1. PROCEDURE

(1) On 28 June 2013 the Commission adopted the Guidelines on Regional State Aid for 2014-20201 (hereinafter "RAG"). Pursuant to paragraph 178 of the RAG, each Member State should notify to the Commission, following the procedure of Article 108(3) of the Treaty on the Functioning of the European Union, a single regional aid map applicable from 1 July 2014 to 31 December 2020. In accordance with paragraph 179 of the RAG, the approved regional aid map is to be published in the Official Journal of the European Union, and will constitute an integral part of the RAG.

(2) By letter dated 27 September 2013, registered at the Commission on 30 September 2013 (2013/096223), the German authorities duly notified a proposal for a regional aid map applicable for the period from 1 July 2014 to 31 December 2020.

(3) On 25 October 2013, the Commission requested additional information (2013/107411), which was provided by the German authorities on 21 November 2013 (2013/116246).

(4) On 17 December 2013, the Commission addressed a second request for additional information (2013/127201), to which the German authorities replied on 7 January 2014 (2014/000951).

2. DESCRIPTION OF THE NOTIFIED REGIONAL AID MAP

(6) In their notification, the German authorities propose a list of regions with a total population of 21 132 620 inhabitants, or 25.85% of the national population, for eligibility for regional aid under the derogation provided in Article 107(3)(c) of the TFEU for the period from 1 July 2014 to 31 December 2020. The notified list includes predefined 'c' areas and non-predefined 'c' areas.

2.1 Predefined Article 107(3)(c) areas

(7) In their notification, the German authorities propose six NUTS 2 regions as predefined areas eligible for regional aid under the derogation of Article 107(3)(c) TFEU for the period from 1 July 2014 to 31 December 2020, as foreseen in Annex I of the RAG.

(8) Table 1 below presents the list of former 'a' areas proposed as predefined 'c' areas along with the maximum aid intensities proposed for each region, distinguishing between the period from 1 July 2014 to 31 December 2017 and the period from 1 January 2018 to 31 December 2020.

3 2.2 Non-predefined Article 107(3)(c) areas

(9) In their notification, the German authorities also propose to designate several non- predefined areas as eligible for regional aid under the derogation of Article 107(3)(c) TFEU for the period from 1 July 2014 until 31 December 2020. The non-predefined 'c' areas are proposed in accordance with the criteria set out in paragraph 168 of the RAG. Tables 2 to 6 below present the list of non-predefined 'c' areas proposed along with the maximal aid intensity proposed for each area. The tables also show the total population of each zone proposed2. A more detailed description of the composition of each non- predefined 'c' area is presented in Annex 1.

2.2.1 Non-predefined 'c' areas in application of Criterion 1 of paragraph 168 of the RAG

(10) Table 2 below presents the list of proposed non-predefined areas along with the maximum aid intensities proposed for each region for which Germany submits that the conditions of Criterion 1 of paragraph 168 of the RAG are fulfilled:

2.2.5 Non-predefined 'c' areas in application of Criterion 5 of paragraph 168 of the RAG

(14) Table 6 below presents the list of proposed non-predefined areas along with the maximum aid intensities proposed for each region for which Germany is arguing that the conditions of criterion 5 of paragraph 168 of the RAG are fulfilled:

2.3 Maximum aid intensities for SMEs

(15) In accordance with paragraph 177 of the RAG, the maximum aid intensities applicable to large enterprises can be increased by up to 20 percentage points for small enterprises or by up to 10 percentage points for medium-sized enterprises. However, the increased maximum aid intensities for SMEs will not apply to aid awarded for large investment projects with eligible expenditure above EUR 50 million.

3. ASSESSMENT

3.1 Proposed list of predefined Article 107(3)(c) areas

(16) The predefined regions proposed by Germany as eligible for regional aid under the derogation of Article 107(3)(c) TFEU for the period from 1 July 2014 to 31 December 2020 are those listed in Annex I of the RAG, including the whole NUTS 2 regions of DE40 Brandenburg and DEE0 Sachsen-Anhalt, as Germany has made use of the flexibility provided for in Annex I for those regions.

(17) The predefined 'c' areas proposed by Germany have a total population of 11 868 592 inhabitants, which represents 14.51% of the total national population (81 751 602 inhabitants) of which 2.61% corresponds to the parts of the NUTS 2 regions of DE40 Brandenburg and DEE0 Sachsen-Anhalt for which Germany has the flexibility to designate them also as predefined 'c' areas.

3.2 Proposed list of non-predefined Article 107(3)(c) areas

(18) According to Annex I of the RAG, Germany can designate areas with a population of up to 13.95% of the total national population as non-predefined ‘c’ areas. In accordance with Annex I of the RAG, this percentage has to be reduced by 2.61% to take account of the designation of the whole NUTS 2 areas of DE40 Brandenburg and DEE0 Sachsen- Anhalt as predefined 'c' areas'. As a result of this reduction, 11.34% of the total national population is available for the designation of non-predefined 'c' areas. Compliance with the population coverage allowed will be determined on the most recent data of total resident population of the areas concerned as published by the national statistical office.

(19) The non-predefined ‘c’ areas proposed by Germany have a total population of 9 264 028 inhabitants, which represents 11.33% of the total national population. Therefore, the percentage of the non-predefined 'c' areas does not exceed the reduced maximum population coverage allocated to Germany for this type of regions of 11.34%.

(20) The total population of predefined 'c' areas (14.51%) and non-predefined 'c' areas (11.33%) does not exceed the maximum population coverage allocated to Germany in Annex I of the RAG (25.85%).

6 (21) Compliance with the population coverage is determined on the basis of the most recent data (that of 31 December 2010) on the total resident population of the areas concerned and available at all different geographical levels. This is in line with the requirement set out in paragraph 170 of the RAG.

(22) The statistics on unemployment used in this section are the average unemployment rates for the period 2010-2012 (i.e. the last three years for which such data are available), as published by the national statistical office. This is in line with the requirement set out in footnote 68 of the RAG.

(23) In cases where non-predefined 'c' areas are proposed that are not defined as whole NUTS 3 regions or islands, paragraph 169 of the RAG provides that the notion of contiguous areas normally refers to whole LAU 2 areas or to a group of whole LAU 2 areas which share an administrative border with another LAU 2 area in the group. In the case of Germany the LAU 2 level corresponds to the town and municipality level. According to footnote 74 of the RAG, the Member State may nevertheless designate parts of an LAU 2 area (or LAU 1 area), provided that the population of the LAU area concerned exceeds the minimum population required for contiguous areas under Criterion 1 or 5 (including the reduced population thresholds for those criteria) and that the population of the parts of that LAU area is at least 50% of the minimum population required under the applicable criterion.

3.2.1 Non-predefined 'c' areas in application of Criterion 1 of paragraph 168 of the RAG

(24) According to paragraph 168 of the RAG, a Member State may designate as non- predefined ‘c’ areas under Criterion 1 contiguous areas of at least 100 000 inhabitants located in NUTS 2 or NUTS 3 regions that have a GDP per capita below or equal to the EU-27 average or an unemployment rate above or equal to 115% of the national average.

(25) Each of the non-predefined ‘c’ areas proposed by Germany under Criterion 1 satisfies the minimum population size condition and the GDP and/or unemployment condition (see table 7 below). Moreover, the Commission has been satisfied that each 'c' area proposed under Criterion 1 consists of contiguous LAU 2 areas or parts of LAU 2 areas as required in paragraph 169 of the RAG.

3.2.2 Non-predefined 'c' areas in application of Criterion 2 of paragraph 168 of the RAG

(26) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under Criterion 2, entire NUTS 3 regions of less than 100 000 inhabitants that have a GDP per capita below or equal to the EU-27 average or an unemployment rate above or equal to 115% of the national average. All non-predefined ‘c’ areas proposed by Germany fulfil the conditions of Criterion 2 (see table 8 below).

3.2.3 Non-predefined 'c' areas in application of Criterion 3 of paragraph 168 of the RAG

(27) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under Criterion 3, islands or contiguous areas characterised by similar geographical isolation with a GDP per capita below or equal to the EU-27 average or an unemployment rate above or equal to 115% of the national average or less than 5 000 inhabitants.

8 (28) Germany proposed one non-predefined ‘c’ area which fulfils the conditions of Criterion 3, since the island of Helgoland has less than 5 000 inhabitants (see table 9 below):

3.2.4 Non-predefined 'c' areas in application of Criterion 4 of paragraph 168 of the RAG

(29) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under Criterion 4, NUTS 3 regions or parts of NUTS 3 regions that form contiguous areas that are adjacent to an ‘a’ area. All non-predefined ‘c’ areas proposed by Germany fulfil the conditions of Criterion 4, since they are adjacent to an 'a' area and form contiguous areas.

3.2.5 Non-predefined 'c' areas in application of Criterion 5 of paragraph 168 of RAG

(30) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under Criterion 5, areas of at least 50 000 inhabitants that are undergoing major structural change or are in serious relative decline, provided that such areas are not located in whole NUTS 3 regions or other contiguous areas that fulfil the condition to be designated as 'c' areas under Criteria 1 to 4.

(31) Germany proposed one non-predefined 'c' area under Criterion 5 (see table 11 below):

(32) The Commission considers that the Saarlouis-Neunkirchen area proposed fulfils the conditions of Criterion 5 for the following reasons: - The area proposed is located within a NUTS2 region not fulfilling the conditions of Criterion 1 to 4 and does itself also not fulfil the condition to be designated a 'c' area under Criteria 1 to 4; - Germany used the following socioeconomic indicators to select the area concerned: per capita GDP, GDP per person employed, annual gross salary per person employed, number of employees subject to social security contribution, number of person employed, proportion of employees working in research and development, the proportion of employed persons with secondary education (vocational training) and tertiary education (university and college degree), youth unemployment rates, number of business registrations, and the ranking in a national dynamic index. The Commission considers that these indicators are appropriate indicators for measuring relative problems of structural change or decline. Moreover, the available data for these indicators were provided by Germany's national statistical office or other recognised sources.3 - The above indicators show that the area proposed in application of Criterion 5 scored below the national average. - The area proposed has a total population of at least 50 000 inhabitants and consists of LAU 2 areas and parts of LAU 2 areas respecting the requirements set out in footnote 74 of the RAG.

3.2.6 Respect of population ceiling for non-predefined ‘c’ areas

(33) As mentioned in recital (19) above, the reduced population ceiling for non-predefined ‘c’ areas was set at maximum 11.34% of total national population. The non-predefined ‘c’ areas proposed by Germany have a total resident population of 9 264 028. This amounts to 11.33% of the total resident population of that Member State and respects therefore the population ceiling set in the RAG.

3.3 Maximum aid intensities proposed for 'c' areas

(34) Paragraphs 174 to 175 of the RAG provide that the aid intensity applicable to investment by large enterprises in 'c' areas should not exceed the following percentages: - 10% GGE in non-predefined 'c' areas; - 15% GGE in former 'a' areas in the period from 1 July 2014 to 31 December 2017;

(35) In accordance with paragraph 176 of the RAG, if a 'c' area adjacent to an 'a' area, the maximum aid intensity in the NUTS 3 regions or parts of NUTS 3 regions within that 'c'

10 area which are adjacent to the 'a' area may be increased as necessary to limit the difference in the aid intensity between the two areas to 15 percentage points.

(36) The German authorities propose to apply a maximum aid intensity of 15% GGE for large enterprises for the following former 'a' areas during the period from 1 July 2014 to 31 December 2017. In the period from 1 January 2018 to 31 December 2020, the maximum aid intensity in these areas will be reduced to 10% GGE:

12 (38) Germany proposes to limit the maximum aid intensity in all other designated 'c' areas to 10% GGE.

(39) In view of the above, the maximum aid intensities for regional investment aid by large enterprises in the 'c' areas notified by Germany for the period from 1 July 2014 to 31 December 2020 are in line with the maximum aid intensities allowed for under the RAG.

3.4 Increased aid intensities for SMEs

(40) In accordance with paragraph 177 of the RAG, the maximum aid intensities applicable to large enterprises can be increased by up to 20 percentage points for small enterprises or by up to 10 percentage points for medium-sized enterprises. However, the increased maximum aid intensities for SMEs will not apply to aid awarded for large investment projects.

3.5 Other commitments made by the German authorities

(41) The Commission takes note of the following commitments made by the German authorities in the notification: (a) The German authorities confirmed that all intentions to grant regional aid will be notified to the Commission in accordance with Article 108(3) TFEU, either as an aid scheme, or as an individual notification, unless a block exemption regulation applies. (b) The German authorities confirmed that all regional investment aid will respect the maximum aid intensities of the area concerned as defined in the regional aid map approved by the Commission and published in the Official Journal of the European Union. (c) The German authorities confirmed that for large investment projects (as defined in paragraph 20(l) of the RAG) the aid ceilings of the area concerned as defined in the regional aid map approved and published by the Commission, will be adjusted according to the formula in paragraph 20(c) of the RAG.

3.6 Conclusion

(42) In view of the above, the Commission concludes that the regional aid map for the period from 1 July 2014 to 31 December 2020, as notified by Germany, is in line with the RAG.

(43) The Commission recalls that the maximum aid intensities specified in the regional aid map apply only to investments carried out in sectors that fall within the scope of the RAG, as defined in paragraph 10 thereof. In particular, these aid ceilings apply to the processing and marketing of agricultural products only to the extent laid down in the Community guidelines for State aid in the agriculture and forestry sector4, or in any guidelines replacing them.
