Election of Chairman Election of Chairman 1. Mr James TO Kun-sun, the member with the highest precedence in the Council among members of the Subcommittee present at the meeting, presided over the election of the Chairman of the Subcommittee and invited nominations for the chairmanship of the Subcommittee. 2. Mr Alvin YEUNG was nominated by Mr Andrew WAN Siu-kin and the nomination was seconded by Mr WU Chi-wai. Mr Alvin YEUNG accepted the nomination. There being no other nomination, Mr James TO Kun-sun declared that Mr Alvin YEUNG was elected the Chairman of the Subcommittee. Mr YEUNG then took the chair. Election of Deputy Chairman 3. Members agreed that there was no need to elect a Deputy Chairman. 4. The Subcommittee deliberated (Index of proceedings attached at Appendix). - 3 - Action II. Any other business Invitation for public views 5. The Subcommittee agreed to invite the public to submit written views on the five pieces of subsidiary legislation. (Post-meeting note: An invitation for public submissions on the five pieces of subsidiary legislation was uploaded onto Legislative Council website on 3 November 2020. Invitation letters for views were also issued to the District Councils. The submission received was circulated to members vide LC Paper No. CB(1)157/20-21(01).) Legislative timetable and extension of the scrutiny period 6. The Subcommittee agreed to move a proposed resolution at the Council meeting of 11 November 2020 to extend the period of scrutiny of the five pieces of subsidiary legislation to the Council meeting of 2 December 2020. If the scrutiny period was extended, the deadline for giving notices of motions to amend the subsidiary legislation would be 25 November 2020. The Chairman would report the deliberations of the Subcommittee to the House Committee on 20 November 2020. (Post-meeting note: The motion was not moved at the Council meeting of 11 November 2020. As such, the period for amending the five pieces of subsidiary legislation expired at the Council meeting of 11 November 2020.) Date of next meeting 7. Members agreed that the date of next meeting would be fixed in due course. (Post-meeting note: The notice and agenda for the meeting on 6 November 2020 were issued to members vide LC Paper No. CB(1)95/20-21 on 2 November 2020.) 8. There being no other business, the meeting ended at 11:50 am. Currently, our party has five members elected to the Hong Kong Legislative Council, the unicameral legislature of HKSAR. 2. In the Universal Periodic Reviews of PRC in 2009 and 2013, not much attention was paid to the human rights, political, and social developments in the HKSAR, whilst some positive comments were reported on the HKSAR situation. i We wish to highlight that there have been substantial changes to the actual implementation of human rights in Hong Kong since the last reviews, which should be pinpointed for assessment in this Universal Periodic Review. In particular, as a pro-democracy political party with members in public office at the Legislative Council (LegCo), we wish to draw the Council’s attention to issues related to the political structure, election methods and operations, and the exercise of freedom and rights within and outside the Legislative Council in HKSAR. Most notably, recent incidents demonstrate that the PRC and HKSAR authorities have not addressed recommendations made by the Human Rights Committee in previous concluding observations in assessing the implementation of International Convention on Civil and Political Rights (ICCPR).

In 2014, after Hong Kong’s Chief Executive declared that the citizens of Hong Kong would be unable to democratically elect their leader in the upcoming 2017 election, a 79-day occupation of major city centers ensued. The memory of the three-month occupation, also known as the Umbrella Movement was instrumental in shaping a political identity for Hong Kong’s residents. Understanding social movements as a process and not a singular event, an analytic mode that problematizes linear temporal constructions, can help us move beyond the deterministic and celebratory views often associated with technology’s role in social movement activism.

In the past year issues such as the increasingly strained relationship between the Legislature and the Executive Authorities, filibustering by a few Members in Council and committees, differences and polarized opinions among political camps often took the limelight. Despite these challenges, Members continued to carry out work in scrutinizing legislative and financial proposals, monitoring the Government and giving views on public policies and matters of public concern. In the 2013-2014 legislative session, the Council passed 19 bills, 10 with amendments. Some of these bills, such as the Stamp Duty (Amendment) Bill 2012 and the Stamp Duty (Amendment) Bill 2013 which implemented measures to address the overheated property market, have far-reaching effects across society.
