Traffic Orders Transport for London GLA 2021 No.0297 THE VARIOUS GLA ROADS AND GLA SIDE ROADS (CITIES OF LONDON AND WESTMINSTER, THE ROYAL BOROUGHS OF KENSINGTON AND CHELSEA, GREENWICH AND KINGSTON UPON THAMES AND THE LONDON BOROUGHS OF BARKING AND DAGENHAM, BARNET, BEXLEY, BRENT, BROMLEY, CAMDEN, CROYDON, EALING, ENFIELD, HACKNEY, HAMMERSMITH AND FULHAM, HARINGEY, HAVERING, HILLINGDON, HOUNSLOW, ISLINGTON, LAMBETH, LEWISHAM, MERTON, NEWHAM, REDBRIDGE, RICHMOND UPON THAMES, SOUTHWARK, SUTTON, TOWER HAMLETS, WALTHAM FOREST AND WANDSWORTH) (VARIOUS PROVISIONS AND EXEMPTIONS (ELECTRIC SCOOTER TRIAL)) EXPERIMENTAL TRAFFIC ORDER 2021 Made 27th June 2021 Coming into force 7th June 2021 Transport for London for the purposes of the Traffic Signs Regulations and General Directions 2016 as amended and in exercise of the powers conferred by section 9 and 10(2) of the Road Traffic Regulation Act 1984a as amended, and all other enabling powers, hereby makes the following Order:- 1. Commencement and citation This Order may be cited as The Various GLA Roads and GLA Side Roads (Cities of London and Westminster, The Royal Boroughs of Kensington and Chelsea, Greenwich and Kingston Upon Thames and The London Boroughs of Barking and Dagenham, Barnet, Bexley, Brent, Bromley, Camden, Croydon, Ealing, Enfield, Hackney, Hammersmith and Fulham, Haringey, Havering, Hillingdon, Hounslow, Islington, Lambeth, Lewisham, Merton, Newham, Redbridge. Richmond Upon Thames, Southwark, Sutton, Tower Hamlets, Waltham Forest and Wandsworth) (Various Provisions and Exemptions (Electric Scooter Trial)) Experimental Traffic Order 2021, and shall come into force on 7th June 2021. a 1984 c 27 GLA/2021/0297 2. Interpretation (1) In this Order- (a) a reference to an Article or a Schedule followed by a number is a reference to the Article of, or Schedule to, this Order so numbered; (b) “carriageway” has the same meaning as in section 329(1) of the Highways Act 1980a as amended; (c) “cycle lane” has the same meaning as in schedule 1 of the Traffic Signs Regulations and General Directions 2016b as amended; (d) “cycle track” has the same meaning as in section 329(1) of the Highways Act 1980 as amended; (e) “electric scooter” has the same meaning as in schedule 1 of the Traffic Signs Regulations and General Directions 2016 as amended; (f) “footway” has the same meaning as in section 329(1) of the Highways Act 1980 as amended; (g) “GLA road” and “GLA side road” have the same meaning as in the Road Traffic Regulation Act 1984 as amended; (h) “pedal cycle” has the same meaning as in schedule 1 of the Traffic Signs Regulations and General Directions 2016 as amended; (i) “Transport for London Road Network” means the road network comprising all roads designated as GLA roads and GLA side roads; (j) “trial” has the same meaning as in schedule 1 of the Traffic Signs Regulations and General Directions 2016 as amended; (k) “vehicle” includes part of a vehicle. (2) The Interpretation Act 1978c applies to this order as if it were an enactment to which that Act applies. 3. Controls (1) The cycle tracks listed in schedule 1 of this Order (made pursuant to section 65 of the Highways Act 1980) are re-designated as restricted carriageway where electric scooters being used in a trial and pedal cycles only have right of way. (2) The shared use areas cycle tracks listed in schedule 2 of this Order (made pursuant to section 65 of the Highways Act 1980) are re-designated as areas of restricted carriageway where electric scooters being used in a trial, pedestrians and pedal cycles only have equal right of way. (3) The traffic Orders listed in schedule 3 of this Order (stating which areas of carriageway are cycle lanes) shall after every instance in which the words “Except as provided in Article 4 no person shall cause any vehicle other than” appear in Article 3 (Cycle Lane Controls) include the following words “an electric scooter being used in a trial (within the meaning set out in schedule 1 of the Traffic Signs Regulations and General Directions 2016 as amended) or”. a 1980 c 66 b SI 2016/0362 c 1978 c.30 GLA/2021/0297 (4) The areas of footway listed in schedule 4 of this Order are areas of footway where the parking of electric scooters being used in a trial is permitted. 4. Exemptions (1) The controls specified in Article 3 do not apply in respect of a vehicle being in the restricted carriageway described in that Article if the vehicle is being used:- (a) in connection with the removal of any obstruction to traffic; (b) in connection with the maintenance, improvement or reconstruction of any road; (c) in connection with the maintenance, improvement or reconstruction of any street furniture including bus stop infrastructure; (d) in connection with the cleaning, removal of ice, snow or any impediment to traffic in any restricted carriageway; (e) in connection with the laying, erection, alteration or repair in or near the restricted carriageway of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunications apparatus as defined in paragraph 1(1) of Schedule 2 of the Telecommunications Act 1984a; if the vehicle cannot be used for that purpose without being in a restricted carriageway. (2) The controls specified in Article 3 do not apply to the restricted carriageway described in that Article in respect of:- (a) a vehicle being used for fire brigade, ambulance or police purposes if the observance of the controls would hinder the use of the vehicle; (b) a vehicle being used by a person or persons authorised by Transport for London 5. Power to modify or suspend this Order In pursuance of section 10(2) of the Road Traffic Regulation Act 1984, a person authorised by Transport for London may, if it appears to that person essential in the interests of the expeditious, convenient and safe movement of traffic, or of the provision of suitable and adequate parking facilities on the highway, or for the preserving or improving the amenities of the area through which any road affected by this Order runs, and after consulting with the Commissioner of Police of the Metropolis, modify or suspend any provision of this Order, save that no modification shall make an addition to this Order. 6. Conditions and power to suspend restricted carriageways. (1) Transport for London may from time to time suspend the use of any section of restricted carriageway. 7. Suspension of existing orders (1) The Notices and Orders listed in schedules 1 to 3 of this Order are each hereby suspended, in so far as their provisions relate to any length of road specified in the schedules to this Order. a 1984 c.12 GLA/2021/0297 The suspensions specified in paragraph (1) of this article shall take effect from the day this Order comes into force Dated this 27th day of June 2021 Glynn Barton Director of Network Management Transport for London EXPLANATORY NOTE (This note is not part of the Order) This Order is made to enable a trial of electric scooters in the relevant parts of London to use certain GLA roads, GLA side roads and associated cycle infrastructure provide a potentially green and sustainable alternative to private car and capacity restrained public transport to support coronavirus pandemic restart and recovery work and collect evidence about any infrastructure changes or safety interventions that would be necessary on the Transport for London Road Network in connection with any possible legalisation enabling the wider use of electric scooters on the highway. Electric scooters owned by individuals are not permitted to be used on the Transport for London Road Network. Electric scooters will only be permitted to be used on GLA roads, GLA side roads and associated cycle infrastructure within London Boroughs where an arrangement has been made between the relevant London Borough, Transport for London and a person who hires out electric scooters. Details of such arrangements and the dates on which electric scooters may be used in the trial within those London Boroughs can be found at www.tfl.gov.uk/electricscooters .     London Cycling Campaign 15 March 2016 Paddington to Wood Lane via Westway overall The London Cycling Campaign is the capital’s leading cycling organisation with more than 12,000 members and 40,000 supporters. We welcome the opportunity to comment on these plans and our response was developed with input from the co-chairs of our Infrastructure Review Group and our local groups the Westminster Cycling Campaign, Kensington & Chelsea Cycling Campaign, Ealing Cycling Campaign, HF Cyclists, and in support of their consultation responses. On balance, we support this scheme. We have serious reservations about the choice to use the Westway. A route that took in surface streets would likely be superior – with more opportunities for cyclists to enter and exit the Cycle Superhighway where they chose (possibly the planned CS9?). But we recognise that due to the intransigence of some London councils, such a scheme is currently unlikely to move forward, unfortunately. The London Cycling Campaign would also like to see all schemes given a CLoS rating (as well as adhering to the latest London Cycle Design Standards) that demonstrates significant improvement from the current layout will be achieved for cycling, and that eliminates all “critical fails” in any proposed design before being funded for construction, let alone public consultation. Section 1 - Westbourne Terrace We have serious concerns about hook risks at the junctions here. Particularly designs such as the Cleveland Terrace junction look set to put cyclists and left-turning traffic in direct conflict. This is not acceptable – and a redesign of these junctions to favour safety over motor vehicle capacity has to be a priority.
