Ordinance No. 000-19 an Ordinance Authorizing

ORDINANCE NO. 000-19 AN ORDINANCE AUTHORIZING EXTENSION OF PERMIT AGREEMENTS WITH THE METROPOLITAN WATER RECLAMATION DISTRICT OF GREATER FOR THE CONTINUING USE OF LAND AT THE NORTH PARK GARAGE FACILITY, 3112 WEST , CHICAGO, ILLINOIS, AND A BUS TURNAROUND AT DEVON AND KEDZIE IN LINCOLNWOOD, ILLINOIS

WHEREAS, Pursuant to Ordinance 98-13, the Authority entered into General Permit Agreements, dated February 19, 1998, with the Metropolitan Water Reclamation District of Greater Chicago, (the “District”), for use by the Authority of two portions of the land situated at 3112 West Foster Avenue, Chicago, Illinois, commonly known as North Park Garage, and for property situated at the northwest corner of Devon Avenue and , Lincolnwood, Illinois, (the “Bus Turnaround”, which together with North Park Garage is referred to hereinafter collectively as the “Premises”); and

WHEREAS, Pursuant to Ordinance 99-22, said Permit Agreements were extended to a term of one year, effective March 1, 1999, and will expire by their own terms on February 29, 2000 (the “Expiration Date”); and

WHEREAS, The Authority and the District are engaged in negotiations for a long term lease of or purchase of the Premises, which negotiations are not expected to be concluded prior to the Expiration Date; and

WHEREAS, The continuing use of the Premises is essential to the efficient operation of bus service; and

WHEREAS, The District has proposed the issuance of a permit to the Authority to allow the Authority to continue to operate the North Park Garage for a period of six (6) months beyond the Expiration Date in consideration of the payment by the Authority of the sum of $111,769.13; and

WHEREAS, The District has proposed the issuance of a permit to the Authority to allow the Authority to continue to operate the Bus Turnaround for a period of six (6) months beyond the Expiration Date in consideration of the payment by the Authority of the sum of $15,793.00; now, therefore:

BE IT ORDAINED BY THE CHICAGO TRANSIT BOARD OF THE CHICAGO TRANSIT AUTHORITY:

SECTION 1. That the Chairman of the Chicago Transit Board, or her designee, is hereby authorized to negotiate and execute a Permit Extension Agreement with the Metropolitan Water Reclamation District of Greater Chicago, for the continuing use of the North Park Garage portion of the Premises for a term of six (6) months, from March 1, 2000 until August 31, 2000, at a total term rental fee of $111,769.13. Said Permit Agreement will include an indemnification of the property owner by the Authority, and such other terms that are substantially in conformance with the other terms set forth in Exhibit A.

SECTION 2. That the Chairman of the Chicago Transit Board, or her designee, is hereby authorized to negotiate and execute a Permit Extension Agreement with the Metropolitan Water Reclamation District of Greater Chicago, for the continuing use of the Devon/Kedzie Bus Turnaround portion of the Premises for a term of six (6) months, from March 1, 2000 until August 31, 2000, at a total term rental fee of $15,793.00. Said Permit Agreement will include an indemnification of the property owner by the Authority, and such other terms that are substantially in conformance with the other terms set forth in Exhibit B.

SECTION 3. This ordinance shall be in full force and effect from and after its passage.
