    E-ISSN 2281-4612 Academic Journal of Interdisciplinary Studies Vol 5 No 2 ISSN 2281-3993 MCSER Publishing, Rome-Italy July 2016 Institutional Political Developments from the Assembly of Durres to the Congress of Lushnja Eldi Sherifi PhD candidate, Faculty of Law, University of Tirana Doi:10.5901/ajis.2016.v5n2p187 Abstract There are several historical studies on the Congress of Durrës and Congress of Lushnja, but in my opinion further studies should be conducted on the history of political institutions and their political organizing operators as well as their inhibitors. On July 29, 1913 the Great powers declared Albania a Hereditary and Sovereign Autonomous Principality. At the Peace Conference in 1919, Clemenceau and Lloyd defended the thesis of "inability of Albanians to Self Government" and offered the solution of sharing the governance responsibility between Yugoslavia and Italy to implement the Secret Treaty of London on 26 April 1915. The Congress of Durres was held after the conclusion of the First World War. It was led by Mehmet Konica and Myfit Libohova. Delegates elected the interim government and the delegation for representing Albania at the Peace Conference in Paris. The Congress of Lushnja came as an illuminating meteor in the dark and hopeless institutional environment. Its development destroyed the anti-Albanian political intrigues. After they toppled the government of Durres by voting against it, the congress delegates established all the powers of the state, according to the principles of Montesquieu. Through several transparent procedures they established "National Council", "Supreme Council" and the Cabinet. The evidence and acts sources of law served as the legal basis.

Its mechanisms, which have gradually developed and become more and more complex, aff ect almost every sphere of social life. As a result, the central focus of all political ideologies of modernity is exactly this state dimension, the dimension of its relationship with the society, its expansion and limitations. Thus, the process of state building in essence is one of the most complex processes that a particular society might undergo. The aim of this paper is to examine this process in the context of Kosovo society in order to identify the specifi cs and character of this process. The paper is structured in two basic parts. The fi rst part will elaborate the modern concept of the state, as well as the general concept of state-building while the second part will conduct an analysis of the historical and political context, from which the process of state formation of Kosovo has derived. The results of this paper are presented through the theoretical analysis which is based, inter alia, on the comparative method, content analysis, historical method, referring to well-known authors of the fi eld, documents and historical processes that illustrate the context and process of state formation and state building in Kosovo, having as its main goal the addressing of a particular dimension of the state, namely the dimension of its relationship with the society.

Halim Bey Gostivari is one such figure whose contribution is the object of study of our paper. By providing detailed documents and information, we aim to shed light on such a personality, whose hard work and sacrifice has been an essential support in the context of the main developments in the history of the Albanian people. we hope that the paper will be an incentive for further studies in this field. Introduction Halim Jakova - Gostivar known as the apostle of Albanianism, was born in 1878 in the street of "Gostivarëve" (The Gostivars), in the "neighborhood of Mahmut Pasha", in Gjakova.9 He was the son of Yusuf and Minusha, who was the brother of Sadik of Gostivar. Halim spent his childhood in his hometown in Gjakova with his brother Sadik. Halimi completed his primary education in his hometown, while in 1905 he was a student at the American College "Robert College", in Istanbul, where he graduated in law.

    ISSN 2411-958X (Print) European Journal of September-December 2017 ISSN 2411-4138 (Online) Interdisciplinary Studies Volume 3, Issue 4 Political Circumstances in Albania from 1920 to 1924 Skender Lutfiu, PhD Cand Institute of History, Prishtinë Abstract The events that marked the period 1920-1924 are undoubtedly those of an interior character such as the Congress of Lushnja and the Vlora War (1920), the parliamentary elections (1921 and 1923), the June uprising (1924), etc. while the external ones are undisputed the recognition of Albania and its borders at the London Conference (9 December 1921) and its admission to the League of Nations (1921). The democratic system imposed by the Congress of Lushnja, proved to be ineffective. That is, because it didn’t bring political and economic stability in the country, but on the contrary caused instability in large proportions, all because of the coup d’etat and the numerous uprisings that characterized the period 1920-1922. When the armed political struggle in Albania intensified, nationalist and moderate concepts were created in the Albanian politics. During this period, the Albanian political scene was divided into several political views through North-South contradictions, Muslim-Christian, Zogu-Noli, Conservative-Liberal, and so on. This diversity of religious, regional, political and conceptual character led to political rivalry within the Albanian leadership in Albania over the 1920- 1924 period, in the name of democratic principles, even with non-democratic means. By thus creating not only a serious political climate, but also an attempt for radical changes in the country's government, such as the June Uprising of 1924.

Albanians have never stopped their efforts for the freedom and independence of Albania. After the large loss of the Balkan terri- tory, the Ottoman Empire gradually began to lose its influence over Albanian lands. This event did not pass easily, influenced also by the Young Turk movement and the influence of the unhappy crowd, in order to benefit from this political measure, the Yong Turk easily won the sympathy of the Albanian people. The Young Turks managed to turn the national war scenes into a peace center in the Balkans under the umbrella of the July 1908 Revolution, the Young Turks committees acted in Resen, Ohrid, Prespa, Skopje, Mitrovica, Ferizaj, Prizren etc. these were Albanians who had indirect links with the Albanian Committee “For the Freedom of Albania”. Candidate, Faculty of Law, University of Tirana Doi: 10.36941/mjss-2019-0202 Abstract Recognition of the intellectual, political and patriotic dimension of the members of the High Council, serves not only to recognize their real activity and contributions, but also to understand the political and institutional mentality of the elite of the time and the judgment and assessment they had of the activity of constitutional institutions. Recognition of members of the High Council has been and is limited. Whereas, the need to recognize them is not only a requirement for students of law faculties, but also for the academic staff of teaching in political and legal sciences that give lectures on the history of political institutions of the Albanian state, Constitutional Law, etc. Aqif Pasha Elbasani, Luigj Bumçi, Abdi Bej Toptani, and Dr. Mihal Turtulli were elected members of the High Council from the Lushnja Congress. While from 1920 when that institution was founded until 1925, when the Republic of Albania was founded, members of the UN were also Omer Pasha Vrioni, Ndoc Pistulli, Refik Totani, Ndoc Çoba, Sotir Peci and Xhafer Ypi. Fan Noli and Ahmet Zogu also performed the function of the chairman of KN.

In particular I analyse the way in which the experience of violence conditioned Albanians’ positioning toward their national identity and their state-building endeavours. In analogy to many studies published on the topic of violence and state- building, the research shows that violence against Italians and Yugoslavs who threat- ened the integrity of Albanian territorial claims and Albanian individuals or groups who were considered a menace to the national cause, contributed to consolidate the feelings of national solidarity and to legitimate Albanian claims for self-determination. How- ever, differently from most of current recent research, the analysis of the events displays that violence for state-building purposes had complex ethical and political implications which hindered the coherence of the Albanian national discourse and the state-building projections that it entailed. The employment of coercive means exposed Albanians’ vul- nerability to the violence of internal and external actors who instead exploited violence to delegitimise Albanian self-determination claims. State-building violence created dis- sidence between Albanian political circles, generated contestation against the authority of the government and led political actors to question the overall value and function of their nation-state-building endeavours.
