The Secretary of State for the Colonies has notified the Officer Administering the Government that His Majesty will not be advised to exercise his power of dis allowance in respect of Ordinance No. 2 of 1937, entitled "An Ordinance to make provision for proceedings in respect of juvenile offenders and for the care of young persons in need of protection". S. MOODY 25th June, 1937. Acting Chief Secretary. (J/330/33) EXCLUSIVE LICENCE TO TAKE FISH. ISSUED UNDER THE FISHERIES ORDINANCE, 1937, SECTION 3. THIS LICENCE is granted by His EXCELLENCY GENERAL SIR ARTHUR GRENPELL WAUCHOPE, G.C.M.G., K.C.B., CLE., D.S.O., High Commissioner for Palestine (hereinafter called "the Licensor") to the Palestine Land Development Company * "־־־ '"" ™ —־(׳"Limited (hereinafter called "the Licensee WHEREAS the Licensee is the present holder of the Concession originally granted in June, 1330, by the Imperial Ottoman Government to MOHAMMAD OMAR BEYUM and MICHEL SURSOCK for the drainage and reclamation of the lands known as the Huleh Area (which concession is generally known and hereinafter referred to as "the Huleh Concession") ; AND WHEREAS by virtue of the provisions of section 3 of the Fisheries Ordinance, 1937, the Licensor may at his discretion and subject to such conditions as he may think fit grant to suitable persons licences to take fish exclusively in such part of ־*־־־״*־ ־־— * ;Palestine as may be specified in any such licence WHE^EATTrie™Licensee has requested the Licensor to grant to the Licensee־-AND an exclusive licence to take fish in the area described in the Schedule hereto and the Licensor is willing to grant to the Licensee such licence subject to the condi tions hereinafter set out; Now, THEREFORE, in pursuance of the premises and subject to the conditions hereinafter set out the Licensor by virtue of the powers and discretion vested in him by proviso (b) to section 3(1) of the Fisheries Ordinance, 1937, hereby grants unto the Licensee the exclusive right to take fish within the area described in the Schedule hereto and hereinafter referred to as "the waters comprised in this licence", or any part thereof, during such time as the Huleh Concession or any Concession replacing the same shall remain in operation. The licence hereby granted shall be subject to the following conditions : 1. The Licensee shall observe and comply with all requirements applicable to the licence hereby granted which may be contained in the Fisheries Ordinance, 1937, or in any other Ordinance for the time being in force relating to fisheries and in any rules made thereunder. 2. No rental shall be payable by the Licensee in respect of this licence save only an annual licensing fee of 500 mils which shall be payable in advance on the first of April in each year to the Chief Fisheries Officer. 3. The Licensee shall submit each month in such form as the Chief Fisheries Officer may require a statistical return specifying with all reasonably possible accu racy all fish caught under this licence from and after the date hereof in the waters comprised in this licence. 4. The Licensee shall permit the Chief Fisheries Officer or any person there unto duly authorised by him to make such inspections and to take such measure ments and such samples of fish from catches made or from the waters comprised in this licence and otherwise to perform any such acts as he may be authorised or bound to do in accordance with the provisions of any Ordinance or of any rules made thereunder or otherwise. 648 THE PALESTINE GAZETTE 1st July, 1937. 5. The Licensee shall be entitled to have endorsed upon this licence the names of all and any persons from time to time employed by him for the purpose of taking fish under this licence subject to the Licensee furnishing to the District Fishery Officer, Eastern Area, the name and three passport-size copies of the photograph of every such person. The Licensee shall further be entitled upon giving prior notice in writing in that behalf to the District Fishery Officer, Eastern Area, to have removed any names of persons so endorsed and, subject to the like notifica• tion of name accompanied by three passport-size copies of photograph of every sub• stituted or additional employee engaged in fishing, to have the names of such sub• stituted or additional employees endorsed upon this licence. Every person whose name shall be so endorsed shall, so long as the endorsement remains, be at liberty to take fish under the authority of this licence in the waters comprised in this licence without being required to obtain a separate licence. 6. Nothing in this licence contained shall enable the Licensee or any other per• son to take fish in any part of the waters comprised in this licence which may at any time be excluded or reserved by the Chief Fisheries Officer as a breeding ground or nursery ground or to take any fish which may be on a spawning migration. 7. Subject as aforesaid the Licensee shall not assign or otherwise part with any of his rights under this licence without the consent of the Licensor which he may in his absolute discretion grant or refuse. 8. In the event of any dispute arising between the Licensor or the Chief Fi• sheries Officer and the Licensee as to any matter or thing arising out of this li• cence or any matter relevant hereto such dispute shall be referred to arbitration in accordance with the provisions of the Arbitration Ordinance in force from time to time. SCHEDULE. The waters comprised in the Huleh Concession Area, more particularly described and registered as Block 13033, parcel No. 4, in the Huleh Concession Area in the Sub-district of Safad, and consisting of an area of 14024 dunums or thereabouts. Dated this sixteenth day of June, 1937. A. G. WAUCHOPE High 'Commissioner. (A/135/36) PALESTINE RAILWAYS. NOTICE. FREE PERIOD FOR LOADING AND OFFLOADING OF EGYPTIAN STATE RAILWAYS WAGONS. IT IS HEREBY NOTIFIED that as from the 1st July, 1937, the following regulation will apply in respect of the loading and offloading of Egyptian State Railways wagons at stations on the Palestine railways and operated lines :— The period allowed free for loading or offloading of Egyptian State Rail• ways wagons, excluding oil and molasses tankwagons, refrigerator vans and perishable vans, will be limited to six hours of daylight,.after which demur• rage, at the rate of 8.5 mils per ton per hour on the carrying capacity of the wagon used, will be charged.
