    Agenda Item * For publication Bedford Borough Council – off Agenda approval October 2013 Report by the Portfolio Holder for Education and the Executive Director for Children’s Services, Schools and Families Subject: ACCEPTANCE OF GRANT TO IMPLEMENT THE CHILDREN AND FAMILIES BILL 1. Executive Summary This report relates to implementation of the Children and Families Bill (2013) which is expected to become the Children and Families Act in September 2014. The Bill changes the statutory framework in relation to Children with Special Educational Needs (SEN). The Council will have a duty to develop and implement the new legislation for more than 700 young people with Statements of SEN in a significantly changed way. The new approach is called the Education Health and Care Plan (EHCP) often referred to as the ‘single plan.’ The Local Authority will have a duty to publish a local offer, embed joint commissioning, offer personalised budgets, develop a key worker role and develop a new statementing process. In addition, the new legislation brings together two statutory frameworks for pre and post 16 and the Borough will therefore have to extend its responsibilities to assessing and monitoring Education, Health and Care Plans (EHCP) for young people in education and training up to 25 years (Appendix A) The implementation of the single plan will inform key judgements made by Ofsted. It is critical that the council utilises this funding stream to deliver the change required. 2. Recommendations 2.1 The Mayor is requested to consider the report and, if satisfied, approve acceptance of the Grant which will provide capacity to prepare and deliver our new legal obligations.

    Appendix A Sevenoaks District Local Development Framework The Future of Sevenoaks District Local Plan Policies beyond September 2007 The Sevenoaks District Local Plan was adopted in March 2000. All the policies in the Sevenoaks District Local Plan were saved for a period of three years from the commencement of the Planning and Compulsory Purchase Act on 28th September 2004 until 27th September 2007. No Local Plan policies will be replaced by policies in the Core Strategy or other new Development Plan Documents before 27th September 2007. The Department of Communities and Local Government (DCLG) issued a protocol for saving adopted Local Plan policies beyond the initial three-year saved period in August 2006. It sets out the criteria that Local Plan policies must meet if they are to have their life extended beyond September 2007. The Council must submit a list of all those Local Plan policies that it wishes to extend and those it does not wish to save, with reasons, to the Secretary of State, through the Government Office for the South East (GOSE), by 1st April 2007. The following two tables list all the Sevenoaks District Local Plan policies. The first table lists those saved Sevenoaks District Local Plan policies that the Council wishes to continue to use beyond September 2007, together with reasons. The second table lists those saved Local Plan policies that the Council does not wish to save beyond September 2007 with reasons. At present the New Barn residential area is split between Dartford Borough, Sevenoaks District and Gravesham Borough; the part situated in Dartford is in the parish of ^outhfleet; the part in Sevenoaks is in the parish of Longfield, whilst the part in Gravesham is unparished. On 30 November 1979» Gravesham Borough Council requested ue to review the boundaries between the districts of Gravesham, Dartford and Sevenoaks in the vicinity of New Barn. Their request was in response to representations from the New Barn Ratepayers Association for the whole of the New Barn residential area to be incorporated within Gravesham Borough. The Association based their representations on a survey of opinion which they carried out in 1978 among the residents of New Barn on the question of whether the area should be under one authority, and if so, which one. The results indicated that a majority (8?#) of residents indicating a view preferred to see New Barn under one authority and a large proportion (6990 of these considered that this should be Gravesham. 2. We noted that Kent County Council, Dartford Borough Council, Sevenoaks District Council, and Longfield Parish Council were all opposed to a review beinp undertaken at that time, although Kent County Council and Dartford BOrough Council did a^ree that the current boundaries in the New Barn area were not wholly satisfactory.

Budget and Policy Framework 1.1 Medway Council does not have a stated policy position on Sub-National Transport Bodies. It is possible, however, to align the principles behind its creation with the Council’s priority of maximising regeneration and economic growth. 2. Background 2.1 Transport for the South East (TfSE) formed as a shadow Sub-National Transport Body (STB) in June 2017, and brings together sixteen local transport authorities: Bracknell Forest, Brighton and Hove, East Sussex, Hampshire, Isle of Wight, Medway, Kent, Portsmouth, Reading, Slough, Southampton, Surrey, West Berkshire, West Sussex, Windsor and Maidenhead and Wokingham. The Shadow Partnership Board also includes arrangements for involving five Local Enterprise Partnerships in its governance process, along with two National Park Authorities, forty-four Boroughs and Districts in East Sussex, Hampshire, Kent, Surrey and West Sussex, and representatives from the transport industry. 2.2 TfSE’s aim, as set out in its vision statement, is to grow the South East’s economy by delivering a safe, sustainable, and integrated transport system that makes the South East area more productive and competitive, improves the quality of life for all residents, and protects and enhances its natural and built environment.

Executive Summary 1.1 The (Licensing Act 2003) Licensing Committee has followed an agreed programme for the preparation of the Council’s Statement of Gambling Licensing Principles for 2016-19 and considered the responses received from consultees. The Mayor is invited to note that the consultation stage of the preparation is now complete and is also asked to consider the responses received during the two phases of that consultation and to recommend the next Statement of Gambling Licensing Principles to Full Council. 1.2 In considering the recommendations to be made, the Mayor is required to apply the requirements of the Gambling Act 2005 and have regard to the Gambling Commission’s guidance to Councils in respect of their Statements of Gambling Licensing Principles. 1.3 The Mayor is advised that in submitting this report, the (Licensing Act 2003) Licensing Committee has itself considered the consultation responses received and the statutory requirements on the Council as Licensing Authority and unanimously endorsed the adoption of the Statement at Annex B to this report. 2.     Choosing Health in Medway The Annual Report of the Director of Public Health 2004 Medway Teaching Primary Care Trust As Chair of Medway Teaching Primary Care Trust I welcome the first Annual Health Report of our Director of Public Health, Dr Anita Sims. As part of our National Health Service, Medway PCT has two major objectives:- - to improve the health of the people of Medway, and - to reduce health inequalities in our communities If we are to achieve these objectives we need a base from which to start and an effective plan of action. This Annual Report forms the foundation on which this process is based and Dr Sims, as a member of Medway PCT’s Board, will be instrumental in guiding the continuing development of our health policies by helping us ensure that priorities are determined by reference to it. Healthy communities can only be achieved by consensus and with people and organisations working together effectively. We have achieved significant success already in this, particularly in terms of our integrated working with Medway Council. I am delighted with the support of Medway Council and the commitment of staff to this process in both organisations and look forward to the continuing development of these arrangements which are so crucial to the well-being of our community.     Accessibility across UK Local Authorities Socitm and Sitemorse collaboration – supporting BetterConnected Introduction Digital accessibility regulation is challenging to manage and is negatively impacting those for whom the rules should be assisting. Public sector bodies must deal with accessibility, against a timetable. Now with a specific timeline in relation to the public sector achieving accessibility compliance for their websites, we have summarised our Q3 / 2019 results, reporting the position across the sector. For over 10 years Sitemorse have been in partnership with Socitm, working on numerous initiatives including BetterConnected. Sept. 29th 2019 | Ver. 1.9 | Release | © Sitemorse In Summary. For the Sitemorse 2019 Q3 UK Local Government INDEX we assessed over 400 authority websites for adherence to WCAG 2.1. The INDEX was compiled 37% following some 250 million tests, checks and measures across nearly 820,000 URLs. 17% Comparing the Q3 to the Q2 results; 49 improved, 44 dropped, with the balance remaining the same. Three Local Authorities achieved a score of 10 (out of 10) for accessibility. It’s important to note that the INDEX covers the main website of each authority. The law applies to all websites operated, directly or on behalf of the authority. 46% The target score is 7.7 out of 10. • Pages passing accessibility level A: 87.11% • Pages passing accessibility level AA: 12.2% • Of the 3,550 PDF’s 56.4% PDF’s passed the accessibility tests. Score 10 - 7 Score 5 - 6 Score 1 - 4 It is important to note that this score is for automated tests; there are still manual tests that need to be performed however, a score of 10 demonstrates a thorough understanding of what needs to be done and it is highly likely that the manual tests will pass too.
