El Chileno Justo Donoso Y El Peruano Francisco De Paula González Vigil* Revista Chilena de Historia del Derecho, Nº 24 / 2013-2014 pp. 15-189 LA PRODUCCIÓN CANONISTA ITALIANA EN DOS PENSADORES HISPANOAMERICANOS DE COMIENZOS DEL SIGLO XIX: EL CHILENO JUSTO DONOSO Y EL PERUANO FRANCISCO DE PAULA GONZÁLEZ VIGIL* ANTONIO D OUGNAC R ODRÍGUEZ ** Universidad de Chile RESUMEN A través de este trabajo, el autor explora la in ] uencia que tuvieron los canonistas italianos, fundamentalmente de los siglos XVII y XVIII, sobre la obra de dos juristas- hispanoamericanos del siglo XIX: el chileno Justo Donoso y el peruano Francisco de Paula González Vigil. Al examinar en detalle el corpus bibliográ \ co de ambos, puede constatarse la predilección que tenían por los autores que defendían el Real Patrona- to, y que por cierto se contaban entre los intelectuales, ya fueran \ lósofos, juristas o teólogos, de la Ilustración Católica y quienes, en lo que respecta a las relaciones entre Iglesia y Estado, se manifestaban a favor del giurisdizionalismo , esto es, la doctrina que sostenía una disminución de los poderes papales y un acrecentamiento del epis- copal y civil. ABSTRACT Through this work, the author explores the in ] uence that had the Italian canonists, mainly from the seventeenth and eighteenth centuries, on the works of two Hispanic jurists of the nineteenth century: the chilean Justo Donoso and the peruvian Francisco de Paula Gonzalez Vigil. Examining in detail the bibliographic corpus of both, it can be seen the preference they had for the autors that defended the Royal Patronage and who, by the way, were among the intellectuals, whether philosophers, jurists or theolo- gians of the Catholic Enlightenment and, regarding the relations between Church and State, were in favor of the giurisdizionalismo , that is, the doctrine that held a decreas e of Papal power and an enhancement of the episcopal and civil powers. GENERALIDADES Ha surgido este trabajo del estudio que, desde hace algunos años a esta parte llevo ha- ciendo, respecto de las ideas jurídicas en la América Española y, particularmente en mi patria, Chile. Llevado a los temas canónicos por la averiguación de las normas acerca de la familia indiana, empecé a adentrarme en los mil recovecos de la doctrina respec- tiva. Saltó a mi vista la recurrencia en la praxis judicial a los pareceres de los juristas, no obstante la prohibición implícita en la primera y segunda de las Leyes de Toro 1. Igual derrotero mostraba el conocimiento cada vez mayor que hemos ido teniendo del contenido de las bibliotecas indianas 2. Mas, las librerías eventualmente podrían ser hasta simplemente decorativas. ¿Cómo llegar a saber si efectivamente eran utilizadas? La producción canonista italiana en dos pensadores hispanoamericanos de comienzos del siglo XIX… 17 Esto último me llevó a examinar con detenimiento las obras de dos connotados intelectuales criollos 3, nacidos en Chile y Perú respectivamente, educados en Amé- rica únicamente, con formación intelectual anclada en la época virreinal y autores de sesudos trabajos en que, con espíritu crítico, fueron examinando lo aseverado por canonistas de diversas épocas. Se trata del chileno Justo Donoso (Santiago de Chi- le, 1800-La Serena, 1868) y del peruano Francisco de Paula González Vigil (Tacna, 1792-Lima, 1875), a los que dedicaré sendos apartados. El análisis de sus obras me ha permitido aquilatar la cantidad de juristas italianos traídos a colación. Tal fenómeno podría parecer normal hallándose la cabeza de la Iglesia en Italia. Pero, al revisar más acuciosamente la índole de los autores, me llevé la sorpresa de constatar que una im- portante cantidad de ellos eran radicales adversarios de la Curia Romana y a \ nes con el pensamiento español de predominio del Estado por sobre la Iglesia. Y es que las vinculaciones dinásticas existentes entre la corona española y di- versos Estados de la Península Itálica habían traído consigo un mutuo conocimiento de las respectivas producciones intelectuales 4 y un intercambio de servidores de la corona 5. En lo tocante a las relaciones entre Iglesia y Estado, la doctrina española de predominio del segundo respecto de la primera ostentaba larga data –en sus variantes patronatista, vicarialista y regalista–, y fue muy utilizada por la corriente contraria a la Curia Romana de los diversos Estados italianos.     Esic Market Economics and Business Journal Vol. 45, Issue 2, May-August 2014, 327-356 The institucional Evolution of Property and Subjective Rights in XVI and XVII centuries in Spain* Ángel Manuel Fernández Álvarez** Universidad Complutense Abstract As a consequence of the enormous amount of gold and silver coming from the overseas territories of the Spanish empire, the Spanish scholastics identified the causal relationships which are responsible of the economic growth as private property, contracts, public budg- ets, fiscal policy, international commerce or inflation, to name a few. First, the study introduces a proposal of classification of the School of Salamanca’s authors which allows a tracking of their ideas about the property and subjective rights. The study introduces also a classification into a Spanish School of Economics, due to the identifica- tion of principles of economic growth defended by the Spanish scholastics. Secondly, the study analyzes the institutional evolution of the ideas on property and subjective rights during the XVI and XVII centuries from Francisco de Vitoria to the figure of Juan de Mariana. Spanish scholastics clearly explained main economic concepts and moral institutions which have been reflected in the works of later authors. They added powerful arguments to the strict protection of the private property and the subjective rights of the citizens against the reason of State and the tyrants, which are key concepts of an open society. * This working paper was presented during the 16th Annual Conference of the European Society for the History of Economic Thought (ESHET) from 17th to 19th May 2012. Beth Ann Griech-Polelle Pacific Lutheran University [email protected] Abstract The long-standing stereotypes of Jesuits as secretive, cunning, manipulative, and greedy for both material goods as well as for world domination led many early members of the National Socialist German Workers’ Party to connect Jesuits with “Jewishness.” Adolf Hitler, Alfred Rosenberg, Dietrich Eckart, and others connect Jesuits to Jews in their writings and speeches, conflating Catholicism and Judaism with Bolshevism, pin- pointing Jesuits as supposedly being a part of the larger “Judeo-Bolshevik conspiracy” aiming to destroy the German people. Jesuits were lumped in with Jews as “internal enemies” and this led to further discrimination against the members of the order. Keywords Judeo-Bolshevism – anti-Catholicism – stereotypes – Marxism – Adolf Hitler … Pure Christianity—the Christianity of the catacombs—is concerned with translating the Christian doctrine into facts. St Thomas’ teaching provides a very helpful understanding of affective maturity and its integral importance for a truly Christian and priestly life in the service of others. It flows from a theological anthropology that recognizes proper affective growth as an integral part of human life and interpersonal relationships. Affective maturity is an essential attribute for the seminarian to acquire because he is preparing to be a priest who has to fulfill his responsibilities to others in a loving, mature and virtuous way. The thesis is divided into three major sections. The first section lays the theological and anthropological foundation for the thesis. Since Pope St John Paul II called for the promotion of affective maturity in seminary formation, the influence of St Thomas’ teaching on St John Paul II’s understanding of affectivity is analyzed.

McGrath (Georgia Southern University) Moral theology, also known as the science of freedom, focuses on human actions as predicated by free will and shaped by natural reason and divine faith. These actions are directed toward a supernatural destiny and do not concern themselves with immediate ends that humans may pursue as a goal for the immediate future. The supernatural component of moral theology is beyond what reason can conceive, and it recognizes the necessary role of God’s grace to accomplish through human actions what human will is not capable of achieving. God’s revelation of Himself through His Son provides the meaning of life and the context with which human actions seek to attain virtue and to avoid sin. Moral theology in Cervantes’ day, however, was less concerned with the manner in which human actions emulated the life of Jesus. While the attainment of virtue was a constitutive element of moral theology, the focus was placed more heavily on ways to avoid mortal sins, and the Council of Trent reaffirmed the obligation of all Catholics to confess mortal sins, which is a sin that satisfies three criteria: it is grave in nature; the person who commits the sin is aware of its seriousness; and the person willingly commits the sin in spite of the recognition of its offensive nature.1 Post-Tridentine seminarians focused specifically on two areas related to moral theology: how to hear confessions and how to cultivate a Christian conscience according to which the people whom they minister to would live their lives.

    38 PRACTICAL ETHICS rudolf schussler¨ Much of medieval ethics was practical. Christian spiritual guidance, monastic culture, the regulatory interests of the Church and princes, as well as numerous other factors merged to create a moral framework with a distinct emphasis on application. Because moral and theological guidance were largely intertwined, practical ethics evolved under the guise of pastoral concerns. The subject area of medieval practical ethics was of course much broader than these brief remarks indicate – so broad, in fact, that systematization appears difficult. Certain key areas of practical ethics, however, have remained the same since the High Middle Ages, including the Church and culture, war and violence, family and sexuality, the economy and social justice, and health and medicine.1 In the Middle Ages, much effort was put into the regulation of monastic discipline and the correct administration of sacraments, often with ethical ramifications.
