All matters have been taken into account in writing this report and recommendation. 1.2 The Site The application site is Abbey Hill Hotel located in the residential area of Two Mile Ash. The site is located off Monks Way and situated to the west of Central Milton Keynes. Details of the location of the site and its relationship to surrounding properties can be seen in the plans attached to this report. 1.3 The Proposal The application seeks retrospective planning permission for the erection of an open sided gazebo with timber decking on the south east corner of the site. Supplementary Planning Guidance Supplementary Planning Guidance - 'Parking Standards for Milton Keynes' 2005 and Addendum 2009. 3.0 MAIN ISSUES (The issues which have the greatest bearing on the decision) 3.1 Impact of development proposals on neighbouring amenity The residential properties on Ellesborough Grove are located nearest to the application site and proposed gazebo. It is considered that the development would have some impact on the amenities of neighbouring occupiers but it would not be so detrimental to warrant refusal of this application. Conditions are proposed to restrict the operations within the marquee to restrict noise pollution. 4.0 RECOMMENDATION (The decision that officers recommend to the Committee) 4.1 It is recommended that planning permission be granted subject to the conditions set out at the end of this report. 5.0 CONSIDERATIONS (An explanation of the main issues that have lead to the officer Recommendation) 5.1 Impact on neighbouring amenity The application site is within the grounds of the Abbey Hill Hotel building located on the south west corner of the site adjacent to the golf course. The rear gardens of the properties closest to the application site have existing closed board timber fencing to the boundary. A low level post and rail fence also exists beyond the boundary of the hotel site and Elleborough Grove. It is noted that the grounds of the golf course and hotel site remain relatively open when viewed from Elleborough Grove. 5.2 The main impact as a result of the development is considered to be the potential increase in noise and disturbance from the use of the gazebo upon the occupiers of the residential properties on Elleborough Grove. The applicant has noted that it is renewing the hotel’s wedding and alcohol licenses and intends for outdoor spaces to not be used past 23.00. It is noted that the existing terrace area and grounds are used by the hotel and the development of a gazebo could further exacerbate current issues of noise and disturbance on the site. Therefore conditions are proposed to restrict the operations within the gazebo to restrict noise pollution and it is considered that the gazebo could only operate during the hours allowed for the existing hotel. 6.0 CONDITIONS (The conditions that need to be imposed on any planning permission for this development to ensure that the development is satisfactory. To meet legal requirements all conditions must be Necessary, Relevant, Enforceable, Precise and Reasonable ) 1. Any amplified music shall be limited to existing function rooms within the existing hotel and not at all within the gazebo hereby permitted. Reason: To protect the amenities of the locality. The existing level of on-plot car parking within the site is considered to satisfy the requirement under the Council’s Parking Standards and therefore no objection is raised. A2.2 Character and Appearance The development is a light weight structure with a canvas roof and timber decking and balustrading. The structure is open-sided and therefore the visual impact of the development is not considered to be significant given that it would not appear as a solid built form. It is considered that the design and scale of the development would not result in any harm to the character and appearance of the area.
