Jochen Otto 1 Wir haben uns zum Ziel gesetzt, jahrhundertealtes Wissen zu erhalten und zugänglich zu machen. Viele bedeutende juristische Werke des 15. - 19. Jahrhunderts sind kaum mehr zugänglich und o schon so beschädigt, dass sie nicht mehr leserlich sind. Es kursieren schlechte Kopien, die als Vorlage für ein ernsthaes Arbeiten am Text völlig ungeeignet sind. Wir haben uns daran gemacht, diese Werke einzuscannen und in mü- hevoller Kleinarbeit nachzubearbeiten, so dass sie als gut leserlicher Reprint zur Verfügung stehen. Bei älteren Werken kommt es o vor, dass durch Abrieb oder Wurm- frass Textstellen ergänzt werden müssen, hier haben wir keine Mühe gescheut, den Text so wiederherszustellen, dass er sich völlig ins Schribild eingliedert. Otherwise we have to take bank charges of € 10,-. 3 IUS COMMUNE – PUBLISHING PROJECT - Introduction The Ius Commune programme covers a period of more than 700 years - bounded by the founding of the School of Bologna in the late 11th century and the advent of national codifications in the 19th century - during which private law developed in Europe. The Ius Commune, and European private law, was built upon prevailing doctrines or opinio communis doctorum. and as such was never introduced anywhere to the exclusion of all other laws. It competed, above all in Germany, with particular legal sources and also local laws. The validity of the Ius Commune may well have been subsidiary, but it proved nonetheless to be very assertive in the long run thanks to its high learned standards. Municipal and state law became ever more Romanized under its influence and over time the system of particular laws was greatly coloured by it: in that way the Ius Commune was effective throughout Europe. The learned discourse within the Ius Commune, which had its beginnings in Italy, and then in southern France and England, was to spread the length and breadth of Europe. The legal sources, the legal literature through to the collections of decisions and concilia were read, discussed and included in academic discourse everywhere in Europe. Accordingly, the important legal literature was also very widely published and printed. The Ius Commune was for centuries a European private law and was one of the currents, perhaps a high-water mark, that led to the national codifications within Europe. The French code civil of 1804, the Austrian ABGB of 1811, not to mention the German Civil Code of 1900, in effect embodied the fruits of the Ius Commune in their sections and paragraphs and thus enabled this great juridical, but also cultural, work which with Helmut Coing we generally call the Ius Commune, to live on. 4 IUS COMMUNE – VERLAGSPROJEKT - Einleitung Das Verlagsprogramm Ius Commune umspannt den Zeitraum von mehr als 700 Jahren. Seit der Gründung der Schule von Bologna Ende des 11. Jahrhunderts entwickelte sich ein Europäisches Privatrecht bis zum Aufkommen der nationalen Kodifikationen im 19. Jahrhundert. Das Ius Commune ist nirgends als Gesetz in der Weise eingeführt worden, dass es ausschließliche Geltung erlangte. Maßgebend für das Ius Commune und damit für das Europäische Privatrecht war die herrschende Lehre, die sogenannte opinio communis doctorum. Daneben hatten vor allem in Deutschland partikulare Rechtsquellen und auch lokale Regelungen Gültigkeit. Die Geltung des Ius Commune war zwar subsidiär, aber auf Dauer gesehen aufgrund seines hohen wissenschaftlichen Standards sehr durchsetzungsfähig. Stadt- und Landrechte wurden mehr und mehr romanisiert. Der partikulare Rechtskreis veränderte sich unter dem Einfluss des Ius Commune: dies hatte in ganz Europa Gültigkeit. Der wissenschaftliche Diskurs innerhalb des Ius Commune, der zunächst seinen Anfang in Italien, dann Südfrankreich und England fand, verbreitete sich schließlich über ganz Europa. Die Rechtsquellen, die Rechtsliteratur bis hin zu den Entscheidungssammlungen und Konsilienbände wurden europaweit gelesen, diskutiert und in den wissenschaftlichen Diskurs eingebaut. Entsprechend wurde die wichtigste Rechtsliteratur europaweit verlegt und gedruckt. Das Ius Commune war über Jahrhunderte ein Europäisches Privatrecht. Dieses Ius Commune mündete als Abschluss, vielleicht auch als Höhepunkt in die nationalen Kodifikationen Europas. Der Code civil von 1804, das ABGB von Österreich 1811 oder gar das deutsche BGB von 1900 fassen im Kern die Ergebnisse des Ius Commune in Paragraphen zusammen und damit lebt dieses große juristische, aber auch kulturelle Werk, das wir mit Helmut Coing allgemein Ius Commune nennen, weiter fort. 5 Having a selection of the key legal literature from the Ius Commune era is essential for conducting research into the history of European law and as the basis for a suitably equipped specialist libraries. The legal literature published over the course of the 700 years of the Ius Commune no doubt run to hundreds of thousands of works. The unavoidable question as to the correct selection is flanked by the present market development. On the one hand, purchasing original legal literature soon exhausts the budget of any university or faculty due to the ever rising prices. On the other hand, the selection of works offered for sale in the field Ius Commune is always small, so that it may not even be possible to build up a sound pool of works within a reasonable period of time. The most important source worldwide for Ius Commune research is the colossal „Handbuch der Quellen und Literatur der Neueren Europäischen Privatrechtsgeschichte” [Manual of Sources and Literature of the Modern European Private Law History] edited by the first director of the Max Planck Institute for European Legal History, Professor Dr. Helmut Coing (1912-2000). University of Keele June 2015 ii iii Abstract This thesis is in three parts: 1) a kinematical study of exoplanet host stars, 2) a study of the detached eclipsing binary V1094 Tau and 3) and observations of other eclipsing binaries. Part I investigates kinematical biases between two methods of detecting exoplanets; the ground based transit and radial velocity methods. Distances of the host stars from each method lie in almost non-overlapping groups. Samples of host stars from each group are selected. They are compared by means of matching comparison samples of stars not known to have exoplanets. The detection methods are found to introduce a negligible bias into the metallicities of the host stars but the ground based transit method introduces a median age bias of about -2 Gyr.

For the often-studied “SMR” giant µ Leo, Smith & Ruck (2000) have recently found that [Fe/H] ∼ +0.3 dex. Their conclusion is tested here in a “statistical” paradigm, in which statistical principles are used to select published high-dispersion µ Leo data and assign error bars to them. When data from Smith & Ruck and from Takeda et al. (1998) are added to a data base compiled in 1999, it is found that conclusions from an earlier analysis (Taylor 1999c) are essentially unchanged: the mean value of [Fe/H] ∼ +0.23 0.025 dex, and values ≤+0.2 dex are not clearly ruled out at 95% confidence. In addition, the hypothesis that [Fe/H] ≥ +0.3dexwhich emerges from the Smith-Ruck analysis is formally rejected at 98% confidence. The “default paradigm” which is commonly used to assess µ Leo data is also considered. The basic characteristics of that paradigm continue to be a) unexplained exclusion of statistical analysis, b) inadequately explained deletions from an [Fe/H] data base containing accordant data, and c) an undefended convention that µ Leo is to have a metallicity of about +0.3dex or higher. As a result, it seems fair to describe the Smith-Ruck application and other applications of the default paradigm as invalid methods of inference from the data.

Mass- luminosity relation for K, M and G class stars Edgars Alksnis [email protected] Small volume statistics show, that luminosity of slow rotating stars is proportional to their angular momentums of rotation. Cause should be outside of standard solar model. Slow rotating giants and dim dwarfs are not out of „main sequence” in this concept. Predictive power of stellar mass-radius- equatorial rotation speed-luminosity relation has been offered to test in numerous examples. Keywords: mass-luminosity relation, stellar rotation, stellar mass prediction, stellar rotation prediction ...Such vibrations would proceed from deep inside the sun. They are a fast way of transporting large amounts of energy from the interior to the surface that is not envisioned in present theory.... They could stir up the material inside the sun, which current theory tends to see as well layered, and that could affect the fusion dynamics. If they come to be generally accepted, they will require a reworking of solar theory, and that carries in its train a reworking of stellar theory generally. These vibrations could reverberate throughout astronomy. (Science News, Vol. 115, April 21, 1979, p. 270).
