R. Evid. 201(b)(2). 8 ARGUMENT 9 A district court “‘may take judicial notice of matters of public record’ and consider 10 them without converting a Rule 12 motion into one for summary judgment.” U.S. v. 14.02 11 Acres of Land More or Less in Fresno Cty., 547 F.3d 943, 955 (9th Cir. 2008) (quoting Lee v. 12 City of Los Angeles, 250 F.3d 668, 688 (9th Cir. 2001)); accord Intri-Plex Tech., Inc. v. Crest 13 Grp., Inc., 499 F.3d 1048, 1052 (9th Cir. 2007) (“‘[A] court may take judicial notice of 14 “matters of public record” without converting a motion to dismiss into a motion for summary 15 judgment’ as long as the facts noticed are not ‘subject to reasonable dispute’”); Casterlow-Bey 16 v. Barnes & Nobel.com, 3:17-cv-05834-RJB, 2018 WL 1382566 at *3 (W.D. Wash. Mar. 19, 17 2018) (judicially noticing records from the U.S. Copyright Office where no reasonable dispute 18 existed as to authenticity). Public records and official reports of administrative agencies are 19 thus proper subjects for judicial notice. See 14.02 Acres, 547 F.3d at 955 (finding no abuse of 20 discretion in taking judicial notice of the Department of Energy National Transmission Grid 21 Study); Interstate Nat. Gas Co. v. S. Cal. Gas Co., 209 F.2d 380, 385 (9th Cir. 1953) (“We 22 may take judicial notice of records and reports of administrative bodies”). 23 The two records for which BP p.l.c. seeks judicial notice are administrative records 24 that are publicly available on government agency Web sites. This document is maintained as part of 3 EIA’s interactive database relating to energy production and 4 consumption in the United States and is available on the EIA’s Web site 5 at https://www.eia.gov/state/analysis.php?sid=WA#18. 6 • Exhibit B is the short summary of Washington State’s current and 7 historical oil and gas production in-state. This information is published 8 and maintained by the Washington State Department of Natural 9 Resources and is made public on its Web site at 10 https://www.dnr.wa.gov/programs-and-services/geology/energy-mining- 11 and-minerals/oil-and-gas-resources#oil-and-gas-in-washington. 12 Because these exhibits are public records, the authenticity of which is not subject to 13 reasonable dispute and the contents of which can be “accurately and readily determined from 14 sources whose accuracy cannot reasonably be questioned” (Fed. R. Evid. 201(b)(2)), each is 15 the proper subject of judicial notice by the Court. 16 CONCLUSION 17 For the foregoing reasons, BP p.l.c. requests that the Court take judicial notice of 18 Exhibits A and B, attached hereto, in connection with its consideration of the Motion. 19 20 Dated: September 11, 2018.
