    ONE THE SUPREME COURT AND THE MAKING OF PUBLIC POLICY IN CONTEMPORARY CHINA Eric C. Ip Post-Mao China saw profound social, economic and legal changes. This paper analyzes an often neglected aspect of these transformations: the evolution of the Supreme People’s Court (SPC) into an increasingly influential political actor in national law and policy-making. The SPC has self-consciously redefined its mandate to manage state-sponsored legal reforms by performing an expansive range of new functions such as issuing abstract rules, tightening control over lower courts and crafting out a constitutional jurisprudence of its own at the expense of other powerful state actors. It is more assertive than ever its own vision of how law should develop in the contemporary People’s Republic of China (PRC)SPC action can be broadly consistent with the Chinese Communist Party (CCP) interests, autonomous and expansive at the same time. However, the SPC’s reform initiatives are inevitably constrained by the vested interests of major bureaucratic players as well as the Party’s insistence on maintaining the Court as an integral administrative agency of its public security system. Eric C. Ip is working towards a doctorate at Oxford University's Centre for Socio- Legal Studies. A student of the political science subfields of comparative constitutional design and judicial politics, he earned his undergraduate degree in Government and Laws from The University of Hong Kong, and an LL.M.     Li, China Leadership Monitor, No.7 Analysis of Current Provincial Leaders Cheng Li China has experienced a large-scale turnover in its national leadership, as demonstrated by the recently held 16th Party Congress of the Chinese Communist Party (CCP) and 10th National People’s Congress (NPC). Less noted, but equally significant, is the rapid change of political elites at the level of provincial leadership. These two national institutions’ equivalents at the provincial level have also selected their top leaders during the past few months. An analysis of the elite change at the provincial level not only sheds valuable light on the relationship between the central and provincial governments, but also provides clues about the characteristics of future top national leaders. China’s provincial-level administrations enjoy more autonomy to advance their local economic interests today than at any other time in the past half century. The dynamic interaction between the need for national integration and the demand for regional autonomy has emerged as a central issue in Chinese politics. Furthermore, provincial leadership posts have become major stepping-stones to positions of national leadership during the past decade. For example, the percentage of 16th Politburo members with previous experience as top provincial leaders (deputy party secretaries, vice governors, or above) rose sharply over the last decade: from 55 percent in 1992 to 68 percent in 1997, and again to 83 percent by 2002.1 Thus, understanding the provincial leaders’ biographical backgrounds, tenure in office, political socialization, career patterns, and rate of reshuffling is essential to the study of Chinese politics. This study focuses on the 412 current top provincial leaders, a cluster of elites that includes all current provincial party secretaries, governors (or mayors of provincial-level administrations in the cities), deputy provincial party secretaries, and vice governors or vice mayors.

LAW A COMPILATION OF A SERIES OF ‘EXPERT ON TIBET PROGRAMS For RADIO FREE ASIA By WARREN SMITH 1 VOICES FROM TIBET Voices from Tibet is a recently published collection of articles about Tibet by Tsering Woeser and her husband Wang Lixiong. The articles were translated into English and published by a Chinese-American woman named Violet Law. Woeser is well-known to many Tibetans as a commentator on the political situation in Tibet. Wang Lixiong is a Chinese democracy activist and supporter of Tibetan human rights. They are based in Beijing. This is the first of a series of programs on their collected articles. The first article, “Freedom for Chinese, Autonomy for Tibetans,” was written by Woeser. Woeser writes about her excitement in October 2010 upon hearing that the Nobel Peace Prize was awarded to the Chinese democracy activist Liu Xiaobo. Lui was the first Chinese to win the Nobel Peace Prize, assuming, of course, that one does not consider the Dalai Lama, who won the Peace Prize in 1989, to be Chinese. Liu had been the organizer, in 2008, of Charter 08, which Woeser had signed, which called for human rights, democracy and the rule of law in China. It was modeled after Charter 77, which had originated in Czechoslovakia in 1977 and was credited to have begun the collapse of the Soviet Union and its empire. In response to the uprising in Tibet in 2008, Liu had organized a petition of 30 Chinese intellectuals calling on the Chinese Government to respect Tibetans’ rights, to cease the repression of their protests and to try to understand their grievances, and to allow them to exercise genuine autonomy as proposed by the Dalai Lama.
