A. L. KIRKBRIDE 8th July, 1936• Clerk to the Advisory Council. (C/154/34) DRAFT AN ORDINANCE TO AMEND THE PATENTS AND DESIGNS ORDINANCE, 1924. BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof :— 1. This Ordinance may be cited as the Patents and Designs Citation. (Amendment) Ordinance, 1936, and the Patents and Designs Ordinance, 1924, (hereinafter called the principal Ordinance), the IsTo. 33 of 1924. Patents and Designs (Amendment) Ordinance, 1930, the Patents No. 13 of 1930. and Designs (Amendment) Ordinance, 1934, the Patents and No. 23 of 1934. Designs (Amendment) Ordinance, 1935, and this Ordinance may No. 7 of 1935. together be cited as the Patents and Designs Ordinances, 1924-1936. 2. Section 7 of the principal Ordinance shall be repealed and Replacement of the following section substituted therefor :— section 7 of the principal Ordinance. "Examination of 7.—(1) The Registrar may at any time before specification. acceptance of the specification require the applicant to make such amendments in the application or specification as may be requisite to secure comp• liance with the provisions of sections 5 and 6 hereof. (2) If it appears to the Registrar that the invention claimed by the applicant has been claimed or described — (a) in any specification previously lodged, or patent previously registered, or (b) in any specification of patent for the protection or registration of which applic• ation has been made entitling any other person to a patent or to registration in priority to the applicant by virtue of the provisions of section 24 or section 51 of this Ordinance (whether or not the spe• cification of the applicant has been already accepted or a patent granted to him in respect of his invention), he shall notify the applicant accordingly and may require any such amendment as may be requisite, provided that it shall in no case be the duty of the Registrar to make any investigation for the purpose of ascertaining whether the invention claimed has been so claimed, described or re• gistered. 772 THE PALESTINE GAZETTE 16th July, 1936 (3) Where an application or specification has been amended, the application shall, if the Registrar so directs, bear date as from the date of the amendment•. (4) •If the Registrar is satisfied that the in vention claimed by the applicant has been already claimed or described — (a) in any specification previously lodged or patent previously registered, or (1)) in any specification or patent for the protection or registration of which ap plication has been made entitling any other person to a patent or to registration in priority to the applicant by virtue of the provisions of section 24 or section 51 of this Ordinance (whether or not the specification of the applicant has been already accepted or a patent granted to him in respect of his invention), he shall unless the objection is removed by amending the specification to his satisfaction, determine whether a reference to any, and if so to what, other specification ought to be made in the specification of the applicant by way of notice to the public. Provided that the Registrar, if satisfied that the invention claimed has been wholly and specifically claimed in any specification previously lodged, shall refuse to accept the specification for such invention. OBJECTS AND REASONS. Section 7 of the Patents and Designs Ordinance, 1924, (the principal Ordinance), provides that where an invention claimed has already been claimed or described in'a specification previously lodged or in a patent previously registered, its specifi• cation shall be amended, or certain other procedure applied as there laid down. Section 24 and section 51 (as enacted in section 2 of the Patents and Designs (Amendment) Ordinance, 1935), provide that applications in Palestine for the pro• tection or registration there of existing United Kingdom patents or foreign "Con• vention" patents, respectively, though made subsequently to ordinary applications, nevertheless confer rights in respect of such patents dating from the date of their original grant, — rights which will take priority over rights of ordinary applicants acquired after that date, even of applicants to whom patents have already been granted. No reference is made in section 7 to applications under section 24 or 51. This Ordinance accordingly extends the provisions of section 7 as to the amend• ment of specifications or other procedure, hitherto applicable only in favour of specifications previously lodged or patents previously registered, to cover the case of applications for the protection or registration of United Kingdom or "Conven• tion" patents under section 24 or 51, which, though not previously made in fact, nevertheless confer retrospective rights as indicated above. 2. The opportunity has ben taken to amend the principal Ordinance by the insertion of a new section 19A, based on section 45 of the English Patents and Designs Acts, 1907-1932, providing that the exhibition or the reading of a paper by an inventor before a learned society shall not, subject to certain provisions, prejudice the inventor's right to apply for a patent in respect of his invention.
