The Committee was given twelve months to complete its assignment. However, due to unavoidable delays at the beginning, and the large number of memoranda received at the public hearings, the Committee was unable to meet this deadline, and it was compelled to seek for, and obtain, Your Excellency’s kind approval for extension from September – December, 2008. 2. In order to carry out this assignment effectively, the Committee consulted widely with individuals, institutions and governments. The Committee sought for and received a total of 1466 memoranda from the general public. The Committee also held public hearings in two capital cities in each of the six geo-political zones and the Federal Capital Territory during which a total of 907 presentations were made. Although the Committee shunned overseas travel as a matter of principle, it benefitted from foreign expertise by inviting for interaction, experts from Botswana, Cameroun, Canada, Cote D’Ivoire, France, Ghana, India, Lesotho, Mexico, Niger Republic and South Africa. The Committee interacted with former Heads of State and ii Presidents to benefit from their wealth of experience in election matters. The Committee also consulted other stakeholders including State Governments, Political Parties, National Independent Electoral Commission, State Independent Electoral Commissions, Security Agencies, Civil Society Groups, Women Organisations, the Media and the General Public. 3. Having reviewed Nigeria’s history with problematic elections along the lines specified in its Terms of Reference, the Committee has established that the lack of independence of the Electoral Commissions at both the Federal and State levels is a key deficiency of our electoral process. Accordingly, the Committee has made appropriate recommendations to address the focal issues of the composition, administrative autonomy and funding of the electoral commissions. The Committee has also made recommendations to improve the performance of various institutions and stakeholders in the electoral process. These include the Legislature, Judiciary, Executive, Political Parties, Security Agencies, Civil Society Organisations, Media and Nigerian citizens. The Committee has found that election mindsets are one of the critical elements that determine the success of electoral practices, and the election mindsets of Nigerians are not only largely negative; they are also largely irrational. Appropriate recommendations have therefore been made to change the election mindsets of Nigerians in order to minimise violence and rigging in elections and build lasting democratic institutions and culture. 4. The Committee has examined the strengths and weaknesses of our present electoral process in relation to electoral best practices in countries similarly placed as Nigeria, and made appropriate recommendations aimed at promoting greater inclusiveness and minimizing both pre- and post-election tension. 5. Some of the recommendations in this Report require changes in existing electoral procedures, reallocation of electoral functions or creation of new institutions. Where such changes require new legislation or amendments to existing laws, the Committee has prepared appropriate drafts of the required iii legislation, in order to facilitate and speed-up the implementation process. The draft legislations which are annexed to the Main Report are:­ (i) Draft of a Bill for an Act to Amend the Constitution of the Federal Republic of Nigeria, 1999; (ii) Draft of a Bill for an Act to Amend the Electoral Act, 2006; and (iii) Draft of a Bill for an Act to Establish the Electoral Offences Commission. 6. The Report of the Committee is structured into the following six volumes: Volume I: Main Report Volume II: Memoranda (22 Parts) Volume III: Analysis of Public Hearings Volume IV: Verbatim Report of Public Hearings (13 Parts) Volume V: Reports of Retreats (2 Parts) Volume VI: Appendices (2 Parts) 7. The Committee is firmly convinced that the acceptance and implementation of the recommendations contained in this Report will significantly restore credibility in the electoral process and usher in an era of free, fair and credible elections in the country. 8. We consider this to be a necessary exercise as the country prepares for the next general elections and the Jonathan Presidency faces the certain fate of becoming lame-duck earlier than anticipated. The general impression about President Jonathan among Nigerians is that he is as his name suggests, a product of sheer luck. They say this because here is a President whose story as a politician began in 1998, and who within the space of ten years appears to have made the fastest stride from zero to “stardom” in Nigerian political history. Jonathan himself has had cause to declare that he is from a relatively unknown village called Otuoke in Bayelsa state; he claims he did not have shoes to wear to school, one of those children who ate rice only at Xmas. When his father died in February 2008, it was probably the first time that Otuoke would play host to the kind of quality crowd that showed up in the community. The beauty of the Jonathan story is to be found in its inspirational value, namely that the Nigerian dream could still take on the shape of phenomenal and transformational social mobility in spite of all the inequities in the land. With Jonathan’s emergence as the occupier of the highest office in the land, many Nigerians who had ordinarily given up on the country and the future felt imbued with renewed energy and hope.

Alabi and Joseph ‘Yinka Fashagba ABSTRACT The role of the legislature in the anti-corruption initiatives of the Nigerian government is critical given the centrality of the role of the legislature. This paper examines how the legislature has faired in performing its constitutional duties in this regard. It finds a wide gulf of difference between constitutional prescriptions and political realities in a country where the legislature itself is confronted by daunting challenges. Introduction One major challenge to Nigeria’s search for enduring socio-economic, political and technological development as well as efficient and productive utilization of allocated resources in the new millennium is the pervasive corrupt practices in the polity. The devastating effects of corruption in the nation have manifested in lopsided distribution of wealth, malfunctioned or decayed infrastructure and degrading living conditions among a great proportion of the citizenry. These have impacted negatively on all aspects of the developmental agenda. The country cannot but therefore respond to both domestic and international pressures to confront corruption with all possible strategies available. Ironically, the institutional mechanism offered by the Constitution for the fight against corrupt practices is itself not immune from the plague. Although it was not originally intended to compare the coverage of the conflicts between papers in the North and those in the South of Nigeria, the perceived differential situations of the media in the two regions necessitated such a comparison. It is a qualitative research project consisting of three studies: First, there was a comparative critical examination, through critical discourse analysis, of the reports by two newspapers, THISDAY and Daily Trust, during the November 2008 religious violence in Jos, a central Nigerian city. Second, by means of interpretative phenomenological analysis interview data obtained through the semi-structured technique from Nigeria were critically analysed. Third, also applying interpretative phenomenological analysis data obtained by means of focus group interviewing from Nigeria were critically analysed. The results in all three cases suggest the newspapers are regionally, ethnically and religiously inclined; they are particularly affected by factors like ownership, location, staffing and audience perception, which determine how they tailor reports; the newspapers are not usually the cause of religious crises but they stoke the problem through biased and sometimes inflammatory reports; and, although, they are very vibrant factors like Nigeria’s economic recession, political culture – arguably comprising of violence, corruption and tribalism – and new media/technology and so on, contribute towards making their role in the conflicts one of amplification rather than mitigation.

Unfortunately, this social ill seems to have defied all remedial measures put in place to curb its expansion. Anchored on elite theory, with heavy reliance on empirical and secondary data, the study examined the Nigerian House of Representative and corruption with a particular focus on 1999-2011. The study found that, constitutionally, the House of Representatives as one of the legislative chambers at the federal level of the Nigerian Government has the mandate to legislate for good governance which includes curbing corruption. However, activities of this chamber over the years revealed that it is indeed an accomplice as far as corrupt practices is concerned in Nigeria. The study, therefore, recommended the need for stiffer punishment for all corrupt public officers among others. Keywords: Corruption, Political Elite, House of Representatives 1. This is because Nigerians across social strata lament over the huge cost of this conflict in the polity. Throughout the history of the Nigerian Government, public officials, political practitioners, journalists, scholars, and other observers have commented on legislative-executive relations, their variation, and their underlying causes and consequences. A wide variety of viewpoints has been expressed, about both conflict and cooperation, whether one or the other dominates, and whether benefits or liabilities result from either. Some, for instance, see conflict between the executive and legislature as a necessary and beneficial precondition to limiting and controlling government. Yet others view it as contributing to gridlock over major public policy decisions, thus, making government ineffective. This paper is part of the debate. The data for this study were generated from Focus Group Discussion and documentary sources. Information generated was analyzed using tables and the technique of content analysis. Conclusions arrived after analyses include budgetary and constituency project issues are the major casual factors.
