steps that would create severe legal consequences not only upon the occupant State, but also themselves. On December 10th 1995, both established the first co-partnership firm under Hawaiian Kingdom law since 1893, and, in order to protect the legal interest of the Hawaiian State, they would establish an acting Regent on December 15th as an officer de facto. Established under the legal doctrine of necessity, the acting Regency would be formed under and by virtue of Article 33 of the Constitution and laws of the Hawaiian Kingdom as it stood prior to the landing of the U.S. troops on January 16th 1893. These include laws that existed prior to the revolution of July 6th 1887, which eventually caused the illegal landing of United States troops in 1893. At the core of these acts taken in December 1995 was the political existence of the Hawaiian Kingdom. Bateman states the “duty correlative of the right of political existence, is obviously that of political self-preservation; a duty the performance of which consists in constant efforts to preserve the principles of the political constitution.”1 Political self-preservation is adherence to the legal order of the State, whereas national self-preservation is where the principles of the constitution are no longer acknowledged, i.e.

I understand that my thesis may be made electronically available to the public. ii Abstract An examination of the ancient sources indicates that there were possibly seven Queens Regent throughout the course of the Seleucid Dynasty: Apama, Laodice I, Berenice Syra, Laodice III, Laodice IV, Cleopatra I Thea, and Cleopatra II Selene. This thesis examines the institution of Queen Regency in the Seleucid Dynasty, the power and duties held by the Queen Regent, and the relationship between the Queen and her son—the royal heir.
