This proclamation is made under section 2 of the Wollongong Sportsground and Old Roman Catholic Cemetery Legislation Amendment (Transfer of Land) Act 2001. ge 2 Page 2 NEW SOUTH WALES GOVERNMENT GAZETTE No. 19 88 LEGISLATION 11 January 2002 Regulations Gaming Machines (Savings and Transitional) Regulation 2002 under the Gaming Machines Act 2001 His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Gaming Machines Act 2001. RICHARD FACE, M.P., Minister forfor Gaming Gaming and and Racing Racing Explanatory note Section 44 of the Gaming Machines Act 2001 prohibits the display of gambling- related signs in relation to hotels and clubs and is to commence before the rest of that Act commences. In order to enable the section to have effect from its commencement, this Regulation provides for certain references in that section to be construed in accordance with existing terminology under the Liquor Act 1982 and the Registered Clubs Act 1976. This Regulation comprises or relates to matters of a savings or transitional nature. This Regulation is made under the Gaming Machines Act 2001, including clause 1 of Schedule 1. r01-432-p02.835 Page 1 NEW SOUTH WALES GOVERNMENT GAZETTE No. 19 11 January 2002 LEGISLATION 89 Clause 1 Gaming Machines (Savings and Transitional) Regulation 2002 Gaming Machines (Savings and Transitional) Regulation 2002 1 Name of Regulation This Regulation is the Gaming Machines (Savings and Transitional) Regulation 2002. 2 Commencement This Regulation commences on 11 January 2002. 3 Definition In this Regulation: the Act means the Gaming Machines Act 2001. 4 Construction of certain references (1) A reference in section 44 of the Act: (a) to an approved gaming machine in a hotel is taken to be a reference to an approved gaming device within the meaning of the Liquor Act 1982, and (b) to an approved gaming machine in a registered club is taken to be a reference to an approved gaming device within the meaning of the Registered Clubs Act 1976, and (c) to a hotelier or a hotel is a reference to a hotelier or a hotel within the meaning of the Liquor Act 1982, and (d) to a registered club is a reference to a registered club within the meaning of the Registered Clubs Act 1976. (2) This clause ceases to have effect on the commencement of section 4 of the Act. JOHN DELLA BOSCA, M.L.C., Special MinisterMinister of of State State Explanatory note The object of this Regulation is to amend Schedule 2 to the Occupational Health and Safety Regulation 2001 to prescribe additional offences in respect of which penalty notices may be served and to correct an incorrect cross-reference. In particular, the Regulation provides that a penalty notice may be served: (a) on an employer for an offence of failing to ensure the health, safety or welfare at work of the employer’s employees, and (b) on an employer for an offence of failing to ensure the health or safety of persons other than employees while they are at the employer’s place of work, and (c) on a self-employed person for an offence of failing to ensure the health or safety of persons other than employees while they are at the self-employed person’s place of work.     M MacDuffs Hill Another name for Aston Hill at West Port - applied when it was in the ownership of Robert MacDuff. Machins Forest Forest road between Cells River and Ellenborough Falls. Road Mackay Street Wauchope. Eric Mackay was a surveyor (1929). Mackellar A road at Stirling Green, Sovereign Hills, Port Macquarie. Probably named for Sir Charles Kinnaird Mackellar (1844-1926), physician, politician and businessman, who was born on 5 December 1844 in Sydney. Educated at Sydney Grammar School, Charles moved with his family to the Port Macquarie district about 1860. He spent several years on the land before proceeding to Scotland to attend the University of Glasgow (M.B., Ch.M., 1871). Returning to Sydney he registered with the Medical Board of New South Wales on 25 March 1872. He died at his residence, Rosemont, Woollahra, on 14 July 1926 and was buried in the Anglican section of Waverley cemetery. His daughter Dorothea wrote the well-known poem ‘My Country’.
