Jirga: a Conflict Resolution Institution in Pukhtoon Society JIRGA: A CONFLICT RESOLUTION INSTITUTION IN PUKHTOON SOCIETY 1Fakhr-ul-Islam, 2Khan Faqir & Malik Amer Atta3 1Pakistan Study Centre, University of Peshawar, Pakistan 2University of Science and Technology Bannu, Pakistan 3Institute of Education and Research, Gomal University, D.I.Khan ABSTRACT Jirga is a unique institution that exists in Pukhtoons social organization. It is a Pashtu word which means circle. (Gankoski and Malik, 2006). It is difficult to trace exact origin of Jirga. Nevertheless, it is as old as the community itself. In this paper the writer has dwelt upon origin and evolution of Jirga. How did Afghanistan and Pakistan adopt and accommodate the concept of Jirga as state institution has also been taken into consideration. Apart from consulting published material, the writer reached out to a number of people belonging to FATA (Federally Administered tribal Areas) and settled districts of Khyber Pakhtoonkhwa province of Pakistan for ascertaining their views on the subject. In this way, the paper contains up-to-date information and communal critique rather than review by a single writer. Key Word: Jirga, Pukhtoons, Tribe(s), disputes, verdict. INTRODUCTION off and on. A sample of 12 respondents was taken through convenience sampling method. In-depth interview was used as a tool for the collection of data from the respondents. The results show that Jirga is deep rooted in Pashtun society. People cannot go to courts for the solution of every problem and put their issues before Jirga. Jirga in these days is not a free institution and cannot enjoy its power as it used to be in the past. The majorities of Jirgaees (Jirga members) are illiterate, cannot probe the cases well, cannot enjoy their free status as well as take bribes and give their decisions in favour of wealthy or influential party. The decisions of Jirgas are not fully based on justice, as in many cases it violates the human rights. Most disadvantageous people like women and minorities are not given representation in Jirga. The modern days legal justice system or courts are exerting pressure on Jirga and declare it as illegal.

    Honour Killing in Sindh Men's and Women's Divergent Accounts Shahnaz Begum Laghari PhD University of York Women’s Studies March 2016 Abstract The aim of this project is to investigate the phenomenon of honour-related violence, the most extreme form of which is honour killing. The research was conducted in Sindh (one of the four provinces of Pakistan). The main research question is, ‘Are these killings for honour?’ This study was inspired by a need to investigate whether the practice of honour killing in Sindh is still guided by the norm of honour or whether other elements have come to the fore. It is comprised of the experiences of those involved in honour killings through informal, semi- structured, open-ended, in-depth interviews, conducted under the framework of the qualitative method. The aim of my thesis is to apply a feminist perspective in interpreting the data to explore the tradition of honour killing and to let the versions of the affected people be heard. In my research, the women who are accused as karis, having very little redress, are uncertain about their lives; they speak and reveal the motives behind the allegations and killings in the name of honour. The male killers, whom I met inside and outside the jails, justify their act of killing in the name of honour, culture, tradition and religion. Drawing upon interviews with thirteen women and thirteen men, I explore and interpret the data to reveal their childhood, educational, financial and social conditions and the impacts of these on their lives, thoughts and actions.

ISSN 1567-214x. Keywords: Jirga system, dispute resolution, informal justice, integration. Abstract: Jirga is an informal but exclusive institution existing in Pashtun society. Jirga is commonly used for settling the disputes related to both the private and the public space. It is preferred over the formal courts, as jirga is considered to be more effective and quicker dispute resolving body. The main intention for the research was to investigate the position of jirga in conflict resolution. The conceptual framework based on jirga considering it as a speedy process of decision making and a body of social integration, was independent variable while dependent variable was effectiveness of jirga as a dispute resolution body. The data wascollected by scheduled interviews, from five villages- LundKhwar, Gul Maira, Mote Banda, ShahDend and Sadat baba. These villages were purposively selected from district Mardan. The sample size was 357 households, selected through stratified random sampling on the analogy design by the Sekaran (2003). The findings of the research indicatethat Jirga is an effective body in delivering justice.
