Kulti, Dist.- Burdwan AND WHEREAS, during inspections by officials of the West Bengal Pollution Control Board (hereinafter referred to as the Board) all the above mentioned eight (08) industries were found to be operating without installing any air pollution control system. Subsequently several show-cause notices were issued by the Asansol Sub-Regional Office directing the industries to install emission control system for the down draft kilns but the industries failed to comply with the Board’s direction. AND WHEREAS, it is seen from the records kept and maintained by the Board that none of the industries possess any valid Consent to Operate of the Board. AND WHEREAS, a hearing was arranged at the Kankinara Circle Office of the Board on 26/07/2010 for the above non-compliance with prior intimation to the industries to remain present during the hearing. But the industries did not turn up for the hearing or provide any intimation regarding their non-appearance. AND WHEREAS, the industries were again called for another technical hearing at the Head Office of the Board on 25/11/2010. But among the eight (08) industries called for hearing, only M/s. Pasupati Bengal Refractories Pvt. Ltd. appeared. None appeared in the hearing on behalf of the other seven (07) industries despite prior intimation. Also, the Director of M/s. Pasupati Bengal Refractories Pvt. Ltd. could not submit any proper explanation for non-installation of emission control system or the non-compliance of directions issued by the Board. NOW THEREFORE, considering the fact that the industries are being operated without Consent to Operate of the Board, without installing any emission control system and also in total disregard of the Board’s directions, all the above eight (08) fire brick manufacturing industries are hereby closed by the Board with immediate effect. The electricity connection of the industries is directed to be disconnected forthwith. The Director (HR), WBSEDCL is requested to take necessary steps to disconnect the electricity connection of the six (06) industries mentioned in Sl Nos. 1 and 3–7 above immediately. The Senior Additional Chief Engineer, DPSC Ltd. is requested to take necessary steps to disconnect the electricity connection of the two (02) industries mentioned in Sl Nos. 2 and 8 above immediately. The Closure Order against the aforementioned eight (08) industries shall take immediate effect. The Officer-in-Charge, Asansol Police Station, Dt. Burdwan under West Bengal Police is directed to execute the Closure Order against the aforementioned two (02) industries (Sl. Nos. 1 & 2) and submit the compliance report to the State Board within seven (07) days from the receipt of this Memo. The Officer-in-Charge, Raniganj Police Station, Dt. Burdwan under West Bengal Police is directed to execute the Closure Order against the aforementioned industry (Sl. No. 3) and submit the compliance report to the State Board within seven (07) days from the receipt of this Memo. The Officer-in-Charge, Salanpur Police Station, Dt. Burdwan under West Bengal Police is directed to execute the Closure Order against the aforementioned industry (Sl. No. 4) and submit the compliance report to the State Board within seven (07) days from the receipt of this Memo. The Officer-in-Charge, Kulti Police Station, Dt. Burdwan under West Bengal Police is directed to execute the Closure Order against the aforementioned four (04) industries (Sl. Nos. 5–8) and submit the compliance report to the State Board within seven (07) days from the receipt of this Memo. This direction has been issued to the Officer-in-Charge, Asansol Police Station, Officer-in-Charge, Raniganj Police Station, Officer-in-Charge, Salanpur Police Station and the Officer-in-Charge, Kulti Police Station in conformity with the order of the Hon’ble High Court, Calcutta dated 21/08/1998. This direction has been issued to the Director (HR), WBSEDCL, Bidyut Bhawan, Kolkata and the Senior Additional Chief Engineer, DPSC Ltd. in conformity with the order of the Hon’ble High Court, Calcutta dated 28/04/1999 respectively. The Asst. Environmental Engineer & Incharge, Asansol Sub-Regional Office of the State Board is requested to take necessary steps for proper execution of the order for closure and disconnection of electricity of the eight (08) industries and visit the industries involving the local police station and Nodal Police Officer of the concerned district. This direction is issued in exercise of the powers conferred under the Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder after being approved by the Competent Authority.
