Important Notice Regarding July 27, 2020 City Council Meeting

IMPORTANT NOTICE REGARDING JULY 27, 2020 CITY COUNCIL MEETING

This meeting is being conducted utilizing teleconferencing and electronic means consistent with State of Executive Order N-29-20 dated March 17, 2020, regarding the COVID-19 pandemic. In accordance with Executive Order N-29-20, the public may only view the meeting online and not in the Council Chamber.

Submission of Public Comments: For those wishing to make public comments at the July 27, 2020 Council meeting, please submit your comments via email to be read aloud at the meeting by the Deputy City Clerk. Email comments must be submitted to the Deputy City Clerk at [email protected]. Email comments on matters not on the agenda must be submitted prior to the time the Mayor calls the item for Public Comments. Email comments on agenda items must be submitted prior to the time the Mayor closes public comments on the agenda item. All email comments shall be subject to the same rules as would otherwise govern speaker comments at the Council meeting. Electronic comments on agenda items for the July 27, 2020 Council meeting may only be submitted via email. Those attending the Zoom meeting remotely may utilize the ‘raise hand’ feature to speak during public comment and individual discussion items. Reading of Public Comments: The Deputy City Clerk shall read all email comments, provided that the reading shall not exceed three (3) minutes, or such other time as the Council may provide, consistent with the time limit for speakers at a Council meeting. The email comments submitted shall become part of the record of the Council meeting.

Page 5. Public Hearing: Fire Equipment Special Assessment (Measure A) 45-100 Background: On June 7, 1994, the electorate of the City of Mt. Shasta voted in favor of a tax initiative setting a special assessment of $8.00 per year for unimproved parcels, $24.00 per year for improved parcels, and $36.00 per year for commercial parcels for the purpose of providing funding for Fire Department equipment acquisition. The Siskiyou County Auditor's Office requires that the Board of Directors of any special assessment district certify that the assessments are valid and authorized before they are placed on the tax roll each year. Report By: Muriel Howarth Terrell, Finance Director Recommended Council Action: Hold the required public hearing for the Fire Special Assessment.

Discussion and Possible Action: Active Transportation Program Grant Application 101-111 Background: The Active Transportation Committee (ATC) recommend moving forward with the Conceptual Midtown Trail Plan presented at the July 13, 2020 City Council meeting. The Committee recommends applying within the infrastructure application type to construct the concept plan. Staff will present their recommendation and report to Council for discussion. Subject: Monthly Investment and Financial Report for the Period Ending June 30,2020

Recommendation: Staff respectfully requests the City Council review the provided information regarding the City’s investments.

Background & Summary: As of June 30, 2020 the combined funds the City of Mt. Shasta had invested in the Local Agency Investment Fund (L.A.I.F.) totaled $1,718,331.76. The June 2020 LAIF statement is attached, along with the performance data for the month of June. Most surplus funds over which the City has control are currently invested in LAIF. The balance of the City’s cash funds are held in the pooled checking account with Tri Counties Bank and the CDBG Fund CD’s held with ProEquities. Current investment rates are: L.A.I.F. June 30, 2020 1.217% Treasury Note – 3 month June 30, 2020 0.13% Treasury Note – 2 Yr. June 30, 2020 0.16% Treasury Note – 5 Yr. June 30, 2020 0.30% Treasury Note – 10 Yr. June 30, 2020 0.65% Treasury Note – 30 Yr. June 30, 2020 1.41%

The LAIF average decreased slightly last month, all other notes decreased or remained the same over the previous month. We continue to anticipate the LAIF rate staying in a narrow range around 1.0%-1.75% The LAIF yield is higher than the 2 Yr. Note. Short term CD rates are not better than the LAIF rate and longer term notes may offer better yields it does not give us the liquidity we need. The LAIF rate remains the best available rate that meets the City’s requirement for liquidity and safety.

City Council Regular Meeting July 27, 2020 16 Revenues:

Property Tax Revenue: The City received $548,206 in property tax through June. With the accrual that came in July the amount collected for property tax will be $26,500 more than budgeted for 2019-2020.

Sales Tax Revenue: The sales tax payments received through June are $1,034,511 which is considerable more than what was expected. The amount collected for April includes an advance as calculated by the State using a state-wide projection of a 13% loss over the prior year. The payment for May, to be received in July will include the same advance amount. The payment in August will have a reconciliation for the actual amounts received for the April-June quarter. I anticipate the State will be owed Sales Tax back from the City. I’m uncertain of that amount, but it will be better than the original forcasted amount.

Cannabis Revenue: Cannabis revenue through June came in at $104,274 which is 84% of the $124,000 expeced for the entire years budget for 19/20. The accruals for June will bring us in at around the 100% mark.

Transient Occupancy Tax: The collecion of the 4th quarter TOT is already $28,000 higher than what was expected given the COVID-19 modifications.The total collected through June was $648,413 for fiscal year 19/20 before accruals that are due by the end of July. I expect instead of the first projected decrease of $200,000 that it will be somewhere around $100,000.

Financial Impact: At this point I anticipate being about $150,000 better than the original $450,000 deficit. I will continue to monitor expenses and receipts and report any changes from expected projections. The investments are in compliance with the City’s investment policy and provide for meeting the City’s cash flow needs for the next month and 6 month periods.

Compliance with 2014-17 City Council Strategic Plan: The City Council’s leadership efforts to ensure adherence to the best possible financial practices and overall transparency falls under Strategic Focus IV – Grow Mt. Shasta Pride and Quality and the Municipal Responsibilities of Progressive Leadership and Financial Health and Economic Opportunity. Background & Summary: In June 2020, Council approved CCR-20-23, placing a ballot measure on the November 3rd ballot. That Resolution did not contain all of the required language; the new resolution rescinds the previous resolution and includes ‘Exhibit A’, the ordinance language that will be placed on the ballot. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MT. SHASTA RESCINDING RESOLUTION CCR-20-23 AND REQUESTING THE ELECTION CLERK OF THE COUNTY OF SISKIYOU TO PLACE ON THE NOVEMBER 3, 2020 BALLOT A BALLOT MEASURE TO AMEND CITY OF MT. SHASTA MUNICIPAL CODE REGULATING INDUSTRIAL CANNABIS BUSINESSES

WHEREAS, an initiative measure regulating industrial cannabis businesses in the City of Mt. Shasta has received sufficient signatures to qualify for the ballot; and

WHEREAS, the City Council must either adopt the measure without change or submit the measure to the voters;

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Mt. Shasta hereby resolves, declares, determines and orders as follows that:

Section 1: The City Council requests that the following question be placed on the November 3, 2020 ballot:

Mt. Shasta Regulation of Industrial Cannabis

YES Shall a measure be adopted amending the Mt. Shasta Municipal Code ______relating to the licensing and regulation of Industrial Cannabis businesses? NO

Section 2: In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections.

Section 3: The County Clerk of the County of Siskiyou is authorized, instructed and directed to give all appropriate and convenient notice of the election, in form, time and manner as prescribed by law.

Section 4: Resolution 20-23 is hereby rescinded.

Section 5: The City Council orders the following ordinance, Exhibit "A" (attached), be placed on the November 3, 2020 Ballot:

MEASURE TO BE SUBMITTED TO THE VOTERS

Regulation of Industrial Cannabis Businesses in Mt. Shasta Act

SECTION 1. This act may be known as the Regulation of Industrial Cannabis Businesses in Mt. Shasta Act.

SECTION 2. Findings and Declarations

The voters of Mt. Shasta find and declare:

1. The people of Mt. Shasta have consistently expressed their support for the medical and adult personal use of cannabis as evidenced by the passage of Proposition 215 in 1996 (medical use of marijuana) and Proposition 64 in 2016 (Adult Use of Marijuana Act), among other things.

2. By adopting this Regulation of Industrial Cannabis Businesses in Mt. Shasta Act, voters reaffirm their support for the medical and adult personal use of cannabis, subject to the terms and conditions of Proposition 215 in 1996 and Proposition 64 in 2016, as well as implementing legislation and regulations adopted by state and local regulatory authorities.

3. However, even before passage of Proposition 64 the City began laying the groundwork for issuing one of the highest number of cannabis industry licenses per capita in our small town compared to all other cities in .

In adopting this initiative, the voters of Mt. Shasta specifically reject the direction set forth by the City Council of encouraging Mt. Shasta to become a hub for the industrial production, manufacturing and distribution of cannabis for use outside the city of Mt. Shasta.

When using cannabis products for medical or personal use, adult individuals are able to assess the risks and benefits of cannabis and make autonomous decisions on what is best for them. Their responsible use of such products generally has little impact on others.

5. However, there are significant impacts to the community as a result of the industrial production, manufacturing and distribution of cannabis that cannot be controlled or mitigated by any single individual. The people must do so collectively.

6. Turning Mt. Shasta into an industrial hub for the marijuana industry is a bad direction for our community, one that degrades our quality of life and changes the character and personality of our community. Children are put at risk as the city attempts to reduce and manipulate buffer zones between marijuana businesses and sensitive areas where kids learn and play, such as schools, day care centers and youth centers so as to accommodate the demands of industrial marijuana businesses.

Growing, manufacturing, storing and distributing marijuana on an industrial scale invites problems. Chemicals used in the manufacturing and production processes may damage the environment. Residents near industrial marijuana businesses are forced to endure the pervasive odor of marijuana which impinges on their enjoyment of their own property.

7. As of the date of the filing of this initiative with election officials, industrial cannabis businesses seeking to expand or locate in Mount Shasta are put on notice that the people of Mt. Shasta intend to prohibit the issuance of any further industrial cannabis permits or licenses and reduce over time permits or licenses for industrial production, manufacturing and distribution of cannabis in our community.

8. To ensure compliance with state and municipal codes and regulations, the people find that public participation and accountability in the licensing of industrial cannabis businesses must be enhanced and become more transparent. Accordingly, this Act requires industrial cannabis businesses to undergo unannounced inspections on an annual basis, and ensures that any resident of Mt. Shasta has the right to actively participate in the license approval and renewal process of industrial cannabis businesses.

Page 4 of 11 City Council Regular Meeting July 27, 2020 28 9. Accordingly, the people of Mt. Shasta enact this Regulation of Industrial Cannabis Businesses in Mt. Shasta Act to help achieve the following objectives:

a. To allow licensed medicinal and adult personal use marijuana businesses to continue to operate in Mt. Shasta subject to the rules and regulations established by state and local governing bodies;

b. To prevent the issuance of any new industrial cannabis permits or licenses and thus reduce over time the industrial production, manufacturing and distribution of cannabis in Mt. Shasta;

c. To increase public participation, transparency and accountability of the licensing of industrial cannabis businesses by providing for increased public participation in presenting information to the City about the operation of industrial cannabis businesses, providing for unannounced inspections of these businesses and timely posting of information on the City's website about these businesses;

d. To ensure the protection of children by enacting in the Municipal Code a 600-foot buffer zone between marijuana businesses and sensitive areas such as schools, day cares and youth centers, and preventing city staff and officials from reducing those buffer zones or manipulating their measurement; and

e. To ensure that the people of Mt. Shasta maintain control over the operation of marijuana businesses in our community, to provide that no amendment to this Act may take effect without first having been approved by the voters of the City of Mt. Shasta in a special or general election.

SECTION 3. No impact on Medicinal or Adult Personal Use of Cannabis

In enacting this Act, the people do not intend any impact on the ability of people to access marijuana and cannabis products for medicinal or adult personal use as provided by Proposition 215 and Proposition 64 and implementing laws and regulations. This Act applies only to the operation of industrial cannabis businesses.

SECTION 4. No Manipulation or Reduction in Buffer Zones for Sensitive Uses

Section 18.91.035 is added to Chapter 18.91 to read:

(A) Cannabis industry license holders shall not be located within a 600-foot radius from a school providing instruction in kindergarten or any grades 1 through 12, day care center, or youth center that is in existence at the time the license is issued.

(B) The distance specified in section (A) shall be the horizontal distance measured in a straight line from the property line of the sensitive use to the closest property line of the lot on which the cannabis facility is to be located without regard to intervening structures or lots.

(C) For purposes of this section, the property of a school, day care center or youth center shall include the entire campus of the school, day care or youth center, including all contiguous lots regardless of whether a classroom or other building is located on the lot. A school, day care or youth center campus includes contiguous lots that are utilized for play, recreation, physical education, athletic competition, instruction, administration, maintenance, storage, parking or similar uses, or are available for open space or future uses. For purposes of this section, a school campus comprising parcels separated only by a City street is considered contiguous.

SECTION 5. No Cannabis Industry in Residential Zones

Section 18.91.030 is amended to read:

18.91.030 (A) Land Use Table. Except as provided in subsection b of this section, the land use table shall be used to determine whether a cannabis industry is permitted (P), not permitted (NP), and permitted with a conditional use permit (CP). If a zoning district in this title is not listed in the land use table in this section, then the use is prohibited, unless specifically addressed in a specific plan, downtown enhancement district, or special district regulation.

b. No cannabis industry may operate in any R1 or R2 zoning district.

Page 6 of 11 City Council Regular Meeting July 27, 2020 30 SECTION 6. Reduction Over Time of Industrial Cannabis Businesses in Mt Shasta

Section 5.80.030 (Maximum number of licenses) is amended to read:

5.80.030 Maximum number of licenses.

(A) The City of Mt. Shasta shall allow four types of cannabis industry licenses: nursery, food- based production, nonvolatile product manufacturing, and cultivator.

(B) Subject to subdivision (E) of this section, the City of Mt. Shasta shall allow no more than five (5) of each license type, for a total of twenty (20) cannabis industry licenses, to operate within the City limits, regardless of the location's compliance with any other section specified in the title.

(C) The total number of industry license holders in operation shall be determined based on the number of locations which have been issued a cannabis industry license by the City or are eligible to submit for a cannabis industry license.

(D) Following the adoption of this Act, the City of Mt. Shasta shall not increase the number of license types specified by subdivision (A) of this section, nor shall it increase the number of licenses available of each license type as specified in subdivision (B) of this section.

(E)(i) Not withstanding any other provision of the Municipal Code, including Section 5.80.040, no new cannabis industry licenses shall be issued following adoption of this Act except as provided by subsection (F) of this Section.

(ii) Subsection E(i) of this Section is designed to stop the proliferation of industrial cannabis businesses in Mt. Shasta and, over time, reduce the presence of the industrial cannabis industry in Mt. Shasta as cannabis industry licenses are revoked, not renewed, abandoned or surrendered.

(F) Subsection (E) of this Section does not apply when the holder of an industrial cannabis license seeks to transfer control or sell the business or operations at a location covered by the

Page 7 of 11 City Council Regular Meeting July 27, 2020 31 license holder to another party for operation at the same location, and the City has determined that the new party should be approved to hold an industrial cannabis license. Such transfer or sale shall not be considered a new license for purposes of Subsection (E), and the City is authorized to issue a license to the new party to effect the transfer of control or sale of the business to the new party for operation at the same location, provided that the City has determined that the new party is approved to hold a license.

(G) For purposes of this Act, an "industrial cannabis business" means a cannabis business licensed as a cultivator, distributor, manufacturer including food-based production or nonvolatile product manufacturing, nursery, testing facility, or transporter, but does not include a cannabis dispensary or cannabis retail facility.

SECTION 7. License Accountability and Transparency

Section 5.80.100 (License renewal) is amended to read:

5.80.100 License renewal.

(A) Applications for the renewal of a permit shall be filed with the Planning Department at least 30 calendar days before the expiration of the current permit. Any permittee allowing their permit to lapse or expire during a suspension shall not be allowed to apply for a new license or permit be required to submit a new application, pay the corresponding original application fees and be subject to all aspects of the selection process.

(B)(i) Any person desiring to renew their respective permit shall have the City complete an annual inspection and pay a nonrefundable filing fee established by the City Council to defray the cost of the review required by this section. An applicant shall be required to update the information contained in their original license application and provide any new and/or additional information as may be reasonably required by the Planning Department in order to determine whether said permit should be renewed.

(ii)(a) In addition to the inspection required in subdivision (B)(i), every entity holding a cannabis industry license shall be inspected annually by the City on an unannounced basis to ensure that

The inspection shall occur during normal hours and on a normal work day for the City and be conducted without notice to the licensee. The City inspector shall inform the licensee that the inspector is conducting an unannounced inspection pursuant to this section and that the license holder is required to grant the inspector complete and unfettered access to the business and its operation.

(b) The City shall suspend or revoke the license of any cannabis industry licensee that refuses to allow an unannounced inspection pursuant to this section or that does not grant the inspector complete and unfettered access to the business and its operation.

(c) The licensee shall pay a nonrefundable fee established by the City Council to defray the cost of the unannounced inspection and inspection reports required by this section.

(d) Inspectors shall prepare a written report of their findings within ten business days of the inspection. All inspection reports shall be considered public documents and shall be posted on the City's website within five business days of completion and be made available to any member of the public upon request.

(e) Any City employee, officer, elected official or contractor who shares confidential information with a licensee that is intended to give the licensee information about the timing or focus of an upcoming unannounced inspection shall be guilty of an infraction. In addition to any other punishment provided by law, City employees, officers or contractors found guilty of this subsection shall be subject to discipline up to and including dismissal or revocation of contract.

(C) Prior to renewal, a letter will be sent from the City to all property owners within 100 600 feet of a cannabis industry operation to identify any nuisance(s) experienced in the last year. All responses received within 30 days after the date on the letter will be kept by the Planning Department and included in the annual inspection report.

(D) Reported nuisance(s) that warrant correction or response by the cannabis industry operation owner will be made in writing from the Planning Department. Facility owners will have a minimum of 30 days to correct any nuisance(s). Failure to correct in 30 days will result in a suspension of the operation and/or revocation of the cannabis industry license; unless written approval for an extended deadline is issued from the Planning Department.

5.80.110 Appeal of denial of license.

(A) The Planning Department, in consultation with the Police Department, Building Department, and Fire Department, will review all cannabis industry license applications, and all other relevant information, including the results of the annual and unannounced inspections, and determine if a permit should be granted, the reasons for denial shall be provided in writing to the applicant and be posted on the City website within five business days and be made available to any member of the public upon request. The applicant shall have 14 business days from the date of the receipt of the written denial to correct the reasons for denial and request in writing reconsideration of permit issuance. Following review of the amended permit application, the Planning Department will approve or deny the permit by providing written notice to the applicant and posting notice on the City website within five business days.

(B) An applicant who disagrees with the Planning Department's decision may appeal such decision to the City of Mt. Shasta Planning Commission by submitting a written appeal within 10 business days from receipt of the written denial. A decision of the Planning Commission may be appealed to the City Council if the appeal is submitted in writing to the City Clerk within 10 calendar days following the Planning Commission's action.

(C) Any resident of Mt. Shasta shall have standing to participate in the license approval or renewal process of an industrial cannabis business including appearing before and presenting information and testimony to the City of Mt. Shasta Planning Department, the Planning Commission and the City Council pursuant to Section 5.80.115 of the Municipal Code.

Section 5.80.115 (License Accountability and Transparency) is added to read:

(A) A list of current cannabis industry licenses or permits granted by the Planning Department shalt be maintained on the City's website and available to the public in paper copy. The list shall include, at a minimum, facility address; business name; mailing address; business owner; issue

Any change to the list of current cannabis industry licenses or permits must be posted to the City's website within five business days.

(B) Any resident of Mt. Shasta shall have standing to participate in the process of granting or renewing a license or permit of an industrial cannabis business including appearing before and presenting information and testimony to the City of Mt. Shasta Planning Department, the Planning Commission and the City Council to seek the denial or approval of a license or permit or license or permit renewal if the resident possesses information bearing on said industrial cannabis business relevant to this Act or other provisions of state law or the Municipal code, or the results of inspections required by Section 5.80.100 related to actions of the business which significantly impact the safety of the community, the environment or infrastructure, including transportation and water systems. The resident has standing to appeal a Planning Department decision to the City of Mt. Shasta Planning Commission by submitting a written appeal within 10 business days from receipt of the written denial. A decision of the Planning Commission may be appealed by the resident to the City Council if the appeal is submitted in writing to the City Clerk within 10 calendar days following the Planning Commission's action.

SECTION 8. Amendments

No amendment to this Act may take effect unless approved by the voters of the City of Mt. Shasta at a special or general election.

SECTION 9. Severability

The provisions of this Act are severable. If any provision of this Act, or its application to any person or circumstance is held to be invalid, such invalidity shall not affect other provisions of the Act which can be given effect without the invalid provision.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MT. SHASTA APPROVING GOVERNMENT CRIME POLICIES FOR THE PURPOSE OF BONDING CITY OFFICERS AND EMPLOYEES AND ESTABLISHING POLICY LIMITS

WHEREAS, California Government Code § 36518 requires City Council by resolution establish the penal sum of the bond for the positions of City Clerk and City Treasurer; and

WHEREAS, California Government Code § 36519 provides that the City Council may require bonds of any other officer or employee of the City; and

WHEREAS, California Government Code § 37209 requires execution of a bond by a Director of Finance where duties imposed by law upon the City Clerk are transferred to a Director of Finance; and

WHEREAS, California Government Code §1480 provides that every officer agent or employee not required by statute to give an official bond may be required to give an individual official bond or other form of individual bond in the amount to be fixed by the appointing power and such bond shall insure to the benefit of the appointing power, state, county or municipality by whom such officer, employee, or agent is employed as well as the officer under whom the employee or agent serves; and

WHEREAS, California Government Code § 1463 states,… a government crime insurance policy or employee dishonesty insurance policy, including faithful performance, may be provided an alternative to the official bond by and county or city, subject to approval by the presiding judge of the superior court and recording and filing as provided in §§ 1457 to 1460.1, inclusive. An insurance policy procured pursuant to this section may be used as a master bond as though it were an official bond, subject to approval of the appointing power of the legislative body; and

WHEREAS, California Government Code § 1481 (b) provides that notwithstanding any other provision of law when deemed expedient by the legislative body of a local public agency, a master official bond or other form or master bond may be used which shall provide coverage on more than one officer, employee, or agent of the local public agency, whether elected or appointed who is required by statute regulation, the appointing power, the governing board of a local agency, or the board of supervisors or a chartered general law county to give bond; and

WHEREAS, California Government Code § 1481 (c ) provides that a master bond under this section shall be in the form and for the term which is approved by the appointing power, state, or local public agency by whom the officer, employee, or agent is employed as well as the officer or officers under whom the employee or agent serves.

1. That the City Council deems it expedient that the bonding requirements for public officers and employees required by California Government Code, Mt. Background:

The City of Mt. Shasta has successfully acquired a Caltrans Sustainable Transportation Planning Grant in the amount of $330,000 for the next two years. Part of the acceptance process is to authorize the City Manager to sign off on Caltrans agreements related to the project and any future project amendments. This is a standard practice with state and federal grants.

Project Description:

The Sustainable Transportation Planning Grant will be used to complete a transportation study that will be the foundation for a new Circuation Element in the 2045 General Plan, updated Active TRansprotation Plan, and new street design standards for roadway projects. A generalized scope for the project is attached with the approved project area.

Fiscal Impact:

The Caltrans grant total is for $330,000, approximately $38,000 will be the City match for the grant. The match can be satisfied through in-kind work through the planning department or other agencies.

Timeline:

The grant schedule begins in September 2020 and ends in April 2023. The 2023 date is n reference to the final deadline for project invoices. The proposed project will conclude prior to that date.

Grantee: City of Mt. Shasta Project Title: Mt. Shasta Regional Transformative Transportation Study Introduction The City of Mt. Shasta is creating a new way of life for the City that responds and adapts to changes in the environment, supports the local economy, and ensures healthy, equitable lifestyles for residents. The City’s General Plan revision process has created a new vision for the future which includes adapting and mitigating climate change, creating an inclusive, walkable community, and providing cutting edge infrastructure while preserving the rich, natural environment of the Mt. Shasta Region. The Mt. Shasta Regional Transformative Transportation Study aims to meet these aspirations by benchmarking current Vehicle Miles Traveled (VMT) and Greenhouse Gas Emissions (GHG), assessing existing transportation infrastructure, policies and individual behaviors and attitudes toward active transportation, and developing strategies to transform the City’s transportation infrastructure into an inclusive, multi-model system while meeting state climate and transportation goals.

The Study will create a set of recommendations which includes goals, policies, and street designs that will be incorporated into City Planning documents, Municipal Code, and development standards. The Study will highlight areas in the City and policy areas that need to be updated or created to meet Caltrans mission, state goals and mandates, and community need. The Complete Street design standards will be used as the template for all future street projects and integrated into development standards for private development. The development standards will be updated within 6 months of the Study's completion date.

The Study will assist the City in updating the existing Active Transportation Plan which guides the development of trails in City limits. The City plans to include right- of-way a street design details, include gaps in infrastructure that should be prioritized for future development, and include policies to assist in creating a more bike and pedestrian friendly city. The standards will follow Complete Street best practice outlined by the state. The updated ATP will qualify the City for more physical infrastructure funding opportunities. The updated ATP is slated to be completed 18 months after the Study's completion date.

Finally, the Study will be used as part of the City's General Plan update. The information provided in the existing conditions report, community engagement, and final recommendations for improvement will be integrated into the Circulation Element of the General Plan to ensure consistency between plans and prioritized the transformed transportation system. The Circulation Element of the General Plan is set to be completed within 1 year of the completed Study's completion date.

City Council Regular Meeting July 27, 2020 41 The City of Mt. Shasta is considered a Low-Income Community under AB 1550, a Disadvantaged Community under Proposition 1, and the City frequently qualifies as a disadvantaged community for federal funding through the Department of Agriculture and Economic Development Agency. The median income for the City of Mt. Shasta is $34,813 which is 51% lower than the State of California median income of $67,739 (2016 estimates). The major disadvantaged group within the City's Planning Area is the aging population. 45% of the City of Mt. Shasta population is over 65 years of age and has a household income under $32,000 a year (City of Mt. Shasta 2018 Survey). This population not only has a fixed income but also requires additional transportation features like accessible sidewalks and wheelchair accommodations. The aging population is also more likely to not have a valid driver's license or personal vehicle.

The entire City Planning Area is considered rural with most of the housing being single-family on larger lot sizes (0.5 acres or more). The primary mode of travel is single occupancy vehicle (78.2% American Community Survey 2016 Estimates). This mode of travel is problematic for disadvantaged households farther out from town due to heavy snow in the winter preventing travel and making non- motorized transportation impossible. During the summer months, there is no public transit stops in the surrounding area and limited cycling and walking infrastructure. The Study will look at the existing infrastructure for gaps and opportunities for improvement to shift the mode of transportation to transit and active means, integrate green infrastructure to provide protection from the elements, increase supporting infrastructure like pedestrian rest areas, bike racks and lockers, and transit stops, and better understand the transportation needs of rural, disadvantaged communities. All these things will improve transportation for Disadvantaged communities.

Overall Project Objectives • Develop and analyze climate change and natural disaster vulnerability maps to identify at-risk transportation assets, resources, and transit- dependent populations within the City’s Planning Area • Analyze and recommend improvements to primary ( and State Highway 89) and secondary regional transportation routes for commercial traffic and evacuation routes • Identify the location and extent of existing and proposed major thoroughfares, transportation routes, terminals, and local public utilities and facilities • Assess and recommend improvements for a connective active transportation network within the City’s Planning Area. • Assess and improve the transportation network for a multi-modal system that meets the needs of all users of streets, roads, and highways for safe and convenient travel in a manner that is suitable to the rural, remote context. The improved network should favor the reduction of greenhouse gas emissions from the transportation sector and give special focus

City Council Regular Meeting July 27, 2020 42 to bicyclists, children, persons with different abilities, pedestrians, users of public mass transit, and the aging population • Facilitate public outreach and input from community members, regional agencies, infrastructure owners and operators, visitors, and businesses to determine goals, policies, implementation measures, implementation timelines, and possible funding sources to improve the regional transportation network • Develop designs and standards for green infrastructure, new and improved bicycle and pedestrian commuter routes, improved highway and railroad crossings, and recreational trails throughout the City’s Limits. The design standards will prioritize safety of all users, reduction of motor vehicle speed, and facilitate snow storage during winter months. • Identify and analyze trends in emerging transportation technology to forecast the impacts on the existing transportation infrastructure and develop strategies to facilitate these new trends, including but not limited to Artificial Intelligence, alternative fuel vehicle use, rideshare, ride hauling, and electric bikes and scooters • Develop strategies to increase transit ridership and improve the Siskiyou Transit and General Express (STAGE) system within the City Planning Area. • Create benchmarks and inventories city-wide Vehicle Miles Traveled (VMT), Greenhouse Gas Emissions (GHG) and air quality impacts attributed to transportation of people and goods • Develop strategies to reduce city-wide VMT, GHG, and air quality impacts of the transportation sector. • Consider the impact of transportation on energy systems such as propane and electrical consumption of alternative fuel vehicles. • Develop strategies to incorporate more alternative vehicle infrastructure in the City’s Planning Area. • Identify and map communication technology infrastructure and compare with vulnerability maps to determine at risk assets and resources • Identify and recommend improvements to education, enforcement, and evaluation of active transportation network • Perform collision analysis for City Planning Area to assess and improve non- motorized transportation safety • Map and offer recommendations for improvement to pedestrian and bicycle facilities, bike parking, transit stops, and wayfinding • Perform equity analysis of transportation network and create recommendations with the goal of promoting more active transportation in youth, aging, low-income, and disabled communities. If any inequities are identified during the public hearing process or the Council disagrees with any of the recommendations of staff, the Levy listing can be further modified before the adoption of the Resolution. Then adopt Resolution CCR-20-xx, A Resolution of the City Council of the City of Mt. Shasta Authorizing the Special Assessments for the Fire Department Equipment Funding Special Tax for the 2020-2021 Tax Roll and Authorizing the Mayor to Execute the Certification.

BACKGROUND: On June 7, 1994, the electorate of the City of Mt. Shasta voted in favor of a tax initiative setting a special assessment of $8.00 per year for unimproved parcels, $24.00 per year for improved parcels, and $36.00 per year for commercial parcels for the purpose of providing funding for Fire Department equipment acquisition. The Siskiyou County Auditor's Office requires that the Board of Directors of any special assessment district certify that the assessments are valid and authorized before they are placed on the tax roll each year.

The Resolution, CCR 93-71 attached, which proposed that special tax for fire equipment funding required that at least once each year the City Council hold a public hearing to consider all objections and protests to the tax as levied. The Resolution also gives the Council the authority to reduce or modify any tax levied. Notice of the Public Hearing was published in the Mt. Shasta Herald on July 8, 2020, and the public was given an opportunity to submit written comment, and until the time of the hearing to submit oral statements regarding the tax.

Staff has reviewed the report files from the Siskiyou County Auditor's Office regarding Measure A, Mt. Shasta Fire #38 for the special fire tax. Staff has updated the reports to incorporate changes due to new construction permitted by the building department and any parcel changes approved since the roll was last certified. There were two new buildings permitted since the last update. There was one parcel split into four parcels since last year. There were two demolitions and one mobile home removal completed since the last update.

The attached report, Measure A, Mt. Shasta Fire #38, reflects all of the current assessments for the 2020- 2021 tax year.

WHEREAS, the term of the vote required the City Council to review the tax and hear any objections and protests once each year; and,

WHEREAS, a public hearing was noticed and held at a regular City Council meeting on July 27, 2020; and

WHEREAS, the City Council has heard and considered any statements presented at the public hearing and the recommendations of staff.

NOW, THERFORE, BE IT RESOLVED, by the City Council of the City of Mt. Shasta that it finds the attached listing of levies for Measure A, Mt. Shasta Fire #38, as annotated and modified, valid and authorized for inclusion on the 2020-2021 Siskiyou County tax roll.

Subject: Active Transportation Program Grant Application: Midtown Trail

Recommended Action:

Not to move forward with an ATP grant application at this time.

Background:

The Active Transportation Program (ATP) is a state sponsored program that consolidated the Transportation Alternatives Program, Bicycle Transportation Account, and State Safe Routes to Schools. The purpose of the program is to:

• Increase the proportion of trips accomplished by biking and walking

• Increase safety and mobility for non-motorized users

• Advance the active transportation efforts of regional agencies to achieve Greenhouse Gas (GHG) reduction goals, pursuant to SB 375 (of 2008) and SB 341 (of 2009)

• Enhance public health

• Ensure that disadvantaged communities fully share in the benefits of the program

• Provide a broad spectrum of projects to benefit many types of active transportation users

The program provides funding for projects that promote the purpose of the program and meets the guidelines set in the ATP application.

The ATP eligible projects are divided into five categories: Infrastructure, Plans, Non- Infrastructure, Combination Infrastructure and Non-Infrastructure, and Quick Build. Projects must meet the screening criteria prior to application review which includes:

• Consistency with an adopted regional transportation plan. • Use of appropriate application.

City Council Regular Meeting July 27, 2020 101 • Supplanting Funds: a project that is already fully funded will not be considered for funding in the ATP. ATP funds cannot be used to supplant other committed funds. • Eligibility of project: the project must be one of the five types of projects listed in Section 13 of these guidelines. • With the exceptions outlined in Section 25 and applicants using the large infrastructure application, an applicant applying for pre-construction phases must also apply for funding in the construction phase. • Request of at least the minimum request amount as outlined in Section 15 of these guidelines. • Projects that are already fully funded or projects that are a capital improvement required as a condition for private development approval or permits are not eligible for ATP funding. • A project applicant found to have purposefully misrepresented information that could affect a project’s score may result in the applicant being excluded from the program for the current cycle and the following cycle.

Projects that do not meet one of these criteria will be screened out of the application process.

The minimum request for ATP funds is $250,000. The minimum does not apply to non- infrastructure projects, safe routes to schools’ projects, recreational trail projects, plans, and quick build projects. At least 25% of the funds must benefit disadvantaged communities. The ATP application requires that the projects describe in detail how the project will fulfill the need of low income people. There are several ways to assess whether projects meet the disadvantaged community threshold.

After the projects meet the basic criteria, the projects are then scored against the grant selection rubric. Points are awarded by a committee at the state for Benefits to Disadvantaged Communities, Need, Safety, Public Participation and Planning, Scope and Plan Layout Consistency and Cost Effectiveness, Context Sensitive and Innovation, Transformative Projects, Evaluation and Sustainability, Leveraging, Implementation and Plan Development Corps, and Past Performance. The project will need to score highly in all of these categories to be competitive and receive funding.

Project Description:

The Active Transportation Committee (ATC) recommend moving forward with the Conceptual Midtown Trail Plan. The Committee recommends applying within the infrastructure application type to construct the concept plan. The presentation given at the July 13, 2020 meeting did not include a significant amount of detail about the plan; therefore, an assessment of the success and feasibility is unknown.

City Council Regular Meeting July 27, 2020 102 The Midtown trail documents have not been provided to City Staff for review. It is the understanding of City Staff that the concept plan does not have planning, design, or environmental documents prepared so the project will need to complete these prior to construction. None have been produced to date. It is difficult to evaluate the needed time and resources to produce the final grant application without detailed information on project location, costs, facilities, and community need. The project has not been evaluated by PACE or another transportation engineer to determine an accurate cost for the planning, design, environmental documentation, and construction.

A survey was conducted by the ATC in 2020. The survey was not reviewed by City Staff prior to deployment and data collected has not been shared. This data is assumed useless for the purposes of planning due to lack of evidence of following best practices. Ideally, public engagement should be completed in a number of different mediums to ensure robust, equitable public engagement. One of the main requirements of ATP is to illustrate the involvement and impact to disadvantaged communities. This includes engagement in non-traditional ways. A survey may not have been accessible to key portions of the population and no other public engagement efforts have been pursued. There is a concern that this will disqualify the grant application prior to scoring.

Grant Writing and Project Management

The City of Mt. Shasta utilizes City Staff and contractors to prepare and manage grant funded projects. City Staff will develop grant applications for projects that pertain to their area of management with the Deputy City Clerk as the exception. The Deputy City Clerk assists other departments with applications. PACE Engineering, the City Engineer contractor, primarily manages the City’s infrastructure projects like roads, water, sewer, and stormwater improvements. TRC Solutions, the On-call Planning contractor, manages planning related projects. Outside of these two contractors the City may go out for a request for proposal (RFP) if the existing contractors are unable to complete the work due to focus area or time.

If a grant is secured, the work plan could be completed by one of the existing contractors or sent out to bid through the RFP process. The City is unable to assign projects outside of the procurement process outlined in Chapter 3.50 “Purchasing System”. The purpose of using a competitive bidding system for project ensures that all eligible individuals or companies have a fair chance at receiving public funds. The state requires a competitive bidding process for all grant dollars and may disqualify the city for not following that process. The state does allow for the using of on-call contractors as long as they are procured using the competitive bidding process.

Project Location:

The Midtown Trail concept does not have an approved route to date. The location of the trail through the City is a concept recommended by the ATC. The exact details of which are not known to City Staff at this time. Prior to construction, the trail route will need to be defined and

City Council Regular Meeting July 27, 2020 103 approved by the City Council. The approved trail route should include public engagement and input from trails oriented organizations.

General Plan Connection:

The 2007 General Plan Circulation Element contains a number of recommendations and approved conceptual bike routes in the City of Mt. Shasta. The proposed Midtown Trail concept is not included in the General Plan. If following proper processes this trail concept would need to be amended into the General Plan prior to dedicating City resources to the project. The 2009 Bike and Pedestrian Master Plan was updated to include a preliminary trail route for the Midtown trail, but the plan was ultimately never adopted into the 2007 General Plan document.

The General Plan Circulation Element and the Active Transportation Plan are outdated and need updating to understand the needs of the community, increase the City’s competitiveness for grant dollars, and meet state mandates concerning Complete Streets and Vehicle Miles traveled (VMT). The City of Mt. Shasta has obtained a Sustainable Transportation Planning Grant to update our General Plan Circulation Element, Active Transportation Plan, and create Complete Streets development standards for future roadway projects. The grant start date is November 1, 2020 and will proceed through 2022 with deliverables of the grant being completed along the way. Environmental Review:

The concept Midtown Trail project has not been evaluated under the California Environmental Quality Act (CEQA). Preliminary information received from ATC indicated that the project would trigger a CEQA review, specifically an Initial Study. The estimated cost of a study for projects is $35,000 to $45,000 depending on the extent of the project. It is unknown the full cost of environmental review until more information is developed for the projects.

Depending on the extent of the project and the final location, the project may also need to obtain environmental permits from Department of Water Resources, Department of Fish and Wildlife, and other organizations that would add to the project cost and work plan.

Fiscal Impact:

Although the ATP is a no match grant, the resources needed to complete a high scoring application will take significant resources from the City and its contractors. The City could be reimbursed to a degree if the grant is award, but there is little evidence to support that the City would be successful with this project at this time.

Timeline:

The grant application deadline for this funding cycle is September 15, 2020.

Review of Public & Outside Agency Comment:

City Staff have met with the Mt. Shasta Trails Association, Tom Hesseldenz, and SORA to discuss the proposed project. There is no desire in the proposed project from the community and

Specifically, the Planning Department works extensively with the Parks and Rec District, SORA, Trails Association, Siskiyou Land Trust, and Mt. Shasta Mountain Bike Association and these organizations have not provided support for the Midtown Trail. All of these agencies have a direct interest in active transportation based programming and projects. None of these organizations have had input in this ATP project development nor review input. It is detrimental to the community if the City supports projects that do not coordinate with other like-minded organizations. The success of a grant application and implementation of a project relies on these organizations buying into it. This can be achieved with more time and through the transportation grant process.

The City has received a Caltrans Sustainable Transportation Planning Grant to conduct a transportation study to update the Circulation Element, Bike and Pedestrian Master Plan, and street design standards. The organizations are excited about this opportunity to update these key documents and feel waiting for the study to conclude would give all of the organizations the ability to successfully apply for grants.

Recommendation Discussion:

The Planning Department recommends not moving forward with an ATP application at this time. The plans are outdated and do not include a new assessment of the community needs and opinions on potential projects. Similar to the Stormwater Master Plan, City plans need extensive public and outside agency outreach to ensure plans and project align with community needs. Community input, traffic assessments, and up to date information is needed to be competitive for these state grants. Any successful project will need the coordination of City Staff and the City’s Engineer contractor to ensure accurately estimate projects costs. The proposed concept is not at a stage where we can accurately gauge the needed grant awarded to make this project happen. We would need additional time that is not available to us to make this grant deadline. Finally, it is difficult to develop a grant application without the project details recommended by ATC. Without the route location, length, preferred design style, etc. We cannot create a grant that is successful in the time left to submit to Caltrans. Based on the information known to date, City Staff is not confident that this grant application will be funded. Attachments:

A. Benefit to Disadvantaged Communities. The benefit provided to the disadvantaged community affected by the project. The score will be impacted by the project location in relation to the disadvantaged community, the severity, and the direct benefit the project will provide. Applicants will also, if applicable, explain how anti-displacement policies and actions are being implemented to discourage gentrification of the community being impacted by the project.

B. Need. Potential for increased walking and bicycling, especially among students, including the identification of walking and bicycling routes to and from schools, transit facilities, community centers, employment centers, and other destinations; and including increasing and improving connectivity and mobility of non-motorized users.

C. Safety. Potential for reducing the number and/or rate or the risk of pedestrian and bicyclist fatalities and injuries, including the identification of safety hazards for pedestrians and bicyclists.

D. Public Participation and Planning. Identification of the community-based public participation process that culminated in the project proposal, which may include noticed meetings and consultation with local stakeholders. Project applicants must clearly articulate how the local participation process (including the participation of disadvantaged community stakeholders) resulted in the identification and prioritization of the proposed project. If there is significant opposition to the project, applicants should summarize any major points of concern raised by the opposition and provide a response.

E. Scope and Plan Layout Consistency and Cost Effectiveness. Evidence that the application, scope and plan layout are consistent with one another and depict what is being proposed. A project’s cost effectiveness is the relative costs of the project in comparison to the project’s benefits.

F. Scope and Plan Layout Consistency. Evidence that the application, scope and plan layout are consistent with one another and depict what is being proposed.

G. Implementation and Plan Development. Specific to applicants using the “plan” application form. Evidence that the plan will lead to implementation of the identified projects.

H. Context Sensitive Bikeways/Walkways and Innovative Project Elements. The “recognized best” solutions appropriate for the local community context will be considered, and a description of the innovative features of the project. OR explain why the context of the project best lends itself to standard treatments/features.

I. Transformative Projects. Evidence of the transformative nature of the project will help to inform the score. In addition, applicants should address the potential for the project to support existing and planned housing, especially affordable housing.

J. Evaluation and Sustainability. How will the effectiveness of the program be measured and sustained after completion?

K. Leveraging. Leveraging of non-ATP funds (excluding in-kind contributions) on the ATP project scope proposed.

L. Corps. Use of the California Conservation Corps or a certified local community conservation corps, as defined in Section 14507.5 of the Public Resources Code, as partners to undertake or construct applicable projects in accordance with Section 1524 of Public Law 112-141. Points will be deducted if an applicant does not seek corps participation or if an applicant intends not to utilize a corps in a project in which the corps can participate. An exception applies for applicants using the Plan application type.

A copy of the agreement between the implementing agency and the proposed conservation corps must be provided to Caltrans.

e. Funded projects will be required to report on the use of the California Conservation Corps or a certified local community conservation corps as noticed in the application.

M. Past Performance. Applicant’s performance on past ATP projects. Point reduction for non-use of the Corps as committed to in a past ATP award or project failure on any past ATP project.

21. MPO Competitive Project Selection

Projects not selected for programming in the statewide competition must be considered by the MPOs in administering a competitive selection process.

An MPO may delegate its project selection to the Commission if it uses the Commission’s statewide competition project selection criteria, weighting, minimum project size, match requirement, and definition of disadvantaged communities.

Dear Tim and the Active Transportation Committee,

Please forgive this very brief last minute response; other trail projects have kept the Mount Shasta Trail Association (MSTA) Board unusually busy this summer. Although we continue to fully support the Midtown Trail in principle, the timing of this request is not optimal, and we cannot lend our support to it at this time. Here are some of the key reasons:

1. The City of Mount Shasta is currently revising its Master Plan. We believe trail priorities are more likely to be funded by grantors flowing from the output of a completed master plan. 2. The Mount Shasta Recreation and Parks Service District is also revising its Master Plan, including trail plans. 3. We hope trail priorities will be established through and agreed to by a collaborative process once the master plans are completed. 4. We understand that both master plans will require environmental analyses, including the Mid Town Trail. 5. We believe that the City of Mount Shasta has received a significant transportation planning grant, and that planning for the Mid Town trail can reasonably be expected to be part of this grant. Doing planning for an individual trail segment would be less effective than for a comprehensive local trail plan.

In addition to the specific related projects listed above, we are very concerned about not only the financial impact of the pandemic on the City and staff, but also on the City’s ability to sponsor an individual trail project at this time. Rather than focusing on any individual trail today, we prefer to see a fully collaborative trail planning process that can be supported by all local trail planning partners and agencies -- the City of Mount Shasta, Recreation and Parks District, Siskiyou County, the Forest Service, and various non-profit groups such as MSTA and the Siskiyou Land Trust. We are certain that allowing the current planning entities to complete their tasks will result in grant requests that are more likely to be funded than individual projects would be.
