NOTICE OF MAKING

BROXTOWE BOROUGH COUNCIL (CONSOLIDATED) CIVIL ENFORCEMENT OFF- STREET PARKING PLACES ORDER 2020

Notice is hereby given that on the 31st of January 2020 Broxtowe Borough Council made and formally sealed the above Order (“the Order”) under its powers contained in the Road Traffic Regulation Act 1984 as amended and under the Traffic Management Act 2004 as amended and all other enabling powers.

The Order relates to existing off-street parking places provided by the Council at the locations listed in the Schedule of Parking Places and Charges below and is intended to come into operation on Monday 16 March 2020 (or as soon as possible thereafter).

The Civil Enforcement of Parking Contraventions (County of ) Designation Order 2008 brought civil parking enforcement into force in the relevant areas of the County of , including the Borough of Broxtowe, on 12 May 2008.

The Order restricts use of the parking place covered by this Order to vehicles of a specified class parked in such positions, on such days, during such times and for such periods as specified at each parking place; and prohibited parking in bays marked for use by disabled persons unless the vehicle is displaying a valid Disabled Persons Badge and currently set time clock.

The Notice of Proposal to make the Order was published on site at each parking place and in the Nottingham Post on 18th November 2019. The effect of the Order is as shown in that Notice of Proposal, with no amendments.

Proposed Penalty Charges

£70 (£35 where paid For contraventions in relation to parking in loading areas; within 14 days; £105 designated disabled persons bays; a restricted area; a permit bay if paid after service or a bay not designated for that class of vehicle; for using a of charge certificate) vehicle in connection with the sale of goods; and for causing an obstruction. For parking in a permit bay without clearly displaying a valid permit.

£50 (£25 where paid For parking for longer than the maximum period allowed; parking within 14 days; £75 if beyond the bay markings; returning to the same parking place on paid after service of the same day within the specified period; parking when the charge certificate) parking place is closed; parking for a purpose other than that permitted; parking with the engine running where prohibited. For contraventions related to parking charges, including: parking without payment of the parking charge; parking after expiry of the paid time; parking without clear display of the relevant ticket(s), voucher or parking clock; and parking without additional payment(s) to extend the parking stay.

Any person wishing to question the validity of the Order (which was made on 31st January 2020) or any of the provisions contained in it on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984, as amended or on the grounds that any requirement of that Act or any instrument made under it, has not been complied with in relation to the Order may, within six weeks from 31st January 2020, apply to the High Court for this purpose.

Documents giving more detailed particulars of the Order are available for inspection on Monday to Thursday between the hours of 08:45 and 16:45 and on Fridays between the hours of 08:45 and 16:15 at the Council Offices, Foster Avenue, Beeston, Nottingham NG9 1AB or at the Council’s website.
