Hav- ing returned to teaching Conflict of Laws last year, after not having taught that course since the mid-1980s, I was interested in re-examin- ing the Erie1 doctrine from the vantage point of both of these subject areas. My goal was to see whether a combination of learning from these two related disciplines would introduce additional coherence into the analysis of this topic. In one sense, the Erie doctrine and traditional choice of law de- terminations present analogous questions, since they both involve making a selection between competing legal rules. Choice of law de- terminations are of course made in a "horizontal" setting, i.e., in de- termining which state's or country's law to apply to an issue, with respect to a transaction touching on two or more jurisdictions. Erie, on the other hand, is implicated in a "vertical" setting, where the ac- tion is being heard in a federal court based on a claim arising under state law,2 and where it is necessary to determine whether the federal court may apply federal law or whether it must apply state law to an issue in the lawsuit. One alternative would be for the forum always to apply its own law-whether that forum is a state court deciding whether to apply its own rule or that of another jurisdiction, or whether it is a federal court deciding whether to apply state or federal law. That approach would certainly be simpler and more efficient. Instead, both choice of 1 Erie R.R. Co. v. Tompkins, 304 U.S. 64 (1938). 2 A shorthand way of describing these situations is that Erie commands that fed- eral courts usually will apply state law in cases brought in those courts based on diver- sity jurisdiction. In fact, of course, the action may be in federal court because the plaintiff asserts a federal question, and the state law claim is heard in the exercise of the federal court's supplemental jurisdiction, or alternatively, the state law claim arises out of a cross-claim, counterclaim, or third party claim. This Article will also adhere to the "diversity jurisdiction" convention. See generally Peter Westen &Jeffrey S. Lehman, Is There Life for Erie After the Death of Diversity?, 78 MICH. L. REv. 311 (1980). 1999] THE ERIE DOCTRINE REVISITED 1237 law rules and Erie counsel that on some occasions, the forum will, or even must, defer to the law of another sovereign. To a large extent, similar reasons underlie this deference. Among the frequently stated rationales are the desire for uniformity of outcome; the predictability3 and certainty that flow from that ex- pected uniformity; the goal of affording faimess to the parties; comity based on respect for the sovereignty of other jurisdictions and their interests in the parties and the dispute, and the resultant enhancing of harmonious relations; facilitation of interstate and international commerce and travel; promoting ease of judicial administration; and the oft-cited aphorism, the wish to prevent "forum shopping."4 Yet, there are other motivations. For the most part, the willing- ness to defer in the horizontal setting to the rules of another jurisdic- tion is the product of comity.5 In the vertical setting, that deference is the result of federalism, and it may in fact be required by the Constitu- tion and/or by statute. State vs. state6 choice of law and Erie also present other striking differences. In the horizontal setting, it would not be inappropriate for the forum, in choosing between the legal rules of more than one jurisdiction, initially to conclude that either choice would be "correct" or acceptable. Indeed, it is not unlikely that different fora, applying different choice of law principles to an identical factual setting, would resolve to apply the laws of differentjurisdictions to that same transac- tion. Either federal law applies to a particular issue or state law 7 applies to that issue, but never both. In the horizontal setting, there are a variety of choice of law ap- proaches that have been suggested by courts, by the Restatements, and by academics, and a state is free to choose among these alterna- tives. Having opted for one of these methodologies, there are only limited constraints, of either a constitutional or statutory nature,8 on the application of that choice in any concrete situation. 9 In contrast, in the vertical setting, although there is disagreement at the margins as to the appropriate rules-some of these disagreements prompted the writing of this Article-for the most part, the limits on this form of choice of law can be found in the major Supreme Court cases and in some lower court decisions fleshing out the Erie doctrine. And, as just noted, Erie's mandate-that a federal court sometimes must apply state law to particular questions of law-is the product both of consti- tutional and statutory (principally the Rules of Decision Act 0 ) imperative. Finally, in the horizontal setting, the basis for choosing between the laws of different states and of foreign countries is that each has some contacts with or interest in the parties and the dispute-whether it be the domicile of the plaintiff or the defendant, the situs of the tort, the place in which the contract was to be performed, or a myriad of other possibilities-that support the application of its rules.

The Court has directed different analyses of Erie cases depending upon whether the federal law in question is in the form of a federal rule (or statute) or is instead a judge-made law. But the cases applying the doctrine are difficult to explain using the standard account. Although the Court and commentators have noted that Erie is a type of preemption, they provide little, if any, rigorous analysis of Erie in light of preemption doctrines. This Article attempts to fill that void, offering an extended analysis of Erie as a preemption doctrine. The analysis demonstrates how and why Erie constitutes a species of preemption. It then shows the appropriateness of preemption analysis to Erie problems whether one is dealing with a federal rule of civil procedure or with federal common law. Because preemption underlies both wings of the Erie doctrine, the standard account’s bifurcated approach is wrong. Moreover, employing doctrines developed in other preemption contexts explains the results of the Supreme Court’s Erie cases better than the Court’s own standard account. By making explicit the linkage between Erie and preemption, one can clarify the analysis and better predict and explain the results of the Supreme Court’s cases. Plaintiffs argue that the court erroneously decided that Virginia’s statute of limitation applied to their claims because: (1) not all of the Arsenal is a federal enclave under the exclusive jurisdiction of the United States and governed by 16 U.S.C. § 457, (2) the defendants agreed not to assert Virginia’s statute of limitations, (3) 16 U.S.C. § 457 does not make Virginia’s statute of limitations applicable to these claims, and (4) even if Virginia’s statute of limitations applies, there are questions of fact for the jury regarding fraudulent concealment that would toll Virginia’s statute of limitations. For the reasons stated below the court will not reconsider its summary judgment opinion. I. These doctrines have tended to favor aggregation for its efficiency, consistency, and predictability. Yet aggregation is suddenly under attack from a new threat, one that has little to do with aggregation directly: personal jurisdiction. In this Article, I chronicle how a recent restrictive turn in personal jurisdiction-seen in modern cases narrowing general jurisdiction and October Term 2016's blockbuster case Bristol-Myers Squibb-threatens the salutary benefits of aggregation across a number of areas, including simple joinder of parties and claims, representative actions, and multidistrict litigation. I offer a solution for preserving aggregation's advantages in the face of this trend in personal jurisdiction: authorize a broader scope of personal jurisdiction in federal court for multiparty and multiclaim cases.

INTRODUCTION Because no special law yet exits to address jurisdiction issues on the Internet, courts have been forced to apply traditional analyses of jurisdiction to cases in this new environment. Our traditional notions of jurisdiction have made a relatively smooth transition into cyberspace. Historically, jurisdictional requirements have centered on the locus and the activity of the parties as a means of determining which state’s law to apply.1 With the advent of the Internet and the new frontier of cyberspace, established ideas about where and how interactions take place must be re-considered in this unconventional, on- line environment. These sorts of issues affect a court’s jurisdiction over parties interacting in cyberspace. Surprisingly, our conventional notions of jurisdiction have adapted well to this new cyber-environment. This is illustrated by the report of the American Bar Association, which extends support to the minimum contacts analysis to determine jurisdiction over on-line parties.2 Cyberspace has expanded the arena for interactions of all sorts,3 and has provided another forum in which parties can reach out to each other from different locations, and possibly create the minimum contacts necessary for personal jurisdiction.4 Traditional principles of jurisdiction are adaptable to cyberspace because they consider the 1.See RICHARD D. Despite the U.S. Supreme Court's clear mandates restricting personal jurisdiction in Daimler AG v. Bauman and Bristol-Myers Squibb Co. v. Superior Court, plaintiffs still "forum shop" for jurisdictions with weak procedural safeguards and low expert admissibility standards — the perfect breeding grounds for questionable claims. Leveraging arguments that challenge the way courts have thought about personal jurisdiction for decades can help companies level the playing field, and escape lawsuits in plaintiffs' preferred forums. Below, we offer four questions to ask when you find yourself litigating a case in a jurisdiction where it does not belong. Are the jurisdictional allegations plausible? In the wake of Daimler and Bristol-Myers, plaintiffs' jurisdictional allegations have become more creative, but in many cases less plausible. While sanctions may be available for the most egregious claims, courts generally allow leeway for jurisdictional theories that may be novel but fall short of sanctionable. This is especially true when the merits are intertwined with the jurisdictional question, making courts reluctant to dispose of the claim without discovery. A plausibility challenge offers a possible solution. Federal district courts in at least five different circuits have held that personal jurisdiction must be plausibly pled under Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal.1 To pass muster, plaintiffs must do more than parrot the language of a long-arm statute — they must provide actual substance.

    STUDENT ANSWER 1: Question 1. On what basis, if any would a federal district court have subject matter jurisdiction over the lawsuit by plaintiff against defendant. ISSUE 1: Whether or not the federal court has subject matter jurisdiction over plaintiff’s complaint. The federal courts are courts of limited jurisdiction and have subject matter jurisdiction over federal question causes of action and diversity of jurisdiction causes of action. A federal question claim arises when the cause of action arises under an act of Congress, the US Constitution or a US Treaty. A diversity claim is a state based claim between citizens of different states where the damages exceed 75,000. In addition the federal court has the discretion to exercise supplemental jurisdiction. Supplemental jurisdiction allows a federal court to hear a state claim that is related to a valid pending claim in the federal court even though independently that claim could not enter the federal court house so long as the state claim against a D derives from a common nucleus of operative facts. To determine whether or not a court has jurisdiction over a federal question claim, the court relies on the well pleaded complaint rule. Under the WELL PLEADED COMAPLAINT RULE, federal courts look exclusively to the plaintiff’s complaint and will not consider that a defendant may raise a federal statute as a defense or that the D will assert a related counterclaim involving federal issues. To determine whether or not jurisdiction exists under a diversity of jurisdiction claim, both plaintiff and defendant must be completely diverse and the cause of action must exceed 75,000.00.

Plaintiffs filed these cases claiming personal injury due to asbestos exposure in Texas state court in 1995. The cases were subsequently removed on the basis of federal enclave jurisdiction and federal officer jurisdiction and transferred to the Eastern District of Pennsylvania In August 2009, the Court ordered a severed group, which had been consolidated under lead Plaintiff Douglas King (“The King Group”), to submit a discovery plan. In October 2009, Defendant AMF filed a Motion to Stay, or alternatively, Dismiss Plaintiff’s Claim for failure to comply with T EX . CIV . PRAC . & REM . CODE ANN . § 90.003 (Vernon 2005) “Chapter 90” in each case in the King group. 1 Of a group originally numbering over 800 plaintiffs, counsel has elected to pursue 86 individual cases. The instant motion applies to all 86 cases and is presently ripe for adjudication. When the integrated firm's loss from fair-trading qua manufac- turer is exceeded by its gain from wholesaling its own and other fair-traded goods qua wholesaler, this will tip the scales of its over-all interest in favor of resale price maintenance. In such a case the economic interest of an inte- grated manufacturer is not that of a non-integrated one but that of a whole- saler, and it can be said to be "acting as a wholesaler." Accordingly, its resale price-maintenance contracts should not qualify for immunity under Miller- Tydings. Because the integrated firm's balance of interests will at least occasionally be that of wholesaler, and because it is impractical to require a court to weigh nicely the respective gains and losses from resale price maintenance to determine when that condition exists, where the wholesaling facilities of an integrated manufacturer sell competing brands this should be sufficient justi- fication for regarding it as a wholesaler and condemning its participation in resale price maintenance.59 Since the McKesson & Robbins wholesale division purchased and resold competing brands the result reached by the court is consistent with the foregoing analysis. But upon that analysis it is equally clear that despite its broad language the McKesson case ought not to be taken to condemn resale price maintenance by a firm which "compete[s]" 0 with those with whom it contracts only by performing similar functions solely with respect to its own manufactured products. Finally, the autonomous nature of the McKesson manufacturing division, and the care taken to assure that the price-maintenance contracts were negotiated and executed exclusive- ly by that division0 ' suggests that the decision is not to be avoided by a separate incorporation of the integrated facilities.
