KUCHING: The Sarawak government will continue being inclusive in its policies, in a way that is not just seen, but also felt by the people in the state. Sarawak Deputy Chief Minister Douglas Uggah Embas said inclusivity and power sharing have been a decades-long practice of the state’s largest Barisan Nasional (BN) component, Parti Pesaka Bumiputera Bersatu (PBB). “PBB has managed to lead the government in Sarawak for a very long time, because of power sharing. “Of course there are times when things seemed to be very challenging, but we are always open for discussion, to make sure that we are not leaving anybody behind. “We are inclusive in our policies which are not only seen, but also felt by the people,” the PBB acting deputy president said in an exclusive interview with FMT in Kuching last weekend. He also addressed concerns that other BN parties were being sidelined due to PBB’s dominance in the state government. This is especially so following the Pujut crisis, which saw a majority of the state legislative assembly members voting for a ministerial motion to disqualify DAP’s Pujut assemblyman Dr Ting Tiong Choon. BN component Sarawak United Peoples’ Party (SUPP) president Dr Sim Kui Hian had earlier told FMT that he and several other BN assembly members were caught “totally unprepared” by the motion brought by the state’s International Trade and E-Commerce Minister Wong Soon Koh.

As is required by the Judicial Appointments Act 2009 (Act 695), JAC has continued its effort to become a body that is truly transparent in the performance of its primary duties in the selection, appointment and promotion of judges. In an effort to strengthen its role and function, the JAC had recommended to the Government to amend section 3 of the Judicial Appointments Commission Act 2009 (Act 695) to include the appointment of a Judicial Commissioner as part of its functions. This was done by inserting the term Judicial Commissioner in the definition of a Superior Court Judge. This amendment is consistent with the requirements of subsection 1(3) of the Act which is clearly the intention of the Government when drafting this Act so that it applies also to the appointment of a Judicial Commissioner.

KUCHING: DAP is considering legal options after an unprecedented resolution was passed in the Sarawak state assembly today to disqualify its Pujut assemblyman Dr Ting Tiong Choon for acquiring Australian citizenship, which he later renounced. “We will look into the legality of it (but) to challenge the decision made in the assembly is a hurdle,” state DAP leader Chong Chieng Jen told a press conference. He was flanked by leaders from DAP and Pakatan Harapan ally, PKR. “There is a provision in the law that says proceedings of the assembly cannot be challenged. That’s what you call immunity. Whether you can get the court to decide on the constitutionality of the (disqualification) is another hurdle – you may not even get there,” he said. Dr Ting was dismissed as an elected representative under Article 17(1)(g) of the state constitution for voluntarily acquiring citizenship outside Malaysia. The motion, tabled by Second Finance Minister Wong Soon Koh, was put to a vote and secured 70 Barisan Nasional (BN) lawmakers in favour of it. All 10 opposition members voted against it. Wong said Dr Ting acquired Australian citizenship on Jan 20, 2010, and renounced it on April 4, 2016, just before the Sarawak election on May 8. Chong admitted to reporters that the court might not be able to overturn the decision of the assembly.

For, the appointment of a judge on account of political allegiance in utter disregard to the questions of his qualifications, merit, ability, competency, integrity and earlier performance as an advocate or judicial officer may bring in, to use the words of President Roosevelt, ‘Spineless Judges’ who can hardly be expected to dispense justice independently according to law and their own sense of justice without regard to the wishes and desire of the government of the day. There is a great possibility that such a judge may remain ‘indebted to those responsible for his designation ...., the beneficiary is exposed to the human temptation to repay his debt by a pliable conduct of his office’137 especially when the executive itself is a litigant. As H. J. Laski aptly said, ‘It is not necessary to suggest that there will be conscious unfairness; but it is .... possible that such judges will, particularly in cases where the liberty of the subject is concerned’, find themselves unconsciously biased through over-appreciation of executive difficulty...’138 Therefore, ‘in appointing judges, a government owes a duty to the people ..
